C1-C8: SPOTLIGHT ON CONDOS Your guide to new condo communities in the Gatineau and Greater Ottawa Area

EDITOR’S NOTE

MOVE-IN DATE GLITCHES A couple of years ago, a friend of mine and her husband bought a pre-construction condo. As the days drew closer to their occupancy date, they finally allowed themselves to get excited. They booked a date to install the internet and cable, and started looking for a mover. Well, guess what? The planned-for spring move-in date that was on the Agreement of Purchase and Sale (APS) was delayed by the builder not once, but twice. Luckily, my friends were living with family, so the changing occupancy dates were more of an annoyance than anything else. Moving day finally came and went without a hitch and my friends love their new home. At the time, however, they did wonder if what happened to them was a common occurrence, or unique to their condo project. In this issue, Howard Bogach, president and CEO of Tarion, explains it’s not unusual for builders to change move-in dates and there are many reasons why this can happen. See what he has to say on page 20. Meanwhile, we hope you enjoy reading this issue of New Home + Condo Guide. If there is something you would like us to write about, send us an email and let us know. Happy house hunting.

DON’T GET CAUGHT IN A REAL ESTATE

INVESTMENT TAX SCHEME

The Canada Revenue Agency (CRA) sent out a warning in June to flag tax schemes involving professionals such as tax representatives and tax preparers, who are claiming to offer individuals tax write-offs through limited partnerships hinging on real estate investments. WHAT THE HECK IS A TAX SCHEME?

Tax schemes are arrangements that are designed to deceive taxpayers by promising to reduce the taxes they owe, for example, through large deductions or promises of tax-free income. A scheme can also include other creative ways to convince people they could pay less taxes. CRA’S OUTLINE OF HOW THIS REAL ESTATE TAX SCHEME IS DELIVERED

Beginning as an advertised real estate investment opportunity through what is being called a 10

June 22–July 6, 2019

“limited partnership”, the scheme is usually heavily promoted as a product with a significant tax advantage and limited liability for the investor. The scheme’s promoter is promising a tax writeoff for more than double what the taxpayer invests. The claim of a significant tax write-off being received is because of costs expensed in the initial year of the project. The example given in the CRA press release is when an “investor has invested $5,500 and is advised that they can write it off on their taxes for $12,500 due to financial services, lease enhancement and tenant improvement costs expensed in the first year.” This is not the case, says CRA. “Limited partnerships are unique arrangements that provide investors with certain benefits similar to partnerships and corporate entities. However, different than general partnerships, the investor’s liability is restricted to the amount they invested.

Therefore, they cannot claim a higher tax write-off than invested.” SERIOUS CONSEQUENCES

Through increased audits of such promoters, improved information gathering and informing taxpayers on how to recognize tax schemes, CRA continues to identify and shut them down. Those who choose to participate in these schemes, as well as those who promote them, face consequences such as penalties, court fines and even jail time. To protect yourself: Ŕ Get professional, independent advice before investing, especially if a deal seems too good to be true Ŕ If you have participated in a scheme, inform CRA to correct your tax situation through its Voluntary Disclosures Program For more information on tax schemes, visit Canada.ca/tax-schemes.

ADVICE | HOME SMARTS

SWIMMING POOLS A GOOD IDEA? OR NOT.

SPOTLIGHT ON

CONDOS

MARNIE BENNETT

C6

As I write this, Ottawa is finally enjoying the summer sun! There are those of us that beat the heat in the comfort of our airconditioned homes, and then there are the lucky ones who enjoy splashing around in an inviting backyard pool. Which begs the question: Is installing a swimming pool a sound investment? I’ll give you the bad news first. From a purely financial standpoint, I’m afraid the answer is, probably not. As desirable as a swimming pool seems during the dog days of summer, I can tell you that many buyers perceive pool ownership as a bigger hassle than a perk. Homes with pools often take longer to sell, because they eliminate some potential buyers right out of the gate. While pools may be the norm in the wealthiest neighbourhoods, and in warmer climates, this isn’t the case in typical Ontario communities. According to the Appraisal Institute of Canada, you’re not likely to recover more than 25 per cent of the money spent on pool installation when you sell your home. Having said that, there are always exceptions to the rules: I have worked with clients who placed a swimming pool near the top of their wish list. And, as someone who lives to see happy homeowners, I wouldn’t discourage anyone from creating

the home they truly want. As long as you’re going in with realistic expectations about recouping your investment, you should absolutely go for it. After all, how do you put a price tag on the years of enjoyment a pool can bring? If you’re eager to move forward, here are some things to consider: Ĺ” *O HSPVOE QPPMT PGGFS NPSF visual appeal, prestige and room to swim; above-ground models are more affordable and far easier to remove. Ĺ” %POĹ?U GPSHFU UP QMBO GPS B TBGFUZ fence that adheres to municipal bylaws – the more attractive, the better. Put lots of thought into new landscaping and your pool deck or patio. In-ground pool installation will wreak havoc with your yard anyway, so it’s the perfect time to get creative. Ĺ” 8IFO JUĹ?T UJNF UP TFMM XPSL to have your pool looking as enticing as possible. Crystal clear water, a weed-free patio, a

OTTAWA AND GATINEAU AREA HOUSING STARTS UP IN MAY Ottawa and the Gatineau region bucked the national housing starts trend in May, increasing from the month before. Nationally, the trend in housing starts decreased – 201,983 units in May, compared to 205,717 units the month before. This trend, according to Canada Mortgage and Housing Corporation (CMHC), measures a six-month moving average of the monthly seasonally adjusted annual rates (SAAR) of housing starts. “The national trend in housing starts decreased in May as a result of continuing decline in the trend for single starts as well as a decline in the trend of multiunit starts that follows gains in this segment in recent months, in urban areas,” says Bob Dugan, CMHC’s chief economist. “The decrease in the trend of multi-unit starts reflects a decline in the SAAR level of multi-unit activity in May from the unusually elevated level registered in April, 16

New Home + Condo Guide |

June 22–July 6, 2019

which leaves multi-unit SAAR starts closer to its 10-year average.” IN OTTAWA

Housing starts trended slightly higher in May because of higher row starts. Year-to-date actual starts are up 14 per cent relative to the same period last year due mainly to a rise in condominium apartment starts while singledetached homes declined. Rising ownership costs are shifting demand toward relatively more affordable dwellings, and tight resale market conditions are encouraging builders to increase supply of condominium apartment units. GATINEAU

From January to May, residential construction in the Gatineau area reached a five-decade record high. This strong increase was attributable mainly to the rise in rental housing starts in the Plateau neighbourhood. The aging of the

population and the low vacancy rate have continued to stimulate starts of this type in the Gatineau area. CMHC uses the trend measure as a complement to the monthly SAAR of housing starts to account for considerable swings in monthly estimates and to obtain a more complete picture of Canada’s housing market. In some situations, analyzing only SAAR data can be misleading, as they are largely driven by the multi-unit segment of the market, which can vary significantly from one month to the next. The standalone monthly SAAR of housing starts for all areas in Canada was 202,337 units in May, down 13.3 per cent from 233,410 units in April. The SAAR of urban starts decreased by 14.4 per cent in May to 186,946 units. Multiple urban starts decreased by 18.5 per cent to 141,851 units in May while single-detached urban starts increased by 1.8 per cent to 45,095 units.

NEIGHBOURLY VIBES BY MARLENE EISNER

What do most people look for when searching for a preconstruction home? Price is probably right up there, followed by building type, number of bedrooms and bathrooms, the floorplan, kitchen size, storage, a garage, a yard – well of course, the list is endless. But what about the neighbourhood? How important is it to know about the area in which the home is being built? Wouldn’t it be great if there was a quick reference that would tell

us what to look for and where to find it? When companies wish to relocate employees to a new city they know nothing about, they look to Mercer. A global consulting firm in health, wealth and career solutions, Mercer conducts annual quality-of-living reports based on factors pretty much all of us would want to know if we moved to a new place. More than 400 cities worldwide are covered and measured by 10 criteria: Consumer goods;

economic environment; housing; medical and health considerations; natural environment; political and social environment; public services and transport; recreation; schools and education; socio-cultural environment. How does this relate to Ottawa? In Mercer’s 21st annual qualityof-living survey released in 2019 that ranked 231 cities, Ottawa placed 19! That’s pretty amazing. NextHome takes a peek into some of Ottawa’s neighbourhoods where you can find a top-quality

development and a new home to call your own. FINDLAY CREEK

Findlay Creek is located south of Leitrim Rd., bordering Albion to the west and straddling Bank St. to the east. This is a neighbourhood that has boomed in recent years, but you won’t hear any of the residents complaining. Once they walk through these boundaries, most feel there is little reason to leave again. This neighbourhood is a family-friendly, yet hipsterposh place to live.

Findlay Creek is built for families. With plenty of greenspace, new and spacious homes and many amenities, this community offers residents a typical suburban lifestyle. This is a tight-knit neighbourhood with a Community Association. The Findlay Creek Shopping Plaza has everything from a Tim Hortons and an LCBO, to a Fresh Co. and the local physiotherapist. There are also many schools in the area from all the Ottawa school boards. Cars are the most popular form of transportation, and although there are bus routes

along Hunt Club and Bank St., it’s not near Hwys 417 or 416. New-home developments include Sundance, Lilythorne, Pathways at Findlay Creek and Cowan’s Grove. CENTRETOWN

This bustling downtown neighbourhood is bounded on the north by Gloucester and Lisgar streets, on the east by the Rideau Canal, on the south by Hwy. 417, and on the west by Bronson Ave. Here you’ll find sky-high office buildings surrounded by smaller residential ones. ADVICE | TARION REPORT

WHEN YOUR MOVING DATE MOVES BEFORE YOU DO

HOWARD BOGACH You did all your research and decided that your next move will be into a new 20

New Home + Condo Guide |

June 22–July 6, 2019

condominium. Whether this will be your first home or perhaps a retirement retreat, you’ve been counting down the days to your move. Then your builder notifies you that your occupancy date is going to be delayed.

There could be many different reasons for it. Condo projects can take a long time to get going due to zoning approval processes, and sometimes issues like material or labour shortages can delay construction schedules.

Since a lot can happen between the time the units are sold and construction is finished, the odds are good that your builder will set a tentative occupancy date. This means they can delay the completion date for up to 120 days as long as they provide at least 90 days’ notice.

Pre-construction condos are sold long before shovels hit the ground – so this means, in most cases, your occupancy date could be two to three years in the future. Your Agreement of Purchase and Sale (or APS) sets out your occupancy date, which can be either a ‘firm’ or a ‘tentative’ date depending on how confident your builder is of the eventual date of completion. Your APS will also include an ‘outside occupancy date’ – an estimate of the latest possible date the project is expected to be completed. Since a lot can happen between the time the units are sold and

construction is finished, the odds are good that your builder will set a tentative occupancy date. This means they can delay the completion date for up to 120 days as long as they provide at least 90 days’ notice. Additional delays – with appropriate notice – are also possible. Once a firm occupancy date has been set, if the condo isn’t ready on that date, you may be entitled to delayed occupancy compensation under the Ontario New Home Warranties Plan Act. Ontario is the only province that offers this compensation – $150 per day to a maximum of $7,500 – which is meant to cover things like the cost of rental accommodation or storage for your belongings. You don’t need to prove expenses to collect this compensation – it is a per diem rate for the duration of the delay. Usually, the builder pays this to you directly, but you can also make a delayed occupancy claim to Tarion after you move into your new condo. Finally, if the outside occupancy date comes and goes and your unit still isn’t ready, you

will have the right to cancel the purchase agreement. The ‘critical dates’ you need to be aware of can be found in the Addendum, which is a document that must be attached to your APS. The Addendum not only details your occupancy dates, but also when your builder is required to notify you if there’s going to be a delay and when you’re entitled to legally back out of your agreement if you choose to do so. So, if your long-awaited condo requires more waiting than you had bargained for, it’s important to know your rights. To protect those rights, be sure to have a real estate lawyer who is well versed in condominium law review the APS and the Addendum before you sign. And if you have questions, visit Tarion.com. Howard Bogach is president and CEO of Tarion Warranty Corp. For more information, visit tarion.com or find them on Facebook at facebook.com/ TarionWarrantyCorp.

WESTBORO

MANOTICK

…continued from page 19

Electrifying, day and night. Centretown is a busy, cultural mecca filled with people from all walks of life. The streets are lined with cars, buses, and cyclists veering in and out of traffic. There is a constant buzz of sound and an energy that is magnetic. Centretown has a mix of older single-family homes and duplexes. New-home developments in and around the neighbourhood include Claridge Plaza 4, Fusion Lebreton Flats, eResidence, SoBa and the Bowery. MANOTICK

This close-knit community is approximately 15 km south of downtown Ottawa and is bordered on the north by Bankfield and Mitch Owens roads, on the south by the Rideau River, to the east by Hwy. 416 and to the west by 3rd Line. First settled in the 1830s as a logging and milling town, Manotick is still brimming with small town,

old-fashioned charm. The quality of life in this neighbourhood is perfect for anyone looking to raise a family, or to retire. Most of your needs can be met without ever leaving the Village. There are plenty of medical doctors and dentists, a public elementary school and lots of small, local food and supply stores. It’s a quick drive to Riverside South and Barrhaven with even more amenities close at hand. New-home developments in the neighbourhood include Riverwalk and Mahogany. WESTBORO

Westboro runs between Churchill and Island Park and south to 417. This area is the epitome of posh. It’s a great area and it’s got it all. This is a trendy, active place where most people have dogs, kids, and a six-figure income. Many residents have to commute

to work, but once home, they have everything they need right at their doorstep. Richmond Rd. is lined with specialty stores, high-end fashion boutiques, restaurants and bakeries. The local coffee shops are filled with runners, cyclists, baby strollers – even at the earliest hours of the morning. Westboro is safe, has everything you need, and it’s still close enough to downtown and the rest of the city. Residents can make use of the Transitway, the many bus stops along Richmond Rd., the O-Train, and the light rail train (LRT). Visitors and residents can also take advantage of the many bike paths, and Hwy. 417 is only a quick drive down the road. A new-home development in Westboro is Westboro Lofts.

YOUR END OF DAY DESTINATION The Bowery’s sublime rooftop outdoor lounging deck is the ultimate end of day destination. With views of downtown and the Ottawa River that are nothing short of spectacular.
