MOVE-IN DATE GLITCHES A couple of years ago, a friend of mine and her husband bought a pre-construction condo. As the days drew closer to their occupancy date, they finally allowed themselves to get excited. They booked a date to install the internet and cable, and started looking for a mover. Well, guess what? The planned-for spring move-in date that was on the Agreement of Purchase and Sale (APS) was delayed by the builder not once, but twice. Luckily, my friends were living with family, so the changing occupancy dates were more of an annoyance than anything else. Moving day finally came and went without a hitch and my friends love their new home. At the time, however, they did wonder if what happened to them was a common occurrence, or unique to their condo project. In this issue, Howard Bogach, president and CEO of Tarion, explains it’s not unusual for builders to change move-in dates and there are many reasons why this can happen. INVESTMENT TAX SCHEME
The Canada Revenue Agency (CRA) sent out a warning in June to flag tax schemes involving professionals such as tax representatives and tax preparers, who are claiming to offer individuals tax write-offs through limited partnerships hinging on real estate investments. WHAT THE HECK IS A TAX SCHEME?
Tax schemes are arrangements that are designed to deceive taxpayers by promising to reduce the taxes they owe, for example, through large deductions or promises of tax-free income. A scheme can also include other creative ways to convince people they could pay less taxes. CRA’S OUTLINE OF HOW THIS REAL ESTATE TAX SCHEME IS DELIVERED

“limited partnership”, the scheme is usually heavily promoted as a product with a significant tax advantage and limited liability for the investor. The scheme’s promoter is promising a tax writeoff for more than double what the taxpayer invests. The claim of a significant tax write-off being received is because of costs expensed in the initial year of the project. The example given in the CRA press release is when an “investor has invested $5,500 and is advised that they can write it off on their taxes for $12,500 due to financial services, lease enhancement and tenant improvement costs expensed in the first year.” This is not the case, says CRA. “Limited partnerships are unique arrangements that provide investors with certain benefits similar to partnerships and corporate entities. However, different than general partnerships, the investor’s liability is restricted to the amount they invested.
Therefore, they cannot claim a higher tax write-off than invested.” SERIOUS CONSEQUENCES
Through increased audits of such promoters, improved information gathering and informing taxpayers on how to recognize tax schemes, CRA continues to identify and shut them down. Those who choose to participate in these schemes, as well as those who promote them, face consequences such as penalties, court fines and even jail time. To protect yourself: Ŕ Get professional, independent advice before investing, especially if a deal seems too good to be true Ŕ If you have participated in a scheme, inform CRA to correct your tax situation through its Voluntary Disclosures Program For more information on tax schemes, visit Canada.ca/tax-schemes.

As I write this, Ottawa is finally enjoying the summer sun! There are those of us that beat the heat in the comfort of our airconditioned homes, and then there are the lucky ones who enjoy splashing around in an inviting backyard pool. Which begs the question: Is installing a swimming pool a sound investment? I’ll give you the bad news first. From a purely financial standpoint, I’m afraid the answer is, probably not. As desirable as a swimming pool seems during the dog days of summer, I can tell you that many buyers perceive pool ownership as a bigger hassle than a perk. Homes with pools often take longer to sell, because they eliminate some potential buyers right out of the gate. While pools may be the norm in the wealthiest neighbourhoods, and in warmer climates, this isn’t the case in typical Ontario communities. According to the Appraisal Institute of Canada, you’re not likely to recover more than 25 per cent of the money spent on pool installation when you sell your home. Having said that, there are always exceptions to the rules: I have worked with clients who placed a swimming pool near the top of their wish list. And, as someone who lives to see happy homeowners, I wouldn’t discourage anyone from creating
the home they truly want. As long as you’re going in with realistic expectations about recouping your investment, you should absolutely go for it. After all, how do you put a price tag on the years of enjoyment a pool can bring? OTTAWA AND GATINEAU AREA HOUSING STARTS UP IN MAY Ottawa and the Gatineau region bucked the national housing starts trend in May, increasing from the month before. Nationally, the trend in housing starts decreased – 201,983 units in May, compared to 205,717 units the month before. This trend, according to Canada Mortgage and Housing Corporation (CMHC), measures a six-month moving average of the monthly seasonally adjusted annual rates (SAAR) of housing starts. “The national trend in housing starts decreased in May as a result of continuing decline in the trend for single starts as well as a decline in the trend of multiunit starts that follows gains in this segment in recent months, in urban areas,” says Bob Dugan, CMHC’s chief economist. “The decrease in the trend of multi-unit starts reflects a decline in the SAAR level of multi-unit activity in May from the unusually elevated level registered in April, 16

which leaves multi-unit SAAR starts closer to its 10-year average.” IN OTTAWA
Housing starts trended slightly higher in May because of higher row starts. Year-to-date actual starts are up 14 per cent relative to the same period last year due mainly to a rise in condominium apartment starts while singledetached homes declined. Rising ownership costs are shifting demand toward relatively more affordable dwellings, and tight resale market conditions are encouraging builders to increase supply of condominium apartment units. GATINEAU
From January to May, residential construction in the Gatineau area reached a five-decade record high. This strong increase was attributable mainly to the rise in rental housing starts in the Plateau neighbourhood. The aging of the
population and the low vacancy rate have continued to stimulate starts of this type in the Gatineau area. CMHC uses the trend measure as a complement to the monthly SAAR of housing starts to account for considerable swings in monthly estimates and to obtain a more complete picture of Canada’s housing market. In some situations, analyzing only SAAR data can be misleading, as they are largely driven by the multi-unit segment of the market, which can vary significantly from one month to the next. The standalone monthly SAAR of housing starts for all areas in Canada was 202,337 units in May, down 13.3 per cent from 233,410 units in April. The SAAR of urban starts decreased by 14.4 per cent in May to 186,946 units. Multiple urban starts decreased by 18.5 per cent to 141,851 units in May while single-detached urban starts increased by 1.8 per cent to 45,095 units.

condominium. Whether this will be your first home or perhaps a retirement retreat, you’ve been counting down the days to your move. Then your builder notifies you that your occupancy date is going to be delayed.
There could be many different reasons for it. Condo projects can take a long time to get going due to zoning approval processes, and sometimes issues like material or labour shortages can delay construction schedules.

Pre-construction condos are sold long before shovels hit the ground – so this means, in most cases, your occupancy date could be two to three years in the future. Your Agreement of Purchase and Sale (or APS) sets out your occupancy date, which can be either a ‘firm’ or a ‘tentative’ date depending on how confident your builder is of the eventual date of completion. Your APS will also include an ‘outside occupancy date’ – an estimate of the latest possible date the project is expected to be completed. Since a lot can happen between the time the units are sold and
construction is finished, the odds are good that your builder will set a tentative occupancy date. This means they can delay the completion date for up to 120 days as long as they provide at least 90 days’ notice. Additional delays – with appropriate notice – are also possible. Once a firm occupancy date has been set, if the condo isn’t ready on that date, you may be entitled to delayed occupancy compensation under the Ontario New Home Warranties Plan Act. Ontario is the only province that offers this compensation – $150 per day to a maximum of $7,500 – which is meant to cover things like the cost of rental accommodation or storage for your belongings. You don’t need to prove expenses to collect this compensation – it is a per diem rate for the duration of the delay. Usually, the builder pays this to you directly, but you can also make a delayed occupancy claim to Tarion after you move into your new condo. Finally, if the outside occupancy date comes and goes and your unit still isn’t ready, you
will have the right to cancel the purchase agreement. The ‘critical dates’ you need to be aware of can be found in the Addendum, which is a document that must be attached to your APS. The Addendum not only details your occupancy dates, but also when your builder is required to notify you if there’s going to be a delay and when you’re entitled to legally back out of your agreement if you choose to do so. So, if your long-awaited condo requires more waiting than you had bargained for, it’s important to know your rights. To protect those rights, be sure to have a real estate lawyer who is well versed in condominium law review the APS and the Addendum before you sign. And if you have questions, visit Tarion.com.
