KEEPING IT REAL When it comes to planning – and budgeting – for a new home, most people concentrate on saving up enough for the down payment. While a bigger down payment means less paid out monthly to the bank, there are many other regular expenses associated with homeownership that should be factored into your budget before you even start looking for a home. Some of these added costs are obvious, like homeowners’ insurance and utilities, but as Marnie Bennett explains, there are other expenses to consider to help you know if that dream home you have your eye on is actually affordable over and above the purchase price. Building 7 will soon be released for sale. “Some people want to make sure they have locked in a purchase price,” says Rahul. “We’ve got units that are spread over the next couple of years.” Prices start at $256,800.

Diamondview Estates boasts 66 singles, and while 45 of the 50- and 60-ft. lots are sold, there are still some up for grabs. “More product will be coming in the next few years,” explains Rahul. “Between 550 and 600 units are planned for this subdivision, with even larger lots for the next phase coming next year.” Prices start at $470,900.

White Tail Ridge and Diamondview Estates communities make use of a community-based sanitary and water system. This practical – and affordable – option means there is no need for a septic tank system, which translates into smaller lots sizes and development savings passed on to the homeowner.

WHITE TAIL RIDGE IN ALMONTE DIAMONDVIEW ESTATES

This semi-private community with large lots is located at the Carp airport. The smallest lot size is 50 ft., making these single-family homes spacious and graciously appointed.

Condo living is all about the efficient use of space. Retailers like IKEA promote its compact, multifunctional furniture and other space-saving solutions specifically to condo owners who need to figure out how to pack all their essentials into a limited footprint. If you’re planning the future layout of your condo based solely on the marketing materials, however, you might be in for a surprise. There is a 14

chance that the floor space may be a little less than expected. Dimensions are a common issue – often discovered when you show up with your trusty tape measure to figure out how to get all your furniture into a 600 sq.-ft. unit. To understand why your small condo might seem even smaller, it’s important to understand how floor space calculation works. Let’s begin with the fact that builders aren’t required to include the square footage of condo units in their materials. It’s only if they voluntarily choose to include the information in the Agreement of Purchase and Sale (APS) that they

need to follow certain calculation guidelines. In fact, what you may see in the sales materials is a standard clause along the lines of “Actual usable floor space may vary from the stated floor area.” Tarion’s Builder Bulletin 22 is an educational tool for new-home builders that lays out the rules for calculating floor space. When calculating an area that meets an exterior wall or corridor wall, the measurement starts from the exterior face of the outside wall. For walls that separate one unit from another, the measurement starts from the halfway point between the walls. …continued on page 16

The board of directors sit at the heart of a condominium corporation and oversees its business affairs. As they are members of the condominium corporation, it’s important that owners hold the board accountable for its decisions.

ELECTING THE BOARD OF DIRECTORS Owners hold supervisory power over the board of directors through elections. Board members are elected at the Annual General Meeting (the AGM). If an owner wants to run for a position on the board, they should notify the board ahead of the AGM. The owner’s name will then be included in

the AGM package sent out to residents before the meeting. At the meeting, candidates will introduce themselves prior to the vote of residents. A board must have at least three directors, since odd numbers help prevent issues during board votes. The number of directors is specified in the condo declarations. Each board member’s term can be up to three

years, but terms are set typically so that they do not all expire at once. IS THERE TRAINING FOR CONDOMINIUM BOARD MEMBERS? Directors elected or appointed on or after Nov. 1, 2017 are required to take online training offered by the Condominium Authority of Ontario. Directors must uphold a standard of care. This means


they must perform duties with care, diligence and skill. If a board member is not doing their job or is acting inappropriately, they can be removed. To have a director removed, a meeting of owners must be called for that purpose. In order to remove the director, a majority of all owners must vote in favour of removal, either in person or by proxy. If the owners vote to remove a director, the owners may elect any person qualified to be a member of the board to serve the remaining term of the director who has been removed, according to the condo corporation’s by-laws dealing with the election of directors.

DIRECTOR QUALIFICATIONS To be a director, there are three qualifications. You must: Ŕ be at least 18 years of age Ŕ not be bankrupt Ŕ be capable of managing property

A director will immediately be disqualified from acting if a lien is registered against their unit or they become bankrupt. The condominium corporation’s bylaws may also include additional conditions for qualification and/or disqualification of directors. While the board of directors holds great power within the condominium corporation, owners are the check and balance. It’s important to attend AGMs, vote for board members and run for positions to ensure your home is well maintained for years to come. must ensure the corporation is run in compliance with the Condominium Act. From personal observation, I’m happy to report that today’s homebuyer may be better informed than at any other time in history. Between easy-to-access information on the internet, help provided by mortgage brokers and lending institutions and – perhaps most significantly – the abundance of real estate reality shows, most homebuyers are entering the market with fairly realistic expectations. That’s terrific, because there’s nothing I hate more than bursting a client’s bubble. I’ve found, however, that one consideration often put on the back burner is the monthly costs associated with owning a home. Most of my clients walk through my door with a figure in mind, representing the price they’re willing to pay for the right home. The crucial question: How have they arrived at this figure? Ideally, they’ve used a mortgage calculator that enables users to experiment with different scenarios. A wide variety of mortgage calculators can be accessed online. I encourage you to choose one that takes monthly expenses (in addition to your mortgage payments) into account. These typically include the following:

These depend greatly on a building’s amenities and on a suite’s square footage; they may include utilities. Be sure to ask how long the current fees will apply, as they may be raised each year. Some additional expenses generally not included by mortgage calculators include the following:

While new homes don’t require expensive overhauls, it’s a good idea to budget for paint, wallpaper, window treatments and furniture that suits your new home. The area that you get is the total area of your unit. That’s why your 10 x 12-ft. bedroom might end up with usable space more in the neighbourhood of 9.5 x 11 ft. Keep in mind that floor space may also be partially taken up by structural components or mechanical requirements. When purchasing a new condo, read your APS and the feature sheet located within it. The marketing materials will give you an idea of what you are purchasing but the details 16

of what the builder will deliver must all be in the APS. When it comes to the size of the unit, Tarion only outlines the approved method for calculating floor area. Warranty coverage doesn’t include floor area discrepancies or miscalculations. You can expect some variance – up to two per cent is considered reasonable by Tarion. However, if you want recourse if the area is not as promised, you need to address this in your APS. So the best advice is to ensure that any commitments to square

footage or other features are made in the APS, and have a real estate lawyer familiar with condominium purchases review it. Remember that any promises, drawings or features that are in marketing material or made verbally by sales staff are not covered by the warranty.
