A comprehensive report published last week by PwC Canada and the Urban Land Institute (ULI) says the focus of real estate in 2020 is on “beds and sheds” — mid-priced apartments, transit-oriented development, and ‘warehousing and fulfillment’ facilities. It’s not a surprise that warehousing and fulfillment facilities, such as what Amazon has built in Bolton, are needed. Demand for same-day e-commerce deliveries continues to increase, but on the residential side, the need for mid-priced housing is nothing new. In fact, it‘s old news. The challenge continues to be a lack of innovative solutions, says Richard Joy, executive director, Urban Land Institute (ULI) Toronto in a press release. “There is a better way to achieve a responsible use of land that addresses affordability concerns, and it’s not from current attempts, like the stress test, to temper demand,” says Joy. “We need innovative solutions for supply constraints and city building issues. I expect the real estate industry will be waiting to see how future developments will be impacted after Canadians go to the polls in October.” The Canadian Home Builders’ Association (CHBA) has been monitoring political parties as they announce platform measures to improve housing affordability. One announcement it identified from the Conservative Party is the new measures it would introduce to make it easier for first-time homebuyers to purchase a home, many of which CHBA has been recommending. “Measures such as fixing the mortgage stress test and increasing amortization periods on insured mortgages to 30 years for firsttime homebuyers, and making use of federal lands to increase housing supply are recommendations that CHBA has asked every federal party to adopt,” says CHBA CEO Kevin Lee. “We are glad to see that parties are listening.” CHBA also championed the New Democratic Party’s promise to reintroduce 30-year term mortgages for entry-level homes for first-time buyers, as well as the Liberal Party’s First-Time Home Buyer Incentive. It noted that shared equity mortgages are “appropriate for some as a complement to mortgage rule adjustments, modifying the stress test smartly and providing 30-year amortizations for well-qualified first-time buyers are the best approaches to unlock the door to homeownership without causing undue risk to the financial system.” The latest platform promises involving housing affordability can be found on CHBA’s website, affordability.ca

Saddington Park for a celebration of the official planning approvals for Brightwater. This new mixed-use 72-acre development on the shores of Lake Ontario will ultimately be home to nearly 6,500 residents. Located at Lake Shore Road West and Mississauga Road South, the plan includes more than 2,500 condo suites and over 400 townhomes; affordable housing and rental units; over 18 acres of interconnected public parks and open spaces; and more than 300,000 square feet of shops, restaurants, offices and services. The Meadoway is bringing nature back into city living by transforming 16 km of hydro corridor lands in Scarborough into an urban greenspace, meadowlands and a trail system that will connect downtown Toronto and the Rouge National Urban Park. MIKEY Network partners with TCDSB All 202 schools and various facilities of the Toronto Catholic District School Board now have defibrillators installed thanks to a partnership with the MIKEY Network. Established by Heathwood Homes and Herity in memory of a colleague, Michael Salem, who died of cardiac arrest in 2002, the Network promotes heart-healthy living and places public access defibrillators, called Mikeys, in as many areas as possible. “We are delighted to partner with the Toronto Catholic District School Board on their

installation of potentially life saving defibrillators. As a not-for-profit organization, we’re committed to teaching people how to use defibrillators and how to lead a heart-healthy lifestyle. Over the

years we have trained over 13,400 in CPR and AED, and to date, have 43 recorded saves, eight of whom are under 18 years of age, and that is very gratifying,” says MIKEY Network Chairman, Hugh Heron. LPAT is necessAry to ensure good PLAnning decisions

If you follow development and building in Ontario, you will be familiar with the Local Planning Appeal Tribunal (LPAT) and its predecessor the Ontario Municipal Board (OMB). LPAT adjudicates disputes on the decisions of municipal councils as they relate to the Planning Act. Opponents of development often label LPAT as biased in favour of developers. These critics erroneously believe that the decisions of local councils 16  New Home + Condo Guide  |  Sept. 28–Oct. 12, 2019

should have primacy over Ontario policy and legislation. What often goes unmentioned are the countless decisions by LPAT that have resulted in new housing developments benefiting those in need. As the provincial government prepares to introduce changes to streamline and expedite the LPAT process, it is useful to remind ourselves of some of these decisions. Thanks to LPAT, Habitat for Humanity was able to build nine affordable housing units at 357 Birchmount Road in Toronto, despite opposition from the local councillor and residents. Housing for over 1,700 students

will be added to the University of Toronto and the University of Guelph after resolution of appeals to the LPAT, in one case due to municipal non-decision and municipal opposition in the other. When the City of Toronto was unable to reach a decision within the prescribed timeframes, LPAT allowed the building of 1,000 purpose-built rental units near transit in the High Park neighbourhood of Toronto. 172 beds, a 172-bed facility funded by the Ministry of Long Term Care, and 49 independent seniors’ apartments. In Hamilton, LPAT approved a residential care facility for adolescent girls with mental health challenges following the intervention of the Ontario Human Rights Commission over objections from the City citing by-law concerns. These are simply some of the numerous decisions that have been made by LPAT and the OMB that have resulted in development that would not have occurred in their absence. These decisions have benefited seniors, students, people with disabilities, and those needing rental housing in a city with a housing shortage. Municipalities in Ontario are creatures of the Province. Their powers and their framework for planning and development are defined through provincial 18  New Home + Condo Guide  |  Sept. 28–Oct. 12, 2019

legislation. When a group feels a municipal development decision runs counter to provincial policy or legislation, the case can be brought to LPAT, which derives its own authority from 10, or more, pieces of provincial legislation. If municipal councillors and local residents do not want to have their planning decisions challenged by LPAT, then they must ensure those planning decisions conform to provincial requirements and precedent. This onus falls equally on builders and developers. The province has rightly recognized the significance of an impartial, unbiased tribunal whose purpose is to uphold provincial planning objectives and good planning. Through Bill 108, More Homes, More Choice Act, the province reinforces the notion that an effective and efficient tribunal is an absolute necessity to ensure that planning conforms to provincial policy and regulations and that the planning process is free of

political interference. Recently the Provincial Government announced changes to LPAT to enhance the effectiveness and speed by which the body adjudicates disputes. These positive changes will increase LPAT resources, streamline the appeals and ensure that decisions are made on the latest and best possible information. Undoubtedly, these are positive steps to increase supply of housing and affordability for Ontarians.

Condo investors worried About A rental ConstruCtion boom?

ben myers Every year someone from outside the Greater Toronto Area (GTA) travels to our neck of the woods for the first time in 10 years. It could be a journalist, a tourist blogger, or a hedge fund manager. They’re immediate conclusion about the level of construction in downtown Toronto is that it must be too much. Toronto absolutely must be building too much housing. Those conclusions been very wrong. But the question is, when will they be right? Based on my best guess, the first year that investors started to buy more pre-construction condominiums than end-users in the GTA was 2007. It was a less talked about phenomenon back then, but by 2011, the stories were everywhere, the condo launch line-ups were long, and the frenzy was real. Although some years are higher than others, since 2011, investors have been buying anywhere from 60 to 75 per cent of all new units, and up to 90 per cent in some downtown projects. This scares a lot of people, and has for some time, but most of those investors plan to hold-andrent the unit for five to ten years after occupancy. investors would lose money and exit their investment. However, that has not been the case. With the change to the mortgage stress-test recently, credit availability has declined and more people that want to buy are forced to rent. In addition, many younger residents of Toronto are choosing to rent for lifestyle reasons. They prefer the freedom of not owning, and they’d rather use the money they’d spend on a down payment on paying down student debt, travelling, and investing. Recent data from Rentals.ca shows that the average rental and condominium apartment in Toronto (former City boundaries) was over $2,500 per month in August, up nearly $200 per month from January! The average rent per-square-foot is now $3.68 per sq. ft. Investors are now having to worry about affordability, can tenants even afford to pay the rent they require to make a monthly profit on their investment unit? According to a survey conducted by Avison Young and Informa, tenants under the age of 30 in Toronto are paying 49 per cent of their income on rent in 26  New Home + Condo Guide  |  Sept. 28–Oct. 12, 2019

Toronto! Financial advisors typically tell clients not to spend more than 30 per cent. However, despite these affordability concerns, it appears that a lot of institutional capital is investing in new rental apartments. These new units won’t be cheap either. Maury Tawse of First National Financial mentioned at the recent Apartment Investment Conference that developers thinking about building rental apartments shouldn’t even consider it unless they think they can get $4.00 per sq. ft. in rent. Apparently they think they can, as the number of rental apartments under construction in the Toronto CMA has more than doubled over the past five years to 7,701 units per August 2019 CMHC data. The data on rental rates clearly shows there is a segment of the market that is willing to pay more than $4.00 per sq. ft. in rent. According to listings from Rentals. ca, 31 per cent of all condominium apartments in Toronto in 2019 were advertised with rental rates at or above that $4.00 per sq. ft. rent figure. Would you pay $2,000 a month for 500 sq. ft.? Based on my own consulting practice, I’ve done a lot of work for

developers looking at building rental apartments, and with the lifting of rent control on new projects, expect the number of under construction apartments to increase in the next few years. This certainly offers competition to the hold-and-rent investors, but as of yet, it doesn’t look like it will have a big dampening impact on rental rates. In fact, many of these buildings will have much higher rental levels than competitive buildings, and the nearby condo rentals might look even more appealing. It will certainly be interesting to watch over the next couple years.

If you’re working with a realtor to purchase a resale condo, or are buying a preconstruction unit in a new condominium, chances are you have heard the words ‘Status Certificate’ a few times. What is a Status Certificate and why is it so important?

WHAT IS A STATUS CERTIFICATE?

A Status Certificate forms part of the condominium disclosure documents, which also include the condo by-laws, declaration, rules, and certificate of insurance (the “Disclosure”). The condominium corporation (the condo corp.) provides the disclosure to purchasers that are interested in buying a resale unit managed by the condo corp. and in the context of new construction, the full package of condominium documents are provided together with the Agreement of Purchase and Sale to enable the prospective purchaser to review same within the 10-day cooling off period.

WHAT SHOULD I LOOK FOR IN THE STATUS CERTIFICATE? COmmON ExPENSES

Common expenses are a monthly fee that unit owners pay to maintain the condominium’s common elements. Common expenses can include maintenance fees, building insurance, central air conditioning, and water. A buyer should first check to ensure that what is listed as being included in the common expenses in the Agreement of Purchase and Sale are the same as what is listed as included in the Status Certificate, sometimes these enclosures can differ. The Status Certificate should also list whether there will be an increase in common expenses for the current fiscal year. This is important for purchasers because it may impact your budget in the coming year. BUDGET

It is common for the condo corp. not to list whether the budget will result in a surplus or deficit. However, the Status Certificate should outline whether the common expenses for the unit have increased, or not, in the current fiscal year. …continued on page 34

The condo corp. will also list whether the board has levied any special assessments for the year. The Status Certificate will list whether the condo corp. has any knowledge of circumstances that may increase the common expenses for the unit during the budgeted period. Here, you may find a problem like outdated plumbing, insulation, or major repairs like the roof or balconies of the building. In the event of unanticipated expenditures, the corporation may have to increase common expenses or provide for a special assessment. This will once again impact the purchaser’s budget and factor into their decision process. RESERVE FUND

The Condominium Act, 1998 requires that all condominiums have a reserve fund. The reserve fund is used to pay for major repairs and replacements to the condominium’s common elements. Part of the owner’s monthly common expense fee goes towards the reserve fund each month. The Status Certificate will list an approximate value of the reserve fund as of the date of the Status Certificate. As a potential owner you should look for a reserve fund healthy enough to pay for any scheduled or unscheduled repairs and replacements to the condominium’s common elements. If a reserve fund is too low its more likely that owners will be hit with a special assessment for repairs. If a reserve fund study has been done and a plan for funding the reserve fund was completed, this will also show in the Status Certificate. This section outlines whether the condo corp. is subject to any litigation. If there is litigation, there may be an increased risk of a special assessment. This may also result in an increase in common expenses. It is important to know the full extent of the litigation and to understand the liability unit owners may face. RULES

The condominium may have restrictions on lifestyle choices that include things like pets, barbecues, balconies, patios, awnings, gardens, and smoking. Before you make the decision to purchase a condo, it’s important to read the condo rules and understand how they may affect your lifestyle. DECLARATION/ BY-LAWS

It is important to review the Declaration and Description pertaining to the unit, including any exclusive use common elements areas, to determine whether or not the seller or any previous owner has carried out a structural change to the unit or modified the common elements in circumstances where the board has not given its prior written consent. It is also recommended to do an inspection of the unit to see whether a breach of the

Declaration, by-laws and/or the rules has occurred as the new purchaser may be responsible. WHY YOU NEED A LAWYER

As per the Condominium Act, 1998, a purchaser buying a resale unit should receive the Status Certificate within 10 days of requesting it. In today’s market, conditions in Agreements of Purchase and Sale relating to the review of Status Certificates are typically two days. In some cases, purchasers are making offers without a condition for Status Certificate review. However, a Status Certificate is extremely important, and it is imperative you have it reviewed by your lawyer. market, expectations are so much higher than what they use to be. People want authenticity and quality. We have also seen a considerable trend that is giving more emphasis on incorporating hospitality features into condominium interiors. DM: We are always researching new design trends and traveling the world to be inspired. There is always innovation happening and our job is to identify the best option for a particular project. We don’t have a signature style and we really work hard to understand each of our projects in depth, and offer unique design solutions best suited for the client’s needs. At Lakeside for example, the aesthetic feels modern, but with classic detailing, which will uphold their style and remain visually significant for many years.

NH: Tell us a more about Lakeside and the spaces you designed. DM: Lakeside is a high-rise community in quite a significant location in the city, south of the Gardiner, across from Sugar Beach, steps from Lake Ontario. It’s a key project for the emerging East Bayfront neighbourhood that is poised to become a key live/work/play district in downtown Toronto. It will offer a mix of sustainable residential communities, state-ofthe-art workplaces and renewed connections to the water and parklands, creating tranquility in a busy city. Everyone – people of all different ages and stages, including families will want to live here. The area is also being planned to become a true extension of the downtown core.

At Lakeside we designed the interior spaces for the third building, Lake Suites, which sits at the most southern portion of the site and is the residence closest to the water. NH: How is Lake Suite’s unique location reflected in the amenity spaces? DM: Tying into the recreational

culture of the waterfront, outdoor condo amenities include a rooftop putting green, outdoor dining and barbeque spaces, as well as a fireside lounge with picturesque views of Lake Ontario. The rooftop putting green is very different and unique for downtown living. Being so close to the water, it provides an opportunity for residents to enjoy an outdoor recreational culture of the waterfront from the comfort of

their own home. Residents will also have access to a rooftop swimming pool on the podium of the adjacent Park and Sky building, as part of the master-planned development. Lobby interiors are inspired by the surrounding waterscape with colours such as warm woods, cool blues and accents of grey. Light wood paneling is contrasted by dark, full height custom doors and hardware. Other features include integrated millwork and bespoke lighting, as well as an art program inspired by the waterfront. Adjustable-rate and fixed rate mortgages There are generally two types of conventional mortgages – a fixed-rate and an adjustablerate mortgage. An adjustablerate mortgage means the interest rate can change over the term of the loan. A fixedrated mortgage simply means that the interest rate stays the same through the entire term of the mortgage and is “locked in”.

In addition to the actual price of a home, there are also closing costs, which will typically make up about two to five percent of the purchase price, not including the down payment. Examples of closings costs include the mortgage processing costs, title insurance, and excise tax, and legal fees.

This is how much a home is worth according to a public tax assessor who makes this determination in order to figure out how much city or state tax the owner owes.
