Canada’s economy poised
for another year of solid growth in 2012: RBC Economics
C
anada’s economy grew at a moderate pace in the final quarter of 2011 and is
expected to pick up steam in the year ahead, according to the latest RBC Economic Outlook issued today by RBC Economics Research. Burgeoning signs of strength in the U.S. economy, low interest rates, solid balance sheets across corporate Canada and elevated commodity prices are setting the stage for continued economic expansion. RBC forecasts real GDP to increase by 2.6 per cent in both 2012 and 2013.
“Canada’s economic growth clocked in at 2.5 per cent in 2011, shaking off a few speed bumps in the middle of the year and ending the fourth quarter with only moderate real GDP growth of 1.8 per cent,” said Craig Wright, senior vice-president and chief economist, RBC. “The country’s main engines of economic activity from the early days of the recovery - consumer spending and residential investment are likely to play supplementary roles as the economy shifts into slightly higher gear on the road ahead.” High commodity prices and strong corporate balance sheets are expected to boost business investment’s overall contribution to economic growth by 0.8 percentage points and 0.9 percentage points this year and next. As the U.S. economy continues on a promising path, Canada will also benefit from improving demand for exports such as autos, machinery, and lumber. Exports account for 30 per cent of Canada’s GDP, and approximately three-quarters of them go to the U.S. RBC forecasts that real exports will return to the prerecession peak level in 2013, with net exports boosting growth to the tune of 1.0 percentage points in 2012 and 0.3 percentage points in 2013. the anticipated tightening in fiscal policy will likely have a restraining effect on economic growth. “We expect that a continuation of accommodative monetary policy will offset the potential impact of the withdrawal of fiscal stimulus,” Wright commented. “As inflation will likely remain close to the Bank of Canada’s two per cent target, we expect that the overnight lending rate will stay at its current level until early 2013.” Despite disappointing labour data that has persisted for the past seven months, with an average increase in employment of just 2,000 per month, RBC expects greater strength in
hiring going forward. The unemployment rate is expected to fall to 6.9 per cent by the end of 2013. The pace of consumer spending eased to 2.2 per cent in 2011, down sharply from 2010’s rapid 3.3 per cent rise. RBC projects that consumer spending this year and next will grow at a rate comparable to 2011, with durable goods accounting for approximately 25 per cent of the increase, slightly higher than its historical share. Elevated debt levels, which stood at 150.6 per cent of personal disposable income in the fourth quarter of 2011, will weigh on consumer spending moving forward. “At this point, the low interest rate environment is keeping the cost of servicing debt manageable. We haven’t seen any significant increase in consumer bankruptcies or a surge in mortgage delinquencies,” explained Wright. “At the same time, household debt has been weighing on the minds of many and the willingness to take on debt has likely diminished. This reduces the likelihood of another debt-charged surge in spending on goods, services, or housing.” At the regional level, Western Canada is expected to top the growth rankings in 2012, with Saskatchewan and Alberta leading the way and Manitoba following closely behind. The economies of Newfoundland and Labrador, British Columbia and Ontario are expected to grow at rates close to the national average. Quebec continues to experience some challenges and, along with the remaining Atlantic provinces, is positioned to grow below the national average. While risk lingers on the global stage, stimulative monetary policy and renewed confidence are expected to carry the world economy in 2012. RBC forecasts that, with the euro zone in recession and the U.K. economy limping along, the leadership baton is being handed over to the U.S., where signs of a more robust year for broad-based growth are materializing. RBC expects the U.S. economy to expand by 2.5 per cent in 2012 and 3.0 per cent in 2013.

7 tips for successful real estate investing Many people think being a landlord and investing in real estate is a way to make easy money. It can be financially rewarding if you do your homework and reduce your risks. But easy, it isn’t and it can lead to financial ruin if not done properly.
• Research the area where you’d like to buy. Is it in decline or on the way up? A good indication is if chains like Wal-Mart, Tim Hortons and Home Depot are moving in. These companies do a lot of work on demographics and income before deciding where to locate. You can get a big picture look at vacancy rates at settlement.org, a federally funded site that helps immigrants with information and resources to settle in Canada.

The trick is to end up with money in your pocket at the end of the month after paying your bills and collecting the rent as you slowly pay down the mortgage and end up with a nest egg. Here are some tips:
• Use a real estate agent who also is an area investor. Ask them to show you their properties and the rents. Ask for the names of other investors they have helped. Call them. Make sure they have a team of professionals you can use, such as property managers, insurance advisers, mortgage brokers, home inspectors, accountants and lawyers. • Once you own more than four rental units, find a reliable property manager. You don’t want to take a call in the middle of the night. A rule of thumb is that you should allocate up to 10 per cent of monthly rent to a property manager. They will make sure your building is properly maintained and can help find tenants. • Do not be in a hurry to rent a vacant unit. Take your time to qualify any potential tenant, since it can take months to evict a problem tenant. Call all tenant references, ask for a current pay stub and speak to at least two prior landlords. Where possible, require the tenant to pay for utilities. The tenant will have to apply to the utility company for an account, which amounts to an extra credit check being done by the utility company. • Be careful with basement apartments and homes rented to students. Although these units can provide additional income, you must make sure that they are legal, comply with the fire code and have any required licenses to operate. • Buy and hold your property for the long term. This way, you have an income and slowly start to pay down your mortgage. • If you are investing with others, have a partnership agreement. However, while social media tools such as podcasts and social networking sites present significant, cost-effective opportunities for businesses to engage customers, only 29 per cent of Canadian small business owners are taking advantage. The survey, conducted by Leger Marketing, found that those who think social media can increase their profit, believe it can do so through: - Promoting their company’s brand or reputation (64 per cent) - Providing broader access to consumers (63 per cent) Niagara Peninsula

“Social media, while still a relatively new communication and marketing channel, is definitely here to stay. We anticipate it playing an increasingly important role for Canadian businesses, as they look for cost effective ways to open new markets and broaden and deepen their connection with customers,” said Cathy Pin, vice president, Commercial Banking, BMO Bank of Montreal. “Our customers are also telling us they value opportunities to interact with other businesses, network online and share insights and experiences. That’s why we recently launched a new online community for business owners,” added Ms. Pin. The BMO SmartSteps for Business Online Community is a virtual hub with social media features and tools, including a blog, live Twitter feed, and hot topic polls, for small businesses to get engaged online. Business owners access over 100 podcasts that provide advice from top industry experts on topics including developing a business plan, managing cash flow, and the importance of social media. For those businesses that use social media tools, Facebook is the most popular choice at 70 per cent, followed by LinkedIn (32 per cent), and Twitter (31 per cent). Pritesh Gandhi, senior manager, Digital Marketing & Strategy, BMO Bank of Montreal, notes that social media tools have become more advanced over the past five years, and offer various benefits to business owners. “While the most popular application is Facebook, there are other networks and tools that can offer benefits to businesses. For instance, LinkedIn is very effective in building and maintaining contacts for recruitment and knowledge sharing purposes, while the effective use of Twitter can help to keep the dialogue open with your customers and respond to queries in real time.” Mr. Gandhi adds that “BMO has increased their social media presence over the past year by actively using Twitter for everything from customer feedback and service issues to generating awareness of the new product or service launches.” The challenge is that a social media presence takes time to build, and the impact on the bottom line is more difficult to measure than some more traditional forms of marketing. On average, Canadian business owners surveyed say that 28 per cent of their marketing efforts are focused online as opposed to traditional media channels. Those who believe social media can increase their profitability are also more likely to devote a higher percentage of their marketing efforts online on average, compared to those who do not believe it will help the bottom line (34 per cent vs. 22 per cent). PRIVATE LENDING…NOT ONLY FOR THE RICH Investment, this is a word that has become a central part of our everyday vocabulary. Almost everyone has some kind of investments. There are investments in stocks, retirement plans, insurance, commodities and of course real estate. It seems that almost everyone is interested in Real Estate investment. In the past this same kind of investing was called speculating, and was something, which was done only by the very rich. Until recently, it was thought that Real Estate investment was a risky business, only indulged in by those who could afford to lose money. Today’s thoughts about Real Estate investment has greatly changed. Real estate investment has proven to be one of the safest investments one can make, while yielding large returns. One of the best ways to make your investment money work for you is through mortgage lending. Instead of actually purchasing a property, you become the lender to someone who is unable to secure a full bank mortgage for various reasons. Many people who have become wealthy through real estate, started with mortgage lending. They were average people who with a calculated risk took a leap of confidence into Private Lending. They were soon to discover, as you will, Private Lending can be very financially rewarding. If you are thinking about becoming a private lender, there are a few things you should consider, before parting with your investment dollars. Private lending is much different from placing your money in an account with a guaranteed rate of interest. You will have to first find a trust worthy Mortgage Broker, who has a history of successful Private Mortgages. It is important to understand that not all Mortgage Brokers are the same, and some will be much more affective with Private Lending recommendations than others. You want to inquire about how many successful Private Mortgages they have arranged, and how many satisfied Private Lenders they have. It would not be out of line to ask for references; after all it is your money. So let’s say you have found an outstanding Mortgage Broker, who has satisfied all your questions with informative answers, are you now ready to hand them a cheque? Not yet. No matter how excited you are to begin collecting those big returns on your money, it is important to know exactly what kind of mortgages your Broker is planning to recommend you invest in. This is an Investor beware moment. Many Brokers have clients who are in dire circumstances and are at risk of losing their home. Often they are experiencing severe credit problems, are in arrears with their mortgage and taxes and need to consolidate their debts. Banks will not lend under these high risk circumstances. Although these mortgages are historically higher yielding, they are also extremely precarious and have a high rate of default. If you are the nerves of steel type, and don’t mind living on the edge, then this might be the kind of investment for you. However, if you like to lay your head on your pillow at night, and enjoy a restful sleep, not worrying about your money, I highly recommend that you steer wide and clear of this type of Private Lending. In years past Banks had a much different criteria for Mortgage Lending. Times have changed, and no longer do you go to your friendly Banker for a Mortgage. Lending rules have tightened and more often than not it is a faceless person on the other end of a telephone or the internet, who will be deciding if a mortgage will be granted to the applicant. It is because of the changes in the way the Banks gear their lending, people who have invested in income properties are finding it difficult to obtain the mortgages they need to purchase more properties. Enter you the Private Lender. Lending to this kind of client is generally a safer proposition, as the income property investor, usually has clean credit, a good income and other assets, that can be secured against the mortgage. This is the type of Private Lending that allows you to experience solid returns of 8-20 percent, while still granting you a degree of security.

Many people who have invested in RRSP’s hoping this will become their retirement nest egg, have come to realize that the interest received is very low, and will not make much of a nest once they retire. It should be noted; not all RRSP plan holders will allow you to Self-Direct your funds into Mortgages. You should check with you plan holders protocol on mortgage lending. This is something you should be looking into before you invest you money in any RRSP plan. Making your home’s equity work for you is another popular way to get involved in Real Estate Investment. By asking your Real Estate Investment Mortgage Broker to arrange to have your home equity made accessible to you, by re-financing your current mortgage, you will now have liquid funds ready for your investment. Interest rates are right now at an all time low. Why sit on money that could be earning you as much as 9-20 percent interest, which is a substantial profit considering the low interest of the Mortgage. At the end of one year your funds have typically come back to you, and you can re-invest. Now that’s truly making your home’s equity work for you. I have extolled on the positive benefits of Real Estate Investment, but what about the risk? With any kind of investment there are always risks and should be well researched before making an involvement decision. A major risk factor to consider would be if the Borrower were not to pay their mortgage obligation. The Private Lender is typically in second position. This is where your participation in your investment is important. It is advisable for you to ensure that the first mortgage is being paid and up-to-date, so you will have control over the sale process, which will help protect your investment. A good loan-to-value on the property is also something that should be considered, in the event of a mortgage default, as long as the first mortgage is up-to-date, you will be in a good position to charge back costs and any associated fees to the property sale. The best way to manage the risk of Real Estate investment is without fail always do your due diligence on the property and the borrower. Get a realistic valuation from a reputable appraiser or valuator. Real estate investing can be very rewarding, providing you follow the basic rules, use proper counsel, and do your due diligence. Become a wise investor, and do not let fear of the unknown cripple your vision of a great return.

What can a commercial landlord
do about tenant default? By Jayson Schwarz and Aaron Grinhaus
Y
ou signed a five-year lease with a new tenant. His credit checked out and all is well – or was... Suddenly, it’s two years later and cheques begin to bounce. You try to speak to the tenant, but communication breaks down. You are owed money and your mortgage company wants its payment. What can you do? The decision is between distress and forfeiture. A distress is when you enter the premises, take control, change the locks and seize all of the tenant’s goods on the premises. A forfeiture occurs when you change the locks and terminate the lease. Remember, a lease is your blueprint on how to proceed and if you have a loose lease, you may have limited options. Whatever the lease does not cover, the Commercial Tenancies Act, R.S.O. 1990, c. L.7 will regulate. Before a landlord can distress the property, a few conditions apply. You must give the tenant notice in writing of the breach. The governing law states that notice is required, unless the lease says otherwise (remember that loose lease). Such notice must be given 15 days before changing the locks. Provided you have the authority by lease or statute, the way to go about this is to attend at the premises with a locksmith and your prepared Notice of Distress and change the locks. Remember, you must give the tenant access

to the premises during normal working hours. Your lawyer can give you detailed advice on how to wend your way through this technical area, so no mistakes are made. Why distress? Subject to PST and HST, you have the right, if the tenant does not pay you current (quite often plus accelerated rent) within five days of the distress, to have the tenant’s goods sold to pay your rent and costs. A Landlord’s distress just about comes before everyone, including secured bank debt – except monies still owing on a conditional sales contract and a bankruptcy trustee if the tenant goes bankrupt before you have completed a sale. If you get all your money, the lease is back in good standing and the tenant’s obligations continue. In a forfeiture, you re-enter the property for the express purpose of terminating the lease, throwing the tenant out and moving forward to release immediately. Having a proper notice is critical. Once the landlord re-enters properly and is in accordance with the law and the lease, the property is secured for the benefit of the landlord alone and the tenant is denied access. The landlord and tenant relationship is ended. The tenant may remove his or her property and the landlord must try to stem his or her damages by re-renting to someone else. This is old law for the case of Highway Properties Ltd. vs. Kelly, Douglas & Co., [1971] S.C.R. 562 stated that once a landlord terminates a lease, it has a duty to mitigate damages by finding a new tenant so that it can offset the losses owed by the old tenant. You still have the right to sue the tenant for your losses, but good luck, unless you have personal guarantees. Perhaps the most difficult part of writing these articles relates not to the actual writing, but thinking of a topic to address. anadian retailers who adopt sustainable business practices are differentiating themselves in an increasingly competitive marketplace and also significantly reducing their costs, according to a new report released today by RBC and Retail Council of Canada (RCC).
“Retailers profiled in this report demonstrate
that sustainable leadership doesn’t need to be a huge endeavour and that, by taking the first step, they can create real change,”said Andrea Bolger, head, Business Financial Services, RBC. “Making a commitment to sustainable business strategies has very tangible bottom line rewards and can help mitigate environmental risks.” The report, entitled Re-envisioning Retail, highlights the risks and opportunities associated with environmental sustainability. Retailers who have implemented sustainable business practices and have benefited from greater efficiency and productivity, improved employee retention and enhanced brand reputation are profiled in the report.

Retail industry leaders’ sustainability initiatives profiled in Re-envisioning Retail include: Canadian Tire: Implemented hundreds of sustainability initiatives over the last two years, from lighting retrofits to efficiency improvements in product transport, saving the retailer approximately $6 million Home Depot Canada: Created a program that gives Canadian manufacturers the opportunity to pitch innovative, environmentally sustainable products. By supporting great ideas, the retailer hopes to help transform the market by ensuring that sustainable products are always on their store shelves. Sears Canada: Replaced more than 116,000 incandescent lights in all of its Sears Home and full-line stores across Canada, making it the first Canadian retailer to install an LED retrofit. This resulted in a 75 per cent annual reduction in energy consumption and two-year payback on investment. Unilever: Conducted lifecycle analysis (LCA) on more than 1,600 of its household products and found that 68 per cent of its green house gas (GHG) emissions occur from consumers’ use of their products. The retailer hopes to empower 200 million consumers to improve their own environment footprints and help reduce GHG emissions by 2015. Walmart Canada: Commissioned an assessment of its heating, ventilation, and air conditioning (HVAC) and energy systems at over 200 stores, resulting in adjustment changes that created a 20 per cent increase in energy efficiency and will provide a payback on investment of less than three years. Whole Foods: Targeted April 2012 as the date when all ingredients will be listed on the packages of all household cleaning products that they sell, to enable their consumers to make greener, healthier choices. Household cleaners that do not meet minimum standards will be removed from store shelves. Small business optimism continues to show signs of improvement “Small businesses saw a little more sunshine in February,” remarked Ted Mallet, chief economist and vice-president for CFIB.“Better conditions in Ontario and the Maritimes, that were once held back by European and US economic worries, appear to be driving the gains in sentiment.” Businesses in Western Canada are generally the most optimistic with Alberta (72.3) and Saskatchewan (70.1) again at the top of the list. However, February also saw meaningful gains in optimism in New Brunswick, Nova Scotia and Ontario. Unfortunately BC’s confidence fell last month and PEI and Newfoundland & Labrador are following the same direction. Optimism weakened in construction and manufacturing, but it was more than offset by big improvements in retail and hospitality, suggesting that consumers are in a positive frame of mind. Owners in the natural resources and the business services sector are the most upbeat. “For the first time on record agriculture makes it into the topthree, in a tie with financial services,” said Mallett.“Overall, there is a very little gap between the most- and the least-optimistic business owners, by sector, which is a welcome sign of general economic stability.” “New orders levels are a little slower in February, on account of weaker manufacturing and construction sentiment, however, these leading indicators, including overtime levels and accounts receivables, remain much higher compared to recessionary levels,” concluded Mallett.

ccording to the latest Business Barometer Index from the Canadian Federation of Independent Business (CFIB), small business confidence has risen to 66.0 in the last month – its sixth-consecutive monthly increase. The Index, however, still has a few points to make up before re-establishing the high levels seen this time last year.

Measured on a scale between 0 and 100, an index level above 50 means owners expecting their businesses’ performance to be stronger in the next year outnumber those expecting weaker performance. According to past results, index levels normally range between 65 and 75 when the economy is growing. The February 2012 findings are based on 877 responses, collected from a stratified random sample of CFIB members, to a controlled-access web survey. Findings are statistically accurate to +/- 3.3 per cent 19 times in 20.
