Small business confidence edges down in May “It’s a fairly small decline, but the index is now at its lowest point since the summer of 2012, when the economy went through a slowmotion act,” said Ted Mallett, CFIB’s chief economist and vice-president.“Canadian small business optimism remains cool this spring.”

Small business owners in Alberta (68.8) are the most optimistic in the country, although Newfoundland and Labrador (68.3), Saskatchewan (65.8), and British Columbia (64.9) are all above the national average. Ontario (61.9), and Manitoba (61.0) are slightly below the national average, while New Brunswick (58.1) and Prince Edward Island (55.6) are further back. The biggest declines occurred in Quebec (58.9), which dropped five full points, and Nova Scotia (50.0), which is by far the lowest in the country.

“Despite a reasonably good outlook for employment and capital investment, there are general signs of sluggishness, including a greater concern over levels of customer demand,” added Mallett.

Ontario’s economic growth to pick up the pace in 2013: RBC Economics

O

ntario’s economic growth is expected to improve this year and next, due to employment gains, improving trade performance and still-strong housing construction at the start of 2013, according to the latest RBC Economics Provincial Outlook. RBC anticipates real GDP growth of 1.7 per cent in 2013 and 2.8 per cent in 2014, both up from 1.5 per cent in 2012.

Ontario’s growth was re-energized in the early stages of 2013 after stalling in the second half of 2012. RBC indicates that Ontario’s international trade deficit decreased slightly, bucking the decade-long deteriorating trend and reducing its drag on economic growth, and the jobs market experienced significant progress.

“We saw a jaw-dropping 51,000 surge in employment gains in May as well as year-to-date annual job growth jumping to 2.0 per cent, more than double the increase in 2012,”said Craig Wright, senior vice-president and chief economist, RBC. “These encouraging developments should go a long way in convincing skeptics that Ontario’s economic engine has restarted.”

On the external trade front, RBC notes that in the first four months of 2013, exports grew 0.5 per cent, despite momentary fatigue in motor vehicles and parts - Ontario’s top exports - which last year recorded a significant 17 per cent increase. With U.S. auto sales

in the midst of a solid recovery, RBC anticipates there is scope for further gains in auto sector exports.

“Generally speaking, the U.S. economy is on an uptick, which bodes well for Ontario’s economy. We expect U.S. demand for the province’s goods and services to improve in the period ahead,” said Wright.

In early 2013, the number of homes (or, more specifically, condos) under construction in Ontario were near 30-year highs, and residential investment remained a factor adding to growth. Nonetheless, RBC expects residential construction activity to slow later this year as sales and starts decline and homes under construction are completed.

“While we anticipate slowing residential construction activity will leave a hole in the province’s economic accounts, strong investment in non-residential structures and infrastructures will more than fill it up,” said Wright.

OFFER PRESENTATION ON INVESTMENT PROPERTIES

So you have decided to buy an investment property. You found the property just right for you and are now ready to take the next step. Before you proceed with making the offer, ensure that an experienced realtor or lawyer who is familiar with investment properties represents you.

Consider that when you are buying a home you are basically buying bricks, mortar and land. However, when buying an investment property, you are also buying rental income and you are assuming tenants along with all the tenant rules, regulations and laws that accompany them. There are also extensive regulations and by-laws such as Fire, Zoning, Health and Safety issues and so on. Your offer must have the appropriate clauses and conditions to address all of the above-mentioned issues.

Your offer should request Tenant Acknowledgments on closing date, whereby a tenant confirms in writing the following: •

Monthly rent,

Consider including a clause allowing for a full property inspection including all units; this is an escape clause terminating the offer if you are not completely satisfied with the said inspection “at your sole and absolute discretion”.

EQUIPMENT Other information that the offer must contain is confirmation of all equipment and chattels that belong to the property are included in the purchase price (i.e. lawn equipment, vacuum cleaners, appliances, snow blowers, cleaning and hardware supplies, ladders etc.).

FIRE REGULATIONS The offer should require that the Seller provide a “Letter of Compliance” from the Fire Department confirming the Fire retrofit was completed and is in compliance. I also highly recommend that a request is submitted for annual fire inspection certificates from a qualified technician.

With today’s strict rules and regulations some properties may not be insurable due to environmental or electrical issues, or the insurance company may charge a premium for certain properties.

This justifies the insertion of a clause conditional allowing the buyer to obtain satisfactory insurance.

FINANCING CLAUSE Unlike residential purchases, the conditional period for arranging financing should be extended (15 to 30 business days). Reason being, commercial lenders will likely request an appraisal, environmental and structural studies before final approval. If you plan to go with a CMHC insured mortgage, be prepared to extend this clause for a much longer period.

Failure to address any of the above matters may result in unnecessary grief, potential lawsuits and possibility of paying too much for the property.

ZONING REGULATIONS The offer should request that the Seller provide a copy of a Zoning Certificate which verifies that all units in the property are legal and meet the zoning bylaws, also confirming that no outstanding work orders exist.

Retailers welcome debate on transit investment: Reject ill-considered Parking Tax proposal

W

hile welcoming the debate on transit investment,

retailers are deeply concerned

with a flawed parking tax recommendation contained in the Metrolinx report tabled in June, said the Retail Council of Canada (RCC).

“Retailers understand the pressing need for investment in transit and transportation, on which we all rely for efficient movement of our customers, employees and goods,” said Diane J. Brisebois, president & CEO of RCC. “Where we part company with the Metrolinx report is on the suggestion of a new property tax on parking spots, which would be certain to hurt Ontario consumers,” added Brisebois.

The parking tax proposal is flawed in several respects, including an ill-defined description of how it would operate. It would fall disproportionately on retail merchants, relative to other business enterprises. Retailers, in turn, would have little option but to pass these costs on in the form of higher retail prices and these higher prices would affect all purchases of groceries and general merchandise.

“A tax on free parking spaces is just another form of property tax and would ultimately affect all consumers alike, whether they drive, take transit or walk to the store,” said RCC Senior Vice-President, David Wilkes.“It would be a double-whammy for consumers, over and above Metrolinx proposed 1 per cent sales tax increase,”Wilkes noted.

Retailers welcome a robust debate, both about needed investments in transportation and transit and on the funding required to make those investments. At the outset, however, retailers demand that certain principles be established, among which are that any revenue measures should be equitable, properly thought out and subject to strict sunsetting provisions.

Regrettably, Metrolinx’s current proposal fails that test on all counts.

legallyspeaking Timelines: In commercial financings, lenders typically require anywhere from 30 to 90 days to carry out their due diligence. It typically takes this long as procuring necessary documentation, i.e. environmental assessments, property appraisal(s), financial statements, etc. takes time.

Purchasers must ensure that any financing condition in an Agreement of Purchase and Sale affords sufficient time for said diligence to be carried out.

Collateral security: Prospective purchasers should also be aware of the possibility that other collateral security may be requested by the lender to secure the commercial mortgage. In many cases a personal guarantee will be required.

Conclusion: Commercial mortgages are more complex financing vehicles than the residential variety to which most people are accustomed. There are numerous elements to be aware of and a considerable number of things to come up to speed on when considering the purchase and financing of a commercial property.

his article explores a few of the considerations inherent in the procurement

of commercial mortgage

financing. Commercial mortgage applications are typically more involved than residential applications and are open to considerable subjective analysis on the part of lenders. This is because the assessed value of the underlying security, i.e. the real estate, is driven mainly by market forces occurring where the property is situated. Hence, location, timing of the current economic cycle, use, rental income and expenses or owner occupancy are key factors considered by lending institutions before advancing a loan.

Loan to value ratio: Lenders rely heavily on loan-to-value (LTV), which is the percentage calculation of the loan amount divided by the purchase price. If you know the LTV requirements of a particular lender, you can calculate the loan amount by multiplying the purchase price by the LTV percentage.

Homework before approaching a lender: Approaching a commercial lender is not simply a matter of just showing up. There is a long list of things you should know and have prepared prior to making a commercial mortgage application; for example: (i) an understanding of cash flow generated by the property relative to debt servicing the mortgage; (ii) ensuring appropriate “conditions� are set in the Agreement of Purchase and Sale; (iii) the documents, surveys, and third party reports the lender will require so it can intelligently assess the risk involved and the cost thereof; (iv) knowledge of the financial criteria the lender will use to assess the application including collateral security; The above list is by no means complete. As such, it is prudent to meet with a lawyer experienced in the area of commercial real estate acquisitions at the beginning of the process in order to make sure you are covered going into the deal.

Mountaineers prove that banking with Standard Chartered is possible even at the top of the world

wo mountaineers have set a world record by being the first to use a mobile banking app on Mount Everest. Climbers Horacio Galanti, from Grande Prairie in Alberta, Canada, and Horacio Cunietti, of Mendoza, Argentina, achieved the feat using Standard Chartered Breeze mobile banking apps during their expedition to summit the highest peak in the world; an altitude of 8,848 metres above sea level.

Coinciding with the 60th anniversary of the first ascent of Mount Everest by Sir Edmund Hillary and Sherpa Tenzing Norgay on 29 May 1953, the two Horacios are aiming to climb into the Guinness Book of World Records. In a series of firsts for banking, they have successfully traded shares with Breeze Trade and conducted funds transfers with Breeze Banking at Everest Camp 3 located at 6,500 metres then confirmed their bank account balances with Breeze Balance at Everest Camp 4 located at 8,000 metres.

Students to learn the importance of small business

Eight students from across Canada have been selected to participate in an internship in Public Policy and Entrepreneurship.

Sponsored by Scotiabank and the Canadian Federation of Independent Business (CFIB), students will be given an opportunity to get hands on experience in research, analysis and reporting on various issues affecting small businesses.

“CFIB is delighted to be partnering with Scotiabank for a third year in a row,” said Dan Kelly, president and CEO of CFIB.“We’re proud to have a program which not only provides our interns with new insight on the importance of Canada’s small business sector, but it involves them in work to influence and improve public policy. This is experience that will give them an important edge in building their careers.”

The Public Policy and Entrepreneurship Internship provides a four-month placement for eight interns, one each from Vancouver, Calgary, Winnipeg, Ottawa, Montreal, Halifax, and two from Toronto. Working at the regional CFIB offices, the interns will be working on projects that have been selected for the purpose of lobbying on behalf of the small business sector including:

municipal spending, property tax, shortage of qualified labour, transportation infrastructure spending, and apprenticeship.

The “Street Smart Real Estate Appraiser” – foREcAST iT My last article focused on a real estate broker’s appraisal techniques. These industry experts are an excellent resource for valuation advice. But, remember to only consult with qualified real estate agents when asking for valuation expertise.

I personally tend to be cautious on comments from inexperienced agents new to the business; that are unseasoned in the dynamics of fundamental appraisal issues and how they may relate to a particular transaction.

What I have found in the 25 plus years in the real estate industry is there is always someone that understands a property better than I do! Who are these other real estate pros? What do they think? What do they see? Why should I find them?

What’s important to them? Why do they buy?

In my opinion, some of these people include: the Property Owners, Property Managers, Developers, Brokers, Builders, Bankers, Accountants, Lawyers, Business Operators, Engineers, Architects, Consultants ....etc. These people offer an invaluable contribution to the valuation of a property because they are industry specific professionals. Depending on the property being appraised, it’s best to talk to these people, understand what they think, know and see, and ultimately get their “trade secrets”. The mission - become a “STREET SMART APPRAiSER”!!

I once again turned to a real estate developer as these are people I normally have meetings with on a weekly basis.

A real estate developer’s valuation trick I’ll give you is “foREcAST iT”!

Phil Ritchie taught me this appraisal “trade secret”.

Phil is the Principal of Keefer Developments Ltd., which is a Niagara based real estate development company specializing in adaptive reuse, heritage and brownfield revitalization projects. Recently, Keefer Developments initiated a project utilizing green design principles to obtain a LEED certification on a new affordable housing project.

The other week upon delivering an appraisal to Phil, I drilled him on how he could make me a better appraiser. I asked him - where do I fall short in the valuation equation that he often works on day in and day out. Phil eased back into his chair…..I opened my note pad…..he paused…….one hour later…..I’m a smarter appraiser….Thanks Phil!!! This has given me more incentive to get a book started.

I can not possibly write enough in this article, to download all of Phil’s ideas, but I will pick one valuation trick that Phil considers regularly left out by appraisers.

Niagara Peninsula

When Phil considers a real estate redevelopment project, something he gives considerable weight to in the valuation process is what does the future hold (i.e. FORECAST IT). I am not talking crystal ball stuff or where the yen might be or how is the general Canadian economy. What he explained to me was what type of items that are generally under his control or have the ability to be steered in a favorable direction. These items include local planning, local zoning, neighbourhood influences, developments in the area (negative or positive – planned or under construction), governmental incentives, road improvements, income opportunities and basic fundamental financials. These forecasting items are often the most critical element for his internal evaluation. How are these items assessed in an appraisal for a Current Effective Date appraisal? Thanks Phil!!! Now I have to develop a day course to teach these techniques.

New Lending Rules and Practices Are you a real estate investor that has run out of options for purchasing rental properties? Are you self-employed and successful in your career, yet cannot get a mortgage? You are not alone!

Having been in the mortgage business now for over 15 years, I have seen many new rules and regulations introduced by various governments. Some changes have worked well and others...not so well. The recent federal changes to borrowing/lending criteria involving cutting back loan-to-value (LTV) ratios from 85% to 80% and amortization periods from 30 to 25 years on insured mortgages has certainly impacted the industry. Of far greater impact and consequence are guidelines issued from the Office of Superintendent of Financial Institutions Canada (OSFI). OSFI has issued practices and procedure guidelines impacting all federallyregulated financial institutions on residential mortgages of 1 to 4 units and include home equity lines of credit. The impact is only starting to make itself felt as various financial institutions have re-worked and are re- working their lending practices and criteria.

The results are becoming dramatic and are beginning to significantly impact the industry.

One result of these changes is that many mortgage brokers have become challenged with finding appropriate financing for smaller investment properties. Lenders and other institutions have now virtually ended small rental property financing. Further, self- employed stated income or low documentation loans and lines of credit have been reduced to 65% (reference “income verification” and “non-conforming loan principles”). Institutional mortgage lending to self-employed investors has been dramatically affected.

Small real investors who have rental properties which were financed some years ago, may be looking at injecting additional cash into their properties for things like improvements and life-cycle repairs. With Banks no longer offering the financing that was available 5 years ago, much stress is now being created. We recently had a client (who is self-employed) who purchased 2 properties some 5 years ago. He wanted to put additional cash into the properties to improve them. However, he was not in a position to contribute his own additional cash equity into the property. Even though the property values have increased, and the investment has run very smoothly with principal loan amounts repaid as part of the amortized mortgage, the investor could not get more than 65% financing based on his specific circumstance. 5 years ago he received 95% LTV financing!

What is the solution to these new restrictions and limitations? The answer is private lending. There are no “rules” imposed on private lending. Pro Funds Mortgages has been focusing on private lending in the recent years. Interest costs are higher, but lending documentation and criteria is not regulated. Different private lenders set their own rules and lending criteria. Often, the strength of the real estate security is of greatest importance. If you are self-employed, or if you are buying a student rental, or if you are buying an investment or a home that needs renovations or may not be complete, or if you are buying in a region that may not be on the Banks list to lend on, or if this is an investment or rental property (large or small), Private lending may be the best approach. We can get the mortgage done. We have lenders that will lend up to 85% loan-to-value in most cases (and up to 90% on exceptions). Why let the banks deter your investment direction and activities. There is (almost) always a way. With the historically low interest rates of today, perhaps a business case can be made to invest with private funds at slightly higher interest rate.

It is certainly worth exploring.

If you are looking for a mortgage and cannot seem to get approved by our Banks then give this option a shot. On the other side, if you are an investor and have RRSPs and cash, this is your time to get involved in investing in mortgages as a lender. New doors are now opening for both borrowers and lenders.
