Are you paying too much property tax? Let’s face it, realty tax on investment properties could significantly impact the N.O.I. (net operating income) and dramatically affect value. Unfortunately most investors take this large expense for granted and assume that the assessment on their investment property is correct and never bother to investigate it.

The reality is that many landlords are paying too much realty tax and they are not aware of it.

•

s an owner, you should investigate if you are paying too much A realty tax on your properties.

•

As a Buyer, you should investigate if the realty tax on the property you are about to purchase is over assessed.

In the Hamilton area, the following is a quick test to determine if your realty tax is properly assessed.

•

Multiply the gross annual rental income (before deducting for vacancy and bad debt) by 20%. As an example, if your gross income is $100,000.00 and you multiply this amount by 20%, the realty tax should be approximately $20,000.00. This is just a rule of thumb, and will give you a general idea where the realty taxes should be.

To prove my point that properties may be assessed incorrectly, I would like to share the following real life experience;

tax was about $12,000.00 too high. My first step was to ask MPAC to review the assessment through a simple application called Request for Reconsideration (RfR)” If you believe your property taxes are too high, go to the MPAC website follow the instructions; download, and fully complete the (RfR) form. A local assessment officer will be appointed to review your application.

Should you not agree with the results from the reconsideration process, you still have the option for an appeal, which is not covered in this article.

In reference to my application for the Request for Reconsideration, I am please to say it was successful. The owner received a revised tax assessment and a refund cheque for over $11,000.00 was issued. It was not just the refund that was big; what was even bigger was the increase in the net operating income as a result of the realty tax reduction. This translated to a huge rise in value. By taking the revised net income and using a market cap rate of say...7%, this equated to about a $150,000.00 increase in value!

I hope this article will inspire investors to take a closer look at their investment property realty tax. If you have any questions about your property taxes or the assessed value; or if you are thinking of buying or selling, I look forward to hearing from you. You buy into a business when you buy a condominium

C

ondominium units represent an affordable, versatile and popular option in the housing market,

especially for first-time buyers and empty

nesters. Approximately half of all new housing stock in Canada is made up of multi-unit dwellings (which includes condominiums), according to Statistics Canada’s most recent census data (2011).

“Many people don’t realize that when they purchase a condo, they aren’t just buying a home – they’re also buying into part of a business,” says Ray Leclair, the vice president of public affairs at LAWPRO.“You become part of the business of running the condominium corporation.”

With this in mind, Leclair offers the following tips and considerations for prospective condo buyers: 1. Be prepared for close community living and restrictions.

Condos may pose lifestyle restrictions you would not encounter in a detached home. Issues can range from noise from neighbouring apartments, to restrictions on pets, limitations on the use of your balcony and even restrictions on window treatments (acceptable curtains or blinds). Condo bylaws, rules and regulations outline your rights, and reviewing them with a real estate lawyer can provide greater clarity and insight.

2. Play an active role in the management of your condo corporation.

There are different ways you can get involved with the management of your condo corporation, including attending annual owners’ meetings, voting on the board of directors, or even joining the board or various committees. The board of directors in a condo is responsible for managing the assets (e.g. reserve fund) and business of the corporation.

3. You are responsible for the condo’s assets – and its liabilities.

Similar to the shareholders of a for-profit corporation, owning a condo unit means you own a “share” of the assets and liabilities of the condo corporation. While the monthly common expense/ maintenance fees you pay to the condo corporation and insurance will often cover liabilities that arise, this may not always be the case. A special assessment could be imposed on you by the board of directors which may represent a nominal or substantial amount (e.g. repaving the underground parking garage or repairing the pool).

Prospective condo buyers are encouraged to discuss these issues with their real estate lawyer before signing an agreement of purchase and sale, to ensure they understand their rights and responsibilities when it comes to condo ownership.

More than what you bargained for Inheriting tenants with a commercial property

U

sually a home or property inspector can give you a good idea of the condition of the real estate you are buying.

Unfortunately, the one thing an inspector cannot tell you is whether tenants will come with the property, and if they are any good.

Purchasing a commercial property with existing tenants can be a great way to hedge investment losses in the property. In addition, having them there will save you the time and expense of advertising to fill vacancies and can help you secure financing for the purchase of the property. However, beware. Having tenants brings with it exposure to several types of liability, in many cases dictated by the commercial lease in place and real estate law.

As a landlord it is important to understand there may be certain obligations for which you are responsible and understanding these obligations is critical to ensure you get what you bargained for.

Prior to purchasing a commercial property where you will be inheriting tenants: Meet the tenants. It is important to discuss with them any complaints that they have with the property. This will help you gauge whether you will have a good working relationship with your future tenants, and will also provide valuable insight into potential issues with the property. If you have many tenants, or you do not want to deal with your tenants directly, discuss the options for engaging a property management company with your lawyer.

Know your rights. When you purchase a commercial property any leases relating to the property will usually be assigned to you at the time of closing. If you consent to this assignment you will be bound to the terms of those leases. For example, these obligations could require that you remove snow from driveways, install or maintain security systems, pay for utilities, etc. Generally speaking, existing leases and then the Ontario Commercial Tenancies Act will govern your relationship with the tenant going forward.

Know your tenant’s rights. The lease will describe your tenant’s rights and the remedies he or she has against you if a dispute arises. These remedies may include abatement of rent payments, court or arbitration, or even cancellation of the lease. Be sure to have a lawyer review the lease and explain how you may be exposed to liability.

Review the leases prior to purchase. The leases will list your responsibilities to the tenant and vice-versa. These rights are impacted by the law relating to commercial tenancies as well. Be sure to make review the leases by your lawyer and that they meet his or her satisfaction, a condition of any agreement of purchase and sale. If you don’t like what you hear, it is not necessarily the end of the deal; you may be able to renegotiate the terms of the lease or the agreement of purchase and sale.

Commercial leases are very complex and intimidating documents; however, understanding your obligations and your tenants’ rights will allow you to feel comfortable knowing that your exposure is limited. These documents function to maintain stability, predictability, and in short, the “status quo.”

Landlord-Tenant disputes often arise when a lease obligation is not being fulfilled or is unable to be filled, resulting in issues with the property.

Ideally, the landlord and tenant should keep a good relationship in order to be able to resolve these disputes amicably without resort to the court system or other formal dispute resolution mechanisms.

Commercial leases require a lawyer familiar with the concepts and the law. Find a lawyer that has experience in the area because you will need a lawyer just as much after your closing as you did before.

Expanding internationally can be tricky but highly rewarding Here’s how to improve your odds abroad

I

f you’re an entrepreneur with growth on your mind, the place to look for fresh markets is no longer just the U.S., the European Union or Japan. It’s increasingly important to consider China, India, Brazil and emerging countries in Southeast Asia, says Frank Pho, Vice President, Global Expansion, at the Business Development Bank of Canada (BDC).

China’s economy grew by over 10 per cent annually from 2000 to 2010, while India’s expanded by 7 per cent yearly and Brazil’s has grown by nearly 4 per cent per year. Meanwhile, the economies of Canada, the U.S. and the European Union each grew by less than 2 per cent annually.

“The emerging markets are where you have constant GDP growth. Going to those countries should no longer a question of why, but rather a question of how,” Pho says. Expanding into these markets offers not just growth potential but also much needed diversification, he says.“Canada is a very small percentage of the global market. Companies that focus only domestically limit their growth potential.”

But Canadian companies are falling behind in the globalization race, Pho says. Just eight per cent of Canadian exports explore the fastest-growing emerging markets, while 85 per cent still focus on the mature developed world. Many companies don’t even consider pursuing international sales, and Pho says that can be dangerous.“If you don’t expand abroad, you’re playing a defensive game, because you will still be competing against foreign companies doing business in Canada.”

The road map to international expansion Canadian entrepreneurs need “a paradigm shift” to catch up, Pho says.

Many start selling abroad without an understanding of the target market’s behaviour, their different supply chain and/or business practices, which results in costly false starts.

Entrepreneurs must adopt the consumer mindset of the target country and adapt their products and solutions. Too often, Canadian companies fail because they assume a product that sells in Canada will sell elsewhere.

While discretionary income has increased in many emerging countries, consumers there still have less purchasing power than Canadians and won’t necessarily go for a product with costly frills, Pho says. Therefore, it may be beneficial to offer a version with fewer features.

It’s important to get help from advisors who understand the local consumer mindset, target market and players in the supply chain, Pho says. This process can take two to three months, but it will save you a couple of trips.

You will then need an additional six months to a year to adapt your product, develop a relationship with in-country partners and validate the business model before you’re ready for a full launch.

That’s often much more time than Canadian companies give themselves.

“Canadians often want to get a deal signed with a local partner after a couple of meetings. That won’t work in a country like China. They want to get to know you and build a relationship,” Pho says.

The path to growth Robert Desrosiers agrees. He started marketing his company, RH Hydraulique— which makes telescoping ladders used on utility trucks—in developing countries five years ago. Sales have just started to pick up now from those efforts, but they already represent 15 per cent to 20 per cent of his revenues. “It’s just the beginning. The potential is enormous,” he says.

Desrosiers says it takes three to five years, on average, to develop a solid foothold in a new country. That includes time to research local regulations, make contacts and educate potential customers about his products.

Presence onsite is also vital, he says, with a foreign venture requiring about 10 visits to the other country in the start-up phase.

In Indonesia and India, he’s also had to adapt some of his ladders because vehicles in those countries are smaller. However, the long wait and adjustments have been worth it, Desrosiers says.“I didn’t have a choice but to do this. If I want to grow, I have to go international.”

Find the right accountant for your business

A

s a small business owner, there comes a time when you need to hire an accountant for the best

interests of the company. But did you know

the term “accountant” is unregulated in Ontario? To make sure that your accountant is fully trained, engage someone who is professionally designated accountant.

Designated accountants, such as certified general accountants (CGAs), have rigorous training and real-life experience. If problems are encountered during the course of a business relationship, with a professional accountant, there is recourse.

Professional accounting associations typically offer mediation services or have a disciplinary process for irregularities and infractions.

Although business requirements may differ, the criteria for selection of a professional accountant are universal. The expertise you choose should lead to productivity, efficiency, sustainability, savings and growth. The interview process is an important one.

The questions you ask will go a long way towards developing a solid relationship based on mutual trust.

To get the right fit for your company, take the following steps to save both time and money: Find the right match. Assess your level of accounting knowledge.

If you have a limited knowledge in this area, choose an accountant who can explain basic concepts in easily understood language.

Define your immediate timeframes. For example, if the Canada Revenue Agency (CRA) is demanding your tax return, your timeframe will be less flexible than if you are starting a new business.

Determine how accessible your accountant needs to be. Will you travel to their office? Or do you require them to report to you personally?

Identify your needs. What functions will you require of your accountant? Will you require services such as the preparation, compilation, review or audit of financial statements? The preparation of income tax returns? Cash flow projections; tax and financial planning? Will you require your accountant to meet with bankers, lawyers or the CRA? Organize your financial papers. Organizing and preparing documentation ahead of time will reduce the time (and billable hours) that an accountant spends on simple tasks.

Completing this task may also help you to assess your knowledge and identify your needs.

Does the accountant have prior work experience with your type of business? Do they make suggestions that indicate an understanding of your business? Will they provide the names of clients in a related line of business? If so, verify with those clients as to whether the accountant is accessible and completes work on time and within cost estimates.

Who will do the routine work, the accountant or other staff?

Whether your accountant will be personally responsible for routine work may depend on your needs, the size of the accounting firm, and the nature and number of their clientele.

Are they open to the idea of using other experts? An accountant dealing with smaller, privately-owned companies should be willing to seek outside advice if or when specialized business affairs warrant such action.

What is the standard billing procedure? An hourly fee is the norm – Once the nature and requirements of your business are detailed, can the accountant provide an estimate?

How was the personal “fit”? Following the interview, ask yourself how comfortable you felt. You want someone whom you can speak freely. Someone who hears what you say and can explain their thoughts and advice clearly. Compatibility is essential.

The “Street Smart Real Estate Appraiser” – foREcAST iT My last article focused on a real estate broker’s appraisal techniques. These industry experts are an excellent resource for valuation advice. But, remember to only consult with qualified real estate agents when asking for valuation expertise.

I personally tend to be cautious on comments from inexperienced agents new to the business; that are unseasoned in the dynamics of fundamental appraisal issues and how they may relate to a particular transaction.

What I have found in the 25 plus years in the real estate industry is there is always someone that understands a property better than I do! Who are these other real estate pros? What do they think? What do they see? Why should I find them?

What’s important to them? Why do they buy?

In my opinion, some of these people include: the Property Owners, Property Managers, Developers, Brokers, Builders, Bankers, Accountants, Lawyers, Business Operators, Engineers, Architects, Consultants ....etc. These people offer an invaluable contribution to the valuation of a property because they are industry specific professionals. Depending on the property being appraised, it’s best to talk to these people, understand what they think, know and see, and ultimately get their “trade secrets”. The mission - become a “STREET SMART APPRAiSER”!!

I once again turned to a real estate developer as these are people I normally have meetings with on a weekly basis.

A real estate developer’s valuation trick I’ll give you is “foREcAST iT”!

Phil Ritchie taught me this appraisal “trade secret”.

Phil is the Principal of Keefer Developments Ltd., which is a Niagara based real estate development company specializing in adaptive reuse, heritage and brownfield revitalization projects. Recently, Keefer Developments initiated a project utilizing green design principles to obtain a LEED certification on a new affordable housing project.

The other week upon delivering an appraisal to Phil, I drilled him on how he could make me a better appraiser. I asked him - where do I fall short in the valuation equation that he often works on day in and day out. Phil eased back into his chair…..I opened my note pad…..he paused…….one hour later…..I’m a smarter appraiser….Thanks Phil!!! This has given me more incentive to get a book started.

I can not possibly write enough in this article, to download all of Phil’s ideas, but I will pick one valuation trick that Phil considers regularly left out by appraisers.

When Phil considers a real estate redevelopment project, something he gives considerable weight to in the valuation process is what does the future hold (i.e. FORECAST IT). I am not talking crystal ball stuff or where the yen might be or how is the general Canadian economy. What he explained to me was what type of items that are generally under his control or have the ability to be steered in a favorable direction. These items include local planning, local zoning, neighbourhood influences, developments in the area (negative or positive – planned or under construction), governmental incentives, road improvements, income opportunities and basic fundamental financials. These forecasting items are often the most critical element for his internal evaluation. How are these items assessed in an appraisal for a Current Effective Date appraisal? Thanks Phil!!! Now I have to develop a day course to teach these techniques.
