Get it in writing
and have your lawyer review your agreement
B
uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important than in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Why infrastructure is crucial to housing
As we tackle the challenge to improve and expand, proximity to existing amenities is increasingly key
I
t’s no secret infrastructure is important to any city and its residents. And in the case of many Canadian cities, there is a growing need to repair existing infrastructure that is decades old, as well as build new infrastructure to accommodate growth. This is why various home building associations and other organizations see some promise with the latest federal budget tabled on March 21, in which Finance Minister Jim Flaherty promised increased funding for infrastructure improvement. Proximity and access to transit and amenities – from highways to health care to schools to shopping to recreation – are critical for builders and buyers alike. Development charges for developers to build new communities, and help fund infrastructure growth, need to be reasonable, so as to deliver new-home prices to buyers that are affordable. It will take months, if not years, for new funding to reach municipalities. In the meantime, prospective homebuyers would be wise to pay careful attention to these matters, and to make honest assessments of how well equipped your potential newhome communities are in this regard.

What location should you choose? Location is a critical factor when
shopping for a new home. After all, a home with everything you need – but in the wrong location – is still not likely going to be the right home for you. Here are some things to consider about location:
» Do you want to live in a city, a town or in the countryside? » How easy will it be to get to where you work? How much will the commuting cost? » Where will your children go to school? How will they get there? » Do you need a safe walking area, or recreational facility, such as a park, nearby? » How close would you like to be to family and friends? Sustainable neighbourhood You also may want a “sustainable neighbourhood” that meets your needs, while protecting the environment. Homes in a sustainable neighbourhood are located near shops, schools, recreation, work and other daily destinations. This helps reduce driving costs and lets residents enjoy the health benefits of walking and cycling. Land and services, such as roads, are used efficiently. Sustainable neighbourhoods also feature a choice of homes that are affordable. In your search for a sustainable neighbourhood, here are some key questions to ask:
» A re there different dwelling types (such as singledetached, semi-detached, townhouse and apartments) in the neighbourhood? » A re the lots modestly sized? Roadways narrow? Driveways/parking areas small? Do natural drain ways lead to streams and storm water ponds or parklands? Is there native vegetation and streams with woodland edges?
“Look and feel” » Do the buildings have a friendly face to the street? Are the community centres, shops and meeting places welcoming? Easy transportation » A re there trees lining the street? Do you find the » A re stores, schools, recreation facilities, restaurants homes interesting to look at? Do the building sizes and health services within walking or cycling disfeel comfortable to you? Are the roads easy to walk tance? Will your children need to take a bus to school? along or cross? Can they walk to the park? Can you do most of your shopping without a car? Safety » A re there nearby bus stops and cycling lanes? How » Do the homes have “eyes on the street”? (In other long is the bus ride to work, or school? Can you words, are there people around who might watch out for you? Is there somewhere to go in an emergency?) safely bike? » Is there adequate street lighting? » A re there safe places for children to play? House size and features » A re the streets safe for cyclists and pedestrians? » A re the homes compact with shared walls to reduce » Is traffic slow moving and light? heating costs? » A re homes reasonably sized with lots requiring For more information, contact Canada Mortgage and less upkeep? N
ow in its final stages of construction with spectacular suites priced from $289,900 with occupancy dates next summer still available. Mastercraft Starwood has taken hotel inspired living to the next level. Now you can live in a condominium where every intricate detail has been designed to awaken your sense of style while simultaneously satiating your desire for comfort. There are only a few opportunities left to experience true hotel inspired luxury. Award-winning architect Roderick Lahey has designed this architecturally stunning 16-storey tower of glass,
aluminum, brick and granite. The Gluckstein design team has meticulously reviewed the finishes to ensure they meet the high standards and protocols previously reserved for luxury boutique hotels. Mastercraft Starwood is also the developer of Toronto’s finest boutique hotel, The SoHo Metropolitan Hotel, and Toronto’s first five-star hotel, The Hazelton Hotel. Each day, life will be enriched by the management and concierge services of Toronto’s SoHo Met Hotel as they raise the level of personalized care to new heights. SoHo Lisgar presents residents with more than 7,000 sq. ft. of indoor and outdoor amenities starting with the fabulous Gluckstein lobby of marble and metal. The impressive SoHo Prime Minister’s Club is the place to welcome friends on a grand scale with its executive boardroom, private dining room, lounge and bar. It is so-named for the portraits of the prime ministers by award-winning photographer Nigel Dickson that you can view at the presentation gallery. The party can spill out to the SoHo Water gardens with living wall, outdoor lap pool, whirlpool, linear fireplace and outdoor kitchen with barbecue. Lounge poolside, work out in the Dalton Brown Gym or unwind in the sauna and hot tub. Host a dinner in the private dining room. Watch a movie or sports event in the private screening room with seating for 24. At SoHo Lisgar, residents will be stars in their own homes. SoHo’s trademark design features floor-to-ceiling and wall-to-wall windows spanning interior widths of 20 ft. – unheard of in condominium living. The design is truly unique and exclusive, too. No other one- or two-bedroom condominiums in downtown Ottawa feature 20-ft.-wide kitchen/living areas with floor-to-ceiling and wall-to-wall windows (most other condominiums feature 10- to 12-ft.wide living rooms). Each floorplan has been designed by Gluckstein to accommodate fine furnishings of every taste and temperament. Each suite will be invested with the same high-

Location plus experience equals success
Minto and Canderel
come together to launch UpperWestOttawa’s most anticipated new condominium
I
n real estate, it’s suggested that there are only three things that matter: Location. Location. Location. And while often true, for Ottawa condominium buyers, there’s one more: Experience! Working together Ottawa’s leading real estate developer, Minto Communities, and the award-winning condominium development team at Canderel Residential, launched UpperWest in the heart of Westboro offering today’s condominium buyers just what they’re looking for: a condominium in a great location from an experienced development team. Already Ottawa’s most highly anticipated new condominium, Minto’s Senior VicePresident of Development, Brent Strachan, isn’t surprised, given the project’s prime location in the heart of Westboro. C22
Minto and Canderel UpperWest in Ottawa
Located at 485 Richmond Rd., the 25-storey tower offers unobstructed views of the vast green and blues expanses of the Ottawa River Parkway and the Gatineau Hills beyond. UpperWest offers residents a “backyard” unlike any other in Ottawa: hundreds of acres of federally-protected parkland that will always remain undeveloped. Not content to simply let the location be what defines the project, Minto and Canderel turned to one of Toronto’s hottest architects, Rudy Wallman, to create a distinctive design that would complement the prevailing urban forms of Westboro, while leveraging the site’s unique natural elements. The result, a new landmark for the Capital. “Rudy Wallman and his firm are among Toronto’s hottest architects,” says Canderel’s Vice-President of Sales and Marketing, Riz Dhanji. “Rudy has earned a reputation for creating distinctive condominium towers that make a bold statement. But, more than just creating icons in the sky, Rudy is well regarded for his appreciation for how people live in a condominium. This unique insight has allowed him to design condominium projects – to design suites and common areas – that really work for the way people really live.” With keen insight from Minto into the needs of the local market and Canderel’s insistence on good design, Wallman has created 195 suites that are designed with the lifestyle of both the young professional looking to “move up,” and the empty nester determined to “right size” in mind. Suites in the tower range from 455 sq. ft. to a spacious 1,391 sq. ft., although the building’s unique design will allow for some units to be combined, creating “some truly customized homes,” says Brent Strachan. Prices start at an affordable $210,900 to nearly $750,000, and all units will boast nine-ft. ceiling heights and large windows. Elegant kitchens offer designer-selected contemporary cabinets with slow close hardware, granite countertops and ceramic backsplashes, stainless steel Energy Star appliances, and stylish kitchen islands with cookware storage drawers (per plan). Equally elegant are the bathrooms which offer
designer-selected cabinetry and granite countertops, ceramic flooring, five-ft. tubs, walk-in showers and brushed nickel accents. Beyond its beautifully designed suites available from studios to three bedroom layouts, UpperWest features a hotel-inspired entry and sophisticated lobby, with a fireplace and three high speed elevators. The podium boasts the amenity spaces, including a state-of-the-art fitness centre, private dining area with demonstration kitchen and a magnificent 5,400-sq.-ft. outdoor terrace with reflecting pool, fireplace, gas barbecues, lush landscaping and elegant furniture. True to Minto’s longstanding commitment to green, sustainable development, UpperWest will be a LEED Certified development. “Together with Canderel we have created a sustainable residential condominium development that doesn’t exist anywhere else in Ottawa,” says Brent Strachan. “At UpperWest, we have matched unsurpassed location with unparalleled design and balanced luxury with affordability.” Canderel’s Riz Dhanji adds that while it’s a condominium that says something about its developers, “it’s a condominium that says more about its purchasers.” For your chance to live at UpperWest, visit the Presentation Centre, at 400 Richmond Rd, call 613.788.2786 or v isit liveupper west.com for more information. builder Minto and Canderel Location Westboro, Ottawa starting price From 455 to 1,391sq. ft. $210,900 to nearly $750,000 sales office 400 Richmond Rd. contact 613.788.2786 liveupperwest.com apr 6 - 20, 2013 | New home & Condo guide eastern Ontario 23

Further intervention
in housing markets not warranted: CHBA
T he feder a l g ov er nmen t
should refrain from further intervention in the housing market by adjusting mortgage lending rules, according to the Canadian Home Builders’ Association. In his inaugural address at the recent 70th National Annual CHBA Conference in Lake Louise, Alta., Incoming President Deep Shergill of Calgary said that such intervention represents “a hammer” that impacts all housing markets, both those that are healthy and those yet to fully recover from the recession. Shergill, President of Prominent Homes Ltd. of Calgary, called on the government to be prepared to take remedial action if housing activity falls below demographic demand or if price stability is threatened. “It seems less than forthright to constrain consumers’ ability to buy a new home – a real asset, while allowing usurious credit card interest rates to bury many consumers in non-asset backed debt,” Shergill said. Working to maintain a stable financing environment would be one of seven priorities in his plan of action for the coming year, he said. The others are regulation, government-imposed costs, a skilled and productive workforce, land availability, market intelligence and investment in research and development. Canada Mortgage and Housing Corp. (CMHC) has played a central role in maintaining stability in mortgage markets since the financial meltdown of 2008, Shergill
said. “We are extremely pleased that the federal government recognizes the corporation’s continued effectiveness.” The industry’s success in improving energy efficiency illustrates the benefits of collaboration with government in research and development. A CHBA analysis of the energy performance of an Ottawa home built in 1975 compared with one built today shows a 66 per cent improvement. Comparing similar models of family cars over the same period showed a maximum improvement in energy efficiency of 16 per cent. Shergill said it’s time to roll back the chronic over-regulation of the new-home building industry. Government-imposed costs are pushing house prices ever higher and must be rolled back and reduced, Shergill said. “So long as governments persist in confusing the effect of low interest rates with real housing affordability, they will fail to recognize the steady erosion of housing affordability.” The same pressures that add to the cost of a new home also inflate the value of existing homes, with no value-added. As a result there is a multiplier effect through the resale housing market every time a new charge, fee or levy is applied to new development. In some urban centres the relationship between house prices and household incomes has reached a crisis point. The growing underground economy is also a result of the rising tax burden on housing. In consultations on the federal government’s plan for long-term infrastructure, Shergill said the CHBA has pointed out that calls for new development to pay its own way deflect from the failure of politicians to invest in basic infrastructure over many decades. “What some call an infrastructure deficit should more correctly be recognized as a legacy of failed leadership. Requiring new development to pay for bad decisions in the past is unacceptable.” The CHBA hopes the next federal budget will outline a national plan for infrastructure investment that will give priority to housing affordability and choice.
The growing underground economy is also a result of the rising tax burden on housing.

Proximity to infrastructure

Ever notice how many builders boast their
new community is “ just minutes from shopping, schools and all the amenities!”? And that “Everything you need is “right at your doorstep!”? Indeed, proximity and access to a variety of amenities and essentials – from transit to health care to schools to shopping to recreation – are critical determining factors for builders and buyers alike, for lifestyle and comfort while living there, as well as resale potential down the road. It’s an important topic we’ve written about before in Fundamentally Speaking and elsewhere in New Home & Condo Guide. In addition, home building associations across the country have commented on infrastructure and related development charges and other fees rising to prohibitively high levels. Consider, for example, development charges imposed by some municipalities can exceed $60,000 per home – costs that are almost always passed directly on to new-home buyers – before a shovel even hits the ground.
The federal budget, tabled on March 21, provides some hope in this regard, in that it contains measures to increase support for national infrastructure. Says Canadian Home Builders’ Association (CHBA) President Deep Shergill: “It’s an opportunity to restore fiscal integrity at the municipal level and fairness for younger generations. At present, many municipalities are financing community infrastructure by transferring the costs into the mortgages of new home buyers, amounting to more than $5 billion a year.” Municipalities across Canada are now lobbying Ottawa to make sure they get their share of available funds to address road and transit needs. Faced w it h such infrastructure and funding challenges, municipalities are also typically considering other options – including new taxes, road tolls and other fees – to help pay for what’s needed. For homeowners and prospective new homebuyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever. With continuing immigration, general growth and construction expansion – all happening at a quicker pace than infrastructure improvements – our highways and transit systems will all be tested until everything catches up. As you’re out there shopping for your new home, look around to see how far you are from the nearest highway or rapid transit system that affords you a reasonable commute; and how close you are to health care, schools, shopping and recreation. These communities will be at a premium, now and in future.
For homeowners and prospective new homebuyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever.

WhY YOU SHOULDN’T FRET OVER a
‘ market correction’ by peter kinch
Pick up any newspaper today and no
one could blame you if you got a little worried about the state of the economy or the fear of a pending market correction in Canadian real estate. Are Canadians taking on too much debt? Have mortgage rules gone too far? Is there a housing bubble about to burst? What if there is a market correction? The real question is, do Canadian homeowners or prospective buyers need to be concerned? Every time there is talk about a market correction, the tone is quite negative. But let’s take a closer look at that situation: rather than argue about whether we may have a market correction, let’s analyze what it really means to Canadians if there is one. First-time homebuyers: If you’re a first-time homebuyer, you have likely felt the pinch of the rising cost of housing, and the new mortgage rules certainly haven’t helped any either. So a slight market correction would be welcome news for you; you can still get into homeownership with only five per cent down, but since your maximum amortization is now limited to only 25 years, a drop in pricing is exactly what you’ll need to be able to get into this market. Conclusion: A market correction is a good thing for you. Current homeowner buying or selling – moving up or downsizing: If you are a homeowner and you’re looking for the right time to sell your house so you can buy another, you may be concerned that the price of your current home is dropping. But, let’s assume the value of the house you are selling drops by 10 per cent. Let’s also assume that you plan to buy another home (whether upsizing or downsizing). Remember that the person selling their home to you is going through the exact same thing. In other words, if the value of your home dropped 10 per cent, so too did the value of the new home you are buying. Focus on what your bottom line “net” is, rather than what you thought or had hoped to sell your home for.

If you’re a first-time homebuyer, you have likely felt the pinch of the rising cost of housing, and the new mortgage rules certainly haven’t helped any either. Conclusion: The net effect of a market correction is likely zero. Real estate investor or second-home buyer: If you are buying real estate as an investment, this is the perfect market condition for you. When there are more sellers than buyers, you have more bargaining power. If you are able to negotiate a better deal and pay a little less for the property you are looking for, it simply makes the deal that much more affordable. Conclusion: You should be hoping for a market correction. Current homeowner with no plans to sell: The main reason we worry about a housing correction is the fear that it will erode our home equity and net worth. A significant amount of net
worth of Canadians is tied up in their home equity, which is the foundation for a lot of retirement plans – so there is obvious concern. But should there be? For the majority of Canadians, the plan is to stay in their current house for at least the next three to five years. So here’s a simple fact: equity is only gained or lost the day you sell. In other words, if the value of your house were to drop by 10 per cent tomorrow, you may feel anxiety over the drop in your net worth – but it would only be on paper unless you actually sold your house tomorrow. If you have no intention of selling soon and you can still afford your monthly payments, then all you need to do is sit and wait until the market bounces back – which it has always done for the past 100 years. Conclusion: A market correction may very well have zero impact on you. In the end, the headlines will continue to talk of impending market corrections. The key for you is to decipher one of three things: 1. Is this a real concern for you? 2. Is this an opportunity? Or, 3. A re you getting worked up about nothing? Bottom line: a lot of people will fret about this topic over the water cooler tomorrow morning – but the majority of them really don’t need to.

This look at your financial health will help you determine whether you would be able to handle increased payments if interest rates go up. While those rates are now at all-time lows, they will likely rise some time in the future. “Canadians need to look at how much debt they are carrying, particularly in the amount of their mortgages, home equity lines of credit (HELOCs), personal lines of credit and variable-rate personal loans,” says Ursula Menke, commissioner of the Financial Consumer Agency of Canada (FCAC). For example, a couple with a 3.1 per cent variable interest-rate mortgage of $277,658 could see their mortgage payments increase anywhere from $72 per month (or $864 per year) if interest rates go up 0.5 per cent, to $145 per month (or $1,740 per year) if interest rates go up one per cent. Choose a dark coloured grout to avoid seeing dirt gather in the grout lines over time. When you do so, you create a more graphic look to your space, which can add to the design aesthetic. Keep in mind that it will take six to eight weeks to get through the process of renovating the average bathroom and it can cost $10,000 to $20,000 for the average bathroom renovation.

Calculate your mortgage payments interest rate
amortization period
chart figure
example: 5%
25 years
5.82
mortgage amount ÷ 1,000 (mortgage amount $125,000)
125
Follow these steps to see if you’ll qualify for a mortgage on your dream home
01
05
Calculate the combined monthly before-tax income of you and your spouse.
Multiply this figure by the amount you need to borrow. Divide by 1,000.
02
06
Divide by three. This figure is the monthly payment you can afford to make on your home.
Add to this your estimated monthly heating costs and monthly property taxes.
03
07
Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.
04
Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers take the 25-year amortization.)
If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home. Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice and get pre-qualified.
