Solid investment decisions begin at home
I
s there a positive to buying a new home in our current economic climate? You bet there is. When you buy from a new-home builder, your investment is backed by a strong warranty program. It protects your deposit before the home is built and it offers protection against defects in work and materials, unauthorized substitutions and delayed closings or occupancies after the home is constructed. Tarion Warranty Corp. oversees the warranty program in Ontario – see the Tarion Report on page C12 for more information. What are the other positives of buying a new home? New housing prices are extremely competitive at this time and interest rates are low. If you think posted rates look good, ask your bank or mortgage broker if they can do better. While no one can guarantee what their home will be worth in the next 10 or 20 years, ask a recent new-home buyer what the value of their home is now. Chances are you will see them smile. There has been a steady increase in the price of new homes, especially in communities with new amenities such as schools, shopping and transit. There are no rules about what exactly a builder or sales representative must tell you about your prospective new neighbourhood, so do some homework of your own and investigate the area. The media often stresses the negative side of the story. It’s time to make solid investment decisions, and look beyond the doom and gloom. Investigate how you can make Canada’s economic environment work for you. Happy new-home hunting!

Choose your mover wisely
For this important part of the homebuying process, take the time to do proper research

ar too many people, it seems, have a moving horror story. Not just tales of damaged possessions, delayed deliveries or unavailable trucks, but far worse instances of outright crime. Moving company ripoffs, in fact, are one of the top scams monitored by the Better Business Bureau (BBB). After saving for a down payment, paying lawyer’s fees and other costs associated with buying a home, who can blame buyers for wanting to save a few bucks on the one area they likely feel they can tackle themselves, or by hiring a discount mover to do the job on the cheap. The problem with the latter choice, especially, is the high risk you run in being victim to the various schemes employed by unscrupulous moving companies. To protect yourself, the Canadian Association of Movers, which holds members to a strict code of ethics, urges consumers to research prospective moving firms: contact the CMA for checklists and referrals, as well as other sources such as Industry Canada and the BBB. Moving into a new home should be an exciting and celebratory experience. Ensure it remains that way by not cutting corners on this last important step.

What if after moving into your new home, you one day discovered that it, along with 20 of your neighbours’ homes, had sunk a half foot into the ground? Imagine placing a deposit on your dream home only to have the builder close up shop without so much as breaking ground. When you buy a new home in Ontario, you can turn to Tarion for help. Tarion staff recently traveled to Southwestern Ontario to meet with a group of residents affected by the recent closure of a builder. In some cases, Tarion will be assuming the warranty for homes already built. In others, buyers of unfinished homes will be making claims to Tarion for financial losses associated with the deposit given to the builder. The other case I referred to was a very complicated situation where Tarion worked with 21 homeowners to raise and repair the sunken homes, while relocating residents for up to two months at a time. In both of these situations, Tarion stepped in to help the homeowners because their builders weren’t able or willing to do so. That is, after all, what we’re here for. Tarion’s role is to backstop the builders’ warranty. Most homeowners have little interaction with Tarion aside from submitting their warranty forms or asking questions about coverage, because they are able to work directly with their builders to resolve their issues. The warranty was designed this way – to set out construction performance and customer service standards that builders must follow. But when something does go wrong along the way, Tarion is there to help. When a homeowner contacts Tarion to make a warranty claim, our process typically involves working with them and their builder to see if we can help them find a resolution. or unable to address an issue that falls under the statutory warranty, we work directly with the homeowner to resolve the matter. This may mean making repairs to warranted items, hiring experts to find a solution to a very complex problem, or paying out claims for deposits given to a builder who is not able to deliver on his promise to build a home. First and foremost, our goal is always to ensure that homeowners receive the warranty protection they are entitled to, regardless of whether the builder is able or willing to honour the warranty. We are able to protect homeowners because Tarion maintains a strong guarantee fund, which is used to pay out claims. Similar to the way an insurance company operates, we follow recognized accounting and actuarial standards for the insurance industry to ensure we have sufficient resources to meet claims as they arise. Small-scale infill housing in Ottawa by John W. Herbert Every five years, the City of Ottawa must update its Official Plan (OP) that describes generally how the City intends to channel its growth for the next five years. In its 2003 OP review, the city introduced the concept of intensification aimed at developing more dwelling units per acre in both urban and suburban environments. Simply, the City wanted to spend more of its energy growing “up” rather than “out.” In urban areas, this has resulted in the approval of many new highrise apartment buildings. It has also resulted in the replacement of single-family homes with units of greater density commonly referred to as small-scale infill housing. The City’s intensification goals were largely unknown to most inner-city residents; the sudden and radical changes to their neighbourhoods came as an unwelcome shock. An influx of highrise buildings in some communities was seen as inappropriate, Simply, the City wanted and community associations actively to spend more of its opposed many of them. Then, abruptly, the City broke off the discussions and in May 2012 it amended its zoning bylaw to apply new regulations. This amendment was unworkable and the infill builders were left with no choice but to appeal the matter to the Ontario Municipal Board (OMB). In a decision released by the OMB in March of this year, dealing only with the question of the City’s authority to regulate certain aspects of design, the OMB identified segments of the infill bylaw that were “flawed.” Following the OMB hearing, several of the community associations and infill builders began to meet without city officials present, and made very positive progress. A meeting was subsequently requested with City staff to discuss a possible “fix” that the City might be developing in response to the OMB decision, however no consultations took place. On June 17, staff presented their proposed strategy for the fix at a public information meeting that was well attended by industry and community group representatives. City staff’s strategy was presented to Planning Committee June 25, and in an historic first-ever event, representatives from the community associations and industry made a joint presentation. City on it strategy to fix the infill bylaw. Unfortunately, Planning Committee members didn’t ask either the community or industry representatives a single question. It passed the staff report unanimously. The Ontario Municipal Board, in a letter addressed to the City earlier this week, states that “the Board was advised that the GOHBA and a community association (Hintonburg) wanted to ‘reset’ the consultative process. The Board supports measures to encourage dialogue, notably to resolve or scope issues likely to arise at the eventual hearing on the merits.” It turns out, nothing prevented the City from undertaking real and useful consultation with community associations and infill builders as it developed its “fix.” Both communities and builders were mystified as to why such an undertaking offering a real possibility of success was never initiated. Fortunately, it’s still not too late to open meaningful discussions aimed at resolving the infill issues by creating a bylaw that works for both community and industry. City officials have since scheduled a first meeting that we hope will be the beginning of a productive consultation process for all concerned. Both the community and industry representatives believe that an effective bylaw can be written that protects both their interests while facilitating the creative evolution of Ottawa’s inner city. Both community and industry are very pleased with the City’s recent consultation initiative and look forward to participating with them in a productive dialogue.

It’s been slightly more than a year since the latest round of mortgage rule changes took place – July 9, 2012, to be exact. At the time, there was much handwringing from various parties – from builder associations to real estate experts to economists – that the new regulations would have too much of a cooling effect, at a time when the economy was wavering and parts of the housing market were softening. A common concern was that many young, prospective homebuyers would be negatively impacted by the new rules, and the fallout would trickle down and cause a slowdown in the overall housing market. Did such predictions turn out to be true? First, let’s revisit the changes: » The maximum amortization period was reduced to 25 years from 30. It was 35 years in 2008, and was reduced to 30 years in 2011. » The maximum amount of equity homeowners can take out of their homes when refinancing was lowered to 80 per cent from 85. » Insured mortgages would be available only to homes with a purchase price of less than $1 million. » The maximum gross debt service ratio was fixed at 39 per cent and the maximum total debt service ratio at 44 per cent.

Like most things real estate, the answer as to the accuracy of the forecasts depends on the specifics – of market location and type, and who the buyers are. At least one source, BMO Bank of Montreal, has produced a report that suggests fear of the changes may have been unwarranted: the majority (66 per cent) of first-time buyers indicate that the changes have not affected their timeline for buying their first home; one-in-five (19 per cent) said the changes have prompted them to wait longer to buy, while 14 per cent will buy sooner. BMO, in fact, goes as far as to say the new mortgage rules actually helped the real estate market, not hinder it, in that they contributed to a soft landing. “While Canadian home sales weakened markedly at the time of the mortgage changes a year ago, they have since stabilized and have even partially recovered in recent months,” says Doug Porter, chief economist, BMO Capital Markets. The survey also reveals that first-time buyers in Ontario are the most likely (76 per cent) to say that the mortgage rule changes will not affect their buying timeline. Buyers in BC – particularly Vancouver, Canada’s most expensive market – meanwhile, are the most likely (33 per cent) to wait longer to buy their first home because of the measures. Although shorter amortizations, in this case, were mandated by government, BMO and other lenders have long stressed the advantages of paying off your mortgage as quickly as possible. Saving as large a down payment as possible, getting pre-approved for a mortgage, choosing a shorter amortization and stress-testing your mortgage at higher rates are among the most responsible approaches you can take to home financing. It’s up to you whether you want to thank the federal government for such a reminder.

From those first tentative steps towards purchasing
a new home, you’ve come a long way! As you unpack your boxes, position your furniture and hang your artwork, you can feel this home becoming your own. You’re probably a little tired – but the exhilaration is enough to keep you going. Ideally, this feeling is strengthened with the confidence that your home has been built to meet both building codes and your own exacting specifications. In most cases, when you’ve chosen your home builder after proper research, and completed a thorough pre-delivery inspection (PDI) as I discussed in my previous columns, you can rest easy that things are as they should be. Sometimes, however, items are missed during that initial inspection. When this happens, it’s important for you to understand the proper course of action to take. In Ontario, Tarion Warranty Corp. is structured to deal with homeowner complaints in a very specific manner; in order to take advantage of the program, it’s necessary that you fill out the appropriate forms and meet set deadlines. Details of the process are outlined in The Homeowner Information Package, provided by Tarion to all new homebuyers. As much as I urge my clients to become familiar with this guide, the truth is that amid the flurry of your home search, purchase and move, it can be a lot of information to digest. Here are some major points to remember: • There are one-year, two-year and seven-year warranties that apply to various aspects of your home. • If you discover a problem with your home within the first year of living there, you have two opportunities to file a warranty form. The 30-Day Form must be filed within 30 days of taking possession, while the Year-End Form must be filed within the last 30 days of the first year.
