Trash and treasure
As the saying goes, one man’s trash is another man’s treasure. But does it apply in real estate?
A
few weeks ago, an item hit the news: “Forsaken Detroit homes for sale for as little as $1.” And digital media being what it is in 2013, within hours the story had been picked up by outlets across the continent, and republished, repurposed, regurgitated and retweeted ad nauseam. “What? Homes for sale for $1? Let’s go buy 10,” seemed to be a common refrain from many people, speculating – some, perhaps, not in jest – that this was their opportunity to become real estate moguls. While interesting reading and entertaining thinking, such scenarios usually offer little real potential. People seem to forget why these properties might be available for next to nothing in the first place: foreclosure, located in a bankrupt city with high unemployment, abandoned by owners and now occupied by squatters, and so on. Even if you really were able to buy a house for $1, what would you do with it? Would you move there? How would you “manage” the property, fix it up, rent it out, pay the taxes – all in a way that made financial sense? And how many years (or decades) would you have to wait to sell it to recoup those investments of time, energy and money? In the real world, such easy riches are but a dream. In Eastern Ontario and elsewhere in Canada, there are no homes for sale for $1 – for good reason.

your new home goes smoothly is to plan it well in advance. The Canadian Association of Movers (CAM) stresses consumers get an early start, giving them time to find the best mover for them – and to ensure they don’t get caught hiring a rogue mover at the last minute. Pitfalls to planning poorly or leaving booking until very late are that you risk getting limited choices for movers, unreliable estimates, empty promises and poor service. Here are 10 points to help ensure a smooth move: DOs 1. DO hire a reputable mover. Check with your provincial government, the Better Business Bureau and/or the Canadian Association of Movers before you contract a mover. 2. DO get three on-site estimates – in writing. An in-home estimate is a more accurate estimate – and that means fewer disputes later on, during or after the move. 3. DO validate any estimate that is significantly different from the others. Check the mover’s reputation and validate their affiliations. 4. DO read Industry Canada’s Consumer Checklist for Choosing a Moving Company on CAM’s website, mover.net. CAM has important information on moving for consumers. 5. DO ask how your goods are protected against loss or damage and insured while in transit. You may wish to request additional cargo protection that is based on your valuation of your shipment. And always get it in writing.

Low prices are often altered on moving day with additional fees and only a disreputable mover will avoid collecting tax. 3. DON’T allow any company to do an over-the-phone estimate. A phone estimate is not binding unless it is followed up in writing and is often unreliable because the mover does not have all of the necessary information. 4. DON’T accept the references a company provides at face value. References can be a marketing strategy so they should not be your deciding factor. 5. DON’T accept any verbal agreement. A verbal commitment cannot be proven in a dispute. Always get promises in writing. You have a responsibility to protect yourself. Find out about your rights and responsibilities. There are consumer protection laws to protect you, but it’s far easier to get a reputable mover than to try and get a remedy after the move.

For some, it works out fine; others have problems resulting from a lack of foresight, poorly packed boxes and inexperience in loading moving trucks. Here are a few tips to help you avoid finding damaged items at your destination:

Baby Boomers and housing trends by John W. Herbert
Since 1921, the largest annual increase in the number of births occurred between 1945 and 1946, with an increase of about 15 per cent, marking the start of the Baby Boom period. The largest relative decrease (eight per cent) was between 1964 and 1965, denoting the end of the post World War II Baby Boom. During the 20 years of the Boom, more than 8.2 million babies were born, averaging close to 412,000 a year. By comparison, births in 2008 – when the population was twice as large as during the Baby Boom – amounted to 377,886. The average number of children per woman was 3.7 during the Baby Boom period, compared to about 1.7 in recent years. According to the 2011 Census, 9.6 million persons, or close to three Canadians out of 10 (29 per cent), were Baby Boomers. In addition to the large number of native births between 1946 and 1965, this generation has benefited from sustained immigration levels since the end of the 1980s. Considerable research has been undertaken regarding the potential housing market impacts going forward of the Baby Boomer generation. Trends anticipated by various researchers and commentators include: • Possible adverse impacts on home values in some newer neighbourhoods, more distant from the downtown core or suburban employment centres, based on more existing units coming onto the market at the same time; • Increased demand for smaller units or condominiums in walkable neighbourhoods that involve less commuting; • Higher housing prices in established neighbourhoods that may effectively reduce opportunities for most “Millennials” or “Gen Y” homebuyers; • Different kinds of housing demand based on values and experiences of Boomers, compared with both older and younger generations; • Increased intensity of local debate over urban growth in cities because retired Boomers have time, money and skills to engage. A Conference Board of Canada study predicted that by 2030, about 80 per cent of new housing demand would come from retirement-aged consumers. This would require homes that are low maintenance, such as condominiums or seniors residences, and the shift would put downward pressure on prices of traditional single-detached homes.

Those same Boomers, when they were in their 20s in the 1970s, helped drive the market to new heights with new housing starts reaching a record 274,000 in 1976. Then it was the Boomer’s children, the “Echo-Boomers,” who helped drive the market last decade as they began forming households. Now, it’s going full circle with Boomers downsizing. In 2006, 57 per cent of condo owners were over the age of 50, while 17 per cent were over the age of 75. Several commentators believe equity and house prices may be adversely affected by Baby Boomers as they reduce purchases and sell holdings during their retirement years. In David K. Foot’s 1996 book, Boom, Bust and Echo – How to Profit From the Coming Demographic Shift, the real estate decline of the early 1990s was projected to continue over the long term. He believed most boomers had already acquired their houses. The “baby bust” generation following them did not have the numbers to compensate. Instead, housing activity picked up again in the 2000s, as immigration, migration within Canada and a resurgent economy drove new residential growth. Estimating the long-run rate of return for Canadian home prices is also affected by the Baby Boomers. The Canadian Home Builders Association projects a 3.5-per-cent annual rate of return to prevail beyond 2015 – this is the long-run rate of increase for home prices in Canada. In other words, home price gains should simply match the pace of inflation. The long-run rate of return for home prices is primarily driven by macroeconomic fundamentals, such as income and economic growth and demographics. Structural changes, including an aging populace and the number of immigrants as a share of total homebuyers, could influence real estate returns. Research from 1980s and early 1990s showed that when people retire they tend to remain in their existing home until they die or are unable to care for themselves. Baby Boomers are the healthiest and wealthiest generation in history and can afford the broad range of services necessary for them to continue this trend and remain in their single family homes for as long as they wish. This projected longevity will keep many of their homes off the market for decades and increase the projected demand for additional land requirements through urban boundary expansions. There is only one certainty about the impact of Baby Boomers on future housing markets – it will be spread over a period of 20 years. It is therefore unlikely that it will generate any unmanageable shocks to the structural or financial market underpinnings.

Don’t curb the curb appeal! The importance of landscaping your new home by Marnie Bennett
The first time you pull up in front of your newly
completed home, you should be dazzled. Here it is – your carefully selected architectural model, brick, trim colours, front porch – exactly as you wanted. Welcome home, indeed! The good news is that your home’s curb appeal is only going to get better. How? Well, the one aspect that usually remains to be completed is the landscaping. (The exception here is for condominium properties, which tend to include full landscaping and lawn maintenance.) Most of you will be met with a nice green lawn and, often, the single planted tree that many builders include among their standard features. That’s a great start – but it’s only a start! Now, I’m not recommending that you go over-the-top in terms of money or style. Gazebos and waterfalls are lovely, but simple gardens can be just as beautiful. Trees, in particular, are one of the best investments you can make: they increase in value every year until they reach maturity. Trees add beauty, shade and a sense of neighbourliness to your home and the whole community – just think how dramatically a streetscape is changed when a big oak or maple is struck down by lightning. As an added benefit, large shady trees can decrease both your air-conditioning costs in summer and, acting as a windbreak, your heating costs in winter.

by howard bogach When purchasing a new home or condominium, it isn’t unusual for homebuyers to negotiate a “side agreement” with their builder. By this, I mean, the builder offers something beyond what is in the Agreement of Purchase and Sale (APS), such as an upgrade or something in lieu of another item. A builder can also offer a supplementary warranty that is over and above the statutory warranties. These agreements can be attractive to homebuyers as they may be offered at a discount, or simply as an “extra.” While most homebuyers would see this as a bonus, it can also be extremely frustrating if the builder does not honour the side agreement.

To protect yourself, remember that if it’s not included in the APS, it’s not covered by Tarion. New home warranty versus a supplementary warranty or agreement Tarion warranty protection ensures your new home meets the structural requirements and health and safety standards of the Ontario Building Code. The warranty includes deposit protection or financial loss, delayed closing compensation, and a one-year, two-year and seven-year warranty that provide coverage for specific items and conditions. While your builder provides the warranty, Tarion backstops it by getting involved at the homeowner’s request if your builder does not honour his/her statutory warranty obligations. Your builder may offer services that are above and beyond the new home warranty, which Tarion does not have authority to get involved with. Over the years, Tarion has seen examples of frustrated homeowners who have approached us for help when either their builder has failed to come through on a side agreement or there is a misunderstanding between parties. It is always disappointing to tell them that Tarion cannot force a builder to honour an arrangement that falls outside of their APS.
Examples of side agreements not covered by Tarion: One of the most common scenarios we see is upgraded electrical components such as wiring for pot lights or pre-wiring for home theatres. Many homeowners negotiate with the builder to wire the home before the drywall has been completed. However, in cases where the upgrades weren’t included in the APS, Tarion wasn’t able to intervene when an issue arose. Over the years, we’ve also received complaints from homeowners who haven’t received items their builders promised, such as finished basements, backyard decks and extended warranties on heating and ventilation systems or foundation waterproofing. My best advice to homeowners is to never accept an upgrade or modification to your new home without having it included in your APS. If you want to add something to your home after your APS is signed, you may be able to have it included in the APS in the form of an amendment. I recommend making these changes with the help of a lawyer to ensure it is done properly. This way, the builder’s agreement will be backed by Tarion and you have somewhere to turn should you need assistance. with a team of trusted professionals – a mortgage broker, lawyer, perhaps a realtor or builder sales associate and maybe a home inspector. Then, assuming you move ahead with your purchase, eventually you will likely need a mover. People often don’t consider a mover as an important member of their team of professionals. However, given the critical role they perform – taking possession, at least temporarily, of all your worldly goods and moving them without loss or damage – it’s a function not to be taken for granted. Not doing your due diligence and taking the time to select a reputable mover can invite untold problems. Case in point: the following example, which admittedly doesn’t involve a new-home move, but the experience is all too common. So is the lesson learned – unfortunately, the hard way. I recently contracted a “professional” moving company to carry out a last-minute move of five pieces of furniture on behalf of my son, a university student. For a variety of reasons, we decided to hire movers rather than rent a truck. After calling several firms – including large, wellknown companies and smaller, independent ones – I selected a moving company based in the location where the pick-up was to take place. Drop-off would be about 100 kilometres away. We agreed on price ($350) and time (9 a.m.) – after I was very clear the move would involve an out-of-town destination. All details were confirmed in a “contract” exchanged via email. The crew was on time for the move the next morning, but almost immediately began talking about a higher rate – $360. Not a huge difference but it immediately raised my suspicions. I’ll spare you all the gory details, but it’s important to share the lowlights of what happened next: » The company I originally contracted the job to the night before was inexplicably unavailable to actually perform the move the next morning, and apparently passed it off to another firm.
phone repeatedly the night before, suddenly was nowhere to be found. » Once the truck was loaded, the fee increased to $450. » Upon arrival at the destination, the movers said the fee was $500. “It’s taking longer than we thought, and the furniture is heavier.” » “Sure,” I said, “right after I call the police.” With that, the sordid tale ended. The job not complete, left for us to move the furniture indoors, now the victims of one of the Top 10 scams monitored by the Better Business Bureau (BBB). “I could write a thesis on this,” John Levi, says president of the Canadian Association of Movers (CAM). CAM offers consumers the following tips on how to avoid being scammed by unscrupulous movers: » Find reputable movers through the CAM, BBB or provincial government consumer protection agencies » Ask three movers for estimates in writing » Get the terms and conditions in writing » Ensure your goods will be protected for loss or damage » Read customer reviews on movers’ websites and other forums “Consumers have recourse with their provincial government’s consumer affairs department and with the Better Business Bureau,” says Levi. “Both of these avenues are fraught with difficulties and often take many months to come to some form of resolution – satisfactory or otherwise. And often, the mover simply out-waits the consumer. “It’s far simpler and more effective to engage a reputable mover in advance rather than trying to fi x a bad situation after-the-fact.” My example, though painful and infuriating, is minor compared to other common horror stories involving similarly unsuspecting clients. Make sure you take the proper steps – and the time – to protect yourself.
