B
uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important than in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Why infrastructure is crucial to housing
As cities tackle challenge to expand, proximity to existing amenities is increasingly key
I
t’s no secret infrastructure is important to any city and its residents. And in the case of many Canadian cities, there is a growing need to repair existing infrastructure that is decades old, as well as build new infrastructure to accommodate growth. This is why various home building associations and other organizations see some promise with the latest federal budget tabled on March 21, in which Finance Minister Jim Flaherty promised increased funding for infrastructure improvement. Proximity and access – from everything from highways and bridges to health care to schools to shopping to recreation – are critical for builders and buyers alike. Development charges for developers to build new communities, and help fund infrastructure growth, need to be reasonable, so as to deliver new-home prices to buyers that are affordable. It will take months, if not years, for new funding to reach municipalities. In the meantime, prospective homebuyers would be wise to pay careful attention to these matters, and to make honest assessments of how well equipped your potential newhome communities are in this regard.

And the growth in energy production and exports would, if managed properly, not damage other facets of the economy, concludes the study, Canada as An Emerging Energy Superproducer. “Further growth in energy production would be of net benefit for Canadians as long
as the risks associated with becoming an energy superproducer and net energy exporter are managed to avoid or minimize any negative impacts that energy sector growth could have on other areas of the economy,” says Gerry Angevine, Fraser Institute senior fellow and co-author of the study. become an energy superpower or a superproducer of energy. It also examines how Canada’s energy resources, production, and net exports rank from a global perspective and provides an overview of the economic benefits flowing from energy resource production, including the royalty payments that flow to governments and interprovincial energy trade. “Prime Minister Stephen Harper refers to Canada becoming an energy superpower, but for a country to become an energy superpower, it has to be able to use its energy resources to set market prices and exercise political power,” Angevine says. “With its adherence to free trade and extensive private sector investment in the energy sector, Canada will not become an energy superpower in the traditional sense.” The study found that Canada currently ranks sixth in the world for oil production (behind Russia, Saudi Arabia, the United States, China and Iran). But with planned new investment in the oilsands and shale
formations, Canada could become the fourth or even third largest global oil producer. The story is similar for natural gas, where Canada is currently the fourth largest global producer, as well as electricity exports and uranium production. Overall, Canada was the fifth largest exporter of oil, natural gas, oil products and electricity combined in 2009, behind Russia, Saudi Arabia, Norway and Iran. Kenneth P. Green, study co-author and senior director in the Fraser Institute’s Centre for Energy and Natural Resource Studies, points out that Canada’s energy sector already makes enormous contributions to the economy in addition to creating jobs and government revenues through royalty payments. Oil and natural gas extraction contributed $94 billion to GDP in 2011; electric utilities contributed $33 billion, while the uranium mining industry purchased goods and services valued at $1.1 billion. Additionally, the study estimates the energy sector as a whole is responsible for at least 663,000 jobs, comparable to almost 4.5 per cent of total payroll employment in 2012. On the revenue side, Canada’s energy resource producers annually pay at least $19 billion to provincial and territorial governments in the form of royalties, lease payments, and fees. “These payments will only become greater as petroleum and uranium production increases and new hydroelectric facilities are built. Growth of oilsands bitumen production alone could result in royalties reaching $50 billion per year by 2033 compared to $4.5 billion in 2011,” Green says.

Keeping the magic in the
New Build process

Keeping the magic in while taking the
mystery out is what The Home Program New Build education sessions are designed to do. Even if you have purchased a home previously, the process of buying a (resale) home versus what is involved in building a new home is substantially different. A little education can go a long way to helping you make smart decisions that can save you substantial dollars, make the entire process a little (or a lot!) less stressful, and give you tools to make smart decisions from start to finish. That is precisely why The Home Program is now providing special education sessions that explain the entire process and then let participants ask the questions they need answered. The sessions are held in various builders showhomes, last approximately 90 minutes and are done in an informal - question and answer format. A mortgage and real estate professional sit and talk with the new-home sales representative to help participants understand the process involved; the best way to approach a new build purchase; and costs and considerations. At each stage of the process, participants are encouraged to join in and ask their own questions.
The sessions include information on financing a new build; builder selection; initial and final pricing; contracts and deposits; selecting the various components in your new home; construction stages and timing; warranties and walkthroughs; and supports and responsibilities available after you have taken ownership. The sessions currently run from 3:30 to 5 p.m. on Saturdays. The sessions ran successfully in February and will be running again in April. The Home Program began as a pilot project in December 2001 to meet the need in Edmonton to assist low and moderate income families in becoming homeowners. Since then it has expanded to include education, counseling and advocacy, referrals to service providers, a Down Payment Assistance Program, and ongoing contact before and after the purchase of a home. The program is now accessed by all income levels and custom education sessions have been developed to include education around such areas as building a new home, and understanding the ins-and-outs of condominium ownership. The Home Program has provided homeownership education to more than 3,700 families and continues to work with those individuals including the more than 1,000 who have now become homeowners. The program is currently available in all major population centres in Alberta, including Edmonton, Calgary, Lethbridge, and Fort McMurray. A large volunteer base of local service providers coupled with financial contributions from participating Realtors has enabled the program to provide more than $1 million in financial assistance to program graduates. The Home Program is offered and operated as part of Capital Region Housing Foundation, Edmonton, and is partnered with local and national non-profits and service providers, including the Alberta Real Estate Association, the Alberta Real Estate Foundation, and Canada Mortgage and Housing Corp. (CMHC). The program was recognized with the first Edmonton Housing Trust Fund’s ROOPH Award for Outstanding Partnerships. EVER NOTICE HOW MANY BUILDERS BOAST THEIR
new community is “ just minutes from shopping, schools and all the amenities!”? And that “Everything you need is “right at your doorstep!”? Indeed, proximity and access to a variety of amenities and essentials – from transit to health care to schools to shopping to recreation – are critical determining factors for builders and buyers alike, for lifestyle and comfort while living there, as well as resale potential down the road. It’s an important topic we’ve written about before in Fundamentally Speaking and elsewhere in New Home Guide. In addition, home building associations across the country have commented on infrastructure and related development charges and other fees rising to prohibitively high levels. Consider, for example, development charges imposed by some municipalities can exceed $60,000 per home – costs that are almost always passed directly on to new-home buyers – before a shovel even hits the ground.
The federal budget, tabled on March 21, provides some hope in this regard, in that it contains measures to increase support for national infrastructure. Says Canadian Home Builders’ Association (CHBA) President Deep Shergill: “It’s an opportunity to restore fiscal integrity at the municipal level and fairness for younger generations. At present, many municipalities are financing community infrastructure by transferring the costs into the mortgages of new home buyers, amounting to more than $5 billion a year.” Municipalities across Canada are now lobbying Ottawa to make sure they get their share of available funds to address road and transit needs. Faced w it h such infrastructure and funding challenges, municipalities are also typically considering other options – including new taxes, road tolls and other fees – to help pay for what’s needed. For homeowners and prospective new homebuyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever. With continuing immigration, general growth and construction expansion – all happening at a quicker pace than infrastructure improvements – our highways and transit systems will all be tested until everything catches up. As you’re out there shopping for your new home, look around to see how far you are from the nearest highway or rapid transit system that affords you a reasonable commute; and how close you are to health care, schools, shopping and recreation. These communities will be at a premium, now and in future.
For homeowners and prospective new homebuyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever.

So you’ve made the decision to buy a home. Statistically you’re one of about 9% of greater Edmonton households that will purchase a new or resale home this year. It’s a big move regardless of what you buy so here’s a few things to think about.
NEW VS. RESALE Let me state clearly that I work with clients in the new home industry, but I will try to keep my bias in check. Because I have purchased both types of homes (a few times) I think I can remain objective.
In general, resale home prices range from 15% to 20% less than new homes of similar size and style. However, that’s not always true in today’s market conditions.
Price is generally the reason people start searching in the resale market. And, at first that appears logical. In general, resale home prices range from 15% to 20% less than new homes of similar size and style. However, that’s not always true in today’s market conditions. A large amount of new lot supply and an increase in new “value priced” condos has kept a lid on prices and made it possible to buy a “new” home for as little as 5% above resale prices – certainly in the entry level segment. Virtually a dead heat when it comes to price. A key consideration is that you must pay GST on a new home while you do not pay it on a resale. However, the rate of GST is subsidized modestly for homes under $450,000 so the impact is lessened somewhat. You should also consider the hidden costs of buying used. First – you will have to fix all those items (no matter how small) that impact a resale homes safety and performance. Leaking faucets, running toilets, drafty windows and doors, inefficient furnaces, hot water tanks in need of repair or worse, creaking garage doors, worn out appliances, and a litany of other “can’t see until you move in” kind of things. Second, there’s personalization and décor changes or upgrades. Musty old carpets with a few stains, 54 NEW HOME GUIDE | APR 12 - MAY 10, 2013
scratched or damaged hardwood, chipped or discoloured paint, broken railings, casings and light fixtures, and of course out of date counter tops, cabinets, etc. These items collectively can add from $25,000 to $40,000 to the cost of a used home almost immediately. All of a sudden that great price disappears faster than those big savings you thought you had.
And, In The Future At the end of all this inconvenience and expenditure you are still essentially living in an older inefficient home. The technology integrated into today’s homes, particularly regarding energy and water efficiency, can save you about $700 PER YEAR over an average sized used home. And, that’s at today’s resource prices! Since 2000, oil prices have risen over 400%, utility rates have gone up 115% and it’s reasonable to assume this trend will continue in the future. So, purchasing a new home built to the highest sustainable standard is not only “smart” for your family and the planet, but is essential for the health of your budget. Many Alberta builders have embraced sustainable building practices that could save you thousands of dollars over the life of your home. So, the battle rages. New or used. It really depends on the product you find and the price you can negotiate. Just remember to think through all the costs associated with the sale and compare them prudently. Fraser Institute school rankings Across Alberta, 42 elementary schools
showed significant improvement in their academic performance over the past five years, according to the Fraser Institute’s annual school rankings. Among these improving elementary schools are public, private, separate, francophone, and charter schools. “This is why the Fraser Institute school report card is the go-to source for measuring academic improvement: it highlights school success stories from Grand Prairie in the west to Fort McMurray in the east and from La Crete in the north to Cardston in the south,” says Peter Cowley, Fraser Institute director of school performance studies. “Our report shows that all schools are capable of improvement, regardless of the personal or family challenges their students might face. If educators want to help students learn and improve, they should be talking to these schools.” The Report Card on Alberta’s Elementary Schools 2013 rates 659 public, private, separate, charter, and francophone elementary schools based on nine academic indicators using data from the annual Provincial Achievement Tests (PATs) administered by Alberta Education. “By pinpointing the subject areas in which individual schools are improving or declining and how their academic performance compares to that of other Alberta schools over the past five years, our report helps parents and educators prioritize learning challenges in their schools,” Cowley says. The report card also includes important information about each school’s make-up, including parents’ average income, the percentage of ESL students and the percentage of special needs students. The poll also reveals a change in Canadians’ expectations for interest rates, with more Canadians now believing today’s low rates will remain in place for at least the next 12 months. Highlights of the poll include: » 46 per cent of Canadians believe today’s low rates will remain unchanged over the next year, a notable increase from the same poll two years ago when only 24 per cent of Canadians believed interest rates would remain low » 45 per cent of Canadians said they would choose a fi xed rate mortgage if they had to decide today; fi xed rate mortgages were most popular among 25 to 34 year olds, with 54 cent stating they would select a fi xed rate mortgage, likely due to the predictability a fi xed rate offers to first-time homebuyers

Forty-six per cent of Canadians believe today’s low rates will remain unchanged over the next 12 months. This is a change from past poll results, where Canadians were more likely to believe that these historically low mortgage rates would be increasing in the short term. This trend suggests Canadians could face challenges in the future if they don’t consider rate changes as part of their long term mortgage strategy. “Our poll suggests that some Canadians are growing accustomed to the low rates we are experiencing, however it’s important to take a long term view when deciding which mortgage is right for you,” says Delaney. “You need to plan ahead for your next mortgage term and consider the impact to your budget if you renew at higher rates a few years down the road.” Low rates an opportunity to accelerate debt repayment
In a poll released by CIBC in January 2013, Canadians identified paying down debt as their number one financial priority for 2013 for the third year in a row. Delaney notes that low mortgage rates can help Canadians to accelerate their debt repayment. “With debt repayment a top priority for Canadians again in 2013, there is an opportunity to take advantage

of today’s low mortgage rates to reduce your mortgage principal faster.” To further accelerate debt repayment, one strategy offered by CIBC is to set your mortgage payment at the amount it would be if rates were one to two per cent higher. Not only does this help to reduce the principal amount owing, but it also prepares Canadians for future rate increases. “Your mortgage is one component of your overall financial plan, which means you can’t choose a mortgage purely on rate” adds Delaney. “A number of factors, including amortization, the flexibility to make extra payments, and whether or not you have other debt should all be considered when choosing the mortgage that’s right for you.”

The da Vinci Robot is an incredibly innovative piece of surgical equipment that will result in a shorter hospital stay, less pain, minimal scarring and significantly faster recovery time for women suffering from cancers of the uterus, endometrium or cervix. should refrain from further intervention in the housing market by adjusting mortgage lending rules, according to the Canadian Home Builders’ Association. In his inaugural address at the recent 70th National Annual CHBA Conference in Lake Louise, Alta., Incoming President Deep Shergill of Calgary said that such intervention represents “a hammer” that impacts all housing markets, both those that are healthy and those yet to fully recover from the recession. Shergill, President of Prominent Homes Ltd. of Calgary, called on the government to be prepared to take remedial action if housing activity falls below demographic demand or if price stability is threatened. “It seems less than forthright to constrain consumers’ ability to buy a new home – a real asset, while allowing usurious credit card interest rates to bury many consumers in non-asset backed debt,” Shergill said. Working to maintain a stable financing environment would be one of seven priorities in his plan of action for the coming year, he said. The others are regulation, government-imposed costs, a skilled and productive workforce, land availability, market intelligence and investment in research and development. maintaining stability in mortgage markets since the financial meltdown of 2008, Shergill said. “We are extremely pleased that the federal government recognizes the corporation’s continued effectiveness.” The industry’s success in improving energy efficiency illustrates the benefits of collaboration with government in research and development. A CHBA analysis of the energy performance of an Ottawa home built in 1975 compared with one built today shows a 66 per cent improvement. Comparing similar models of family cars over the same period showed a maximum improvement in energy efficiency of 16 per cent. Shergill said it’s time to roll back the chronic over-regulation of the new-home building industry. Government-imposed costs are pushing house prices ever higher and must be rolled back and reduced, Shergill said. “So long as governments persist in confusing the effect of low interest rates with real housing affordability, they will fail to recognize the steady erosion of housing affordability.” The same pressures that add to the cost of a new home also inflate the value of existing homes, with no value-added. As a result there is a multiplier effect through the resale housing market every time a new charge, fee or levy is applied to new development. In some urban centres the relationship between house prices and household incomes has reached a crisis point. The growing underground economy is also a result of the rising tax burden on housing. In consultations on the federal government’s plan for long-term infrastructure, Shergill said the CHBA has pointed out that calls for new development to pay its own way deflect from the failure of politicians to invest in basic infrastructure over many decades. “What some call an infrastructure deficit should more correctly be recognized as a legacy of failed leadership. Requiring new development to pay for bad decisions in the past is unacceptable.” The CHBA hopes the next federal budget will outline a national plan for infrastructure investment that will give priority to housing affordability and choice.

one could blame you if you got a little worried about the state of the economy or the fear of a pending market correction in Canadian real estate. Are Canadians taking on too much debt? Have mortgage rules gone too far? Is there a housing bubble about to burst? What if there is a market correction? The real question is, do Canadian homeowners or prospective buyers need to be concerned? Every time there is talk about a market correction, the tone is quite negative. But let’s take a closer look at that situation: rather than argue about whether we may have a market correction, let’s analyze what it really means to Canadians if there is one. First-time homebuyers: If you’re a first-time homebuyer, you have likely felt the pinch of the rising cost of housing, and the new mortgage rules certainly haven’t helped any either. So a slight market correction would be welcome news for you; you can still get into homeownership with only five per cent down, but since your maximum amortization is now limited to only 25 years, a drop in pricing is exactly what you’ll need to be able to get into this market. Conclusion: A market correction is a good thing for you. Current homeowner buying or selling – moving up or downsizing: If you are a homeowner and you’re looking for the right time to sell your house so you can buy another, you may be concerned that the price of your current home is dropping. But, let’s assume the value of the house you are selling drops by 10 per cent. Let’s also assume that you plan to buy another home (whether upsizing or downsizing). Remember that the person selling their home to you is going through the exact same thing. In other words, if the value of your home dropped 10 per cent, so too did the value of the new home you are buying. Focus on what your bottom line “net” is, rather than what you thought or had hoped to sell your home for.

Current homeowner with no plans to sell: The main reason we worry about a housing correction is the fear that it will erode our home equity and net worth. A significant amount of net

worth of Canadians is tied up in their home equity, which is the foundation for a lot of retirement plans – so there is obvious concern. But should there be? For the majority of Canadians, the plan is to stay in their current house for at least the next three to five years. So here’s a simple fact: equity is only gained or lost the day you sell. In other words, if the value of your house were to drop by 10 per cent tomorrow, you may feel anxiety over the drop in your net worth – but it would only be on paper unless you actually sold your house tomorrow. If you have no intention of selling soon and you can still afford your monthly payments, then all you need to do is sit and wait until the market bounces back – which it has always done for the past 100 years. Conclusion: A market correction may very well have zero impact on you. In the end, the headlines will continue to talk of impending market corrections. The key for you is to decipher one of three things: 1. Is this a real concern for you? 2. Is this an opportunity? Or, 3. A re you getting worked up about nothing? Bottom line: a lot of people will fret about this topic over the water cooler tomorrow morning – but the majority of them really don’t need to.

Today’s new homes boast improvements in energy efficiency that help homeowners reduce operating costs, live more comfortably and be friendlier to the environment. Homebuyers can choose the level of efficiency they want – all the way up to Net Zero homes that are designed to produce as much energy as they consume. All homes built today include energy saving features that are light years ahead of the standard found in many existing homes. Just how far we’ve come is detailed in a new Canadian Home Builders’ Association report that looked at energy consumption for a two-storey, 2,100sq.-ft. home built in 1975 and then calculated how the same structure would perform using current minimum standards. The 1975-era home would suck down 343.2 gigajoules (GJ) annually. The same home built today according to current codes would sip just 116.8 GJ a year – a savings of 66 per cent. Along with those energy savings come dramatic reductions in greenhouse gas emissions. Even though the number of homes and their size has grown over the past decade, the residential sector’s share of national emissions fell from 7.3 per cent to 5.9 per cent in the last 20 years. More than 80 per cent of the energy consumed by the 1975-era home was required for heating. In 2012, heating consumed just over half of a home’s energy budget. Those are dramatic improvements, but what’s more impressive is that those are the gains achieved using minimum current standards. Many home builders today set the bar far higher and consumers have the power to decide how efficient they want their new home to be. Talk to your builder if energy efficiency and environmental sustainability are high priorities. CHBA – Alberta’s annual Green Home award program recognizes excellent work by builders. The award criteria can help homebuyers understand areas for potential energy savings. Competitors are awarded points based on the EnerGuide rating for their entry. Natural Resources Canada estimates most new homes earn a rating of 65 to 72 out of a possible 100, with scores of 80 and above considered excellent. Not all new homes are EnerGuide rated, but existing homes would likely score from zero to 50 points, while upgrades could improve the rating to the range of 51 to 64 points. 136 New home Guide | apr 12 - may 10, 2013

Imagine the amount of money that could be sucking out of your household budget. Beefing up home insulation, replacing windows and doors to reduce drafts, and installing a new furnace can both lower energy bills and reduce moisture and condensation issues. So, along with lower costs and emissions, the quality of the air you breathe will be better. Those advantages already come with any new home you purchase because home builders have come a long way since 1975.
