Is taking a
“mortgage vacation” the way to go? by Nelly van berlo
Lenders are advertising the option of skipping a mortgage payment more often these days – with one major bank even creating a TV ad centred on taking a “mortgage vacation”! But unless this is your only option, it’s not recommended that you skip a payment because, like most ads, that sounds too good to be true – this option is as well. The banks want you to think they’re advertising the option to skip a payment to do you a favour. But it’s important to

realize that lenders are in the business of making money. They’re not going to create an ad that doesn’t benefit them in the long run. And it’s not like you can simply choose to skip any payment at will when you need it most. You actually have to prepay your mortgage in order to take advantage of this vacation option. You can miss a regular payment as long as you have already prepaid that amount by doubling up any mortgage
Using the example of a $350,000 mortgage, with a 30-year amortization and an interest rate of 3.30% (which would equal a mortgage payment of $1,530), skipping just one payment will cost a borrower $2,442.87 in additional interest over the remaining amortization. payment, increasing your mortgage payments or making lump sum payments. It’s important to know how much you can prepay each year before making extra payments – this varies from lender to lender. And if you’re going through the trouble of prepaying your mortgage, you want to make the savings work to your advantage by actually paying off your mortgage quicker – not diminishing those savings by taking a mortgage vacation. The number of eligible payments covered by your payment vacation will be based on a combination of your prepaid amount and your current regular monthly mortgage payment. There is also typically a maximum payment vacation permitted per mortgage term, regardless of how much you have prepaid your mortgage. Other considerations to think about when looking at the mortgage vacation option include: • Interest is capitalized (for example, added to your outstanding principal balance) • Borrowers lose the benefit and interest cost savings of prepaying their mortgage once they use the mortgage vacation option

istoric Little Italy has changed and grown since being settled by Italian immigrants in the early 1900s, but the original old-country culture is still visible and enhanced by additions to the community — like Nuovo condominiums by Domicile, which will feature a new Nicastro’s fine foods specialty grocer — La Bottega Nuovo — on the ground level. lots of them to make when buying a home, and one of the most significant is whether to buy a brand new or resale home. Last year, there were more than 61,000 new home and condo starts in Ontario, and in 2014 Canada Mortgage and Housing Corp. (CMHC) forecasts about 60,000 starts. So, what makes thousands of consumers choose to buy a new home or condo versus a resale home? Here are five good reasons: Design It all starts with design. Warranty Program In Ontario, builders must be registered with the Tarion Warranty Corp. program which offers one of the best, most comprehensive warranty coverage programs in the country. New-home buyers benefit from deposit protection and protection against delayed closings or occupancies without proper written notices. New-home owners are also covered against defects in work and materials, and major structural defects. The pluses to buying new really add up. Many people will buy their first home from a builder, whether it is a detached home, townhouse or condominium unit. Buying from a builder means you can customize your home to your tastes. It means better energy efficiency ratings than older homes, and often higher quality building materials. New homes also have lower maintenance costs, and are less likely to surprise you with serious issues such as foundation or plumbing problems, insulation or wiring that needs replacing. There are some pitfalls specific to a new home purchase too – pitfalls that we don’t want you to run into!
Buying from a builder means you can customize your home to your tastes. 36

THE AGREEMENT OF PURCHASE
In most new home transactions, the builder will have a standard agreement it uses. These agreements are lengthy and contain a great deal of information about your purchase, including: • Financial specifics of the purchase (taxes, purchase price, deposits, development charges and other fees that can be expected); • Items included in the purchase price (landscaping, fencing, air conditioning); • Timelines for selecting extras and colours; • Timelines for closing and how it may be delayed; • Any restrictions on what can be done with the land; • Any items that will be rented (such as a hot water tank); • Procedures in the event of a dispute; and • Whether the agreement can be transferred or assigned. Most builders will not permit changes to their standard forms. The importance of consulting a lawyer prior to signing cannot be overstated, so that you at least know your obligations and rights under the contract. The fine print in a builder’s contract could mean you are responsible for certain
additional taxes or fees, especially if you are buying a rental property. Your lawyer should be able to review the agreement while it is still conditional and provide you with a summary and advice prior to you signing. Without legal advice before you sign, you could end up with a utility box on your front lawn, the floorplan altered, or other changes that you won’t be able to do anything about. If something is important to you as a buyer, it must be in the contract when you sign it. TARION WARRANTY COVERAGE
All new homes bought in Ontario must include coverage under the Tarion Warranty Corp. program. All builders must give their purchasers an information package about the warranty, which should be carefully reviewed. Additionally, a schedule to the agreement must list important dates and, as of 2012, a schedule must list any expected additional costs that will be payable on closing. Homebuyers can also look at the Tarion website, tarion.com, under the Licensed Builder Directory to see how many homes the builder has built in the past 10 years, whether it has won any awards and the number of complaints, if any, made to Tarion against the company. You may also want to visit any already-built homes and talk to the neighbours. Ask if the builder was diligent in fixing every problem with the home that was identified by the buyer during their pre-delivery inspection. TITLE INSURANCE
All home purchasers should ensure they get a title insurance policy. This is arranged by your lawyer and is often the easiest and most cost effective way of protecting you from various problems that may occur before or after closing. Although not all title insurance policies are the same, a good policy will protect you from title problems (such as unpaid debts or building violations) and legal errors and omissions. Some policies will protect you in the future if you lose your property as a result of a property or mortgage fraud.

Often, the municipal property taxes on new homes have not been calculated. This is because the Ontario Municipal Property Assessment Corp. has not yet assessed the value of the new house portion for city taxes. Although the builder has often paid the property taxes on the land itself, the house portion cannot be billed by the city until the assessment is completed. This can take a year or more to occur, but once the new assessment is complete, buyers will receive a supplemental tax bill for property taxes on the building from the purchase date. Make sure you save up this money, as it can often be a considerable amount to pay at once. GETTING YOUR KEYS
On the closing date, your lawyer will ensure that your money (both the down payment and mortgage) goes to the builder. In exchange, the builder will send over the keys. Once all the items are exchanged, the lawyers will register the purchase through the Ontario Electronic Land Registry System, and will contact you about picking up your keys and documents which are usually ready late in the afternoon of the closing day. Buying a home is one of the most exciting of times, especially when you get to visit so many beautiful builder models! With proper planning and advice, you can make sure that your purchase is a smooth and enjoyable experience.

Builder warranties backed by Tarion by Howard Bogach
When buying a new home, there are many decisions to make: downtown or suburbs, two or three bedrooms, hardwood or laminate. But the one thing you don’t have to worry about is your new home’s construction. That’s because almost every new home and condo sold in Ontario comes with a builder’s warranty, backed by Tarion. The warranty process starts before your builder even breaks ground, and lasts for seven years from when your new home or condo is completed and ready for possession. Although it is often lumped into one warranty for simplicity’s sake, in reality, just about all new homes in Ontario come with deposit and delayed closing protection, in addition to three separate warranties that provide different types of coverage at different points in the life cycle of your home.

Your deposit protection and delayed closing protection begins before you move in. Deposits are protected up to a maximum of $40,000 for freehold homes in the event that your builder goes bankrupt, breaches the purchase agreement or in situations where you are legally entitled to back out of the purchase agreement before closing. The delayed closing and occupancy provision means your builder guarantees that your home or condo will be ready for move in either by a date specified in the purchase agreement or by a date that has been properly extended if circumstances occur that delay your condo’s completion. In many cases, your builder will be required to compensate you if a delay occurs.
The one-, two- and seven-year warranties begin when your home is complete and ready for possession. The one-year warranty covers defects in work and material, protects against unauthorized substitutions and ensures your home is fit for habitation and constructed according to the Ontario Building Code. The first-year warranty includes almost everything inside and outside your home that was provided by the builder, from flooring to drywall to heating and air conditioning systems, and is in place for one year from your home’s date of possession. The two-year warranty protects against defects in work or materials in the electrical, plumbing and heating delivery and distribution systems owned by your unit. It continues to provide protection against violations of the Ontario Building Code that affect health and safety, and applies for two years beginning on the home’s date of possession. The seven-year warranty, referred to as the Major Structural Defect Warranty, provides coverage for any defect
in work or materials that results in failure of a structural, load-bearing element of the building or one that would reduce the expected life span of a structural element. It also includes protection against a defect that adversely affects the use of the home. Condos also have another type of warranty coverage for the shared elements of the building, such as the roof, exterior cladding, parking garage and recreation facilities. This warranty is managed by your condo board.

Pearls of wisdom From affordability issues to mortgage rates, there’s a lot for consumers to consider when buying a home. What are the most important factors to keep in mind when buying a new home in 2014? Greg Gr aham, president of Cardel Homes Ottawa, sees a number of factors affecting
homebuyers this year. “In today’s economic climate, there is an abundance of things consumers need to keep in mind when purchasing a new home,” Graham says. “From financing and interest rates to location and lifestyle – taking time to consider all aspects will lead to a well-considered decision.” Graham firmly believes a big part of that wellconsidered decision is understanding financing, including pre-approvals, the current interest rates, and likely future rates, is key. Discussing scenarios with individual financial advisors allows for all questions to be answered and all options to be fully explored. That’s not the only consideration, of course. Says Graham, “Stage of life is also a critical factor. The needs of first-time buyers might focus on affordability and building equity, where a downsizer might be looking for low maintenance and converting equity to retirement income. A thorough consideration of lifestyle needs will help narrow the choice of home type.” From there, he adds, personal preferences and day to day needs will help in the selection of a proper floorplan, elevation and upgrades in the home. “Of course, there is location, location, location,” Graham says. “Community features, amenities, proximity to transit, ease of access, and the overall feel of the development are often the starting point of the new home search.” And price? “Affordability continues to be a concern for the industry, especially since municipal fees, government taxes and city development charges are approximately 23 per cent of the cost of a new home. With a reduction in land availability, land prices have soared, which also drives up new home costs. Many purchasers of new homes are buying their second or third home after assessing the cost to renovate and the associated disruption during such renovation, versus having a new home constructed and personalized for their needs and desires.”

Finally, he says, get involved. “As governments implement strategies to control consumer debt and drive intensification, consumer choices are eroded. Consumers of new homes (now and in the future) need to ensure they watch the market carefully and understand the impacts of municipal policies on housing. Have a voice and ensure that voice is being heard to help control costs, allow for choice of style and location of a home, and to satisfy you and your family’s long term needs.” 2014 Home Builders’ Annual

Mattamy Homes Ottawa President Mark Parsons sees financing as one of the first key issues.
“If a buyer can get a mortgage, there are really good rates out there now,” says Parsons. “There have never been better mortgage interest rates, and this is an aggressive market.” When asked about the affordability of homes and mortgages, he says, “There are still lots of affordably priced homes out there. You can still purchase in the high $190,000s or low $200,000s. It’s actually a buyers’ market right now.” What else does he think is important? “Who you’re buying from,” he answers, with no hesitation. “You have to think long-term. Unless you’re thinking of flipping a property – which is not a great idea now, as there isn’t much quick appreciation of property. There will be, but currently the market is fairly stable, meaning prices won’t jump up in a few months.” This means buying a home right now is a decision you want to live with for a while. He says, “There will be lots of interaction between yourself and your builder. The whole interaction should be positive. Make sure before you commit that you will be able to work well with these people for a couple of years – from beginning to end.” He means what he says and stresses the point. “This is all about a positive experience for the homebuyer. As a builder, we want 50

our homeowners to walk down the street and see us and be happy. That is what we at Mattamy really strive for.” Parsons states there are about 25 sizeable builders in the Ottawa market, and about seven that do 60 per cent of the business. “But, significant choice is out there, especially with affordability issues. There are stacked condos, highrise condos, or back-to-back semis like we produce.” What about choosing the right neighbourhood? “Neighbourhood is very important,” he agrees. “It’s also very subjective. A purchaser with urban tastes will want to stay within the downtown core. In the suburban and outer Ottawa regions, buyers might be looking for amenities like the brand new recreational centre at Half Moon Bay in Barrhaven. Or a place like Stittsville has terrific facilities, and the east end is adding facilities, too.” Currently, he says, about 80 per cent of Ottawa’s lowrise sales are in the south and west of the city. “There is not as much land supply in the east end.” Parsons also looks at the bigger picture. “What’s positive about the Ottawa market is customer satisfaction. In surveys done across the country, Ottawa builders do well. For customer satisfaction, the environment here is very good.”

Fr ank Nieuwkoop, Director of Sales and Marketing at Valecr aft Homes, says the new mortgage
rules affect all homebuyers, but first-time buyers in particular. The federal government has changed mortgage rules, and recently Canada Mortgage and Housing Corp. (CMHC) has clamped down on its qualifying criteria for CMHC-insured loans. “The government thought the banks were too lenient accepting new mortgages,” says Nieuwkoop, “leaving the government guaranteeing too much debt.” This has made it more difficult for first-time homebuyers to qualify for a high-ratio mortgage, but Nieuwkoop says there are ways buyers can improve their chances. For one thing, he says, “Lenders have to make sure it’s clear to purchasers they should not accumulate more debt. Some purchasers don’t realize that if they qualify for a mortgage, then go out and buy a car or furniture or take an expensive vacation on credit, that they could lose their opportunity to qualify.” Most lenders do another credit check about 30 days before the purchase closing date, and if the borrower has incurred extra debt, that could change their status. He also suggests that any buyers who can put down 20 per cent up front, do so. “Save yourself the insurance fees and the extra issues.”
Another bright spot for buyers is the current market. “There are still products in the comfortable $400,000 to $500,000 range,” Nieuwkoop says. “Typically, the value of real estate in Ottawa doubles every 10 years. Even if interest rates creep up, it’s a good time to buy.” Regarding options, Nieuwkoop is excited by all the new home technology available. “There are opportunities to upgrade to smart home packages, and most sites offer free Internet, phone and TV for a year. We even offer home theatre systems.” But is it confusing to deal with all these options? “There’s help,” he says with a laugh. “We have a company called Concept, where new-home buyers get a free consultation to help them determine their tech needs.” Valecraft also gives purchasers access to interior decorators to help with colours, finishes and options. 2014 Home Builders’ Annual

R ahul Kochar, vice-president of oper ations at Phoenix Homes, cites that
familiar subject – location. “Location tends to be the most important factor,” Kochar says. “Minimizing your commute time to work, school and amenities has a big impact on your quality of life. The driving culture in Ottawa tends to be less forgiving to long drive times.” Kochar’s statement brings up something that improves living on a daily basis. If it’s possible to live close to work, or close to an easy way to get to work, take advantage of it. In Ottawa, there are plenty of locations with good access to highways and to public transit, and there are pockets of the city where people can live while working nearby. What else? Kochar grins engagingly. “Knowing your realistic budget is very important. You should consider all costs associated with homeownership, such as the full price of the home.” This includes all applicable taxes and fees, anticipated property taxes, anticipated utility costs, 52

maintenance costs and insurance. He suggests doing calculations for different mortgage rates, too. “You want to ensure you are financially healthy if rates were to go up as much as even two percentage points. Once you know your budget, you can find a builder that has product in your price range.” Those are two great ideas for saving money and maximizing your equity in the investment. What else? “Your spatial requirements are the next thing to consider,” says Kochar. “Think about the stage in life you are in and how your needs are likely to change over the coming years. You may consider a smaller home for a shorter period of time with the intention of moving into something larger if and when your family size necessitates it.” He adds a thoughtful tip. “The livable area in a basement should also be taken into consideration.” He says the cost of finishing these spaces with your builder at the time of purchase can be quite affordable, so now might be the most advantageous time to do it. “You should also consider delivery timelines, as they can range greatly depending on the stage of approvals.” A good point, and one of the reasons to be careful choosing your builder. He finishes with, “The housing type is also important, as there are important financial implications to having a condominium or a home on a private roadway. You should make sure your agent provides all the information and documentation for these types of housing products.” Phoenix Homes builds homes in many sizes, styles and price ranges, so Kochar, who grew up in the business alongside his father Cuckoo Kochar, knows what he’s talking about, and provides great tips.
