JAysoN sChwArz If you’ve ever bought, sold or rented a property you’re probably familiar with the term vacant possession. Giving vacant possession refers to a legal obligation to ensure that a property is in a state fit to be occupied at a given point in time. WHEN DOES VACANT pOSSESSION HAVE TO BE gIVEN?

It’s common to see vacant possession as an express term in Agreements of Purchase and Sale or a lease. But vacant possession usually has to be given in the following circumstances: • When property is sold • When a lease is granted • When a tenant vacates at the of the term However, the Ontario Superior Court has held that in the absence of an agreement as to a specific time of day on which vacant possession must be delivered, a seller can deliver vacant possession at any time before the day expires. Therefore it’s important to be specific if you want to ensure that the property is vacant before midnight on the agreed day. WHAT DOES VACANT pOSSESSION MEAN?

It seems natural to think that a property will be delivered with vacant possession if all of the occupants have left, but chattels, or movable objects, must also be emptied. However, depending on the circumstances, vacant 8  NextHome.ca

possession may still be given even if these requirements are not wholly met. The test the courts apply is whether the chattels left behind substantially interfere with or prevent the enjoyment of the right of possession for a substantial part of the property. But the court is clear that not any impediment will do. It must be one which substantially prevents or interferes with the enjoyment of the right of possession of a substantial part of the property. Given the subjective nature of this test it’s important to keep in mind that each case will turn on its own set of unique facts. In one Ontario Superior Court case the court held that a Quonset hut, which remained on the land after the closing date, did not impeded the delivery of vacant possession. In that case the Plaintiff was willing to accept the property with the hut remaining. However the court conceded that even if the hut should have been removed, the purchaser would only be entitled to the cost of removing the hut as an abatement of the purchase price and nothing more. In a subsequent case, however, the court found that failing to remove equipment was a failure to provide vacant possession as required in the lease. The effect of this failure was to prevent the tenant from being able to carry on their business. In that case the tenant was entitled to damages. WHAT HAppENS IF VACANT pOSSESSION IS NOT gIVEN?

Where vacant possession is being given on the sale of property

a buyer has several options. A buyer can apply for specific performance, where the courts will enforce the contract, in addition to damages for any losses suffered. The contract may also be rescinded. But if the parties are willing to negotiate they may be able to agree on an abatement of rent/the purchase price or a different closing date. Courts act more favourably towards sellers who have made attempts to deliver vacant possession, rather than those who make no effort to honour the terms of the contract. WHAT DOES IT MEAN TO ME?

Vacant possession is extremely important. Let’s look at some examples. You are closing your new resale home and the vendor has left a broken down truck in the garage and all of its old furniture in house. The tenant of the vendor is still living in the basement. This is an example of a situation where you could apply to the Courts to enforce your rights to specific performance. Every situation is unique and requires a holistic overview of what is involved and then the application of both common sense and the law. This is the time your lawyer becomes very important. GrowinG Home Renovation industRy Helps Boost tHe

Canadian economy Dave wilkes I recently read an Altus Group Housing Report and I was impressed to learn that Canadians spent nearly $77.7 billion last year on residential renovations across the country. In fact, renovation numbers have been increasing steadily for the past 18 years making the renovation and repair industry larger than the new home construction industry and providing a boost to the Canadian economy. In 2017, the value of upgrades to Canadian homes totalled $59.1 billion, virtually matching spending on new home construction. When the $18.6 billion in home repairs are added on the renovation side, total renovation spending in 2017 accounted for 57 per cent of all residential construction. The 2016 Census identified about 920,5000 existing housing units that were in need of major work. The list included such things as defective plumbing or electrical wiring, structural repairs to walls, floors and ceilings. This number represents about 6.5 per cent of the total overall Canadian housing stock. This should not come as a surprise as the need for major work increases with the age of the home. More than half the homes requiring substantial renovations were built between 1946 and 1980, when home construction dramatically increased to accommodate returning World War II veterans and as the first half 16  NextHome.ca

of the baby boomers entered the housing market. The renovation industry is expected to continue to grow at a record pace, meaning that there will be an influx of entrepreneurs looking to take advantage in the growth of the industry. Furthermore, there will be more pressure on municipalities to process building applications. When it comes to choosing a renovator, I encourage you to visit www.renomark.ca and educate yourself on the RenoMark Code of Conduct that gives homeowners peace of mind. All RenoMark renovators must abide by the RenoMark Code of Conduct. It requires renovators to offer a minimum two-year warranty on all work, carry a minimum of $2 million in liability insurance and provide a detailed written contract. To expedite the increase of new building applications, BILD is working with municipal governments to find innovative ways to make it easier for home owners to obtain building permits and reduce the lengthy approval processes. That is why we wrote our own Renovation Service Standard of Excellence that was presented to the City of Toronto, outlining a practical system that would streamline building permits and inspections. By adopting a Standard of Service Excellence, municipalities would speed up new building and homeowner renovations. Under this standard municipalities would: • Commit to reasonable turnaround time and a specific

timeframe for building permit applications measured in weeks, not months. • Implement a web-based, one-window permitting portal that makes the application process smoother and provides transparency and accountability for the stage a permit is at. • Improve service by building inspectors. Inspectors should be accessible to renovators via mobile phone, providing reliable timeframes (two-hour windows) for inspections. We can do better if we all work together. As the municipal elections approach, BILD encourages all municipalities to adopt a Standard of Service Excellence. The majority of GTA ResidenTs AGRee: more new homes will help housinG affordability The Building Industry and Land Development Association (BILD) and the Toronto Real Estate Board (TREB) came together to shed light on voters’ priorities and issues for the upcoming municipal elections. For this survey, a sample of 1,503 GTA residents from the Ipsos I-Say panel was interviewed from August 20 to 23, 2018. “Last week’s poll data clearly showed that housing affordability and supply are key issues for GTA residents. Residents expect municipal politicians to tackle these issues in the upcoming election,” said Garry Bhaura, TREB President. “This week’s results show that building more new homes is seen, overwhelmingly, as a critical part of the solution to housing affordability. However, overcoming resistance to change and ‘not in my backyard’ sentiment in existing neighbourhoods is a huge barrier that municipal leaders can help overcome by taking a leadership role.” Some of the key results from the poll are as follows: • There was a clear consensus on the role of new builds as a means of addressing the issue of housing affordability in the GTA. • 87 per cent of respondents indicated that it is important to build new homes in the GTA as a means toward addressing the issue of housing affordability. Notably, GTA residents across all areas expressed this importance, including those living in York Region (87 per cent), Toronto (88 per cent), Peel Region (87 per cent), Durham Region (88 per cent), and Halton Region (81 per cent). 28  NextHome.ca

Those living in the 416 (88 per cent) feel slightly more strongly about the importance of new builds versus those in the 905 (86 per cent). Nearly nine out of 10 agree that municipal zoning by-laws should be reviewed, and changes considered, to allow for greater flexibility in creating middle-density housing types. Those living in Toronto (89 per cent) are more likely to hold this view than those in living in the surrounding municipalities (85 per cent). Opposition to new build construction increases with proximity and density. Specifically: • 30 per cent say they oppose the building of a new single family detached home within a half kilometre of their home; 37 per cent say they oppose the building of a new townhouse development within a half kilometre of their home; 44 per cent say the oppose the building of a stacked townhouse development (defined as middle-density housing) within a half kilometre of their home; • 49 per cent say they oppose the building of a small condo apartment building (defined as middle-density housing) within a half kilometre of their home; • 52 per cent say they oppose the building of a mid-rise condo apartment building (defined as middle-density housing) within a half kilometre of their home; • 59 per cent say the oppose the building of a high-rise condo apartment within a half kilometre of their home. In order to accommodate the tremendous growth that the GTA

has experienced in recent years, and the continued anticipated growth to 2041, policies of urban intensification and increased density of housing have been implemented by various levels of government. Resistance to new development slows construction of new housing, negatively impacting supply and increasing housing prices. “In order to build a livable GTA for the future, we need to be able to build more homes, faster. Clearly we need to have a broader discussion on how to accommodate growth, particularly in established neighbourhoods. I encourage citizens and municipal candidates to learn more about this at www.buildforgrowth.com,” said Dave Wilkes, President and CEO, BILD. “If we want to truly address housing issues in the GTA, we need to take a comprehensive approach and that means being open to innovative ideas and change. Outdated zoning rules and other obstacles need to be reconsidered. Guess What? More Condos are CominG to toronto!

According to data from CMHC, there were 57,613 apartments under construction in the Toronto Census Metropolitan Area (CMA) at the end of August, of which 49,377 will have condominium tenure. This level of future supply is near the record-high level set in 2014. There will always be some worry about overbuilding, but most of these units have already sold, and despite all the cranes you see in the sky, the new development industry has been underbuilding for the last three years. In May 2015, there were over 2,800 completed and unsold new condos in the Toronto CMA, that has declined to just 106 as of August 2018. Demand remains sky high. For almost a decade, the pundits and worrywarts said that the high-rise market in Toronto was overbuilding, and a glut of supply would result in major price declines, send investors running for the doors, and cause a correction of epic proportions. They were proved wrong once again in 2017 (the tenth straight year they’ve been proven wrong). A significant change made about 13 years ago is partially responsible for the condo boom you see today. According to a press release from Ontario’s Ministry of Infrastructure, “The Greenbelt Act, 2005 and Greenbelt Plan permanently protect 1.8 30  NextHome.ca

million acres around the Greater Golden Horseshoe” with the intent of preserving “our watersheds, rivers and forests to protect the water we drink and the air we breathe.” Like many acts with noble intentions, there was one unintended consequence, a decline in low-rise housing supply (and a subsequent major increase in prices). Some of the protected lands were ripe for residential redevelopment. Low-rise housing supply declined from about 17,000 available units a decade ago to just 5,000 today per data from Altus Data Solutions. Combine this trend with low interest rates, and the shifting preferences of young buyers away from cars and commutes to walkable amenity-rich urban neighbourhoods, has fueled the condo boom. The new mortgage stress test is limiting credit availability, interest rates that are now going up, and affordability concerns are all pushing more people into condominium living. Look for a greater variety of midrise developments in more neighbourhood settings, look for innovative stacked townhouse projects that bridge the gap between high-rise towers and traditional rowhouses, and look for back-to-back townhouses in more suburban settings. At some point in the future the Toronto condominium market is going to slow down, but consistent immigration and strong job growth continue to support new housing. Sales of

new condominiums are down from the record-breaking levels in 2017, but demand continues to exceed supply in the new and resale markets, and there’s a lot less talk of condo oversupply and a condo glut. In fact, there has been more talk about condominium and rental apartment shortages. I always recommend surrounding yourself with a competent and experienced team, whether this is your first or fifteenth condominium purchase: a good realtor and a knowledgeable mortgage broker is a must. The good news is that anyone looking for a condominium suite in the Toronto area these days has more choice than anywhere else in North America. Condo shoppers in Toronto and the Greater Toronto Area have a tremendous scope of locations, designs, amenities, layouts and features from which to choose. The opportunity is incredible opportunity, and yes, it might seem a bit overwhelming. There are hundreds of new condominiums on the market, so how do you begin? I have a suggestion that may seem oldfashioned, but it is a tried-and-true approach that works – make a list! Whether you use pen and paper or an Excel spreadsheet, listing your priorities and then checking them off as you visit different condominium sales offices will go a long way to helping you make the best choice. In our experience at Baker Real Estate, purchasers start with location first. Perhaps a downtown location would make it possible for you to walk to work or take public transit. As you figure out your budget and what you can afford, the ability to cross off a vehicle from your expenses can be a major plus. If you are an investor, remember that condos situated close to subway and bus lines are easier to rent. When you walk into a sales office, you need to know approximately what range of suites you can consider. Affordability also involves the suite size and configuration you desire. Realize that nowadays, suites are so well designed, that you can likely live comfortably in a smaller square footage than you imagine. I often talk about right-sizing your lifestyle, which means choosing the size that is best for your life circumstances at the time. So, what should be third on your list? I would advise lifestyle. Most purchasers welcome the condominium lifestyle, which includes things like a fitness centre, party room and any number of other amenities under

their roof. Condo shoppers also gravitate to buildings that offer concierge service for convenience and increased safety. On your major-item list, make a note to check out the background of the developer and builder, as well as looking at exterior and interior renderings to make sure the condominium will feel like “home” to you. A condominium suite is a major purchase. Take some time to make a list, compare fairly and make the very best choice for you! A lot has changed in the building industry over the past few decades. New building materials, new technology and new Green design initiatives have made today’s new homes better than ever. At the same time, real estate marketing has dramatically changed, including builders’ sales offices and presentation centres. There was a time when a builder would drop a sales trailer on site, hang a handful of floorplans on the wall, and be open for business. But that was then, and this is now. Now sales offices are spacious and sophisticated selling environments showcasing a builder, a community, and a range of homes. Many sales offices are single, stand-alone structures but the bigger master-planned communities incorporate massive sales compounds, bringing together sales offices for multiple builders. The exteriors are striking, being both a landmark and a beacon to draw in drive-by traffic. And the interiors are something else, too. Today’s sales offices feel more like home. Interiors can be warm and inviting, or they can be cool and contemporary, but they are places you want to spend time in. Each conveys the project’s unique brand and at the same time it is a sales environment that over the years has been revolutionized

by the advent of new digital technology. The receptionists who greet visitors no longer take down details on a paper form – today all that buyer data and contact information can be recorded using a tablet, the first step in what will be a constant stream of electronic communication between builder and buyer. Prospects step into the space and are dazzled by multi-screen video walls featuring eye-catching audio-visual that conveys the personality and all the details of the community. The traditional site plan is now digital, and it is interactive and easily updated whenever a new home is sold or a new phase is released. The floorplans are digital too. display screen, and with the touch of a finger, go back and forth comparing one plan to another. All this new interactive technology engages the buyer like never before. What is the future of real estate marketing? TYPES OF HOMES nOT EligiblE FOr warranty cOvEragE

Whenever I write about the Ontario new home warranty program, I make the observation that almost every new home and condominium is covered under the seven-year, $300,000 warranty. However, there are exceptions to warranty coverage, and I thought it would be useful to remind potential new home buyers about homes that are not covered. Perhaps the category of new homes we get the most questions about are owner-built homes. A home is considered ownerbuilt if the owners build the home themselves on land they own, and then occupy it. It can also be considered an owner-built home if the owners hire someone else to build the structure, but exercise “significant control” over the construction of the home and then move in after it is built. Significant control includes: selecting, contracting directly with or terminating contracts with subcontractors, trades and suppliers; reviewing, revising, approving, supervising or directing work; and/or supplying materials. Whether the control exercised by the owner is significant depends on the nature, value and quantity of the work or materials controlled or contributed by the owner. There is a simple reason why owner-built homes are not covered by the statutory warranties: the vendor of the home (as defined 36  NextHome.ca

in legislation) is responsible for providing the warranty, and in the case of owner-built homes, there is no vendor. There are other types of homes and condos that are exempt from coverage, too. If an existing residential home has been renovated – for example, a new addition was constructed – the home is still not considered new and would not be eligible for statutory warranty coverage. Homes – even newly built ones – that have been previously occupied by the seller or the builder or rented by other persons before being sold to a purchaser, are not covered. A new home built on a preexisting foundation will also be exempt if that pre-existing portion of the foundation exceeds 40 per cent of the footings of the new build. Another category not covered by the warranty is the seasonal home. These are homes that don’t meet the year-round occupancy requirements of the Ontario

Building Code and are therefore not built for year-round occupancy. While condominium projects converted from existing nonresidential buildings are now covered by the warranty (this coverage was added January 1, 2018), buildings that were originally rental apartment buildings do not qualify for coverage. It’s important to note that these warranty exemptions represent a small portion of newly built homes or condos on the market. If you’ve already started investing in stocks, bonds, mutual funds, ETFs or more, you may be like many Canadians wondering if adding real estate might be right for you (outside of your principal residence). Many investors love the tangibility of holding an asset as opposed to the more nebulous stock or bond market. You can see it, hold it, control it. But it does require a much larger investment than other options and doesn’t allow as much diversification considering how high the average home costs are in this country. Investing in real estate outside your primary residence can be one way to grow your assets for retirement. You can deduct the interest on borrowed funds and have a renter paying your mortgage. Maili Wong, Certified Financial Planner, First Vice-President & Portfolio Manager with CIBC Wood Gundy says that “the cash flow you receive from renting out the residential or commercial property could potentially supplement your retirement income.
