Review your contract

Know what you’re signing for – beforehand

H

ome-shoppers may not realize that the contract for a new home is different from the traditional resale version. Since a new home is not always built when the contract is drawn up, it’s often based on the lot and a model that you, the buyer, have selected. Builders often offer several versions of one model and different variations on the exterior appearance as well, so be sure to verify that your contract describes the right home and the elevation type and floorplan specifications you want. The lot and orientation of the home are also important to verify, since a builder may assign certain models to specific lots in order to create an attractive streetscape. This may result in a reverse floorplan to fit into the overall community design, which means the entire home will be reversed when compared to the floorplan you reviewed. Check with your builder if this is the case with the home you are considering if you are concerned about this being a possibility. Some people don’t mind, while others do. A good sales representative will review your specific home and contract with you, and a proper new-home contract will include all of these details. Since contract agreements differ from builder to builder, be sure that all is in order by having your contract reviewed by a real estate lawyer to make sure all the details are documented properly and accurately.

Here’s to 2013

Next year looks stable, if somewhat challenged, all things considered

I

t’s certainly been an interesting year, 2012. As I write this, the U.S. economic expansion continues gradually, Europe remains in recession, growth in China is stabilizing and the Bank of Canada has once again held its overnight lending rate at one per cent. And somehow, despite it all, the Canadian economy and housing market continue to hold their own, albeit somewhat tenuously in some areas more than others. RBC Economics Research says homeownership affordability improved in many markets in the third quarter of this year, and Canada Mortgage and Housing Corp. forecasts that 2013 will be a year of moderation in some areas, continuing growth in others. Most importantly, Canada’s economic fundamentals remain strong and supportive of housing demand. Indeed, against the backdrop of what’s going on elsewhere in the world, Canada’s performance in 2012 is worth celebrating. Not that our industries and housing market are immune from international developments – in fact, far from it. But with smart fiscal policy and prudent lending practices – and awareness of key market fundamentals by Canadian homebuyers – here’s to more of the same in 2013.

What’s all the fuss about a

‘ market correction’? by peter kinch

Pick up any newspaper today and no one

could blame you if you got a little worried about the state of the economy or the fear of a pending market correction in Canadian real estate. What if Greece defaults? What about the “fiscal cliff” in the US? Are Canadians taking on too much debt? Have mortgage rules gone too far? Is there a housing bubble about to burst? What if there is a market correction? The real question is, do Canadian homeowners or prospective buyers need to be concerned? Every time there is talk about a market correction in Canadian real estate, the tone is quite negative. But let’s take a closer look at that situation: rather than argue about whether we may have a market correction, let’s analyze what it really means to Canadians if there is one. First-time homebuyers: If you’re a first-time homebuyer, you have likely felt the pinch of the rising cost of housing, and the new mortgage rules certainly haven’t helped any either. So a slight market correction would be welcome news for you; you can still get into homeownership with only five per cent down, but since your maximum amortization is now limited to only 25 years, a drop in pricing is exactly what you’ll need to be able to get into this market. Conclusion: A market correction is a good thing for you.

But let’s take a closer look at that: assume the value of the house you are selling drops by 10 per cent. Let’s also assume that you plan to buy another home (whether upsizing or downsizing). Current homeowner buying or selling – moving up or downsizing: It is very rare that someone buys something without selling something first, and vice versa. If you are a homeowner and you’re looking for the right time to sell

our home equity and net worth. Over the last decade, a significant amount of the net worth of Canadians has been tied up in their home equity, and this has provided the foundation for a lot of retirement plans – so there is obvious concern. But should there be? Again, let’s look at the facts. For the majority of Canadians, the plan is to stay in their current house for at least the next three to five years. So here’s a simple fact: equity is only gained or lost the day you sell. In other words, if the value of your house were to drop by 10 per cent tomorrow, you may feel anxiety over the drop in your net worth – but it would only be on paper unless you actually sold your house tomorrow. If you have no intention of selling soon and you can still afford your monthly payments, then all you need to do is sit and wait and go about your normal life until the market bounces back – which it has always done for the past 100 years. Conclusion: a market correction may very well have zero impact on you.

The law of good faith (or the lack thereof) by Jayson Schwarz

The Supreme Court of Canada has said that good faith is

not a requirement by either side in the negotiation of a contract. They went on to say that once the contract is signed there is an obligation to perform in good faith. What does this mean to you, the homebuyer?

01 The most important thing to remember is that if it is not in writing, in the Agreement of Purchase and Sale, it is not binding on either side. 02 It does not matter what the agent says or promises (see 1 above). 03 It does not matter what is written in the brochure or advertised at the sales office (see 1 above). 04 Every Agreement should be reviewed by a lawyer who knows real estate before it is binding. 05 Only your lawyer has a legal, moral and ethical requirement to protect and put you first. 06 Every Agreement should be conditional on the lawyer’s review and the condition must be in writing, and keep it that simple. Some Agreements have condition clauses that are all mumbo-jumbo and do not let you really change anything. Also, make sure some time for review is allotted and sufficient. Okay, the Agreement is signed, reviewed, amended and ready. Now what? The parties must thereafter act in good faith to complete the contract in accordance with the terms of the Agreement. Remember, most builders and their sales people are honest, caring individuals who want to deliver a quality product. Just be careful not to bite into the bad apple in the bunch. Happy home hunting!

BILD raises $30,000 for Habitat for Humanity More than 450 industry professionals

turned up on November 20 for the Building Industry and Land Development Association’s (BILD) Party for Humanity, and raised more than $30,000 for Habitat for Humanity Toronto. The fourth annual event was held at the Warehouse in Downsview Park, and attendees dressed in their favourite white pieces, in accordance with the party’s “white out” theme. Fundraising efforts included a silent auction, raffle and a “wardrobe tax” for those whose attire lacked the mandatory white piece. “This event has been a tremendous success in each of its first three years, but we chose to think outside the box this year and try something different,” said BILD President and CEO Bryan Tuckey. “Our team is always thinking of new, creative ways to raise money for our community partner, Habitat for Humanity Toronto, and this event is yet another example of how committed this industry is to giving back to the community.” BILD’s Party for Humanity is one of four major fundraisers for the charity. Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to finance our social security programs and create a more equitable taxation system. Almost 40 years since and it is still around. Don’t you feel more secure about your social security and equality in our tax system? Some countries such as Belize, Barbados, Cayman Islands, Egypt, and Hong Kong have no capital gains tax. On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit.

Two years ago, I purchased a new home from a builder in north Toronto. Occupancy is this November and expects to complete transaction in March of next year. My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? How much and can I claim the lifetime exemption? Brian, Scarborough

A.

Capital gains tax is charged on the profit realized from the sale of noninventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment.

RBC Economics is currently forecasting the Canadian economy will grow by 2.4 per cent in 2013. “The Canadian economy has been growing at a rate close to its long-run potential,” says Craig Wright, senior vicepresident and chief economist, RBC. “However, we will have a sharper picture of Canada’s future growth prospects when the US addresses the fiscal cliff and European policy makers can move the Eurozone out of recession and address fiscal and financial market imbalances.”

Twothirds of Canadians plan to be money savers and budget makers this holiday season The holiday shopping season is here and Canadians are

looking for ways to save and make the most of their budget. According to a recent survey by TD Canada Trust, when asked what type of holiday shopper they would be this year, the majority of Canadians said they plan to spend very little and only what they need (37 per cent) or that they would budget and manage their spending to ensure they don’t overspend (35 per cent). Next, look for sales that are on now. Spend time planning how you can best take advantage of online and in-store timesensitive sales, price-match guarantees and price adjustments opportunities. The holidays are just around

the corner and only the most savvy of us have everything under control. That’s one of the problems with our very busy lives… there’s just no time. But if you want to have a happy holiday that doesn’t leave you holding your aching head when the bills roll in come January, you have to start planning early. The longer you wait, the more you’re prone to give in to stress, make impulse purchases, blow your budget or even buy a lame gift. Look at your holiday spending as you would any other big-ticket item. While you’re splitting the cost among a variety of expenses, the bottom line is still the same – you’re spending a lot of money in a short period of time. In the best of all worlds, you would have started saving for your holiday spending in January. Yes, you would have made it a budget item and set aside $10, $50, $150 a month so when the season rolled ‘round, you’d be ready. After all, it’s way easier to set aside $100 a month than to come up with $1,200 all at once. This is how I do it, and come August I start keeping my eyes open for “deals” on things I know my friends and family will love. if you can’t do that, start here, with THIS “Holiday Spending Plan”: » Write down the amount you want to spend in each category of holiday expenses. Calculate the combined monthly before-tax income of you and your spouse.

Multiply this figure by the amount you need to borrow. Divide by 1,000.

Divide by three. This figure is the monthly payment you can afford to make on your home.

Add to this your estimated monthly heating costs and monthly property taxes.
