When buying a new home,
do your due diligence by Jayson Schwarz LL.M.
Purchasing a new home will likely be the largest investment you ever make. Think about that... Why, you ask? The answer is that in my 35 years of practicing law, I have seen young couples spend more time researching a new telephone than a new home! The most important advice I can give, and if you take anything from this article, it is this: research everything ahead of time, such as prospective builders, areas, amenities, property taxes, lawyers, your financial ability, zoning, bylaws and neighbours. And don’t allow yourself to be pressured by anyone. What can you afford? Review your available cash for deposit and annual income to pay a mortgage and expenses. Once you have done that, speak to the mortgage specialists at the bank you deal with and speak to a reputable mortgage broker. Companies such as the Mortgage Centre in Mississauga and Mortgage Providers in Toronto have the experience and integrity to get you the best deal. Find out how much money you can borrow and how much of a deposit you’ll need to put down. This will allow you to focus on homes you can afford. Get a pre-approval in writing so you have something to rely on, because especially today, it is critical that you do not get caught up in the rush of buying a house that is beyond your budget. Do you want a condo or a freehold? Condo living provides a carefree lifestyle – someone else cuts the grass and shovels the snow – but you pay additional monthly common expenses and sometimes others determine how the amenities, if not your unit itself, can be used. Freehold provides the freedom to do what you want, but maintenance and upkeep fall on your shoulders. The choices are boundless. Once you determine what kind of home you want, you need to decide new or resale. If new, the offers are long and filled with clauses that could cost you money or result in long delays. Be sure to see an experienced real estate lawyer familiar with these kinds of agreements before it is final and no longer conditional. Research the builder and go to other sites the company has done and ask people about quality and after-sales service. Find the right lawyer A lawyer must advise you at the time you make your offer, to guide you in understanding the offer (Agreement of Purchase and Sale). The right lawyer will explain how real estate agents work, what
documents you will sign and what is to be included in the offer. It is important that your lawyer explains all the potential costs you will face and what you may encounter. Ensure that you arrange a pre-agreed fee with the solicitor. Get the fees locked in. The fee to close a standard resale home or condominium priced less than $500,000 should be somewhere between $800 and $900, plus HST and disbursements. This may vary in special circumstances. Also, make sure you get a free offer review. Then have your lawyer provide you a list of disbursements – those monies expended on your behalf necessary to properly search and close the transaction. This is where some lawyers may try to charge large fax, mail and photocopy fees. Make your lawyer justify all expenditures that don’t make sense. Miscellaneous Do you have a will? If you do, is it up to date and does it represent your current situation and state of affairs? A will prevents sibling disputes, clarifies who will look after children, keeps the government out of your affairs, allows for an orderly disposition of everything from possessions to your realty, stocks and bonds, and will help guide your funeral arrangements. You will also need insurance for the home. This is the right time to look at life and disability insurance, to determine if you should be insuring your mortgage in case something happens to the major wage-earner. As you can see, there is a lot to consider when buying a new home. Being prepared will help you enjoy the experience and find that dream home.

Decisions, decisions, decisions – there are certainly
lots of them to make when buying a home, and one of the most significant is whether to buy a brand new or resale home. Last year, there were more than 61,000 new home and condo starts in Ontario, and in 2014 Canada Mortgage and Housing Corp. (CMHC) forecasts about 60,000 starts. So, what makes thousands of consumers choose to buy a new home or condo versus a resale home? Here are five good reasons: Design It all starts with design. Good home design begins with an understanding of how people live in their homes.

Times have changed. Families have changed, and with that, our lifestyles have evolved. New home builders offer fresh, innovative plans and designs that meet the needs of today’s consumers, using modern technology to build homes and condos that are attractive, highly functional and feel good to live in. These homes include efficient use of space, open layouts, plenty of natural light, functional kitchens, flexible space and of course, lots of storage – something that’s usually absent in older homes.

From windows and insulation to state-ofthe-art heating and air conditioning systems, today’s new homes are superior when it comes to energy efficiency. And we can expect that advances in energy efficiency will continue to grow as the price of energy goes up and we, as a society, recognize our responsibility to conserve energy and reduce our own environmental footprint. Environmentally Responsible Products No doubt about it, today’s new homes are much more environmentally friendly than those built 40 or 50 years ago. Great advances have been made in developing and manufacturing building products that contribute to the Greening of Canadian homes and condos. Manufacturers and suppliers are continually looking for ways to make their products and systems more acceptable to today’s environmentally savvy customer. Safety In part because of changes to Ontario’s Building Code over the years, new homes boast many products and features that ensure your family home is a safe environment. Whether it is superior air ventilation and heating systems, stair railings and risers built to code, improved electrical components, or products with fewer gas emissions, a new home is built to an alwaysimproving building code. A newly built home is also inspected during various phases of construction, ensuring that it is built to minimum energy efficiency as well as code and safety requirements.
Warranty Program In Ontario, builders must be registered with the Tarion Warranty Corp. program which offers one of the best, most comprehensive warranty coverage programs in the country. New-home buyers benefit from deposit protection and protection against delayed closings or occupancies without proper written notices. New-home owners are also covered against defects in work and materials, and major structural defects. The pluses to buying new really add up. Newly built homes and condos use advanced design, materials and construction techniques that provide buyers with a wide range of options and great value – something to think about when you are making decisions about the purchase of a home.

Quality homes, guaranteed Builder warranties backed by Tarion by Howard Bogach
When buying a new home, there are many decisions to make: downtown or suburbs, two or three bedrooms, hardwood or laminate. But the one thing you don’t have to worry about is your new home’s construction. That’s because almost every new home and condo sold in Ontario comes with a builder’s warranty, backed by Tarion. The warranty process starts before your builder even breaks ground, and lasts for seven years from when your new home or condo is completed and ready for possession. Although it is often lumped into one warranty for simplicity’s sake, in reality, just about all new homes in Ontario come with deposit and delayed closing protection, in addition to three separate warranties that provide different types of coverage at different points in the life cycle of your home.
Your deposit protection and delayed closing protection begins before you move in. Deposits are protected up to a maximum of $40,000 for freehold homes in the event that your builder goes bankrupt, breaches the purchase agreement or in situations where you are legally entitled to back out of the purchase agreement before closing. The delayed closing and occupancy provision means your builder guarantees that your home or condo will be ready for move in either by a date specified in the purchase agreement or by a date that has been properly extended if circumstances occur that delay your condo’s completion. In many cases, your builder will be required to compensate you if a delay occurs.

The warranty process starts before your builder even breaks ground, and lasts for seven years from when your new home or condo is completed and ready for possession.
The one-, two- and seven-year warranties begin when your home is complete and ready for possession. The one-year warranty covers defects in work and material, protects against unauthorized substitutions and ensures your home is fit for habitation and constructed according to the Ontario Building Code. The first-year warranty includes almost everything inside and outside your home that was provided by the builder, from flooring to drywall to heating and air conditioning systems, and is in place for one year from your home’s date of possession. The two-year warranty protects against defects in work or materials in the electrical, plumbing and heating delivery and distribution systems owned by your unit. It continues to provide protection against violations of the Ontario Building Code that affect health and safety, and applies for two years beginning on the home’s date of possession. The seven-year warranty, referred to as the Major Structural Defect Warranty, provides coverage for any 26
defect in work or materials that results in failure of a structural, load-bearing element of the building or one that would reduce the expected life span of a structural element. It also includes protection against a defect that adversely affects the use of the home.

Why the GTA housing market is
fundamentally solid in 2014 by WAYNE KARL
WHEN BUYING A NEW HOME, CONDUCTING YOUR RESEARCH and due diligence is paramount. One of the best resources – whether you’re a first-time or move-up buyer – is Canada Mortgage and Housing Corp. (CMHC). And of all the valuable information and data CMHC produces, none is more educational than its annual housing outlook conferences. If ever there was an excellent refresher on the fundamentals that determine and support real estate market conditions, and puts it all in perspective, this is it. Here is a summary of some key points for the GTA: » The economy: Throughout 2013, the economy in Toronto has seen a steady decrease in unemployment as a result of strong employment growth. Although the four-per-cent employment growth of the first three quarters of 2013 will not be sustained for the full year and through 2014, the average unemployment rate will fall to 7.7 per cent 2014, the lowest it has been since the economic downturn in 2008. Income growth will match employment growth. The strengthening U.S. recovery will be of greater benefit to Ontario than western Canada, as Ontario employment is more strongly correlated to cyclical movements in the U.S. economy. » Mortgage rates: Mortgage rates to see modest and gradual increases late in 2014, but will remain low by historical standards. This outlook will continue to support housing market activity next year. » Housing starts: Housing starts, an important indicator of growth and health of the housing sector, will ease slightly in 2014. Rapid growth in the price for new single-detached homes will shift demand to more affordable low-rise options such as semi-detached and rowhomes. » Employment and immigration: As the leading indicator of housing demand, employment levels will continue to support the housing market. Migration accounts for close to two-thirds of population growth and household formation in Toronto. In the last few years, the number of people moving to Toronto from other provinces roughly matched the number moving to other provinces, but in the year ending June 2013, the balance shifted in favour of western Canada. At the same time, net 32
gains from international migration diminished. » GTA market: So, what does all this mean for the GTA? The housing market is forecast to remain stable in 2014, CMHC says. Housing starts will shift to multi-family, mortgage rates will rise gradually, keeping existing home sales growth modest. » GTA opportunities: These relatively minor challenges in the short term underline the importance of looking at home purchases over the long term. Prices of single-family homes in Toronto may be rising to the point of testing sustainable affordability, but areas outside the city offer a reasonable alternative. Richmond Hill, Newmarket, Mississauga and Pickering are examples of high performing areas; Etobicoke, Brampton, Aurora and Milton also perform well but are more affordable. Looking at the big picture and long term for the GTA, the important determining factors are – fundamentally solid.

Trends come and go, but some things are
timeless. Knowing where to make that extra investment in your new home will help not just with resale value, but also with creating that warm and inviting space that makes it “home.” Here are my top 10 upgrades to take your home from cookie-cutter to one-of-a-kind:
In the kitchen 1. Cabinetry Upgrading the cabinetry means improving the view from every angle. Wood is both a hot 2014 trend and an ageless classic, so consider skipping the safe white or near-black espresso and go with the grain, so to speak, such as a gorgeous textural walnut. 2. Hardware Why invest in new cabinets but settle for standard hardware? Even standard cabinetry will benefit from the face lift provided by this relatively inexpensive upgrade. Try pairing sleek pulls for the bottom cabinets, with a contrasting knob for the uppers. Also, consider upgrading doorknobs and other oft-forgotten hardware to achieve true bespoke appeal. 40
3. Backsplash A mirrored backsplash dramatically opens the visual space, making 800 sq. ft. feel like 1,600. Plus, there will be no trendy tile patterns that will grow dated in a few years. One of my favourites is a grey glass that gives a warm, smoky character to the reflection for sophisticated elegance, with minimal cuts for a seamless look. 4. Countertop I love mixing different materials to get a sense of contrast between the island top and the main counters. There’s nothing wrong with pairing clean quartz and rich marble. To save costs, invest in a beautiful material for the island where it will be showcased centre stage, and save the standard finish for the back counters which draw less attention.
In the bathroom 5. Tiling Taking the tile from floor to ceiling creates a polished look essential to a feeling of spa-like luxury – a key to both market value and for your own day-today feeling of relaxation. Try a 1/3 offset pattern for subtle movement.

6. Shower Once you have beautiful tile in place, show it off with a glass shower panel rather than a curtain. If your space doesn’t already have one, you’ll find it almost essential for resale down the road. Allow for a minimum 22-in. opening, or use a glass door for access. 7. Vanity Storage is important, but so is feeling like you have room to move and breathe. A vanity with legs and plenty of open space will visually expand your bathroom without knocking down any walls.
In the living room 8. Lighting I have worked on many condo renovations that involved concrete ceilings where no extra lighting could be added – or so you thought! A dropped ceiling panel will reduce the perception of lofty ceiling height, while allowing for the installation of pot lights or pendants. Adding this extra layer of light avoids harsh shadows and dim spots. 9. Floor In a small space, avoiding breaks between flooring provides the illusion of greater square footage. Let one hardwood run throughout as much area as possible (even through the kitchen) for a harmonious look that seems to extend forever.
10. Focal point Last, but not least, create a focal wall to balance the visual weight of built-in features like cabinetry. This may seem like a superficial upgrade, but even just one large mirror will open the space while providing a visual anchor, enhancing the way you and your guests psychologically perceive the rest of your material investments.

Matthew

Matthew was born in August 2012, three weeks prematurely. At 30 weeks gestation a routine ultrasound showed fluid in his abdomen. Matthew’s mom, Gillian, was transferred to the high risk unit at their local hospital. Their doctor there suspected that Matthew had meconium peritonitis, a rupture of the bowel. This is rarely seen in babies in utero, but is associated with babies who have cystic fibrosis. His parents were tested and learned that they carry the gene for cystic fibrosis. This came as a total surprise to them as there is no CF in their families. At birth, Matthew had a blood test and was confirmed to have CF and presented with the “classic” form – the delta gene. He was transferred to SickKids and had surgery to unblock his bowel on his first day of life. He

had some complications, and spent six weeks at SickKids. Shortly before Christmas, he had a second surgery and was in hospital for three days. Matthew’s condition has already affected his pancreas and although it has not yet affected his lungs, his parents expect that it will as he develops and grows. They do physiotherapy with him daily to keep his lungs as healthy as possible. “It’s the worst feeling watching your child fight to get better,” says Gillian. “But despite his condition, Matthew’s been a happy boy providing us smiles.” Matthew’s parents decided that they want to do everything they can to help advance research. They met Dr. Felix Ratjen, head of respiratory medicine and co-director of the Cystic Fibrosis centre, who spoke to them about CF stem cell research and they readily agreed to allow SickKids to take a sample of Matthew’s skin when he came to have his surgery in December. “You can’t do anything to help other than be there and love them unconditionally. There were really two reasons behind participating in the research study: a little hope and a lot of fear. My optimistic side would say a lot of hope,” says Gillian. Last year, SickKids researcher, Dr. Janet Rossant and her team became the first in the world to use skin cells from patients with CF to produce mature lung cells in a petri dish. Lung cells generated from patients can be used to develop and test drugs that target the genetic mutation underlying the condition. If the drugs work on the lung cells, then later they may also be tried on the patient. Until recently, the only therapies available for patients with CF targeted the symptoms, like infection and digestive disorders, rather than the underlying genetic alteration.

purchase you’ll make in your lifetime. It’s no wonder that purchasing real estate has prospective buyers – especially first-timers – a little apprehensive. You want to make sure you choose the right home in a great location, by a builder you can trust.

hen one looks at Canada’s economic picture, there’s little doubt that homeownership is the best way to create financial security. While there are many reasons this is the case, the most enticing is the fact that there are no taxes applicable on the resale of a principal residence, making homeownership by far the highest 48

And if homeownership is the most reliable form of investment in Canada, the Greater Toronto Area is clearly the best place to make it. Recent headlines indicate building permits in the GTA are ahead of the national average. This, of course, is no surprise, because Toronto and the GTA have been the financial centre for the country for a number of years. Other areas may be richer in minerals and generate higher tourism dollars, but most people would prefer to invest in the GTA for a guaranteed long-term return. In 2012, the construction industry in the GTA was the largest single wealthbuilder, contributing $26.4 billion to the economy. This is why 70,000 to 80,000 thousand new immigrants settle in the GTA every year. Some of them start businesses and some of them start families – but all of them need a place to live. At today’s highly affordable mortgage rates, it takes, on average, only two years for immigrants new to Canada to save enough to make a down payment on a new home or condominium. This means there is always a steady influx of new demand for the purchase of existing homes, which makes it easier to sell your current home and move into a larger one as your needs change. With this in mind, when you are looking for your new home, purchase only what you need today. In other words: if you need only three bedrooms for your current family, purchase a home of that size and pay down your mortgage as soon as possible. Don’t worry about not being able to find a home to grow into; due to the GTA’s strong market, rest assured there are many options if and when you need additional space. If you buy what you need for today, you will pay less in heat, hydro and taxes throughout the year and you will own your new home sooner. Regular mortgage payments, preferably by opting for accelerated bi-weekly payments, will create equity in your new home that will help you along your path to financial freedom. Following this simple formula, you will soon find that your equity has given you the freedom to do other things you want to do in life, whether it’s owning a bigger home, traveling or funding your children’s education.

You’re going to get lots of valuable advice about what to keep in mind when shopping, and it’s going to include very important considerations such as price or budget and location. As this is one of the most important decisions you’ll ever make, you definitely want to carefully research and plan around all of those things. In my mind, there is an over-riding element that, if properly considered, actually takes care of all that. It’s focusing on the needs of your family. There has been a real tendency over the past few years for people to view their house primarily as an investment. And while it’s a fact that it’s the biggest purchase of most people’s lives, this can tend to distract from the reality that a house is not just where you live until the investment appreciates. A house is a home. So the real question is how do you turn the bricks and mortar into a place where you can make memories. So, first and foremost, ask yourself what the needs of your family are. What do you truly need in your home? Is your family going to be growing, or will you be downsizing? Is a yard a must-have or just a burden and you prefer that someone else look after maintenance? Is easy access to work, shopping or public transit important to you? Will you be working out of your home? Do you have multi-generational needs for the home, such as aging parents you may need to care for? Your unique lifestyle needs really should drive your decisions on the type of housing you decide on, which will in turn drive considerations of price and location. There are many different forms of housing out there today to support many types of lifestyle needs – community builders such as Mattamy offer many options (often in the same community),

First and foremost, ask yourself what the needs of your family are. What do you truly need in your home? Is your family going to be growing, or will you be downsizing? If you make good decisions grounded in what your family truly needs from a home, that’s the most important thing. With new changes to mortgage rules and affordability becoming a greater issue across the demographic spectrum, it’s important to ensure that the home you purchase takes into account your personal needs. If you

prefer to live outside the city and commute downtown for work, public transit or quick access to the major 400-series highways will be important. Choosing a home without these options can quickly feel overwhelming as you’ll spend a great deal of time in your car or on several modes of public transportation rather than enjoying the home you’ve invested in. Many Menkes communities, both highrise and lowrise, are strategically placed along subway lines, streetcar routes, and within minutes of major thoroughfares to increase the time you spend at home, not on the road. Locations close to greenspace or schools become a greater need for growing families or pet owners. Research areas before deciding, to ensure the local schools have a good reputation, and that parklands and walking trails are safe and well-lit. Committing to an area by properly researching it will ensure many years of enjoyment and avoid the hassle of an inconvenient and costly subsequent move. Finally, it’s important to consider your own social lifestyle before you make a final choice on where you’d like to live. Many people who found themselves stating that they’d like to get away from it all move out to the suburbs only to regret their decision if their social group remains in the city, or if they’re not quite done with city life. The same works in reverse for those who move into the city to avoid commuting, only to find that vast and less-crowded greenspaces are no longer available as they were in their former suburban life. In the current economic climate, find the right home for your price range, and then ensure it meets your travel and lifestyle needs before putting down roots.

s an advocate for the new homes industry, I am often asked by my friends and family to explain what it is about new homes and condominiums that stands out and above their resale counterparts. While there are a number of reasons to pick from, I would have to say that the underlying factor is the freedom of choice. When you buy a brand new home or condo, you get to choose your builder based on their reputation and track record. Just like buying a new car, you know that certain brands carry a definite advantage and with no previous owner, you know you’re getting exactly what you’re paying for. While choosing your builder is a critical step, choosing your finishes is where the fun begins. Newhome buyers can completely customize their homes or suites to their liking. Whether it’s floors, kitchen cabinets, countertops or faucets, your new home is

built completely to your liking. Upon purchasing, homebuyers are invited to choose from dozens of different packages that best fit their budget, taste and lifestyle. New homes are built using the latest construction tools and materials, so you know you’re getting the most out of your home. This is especially true when it comes to energy efficiency. In 2012, the Ontario Building Code was updated to include higher standards for building energy-efficient communities and our industry has not only met, but exceeded these new requirements. New-home buyers can now choose from an array of Green features such as high-pressure, low-flow showerheads and faucets, dual-flush toilets and front loading washing machines which reduce both water and energy consumption. With the industry’s shift toward high-density housing in recent years, condo developers have taken amenities to a whole new level in recent years. Those looking to find both entertainment and convenience without having to travel can now do so in the comfort of their own condo buildings. From theatre-sized movie rooms to virtual games rooms to luxury spas, new highrise buyers can really maximize on the benefits of condo living. There are even pet-themed amenities to help reinforce the notion that you don’t need to compromise your lifestyle when you live in a condo. While this is a huge leap from the traditional package of a swimming pool and fitness centre, home builders understand that some buyers are perfectly happy with simply enjoying their suites. When it comes to clinching the deal for your
desired home, heed the phrase, “a stitch in time saves nine.” It’s prudent to seek mortgage advice well before you start to shop for a home – at least three to six months before. This will allow your mortgage professional the time needed to re-structure your credit worthiness and finances, allowing you access to the “cream of the crop” mortgage products offered only to the privileged few. Many ask, why seek the advice of an Accredited Mortgage Professional (AMP) when they can just visit their bank, with whom they have an existing relationship? We encourage our clients to do their due diligence. Being ill prepared and choosing the wrong mortgage strategy can cost thousands of extra dollars. Key RISK factors to consider when obtaining a NEW mortgage:
› If you opt for your bank’s variable rate, you will lose one per cent on your conversion rate should you need to convert to a fixed rate in the future when rates rise. › Penalties are higher than they appear – another common misstep with taking a bank mortgage. Banks use their posted rates less a discount that they give to you. This discount off the bank’s posted rate will cost you thousands more in penalties in the future if you break your mortgage prior to the end of the term. › All of the big six banks now have mortgages that are collateral charges, which are basically a different method of securing a mortgage on your home. Avoid being handcuffed, thereby losing your leverage at renewal time. An AMP can show you how to save tens of thousands of dollars in potential interest rate penalties, conversion differentials, and obtain for you the leverage that you need at renewal time to secure the best deal. › Changes to mortgage insurance premiums Canada Mortgage & Housing Corp. (CMHC) mortgage insurance premiums will increase for all loan-to-value ranges, for standard owner-occupied purchase applications submitted on or after May 1, 2014.
› Increased Home Buyers’ Plan withdrawal limit If you have RRSPs, the withdrawal limit is up to $25,000 tax-free for first-home purchases and related costs such as your down payment and closing costs. › First-Time Home Buyers’ Tax Credit You can claim a non-refundable tax credit on an amount of $5,000, for a credit of up to $750, in the year the home is purchased. › Five-per-cent down payment minimum Gone are the days of the five-per-cent cash-back mortgage from banks, due to recent federal government rule changes. However, there are some lenders, not governed under the Bank Act, that can still offer a five-per-cent cash-back program. › Energy-efficient home rebate Receive a 10-per-cent refund on your CMHC mortgage insurance premium when purchasing an energy-efficient home or when renovating your home to meet energy-efficiency guidelines › Limited income verification Self-employed and commission sales people have struggled to buy their first home, with strict down payment requirements of 25 per cent. Now with limited income verification, entrepreneurs can purchase with as little as 10 per cent down. Your goal should be to reduce your total cost of homeownership by developing a mortgage strategy that minimizes your interest paid over the life of your mortgage. Is your plan only for the first five-year term of your 25-year mortgage? With the interest on the mortgage costing more than the purchase price, shouldn’t there be a strategy in place to reduce this enormous amount of the full 25 years? Do you have one?
