Get it in writing

and have your lawyer review your agreement

B

uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction.

The term “get it in writing” has never been more important than in the case of the new-home purchase since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder.

Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province.

Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Why transit is crucial to housing

As we tackle transportation and infrastructure challenges, proximity to transit is increasingly key

I

f you’ve been following the debate over transit and infrastructure expansion in the Greater Toronto and Hamilton area, you’re likely well aware of just how important a topic this. These issues are critical to the future of the region.

This is why various home building associations and other organizations see some promise with the latest federal budget tabled on March 21, in which Finance Minister Jim Flaherty promised increased funding for infrastructure improvement.

Proximity and access to transit and amenities – from health care to schools to shopping to recreation – are critical for builders and buyers alike. Development charges for developers to build new communities, and help fund infrastructure growth, need to be reasonable, so as to deliver new-home prices to buyers that are affordable.

It will take months, if not years, for new funding to reach municipalities, and that’s assuming cities such as Toronto, Hamilton and elsewhere can agree on expansion plans.

In the meantime, prospective homebuyers would be wise to pay careful attention to these matters, and to make honest assessments of how well equipped your potential newhome communities are in this regard.

As we approach the season for warm weather, I spoke with Brenda Luckhardt, business-to-business marketing and development manager for Sheridan about making plans for spring.

To get you in the mood for gardening season, bring some of the outdoors inside. Luckhardt says that outdoor plants are now transitioning out of dormancy and it is possible to force blooms ahead of their normal period if brought indoors. Good choices include pussy willow, forsythia, flowering cherry and crab apples. Cut branches are often found in Gardening Centres. Luckhardt also suggests “Fresh herbs provide a taste of summer all winter. When kept in a sunny window, they can be transferred to the garden once the threat of frost is gone.”

Novice gardeners will discover many gardening websites, blogs and videos to fuel their inner green thumb.

Luckhardt recommends you also visit your local nursery for information about product and care tips suited specifically for our own hardiness zone.

I asked Luckhardt about new plants making an appearance this year. “People are always excited about adding something new to their collections. Sheridan is celebrating its 100th anniversary and has introduced many namesakes to mark the occasion: delicately fragrant floribunda rose Sheridan’s Anniversary Blush; a floriferous ninebark Mahogany Magic; Hosta Flash Forward; and a re-blooming Dwarf Lilac Purple Be Dazzled,” she says.

Many of these plants were featured at Canada Blooms in mid-March. Popular colours in gardens often follow the pantone colour of the year. This year is Emerald Green, which works with any flower hue. You only have to walk through a shopping mall to see the return of bright and bold colours in clothing and accessories. Luckhardt explains that this also translates into gardens, with more people favouring strong colour over pastels. White is always a garden staple and looks especially striking in shade. She adds that in an online survey, Proven Winners – a developer of new annuals, perennials and flowering shrubs –

learned that purple annuals won over traditional red and ever popular pink. Expect to see some new purple plants in the next few years.

As Geranium is a new-home builder, I was keen to ask what landscape planning suggestions Luckhardt would offer to the fi rst residents of a house. She responds, “Any time of year is a good time to start to plan a garden. New-home owners are fortunate to have a blank slate to work with. Creating a landscape plan can save both money and time in the long run, as plants purchased will be chosen to thrive in a specific location.

The garden can be phased as your budget permits. Of course, a design should ensure the garden will look good in all seasons.”

If you’ve never owned a home with a garden before, you might not have the tools you’ll need to get you started. Luckhardt recommends investing in tools of the highest quality, even if it means buying fewer at fi rst. “At a minimum, a new gardener should start out with a sharp digging spade, a fan rake, a garden fork, a hand trowel and a pair of bypass secateurs,” says Luckhardt. And, don’t forget a couple of good pairs of gloves!

TD’S CHIEF ECONOMIST, CRAIG ALEXANDER, ADDRESSED 90

members of the Hamilton-Halton Home Builders’ Association recently at the TD Economic Outlook Breakfast in Hamilton. Alexander highlighted the global economic slowdown and described a changing of the tides in 2013 and even greater momentum in 2014.

Worries remain about the U.S. fiscal drag, but U.S. housing prices have fi nally turned a corner. Business confidence is the key to U.S. economic growth and this also applies to Canada.

Interest rates are forecasted to remain unchanged until the third quarter of 2014 and they should only increase by half a percent point before 2015. This will support moderate economic growth across the country for the next two years.

On the subject of the housing market, Alexander explained that there are still some fears of home price over evaluation in parts of the Canadian housing market, particularly Vancouver. As well, the condo supply in the GTA is a concern for TD because of the high level of supply of new units and slowing demand. However, these concerns do not impact Hamilton.

Alexander forecasted that average home prices will increase by two to three per cent per year over the next two years in the Hamilton-Halton market. As well, there are no major signs of a price correction in our housing market.

“The market should stabilize by spring 2013 and gain some momentum

later in the year,” Alexander said.

The Hamilton housing market is in good condition and looking stable. The HHHBA is delighted to hear TD’s chief economist confi rm what we have been saying for months, which is that the Hamilton housing market is healthy and it is a great time to invest in Hamilton.

Federal budget: a hit and miss austerity style budget

The HHHBA welcomes Finance Minister Jim Flaherty’s budget measures that increase federal support for national infrastructure and improve the supply of skilled tradespeople.

This is a prudent budget aimed mostly at cutting expenses and focussing on the reduction of the deficit. There are many good intentions in this budget such as the reduction of red tape for businesses, the support for affordable housing, and the investments in research. However, we’ll see how they turn out in reality.

The attempt to increase revenues from cracking down on international fiscal evasion is also a step in the right direction, but the Minister failed to put importance on a much more specific domestic issue: the underground cash economy.

It is disappointing to see the federal government focussing its attention on international tax evasion when a simple renovation tax credit would increase the amount of legal renovations and as a direct result reduce tax evasion here at home.

Every household will need to renovate/ update their home eventually, versus very few wealthy people benefitting from tax havens. This represents a large missed opportunity for our industry.

A number of new businesses have also made their way to Oakville, bringing more than 650 new jobs and absorbing more than 411,000 sq. ft. of commercial and industrial facilities.

An historic town with a thriving waterfront, Oakville has preserved its rich heritage, with many 19th Century buildings in the downtown core. Downtown also boasts one of two local harbours on Lake Ontario, featuring more than 1,000 slips and moorings for sail and powerboats.

Bronte is the location of Oakville’s second harbour, and has an abundance of fine shops and restaurants.

Transportation *Supporting all this development is a strong and further improving transportation infrastructure. Prime location at the centre of major transportation routes – the QEW and Hwys. 403 and 407 – facilitates access to major markets in Canada and the US. The network includes toll and toll-free expressways, commuter and urban public transit, by rail and bus, national and international rail service for people and goods, global passenger and cargo aviation services, and extensive inland and international marine shipping facilities.

Illustrating how important transportation is to the city, the Town of Oakville is currently surveying residents to help identify community priorities from now until 2031.

The “Switching Gears” Transportation Master Plan is intended to deliver an exceptionally detailed level of integration between land use and transportation planning, to help identify Oakville’s transportation needs and consider a diverse range of options to satisfy future travel demands.

Says Mayor Burton: “Our goal is to offer more balanced, efficient and sustainable transportation choices for people, goods and services to move around Oakville. Public input is key to helping us focus on transportation priorities that matter most to our community.”

Switching Gears is one of several master plans that together with other key planning initiatives will create a path to a more livable and sustainable Oakville into the future, the Town says.

Developers see the growth potential in Oakville, and a number of projects are underway from companies such as Fernbrook Homes and Menkes Developments. And in nearby Hamilton, DiCenzo Homes, Multi Area Developments and New Horizon Homes have new openings, while in Burlington, Davies Smith Developments is also building. This means plenty of new-home shopping options for prospective buyers.

Culture *Oakville also boasts abundant natural attractions and culture, with more than 2,400 acres of parkland, theatres and galleries, Glen Abbey Golf Club, and the annual Waterfront Festival and Jazz Festival.

Culture in the city, in fact, received a big boost on March 24, 2012 with the grand opening of the new Queen Elizabeth Park Community and Cultural Centre (QEPCCC). Located at 2302 Bridge Road, QEPCCC offers more than 144,000 sq. ft. of active living space, making it one of the largest venues in Canada to house such a diverse collection of recreation, arts and cultural opportunities. It offers classes, workshops, camps, drop-in activities and events for all ages and abilities. The facility boasts an aquatics centre, two gymnasia, a youth centre, an older adult centre, dance studios, a recording studio, fine arts studios, a rehearsal hall, black box theatre, gallery and museum space.

“This new facility symbolizes our goal to be the most livable town in Canada, and its opening clearly demonstrates our continued progress towards that goal,” says Burton.

National SAM Awards NEW-HOME BUILDERS, RENOVA-

tors and developers from across Canada celebrated achievements in the housing industry at the recent Canadian Home Builders’ Association’s National SAM Awards presentation. The awards were a highlight of the CHBA National Conference with builders from Ontario and A lber t a receiv i ng ma ny of t he top honours.

Albi Homes Ltd. of Calgary won the prestigious Grand SAM Award. The firm also won the New Home Award for the best single-detached home over 2,200 sq. ft. in the production category and the best sales office in the Marketing Awards category. The Grand SAM is presented annually to a CHBA builder member for combined excellence in both the building and marketing of new homes.

“Each of these National SAM Award winners has demonstrated leadership and produced leading-edge products,” says CHBA President Ron Olson. “Every award recognizes an outstanding success and I congratulate all the winners.”

The CHBA National SAM Awards presented by Schlage and Trane is the premier competition for new homes, home renovations, community development, marketing and sales. The awards recognize outstanding performance in new homes and renovation design, innovative technology and construction techniques,

and outstanding marketing and sales activities. The competition is open to all new-home builders, renovator and developer members of the CHBA. An independent panel of judges selected from across the country reviews all entries.

Marketing Excellence Award

Brookfield Homes (Ontario) Ltd. of Markham won the Marketing Excellence Award for its project, Pathways in Caledon East. Creative concept and production: BAM Builder Advertising & Marketing Inc. The award goes to the CHBA builder member whose single project combines the best overall achievements in marketing. The award is based on the cumulative results attained in at least four Marketing Award categories.

Green Home Award

Effect Home Builders Ltd. of Edmonton won the Green Home Award, presented to a new home builder or developer member for outstanding environmental performance in a new single-detached home.

Community Development Award

The Community Development Award, recognizing members’ achievements in creating attractive, exciting and innovative communities, was presented to Watermark Development LP of Calgary for Watermark at Bearspaw – Phase 1.
