he best piece of advice I’ve ever heard about buying and selling real estate is very simple: don’t involve your emotions.

It may sound easy, but for most, it’s not as simple as it seems.

Over the years, having bought and sold, I’ve caught myself more than once feeling emotions edge their way into the decision making. It’s easy to see how it happens from inside the process. It’s all too common for buyers to ‘fall in love’ with a home, while sellers who have lovingly looked after their home for decades feel its worth its weight in gold. Welcoming new possibilities or saying goodbye to fond memories definitely has an emotional toll, but this can damage your bargaining position. Low-ball offers feel like a personal affront, for example, while a seller who might have negotiated price will hold firm if their agent realizes the buyers are not prepared to walk away.

This is where a good real estate agent can help guide the way. A seller’s agent can help keep objectivity, not letting a seller price their house out of the market because they confuse intrinsic value with market value. A buyer’s agent can help ensure the buyer stays within budget.

A combination of a good agent and a strong understanding of the process through research and expert advice – like the articles featured in Resale Home & Condo Guide – will help prepare you for that purchase.

Public-private partnerships an important option for improving Canada’s transportation infrastructure

C

anadian governments should increasingly consider public-private partnerships (P3s) as they confront the challenge of improving Canada’s roads, bridges, railways, and other public transportation infrastructure, argues a new report from the Fraser Institute, an independent, non-partisan Canadian think-tank.

“Canadian and international evidence shows that P3s tend to be built on time and on budget, and they typically outperform conventional infrastructure projects,” said Charles Lammam, Fraser Institute associate director and coauthor of Using Public-Private Partnerships to Improve Transportation Infrastructure in Canada.

“P3s also provide greater value for money and opportunities for innovation, allowing Canadians to benefit from higher quality infrastructure and often at a reduced cost to taxpayers.”

Using Public-Private Partnerships to Improve Transportation Infrastructure in Canada explains why P3s outperform the conventional process (whereby governments direct every phase of the project separately, including designing, building, financing, operating, and maintaining the infrastructure), dispels myths and misunderstandings about P3s, emphasizes the conditions under which P3s are most successful, and measures the extent to which P3s are currently used in Canada.

In a P3 infrastructure project, a single private-sector partner is responsible for two or more of the following tasks: design, build, finance, operation, and/or maintenance. The project usually lasts several decades.

“P3s are not a form of privatization. The public sector sets the project goals and retains ownership, while the role of the private sector is to meet the government’s quantity and quality requirements – things like highway safety or traffic flow,” Lammam said.

The report notes that the benefits of P3s come from improved incentives for the private-sector partner to provide timely and high-quality results. A key feature of P3s is that the private-sector partner takes on some of the project’s risks that would otherwise have been borne by

taxpayers. For example, if the risks of construction delays are assigned to the private partner, then the private partner has a stronger incentive to finish the project on time; if not, it loses out on some profit.

“P3 projects that include private financing for up-front capital costs motivate positive performance since the private-sector partner has its own money at risk. With payment conditional on meeting the public sector’s preset criteria and penalties levied otherwise, the private-sector partner has a strong incentive to deliver favourable results,” Lammam said.

“Assigning multiple tasks to a single private-sector partner also encourages increased quality and efficiency throughout the project’s life. After all, the private-sector partner has an interest in designing the infrastructure in the initial stage so that it is more cost effective to operate and maintain later on. These incentives do not exist in the conventional process.”

The report concludes that to ensure successful outcomes, P3s should be used selectively and employed with proper care on the part of government.

“Rather than blindly encourage the adoption of P3s, governments should focus on establishing a framework in which P3 projects have the ability to succeed and create value for money,” Lammam said.

“Critics who are fundamentally opposed to P3s often point to specific projects that are problematic and claim that specific cases discredit the P3 model. The reality is that the overall pattern of P3 projects shows them to be an effective alternative in the provision of infrastructure.”

The report notes that from 1985 to January 2013, Canada had cumulatively planned, started, or completed 59.5 transportation P3 projects (three of which are shared with the United States) at a total cost of US$44.4 billion.

Approximately 60 per cent of those projects occurred in British Columbia and Ontario.

“British Columbia and Ontario are leaders in terms of using the P3 model, but more widespread adoption could improve the design, quality, and overall management of Canada’s vast transportation systems.”

I purchased a rental investment property nine years ago. Every year I have filed the rental income on my tax return. This year I sold the property. In addition to my rental income, what tax implications will I have to report? Jared, Toronto

Hopefully, you made a profit! The real estate market has been healthy for the past several years and continues to be strong. Selling a real estate investment property will generate either a capital gain/loss and/or a recapture of income/terminal loss.

You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. A capital loss occurs when the cost is greater than your proceeds. The capital losses should be included on your personal return and applied against capital gains in that year. Any excess losses can be carried back three years, or carried forward indefinitely to reduce capital gains.

In calculating the capital gain/loss, determining the adjusted cost of the property is an essential factor. The adjusted cost must include not just the purchase price but also other costs incurred that had to be capitalized. As well, the proceeds of disposition are all the cost, including the selling price and adjustments pertaining to the sale of the investment.

In addition to the capital gains/losses, you may have a recapture of income. This occurs when you are taking Capital Cost allowance (depreciation) on the building, in any of the years that it was owned by you. The balance in this account is called the “undepreciated portion.�

A recapture of income occurs when the lesser of the proceeds and the cost of the property is higher than the Undepreciated Capital Cost (UCC). The recapture of income is taxed in its entirety at your personal tax rate. Alternatively, a terminal loss occurs when the lesser of the proceeds and the cost of the property is less than the UCC. This terminal loss can be applied in the current year to reduce other income (such as salaries or business income). Any unused amounts can be carried back three years or carried forward.

Good record keeping is essential to calculate the correct gains and/or losses.

Why are you in debt?

ften people who are in debt say they no longer want to be in debt. And often they take the steps to get themselves out. But, it seems to me, just as often people who claim they want to get out of debt do little to change their behaviour and their outcome. They keep on doing the things that got them into debt in the first place. Here are the first four of 15 questions you may want to ask about why you’re in the hole. ›› Do you buy stuff you don’t need? The biggest cue that you’ve got the impulse monkey on your back are the things you have bought but not used: the clothes with the tags still on, the shoes you have yet to wear, the new dishes you’ve used just once or twice in the six months that you’ve owned them.

Impulse shoppers are the first to admit they have a problem and the last to do anything about it. If you’re an impulse shopper, you need to remove the fuel for the impulse. That means cutting up your credit cards – or disabling them in some other fashion – and limiting the amount of cash you carry. It also means leaving your debit card at home unless you’re headed out to take care of a need: gas, groceries, etc. When you do go shopping, you have to use a list and never stray from it.

Window shopping is torture for the impulse shopper so don’t browse stores or participate in this female bonding ritual since you’re just teasing yourself by drooling over a bunch of stuff you don’t need. ›› Do you use credit to buy things you can’t afford to buy with cash? Hey, when you spend money you don’t have by using your credit card, line of credit or overdraft, you’re doing the wrong thing, plain and simple. If you can’t afford to pay for something in cash today, you should not be buying that thing, I don’t care how important you think it is, how great a deal you’re getting, or how desperate you feel.

Using credit is no way to get out of debt. Put away all forms of credit and commit to building yourself a budget that balances. If you want something, you’ll have to give something else up to accumulate the cash you need to buy it. If you can’t come up with the cash, you must not want it badly enough. ›› Do you buy things for a one-time use that you could borrow from a friend or rent? Practically everyone is guilty of this. You need something such as a sewing machine or power washer twice a year so you go and buy one and then watch it – and the money you spent, likely on credit – sit and grow cobwebs (and interest charges). What’s with us all? Do we have to own everything we ever use? In the old days, friends borrowed from each other and stuff got way more use. Now our possessions are so much a part of who we are we: a) hate to lend, and b) hate to have to admit we don’t already have one. Dumb! And why do we feel the need to apologize because we don’t have the right kind of wine glasses when entertaining guests? “Sorry, I only have these cheap glasses.” It’s a glass, for heaven’s sake!

›› Do you buy certain brands because they are a status symbol? While any car gets you from point A to point B, the high-cost, brand-name buggies come with “oohs” and “ahhs” from friends and relatives. Ditto with the D&G sunglasses, the LV handbags, the CL shoes . . . I could go on forever.

If you’re paying a premium to have a brand name, you have to ask yourself why. Is it because you don’t have confidence in your own sense of style?

Is it because you’re trying to emulate the dudes and dames of TV and movie fame, wearing what they wear, driving what they drive, eating what they eat?

How come? Is your life so sad that you’re trying to escape?

Hey, I’m all for spending your money on the things that bring you pleasure, so if you’re not using credit to make expensive brands part of your image, I’m not talking to you. But if you are using credit, what makes you think you have the right to this stuff if you can’t afford to pay for it?

Location, Location, Location BMO report shows safety, quiet street and good neighbours are top priorities for homebuyers

W

hile there are a number of factors to consider when deciding on the right location to buy a home, Canadians view the safety of a neighbourhood to be the most important (63 per cent) feature of a home’s location, according to a new BMO Bank of Montreal survey.

The survey, conducted by Pollara, also found that living on a quiet street (43 per cent), having good neighbours (30 per cent), having a short commute to work (28 per cent) and being near family and friends (25 per cent) rank high on Canadians’ list of location priorities when buying a home.

“Everyone has a unique set of personal and financial priorities, so it’s important that those particular needs are considered when deciding on the right location to purchase a home,” says Laura Parsons, mortgage expert, BMO Bank of Montreal. “Taking a practical approach to home buying is the key to preventing yourself from getting ‘swept away’ by the bells and whistles of a home. Buyers should make a list of needs versus wants and prioritize

them in order of highest to lowest importance.”

The poll also revealed that significant differences become apparent when comparing the national averages to first-time homebuyers. For instance: • Having a short commute to work is more important to first-time buyers than the average buyer (34 per cent versus 28 per cent) • Living near public transit (28 per cent versus 19 per cent) is also higher on the priority list for first-timers than repeat buyers However, living on a quiet street (30 per cent versus 43 per cent) and having good neighbours (21 per cent versus 30 per cent) are far less important to first-timers.

2. Divide by three. This figure is the monthly payment you can afford to make on your home.

3. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

4. Refer to the chart below. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers choose the 25-year amortization).

5. Multiply this figure by the amount you need to borrow.

Divide by 1,000.

6. Add to this your estimated monthly heating costs and monthly property taxes.

7. If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.
