Much like that bank commercial that says, “you’re richer than you think,” a new home may be more affordable than you originally thought. Perhaps you only need to change your definition of “home” to get into the market. While a detached home is the traditional choice, highrise and lowrise suites, lofts and townhomes have become a prime choice among first-time buyers and empty nesters in the market for new place to call “home.” Not only does condominium living afford you the opportunity to live in a prime neighbourhood at a great starting price, when it’s time to move you can often opt to remain in the same neighbourhood, since many buildings and townhome communities offer a mix of designs and sizes, which allow families to relocate easily without having to change jobs or schools. have said it before, and I’ll say it again: the province’s Places to Grow legislation was a game changer for how the GTA builds its cities and towns. The 2006 growth plan lays out the province’s vision to manage and promote growth in the Greater Golden Horseshoe until 2031. It is an important time for this discussion. We’re in the midst of an 80-day consultation with Ontario’s Municipal Affairs and Housing Minister Linda Jeffrey about what changes should be made to the land-use planning and appeals system. The minister wants input on what can be improved from the public. Zoning bylaws should be part of that discussion, and here’s why. 014 new Condo Guide dec 14, 2013 - jan 4, 2014

To accommodate the 100,000 people and 50,000 jobs that come to the GTA every year, the province encourages intensification, or the construction of new midrise and highrise homes. That’s often more easily encouraged than done: while high-density construction is underway all over the GTA, most municipalities do not update their zoning bylaws to permit the construction of all forms of development. Without proper zoning, this can cause months or years of delays in construction. What some of you may not know is that our industry is one of the most regulated in the province. Every new development introduced into a community undergoes a rigorous, multi-stage government approval process that can last up to 10 years. And who pays the price of long waits and added costs? New-home buyers. I’m afraid that NIMBYism is a big factor in preventing zoning changes. NIMBY stands for “not in my backyard,” a term that describes those opposed to new development in their neighbourhood. NIMBYists often complain about a potential increase in noise or traffic, new people joining the community or just a general fear of change. We need to plan for change, not fear. While the province mandates that municipalities’ official plans are reviewed every five years and are expected to be updated, there’s no such mandate for zoning bylaws.
It’s not a situation that can be remedied easily, but our cities and towns can pre-zone lands where intensification meets the vision of the provincial plan. And it’s difficult to set course for that new vision of building complete communities when many zoning bylaws around the GTA date back to the 1980s and 1990s, with some even from the 1950s. As a result, new development and construction avoids a long holding pattern: a builder doesn’t have to go through several development applications, or apply for a zoning bylaw application which can be a very political process. With proper zoning in place, building new homes becomes a streamlined exercise for all stakeholders: the general public, developers, land owners and the municipalities. And most importantly, buyers get into their new homes sooner, perhaps by a year or two, and avoid the added costs that come with delays. All of us can benefit from the province’s vision.

BILD’s Party for Humanity is one of four major fundraisers for Habitat for Humanity Toronto
The Building Industry and Land Development Association (BILD) held its fifth annual Party for Humanity and raised more than $20,000 for Habitat for Humanity Toronto, as the industry celebrated helping 10 Habitat families into 10 homes in 10 years. The event was attended by more than 400 industry professionals, who arrived at Muzik nightclub at Exhibition Place in Toronto, dressed according to the theme: jeans, jackets and jewels. Fundraising efforts were aided by a silent auction and raffle. Those who entered the raffle were given gold, red and green beaded necklaces. “This event has been a tremendous success every year, and this year was special because we’ve helped build 10 homes in 10 years with Habitat for Humanity Toronto. November housing starts Housing starts in Canada were trending at 194,014 units in November compared to 195,274 in October, according to Canada Mortgage and Housing Corp. (CMHC). The trend is a six-month moving average of the monthly seasonally adjusted annual rates (SAAR)1 of housing starts. “The trend in housing starts has increased slightly since July, before stabilizing in November. Overall, housing starts have been following a trend similar to sales on the existing home market. As sales rise relative to listings of existing homes, buyers are increasingly meeting their needs in the new-home market,” says Mathieu Laberge, deputy chief economist at CMHC. CMHC uses the trend measure as a complement to the monthly SAAR of housing starts to account for considerable swings in monthly estimates and obtain a more complete picture of the state of the housing market. In some situations analyzing only SAAR data can be misleading in some markets, as they are largely driven by the multiples segment of the markets which can be quite volatile from one month to the next. The standalone monthly SAAR was 192,235 units in November, a decrease from 198,161 in October. The SAAR of urban starts decreased by 3.4 per cent in November to 171,347 units. Multiple urban starts decreased by 3.5 per cent to 111,036 units in November while the single-detached urban starts segment decreased by 3.1 per cent to 60,311 units. In November, the seasonally adjusted annual rate of urban starts increased in British Columbia and the Prairies, were essentially unchanged in Quebec, and decreased in Atlantic Canada and Ontario. Rural starts2 were estimated at a seasonally adjusted annual rate of 20,888 units. 1 All starts figures in this release, other than actual starts and the trend estimate, are seasonally adjusted annual rates (SAAR) — that is, monthly figures adjusted to remove normal seasonal variation and multiplied by 12 to reflect annual levels. By removing seasonal ups and downs, seasonal adjustment allows for a comparison from one season to the next and from one month to the next. Reporting monthly figures at annual rates indicates the annual level of starts that would be obtained if the monthly pace were maintained for 12 months. This facilitates comparison of the current pace of activity to annual forecasts as well as to historical annual levels. 2 CMHC estimates the level of starts in centres with a population of less than 10,000 for each of the three months of the quarter, at the beginning of each quarter. During the last month of the quarter, CMHC conducts the survey in these centres and revises the estimate.

After a lengthy conversation with your neighbour, you realize nothing is going to change and you are faced with the horrible future of sleepless nights, interrupted dinners and a home life that is a mess. What are your rights?

The first thing to do is what you already did: you speak to the offensive occupant and then put your complaint in writing. Wait a reasonable time and then send a second letter, keeping copies of each. If you get no results, the time has come to write to the condominium corporation and ask them to enforce the rules and make the noise stop. Generally, the condo has the full power to require the offensive unit holder making excessive noise to install carpet, cease and desist, change hours of dance, or some other solution to the noise problem. Give the condo corporation a reasonable time to effect compliance and send another letter. If, after a number of attempts, the condominium corporation does not comply, it is time to seek a lawyer’s assistance. Your lawyer will force the condominium corporation to enforce its bylaws. On Jan. 18, 2013 the Supreme Court of Ontario decided this point. In the case of Dyke v. Metropolitan Toronto Corp. No. 972 [2013] O.J. No. 301, Mr. Justice E.M. Morgan dealt with such an issue. The facts in their simplest form were that a unit holder on the floor below was subjected to the unit occupant above running a dance studio on wooden floors. Justice Morgan found that the condominium corporation “breached its duty to ensure compliance with its own bylaws and rules.” Justice Morgan ordered the condominium corporation to take all reasonable steps to ensure compliance with its bylaws and rules. In other words: make the offending unit occupant comply. The condominium corporation was ordered to pay special damages in this case. The conclusion is this: you have a right to quiet enjoyment of your unit provided the bylaws or rules support your position.

ondominium ownership differs from lowrise homes in many ways, especially where fees are concerned. Those entering into condo ownership for the first time will do well to understand exactly what these costs are, and what they cover. One of the most misunderstood expenses is the interim occupancy fee. When your lowrise home closes and you move in, you officially own it. With a condominium, depending on when in the sales/construction process you purchase, you will most likely enjoy occupancy long before you receive the title to your suite. Unless you move in after the condo is registered, you do not own your suite outright. You enter into what is referred to as “interim occupancy.” This is the gap between the occupancy date given to you once roof-topping has occurred, and when the condominium is registered and you receive title. Until that time, the suite is still owned by the vendor.

In Ontario, a “condominium” is not formed until it is completed and passes the approval processes that enable it to be registered with the Land Registry Office. In highrise condos, the lower floors are finished long before the upper levels, but the approvals process begins once the first suite is occupied. It typically takes up to six months, although sometimes it can be quicker. During this time, you will pay an occupancy fee to the developer. This fee encompasses three elements. First, it is determined by the interest portion of the balance owing on the purchase price (usually payable on the registration date) based on a one-year mortgage rate of the Bank of Canada. Second, it includes the estimated maintenance fees for the suite, and third, its portion of the estimated real estate taxes. There are also other fees such as the enrollment of your suite with Tarion Warranty Corp. You may think of this as rent, but it is not considered rent, and it is not money that can be applied toward your mortgage. Once the title is transferred, you take out your mortgage and the builder/developer receives the money. The benefit to the suite owners is that you get to move in more quickly and not have to wait until registration. You have a substantial amount of notice before your occupancy date. Remember that during interim occupancy, you must have your homeowner’s insurance in place, and you have to arrange for utility hook-ups as if you own the home. Your appliance warranties kick in upon occupancy because you are actually using them, and your Tarion warranty is officially in place. Keep in mind that your maintenance fee dollars provide a lot of value. For one thing, they enable exterior and interior elements to be kept looking beautiful and in good repair. To be fair, consider what you would have to spend to receive the same service in a lowrise home. Most condominiums today offer 24/7 concierge service, and these professionals have to be paid. Those who choose to add a security system to their lowrise home pay a monthly fee for monitoring. In a lowrise home, chores such as mowing the lawn, weeding the garden and washing the outside windows have to be done by someone, and hiring professionals is an expense. In addition, the ongoing cleaning and maintenance of things like condominium elevators, the lobby and hallways are covered by your fees. A portion also goes toward the “reserve fund,” which is administered by the condominium board. This fund ensures that essential services can be paid for in the future, should unexpected problems arise after Tarion Warranty coverage is over. In some condominiums, a percentage of maintenance fees covers utilities. Nowadays, many condos provide individual hydro and water metering per suite, which means that buyers pay only for what they use. The important thing is to ask questions about the fees that are expected of you and what they cover, and then make your condo purchase decision accordingly. An educated shopper makes a happier owner.

Condo Market in 2014 was going to be an absolutely dismal year for new-condo sales. It turns out that 2013 was actually a pretty good year, and the past few months in particular have shown that large condo buildings can still sell out quickly if the conditions are right. Developers that I speak to every day are heading into 2014 feeling much more confident and ready to launch many exciting new projects.

2. Competitive pricing The condo projects that did extremely well and sold the most number of units in 2013 were those that priced their product in line or below that of their resale equivalent. The projects that languished the most in 2013 were mostly those whose pricing was more in line with the record breaking days of 2012 where investors were willing to pay large premiums above current resale values to get into pre-construction sites. Now a full year removed from those crazy days of 2012, developers have for the most part realized that if they offer truly great value to investors, they will buy. If investors don’t clearly see the value equation, they are passing over sites completely – especially those in “B” locations. 3. Re-launching existing projects Some of the projects that did not sell well in 2013 will likely re-launch under new names or with new branding and with new pricing and/or incentives. As long as the value is there for investors, these projects will still perform well. Investors don’t care if it’s called ABC Condos or XYZ Condos, as long as they see the potential for a good return on their investment dollar, they are happy.

Here are three themes that I see emerging as the condo market heads into the new year. 1. More new launches For the new condo market, in many ways 2013 turned out to be a much better year than was expected. So many of the so called “experts” were saying at this time last year that 2013

Can your home equity be part of the solution? Let me share the story of a client of mine – we’ll call him Dave. Dave is in his early 40s with a house and young family, and works in a great industry with a well-paying job. But like many Canadians, Dave has concerns over long-term job security and his long-term pension needs. He has allocated some savings to his Retirement Savings Plan and other investments, but has decided that buying one or two rental properties would be a great way to supplement his current pension. Of course, a big question is affordability. Since Dave lives in a suburb of Vancouver, a greater concern was the inability to find a profitable investment property, given the high cost of housing where he lives. I suggested that he review his family budget. We looked at how much money he could afford to invest on a monthly basis over and above what the family was currently spending. His answer was between $300 and $400. You may ask, how can anyone afford to buy a property with only $300 or $400 a month? Consider the following:

In Dave’s case, $190,000. (I don’t want Dave or his wife to feel over-leveraged, so we’ll only use $100,000 of the accessible equity.) › We set up a new mortgage/line of credit (LOC) on their home based on 65 per cent of their house value – an amount both Dave and his wife are comfortable with. This structure provides Dave with $100,000 of “investable capital” from his home equity. › Dave can use the $90,000 as a down payment on a $400,000 rental property and keep $10,000 from the LOC to place in a contingency fund. You might say this is going to cost a lot more than $300 a month. Just the interest alone on the down payment of $100,000 is more than $300 a month. The answer to this is Yes, and No. When buying an investment property, the down payment is typically considered the main expense. However, Dave and I analyzed the true out-of-pocket expense of making this purchase. Real estate, unlike many other investments, has the potential to create revenue. The amount of monthly rent you can collect for a $400,000 purchase will vary greatly depending on the city, so we’ll be conservative with the numbers we use. Remember, Dave was willing to invest between $300 and $400 per month in additional money out of the family budget. So let’s break this investment down to see what the true monthly cost is:
Let’s assume a monthly rental income of $2,000 (which is very possible in many parts of Canada).
We would access $100,000 from a LOC on the principal residence. We would take $10,000 of that and set it aside in a “contingency fund.” This is equal to roughly five month’s rent. We would have a new first mortgage on the rental property for $310,000. Monthly expenses:

Again, assuming the above scenario, the only amount of money that would actually be coming out of Dave’s family budget to make this investment purchase part of his long-term financial goal is $324 a month. Hopefully, you made a profit! The real estate market has been healthy for the past several years and continues to be strong, over the long term. Selling a real estate investment property will generate either a capital gain/loss or a recapture of income/terminal loss. You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. A capital loss occurs when the cost is greater than your proceeds. The capital losses should be included on your personal return and applied against capital gains in that year. Any excess losses can be carried back three years, or carried forward indefinitely to reduce capital gains. In calculating the capital gain/loss, determining the adjusted cost of the property is an essential factor. The adjusted cost must include not just the purchase price but also other costs incurred that had to be capitalized. As well, the proceeds of disposition are all the cost, including the selling price and adjustments pertaining to the sale of the investment.
You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. In addition to the capital gains/losses, you may have a recapture of income. This occurs when you are taking Capital Cost allowance (depreciation) on the building, in any of the years that it was owned by you. The balance in this account is called the “undepreciated portion.� A recapture of income occurs when the lesser of the proceeds and the cost of the property is higher than the Undepreciated Capital Cost (UCC). The recapture of income is taxed in its entirety at your personal tax rate. Alternatively, a terminal loss occurs when the lesser of the proceeds and the cost of the property is less than the UCC. This terminal loss can be applied in the current year to reduce other income (such as salaries or business income). Any unused amounts can be carried back three years or carried forward. Good record keeping is essential to calculate the correct gains or losses.

This usually starts with the sales office itself, and in the case of condominiums, will include common areas such as lobbies and party rooms. If you’re currently shopping for a new home, you likely already have, or soon will compile a list of “must-haves.” Your must-have list is essential to understanding what you absolutely need in order to feel comfortable in your new home. It is fairly easy to assemble when you consider what does and doesn’t work in your current living environment. Although the recipe has changed with the times, paint is still an essential part of any interior – and an element that has long outlasted trends and technology to remain one of the easiest and most powerful ways to set the stage for a beautiful interior design.

TIP: Light colours naturally reflect more light, while darker ones absorb light and will appear more flat. Keep this in mind when choosing a finish: white paint in a glossy finish becomes highly shiny and will reveal the smallest flaws, so you may want to stick to satin or matte. To help you create your own condo palette with confidence, here’s my guide to choosing the best paint, from start to finish. It’s easy as 1-2-3!
1. Start with the finish Matte or “flat” paint has the least
sheen. It reflects very little light, and thus hides imperfections on a wall surface. It’s the traditional finish for rustic looks, but has also become trendy for modern schemes. Also common for ceilings. Matte finish paints are more difficult to maintain. Satin is partially glossy with a slight sheen. It’s great for adding slight depth while still minimizing imperfections, like matte. (I often use matte for the main surfaces and satin for trim and doors.) Eggshell is halfway between matte and glossy. It’s a popular go-to for homeowners as it balances the pros and cons of each. Semi-gloss carries a definite, noticeable sheen. It can withstand repeated cleanings, great for moist areas such as bathrooms, or for trim in high-traffic areas like children’s rooms. Visible changes in the way light bounces off dents or bumps will make imperfections more obvious. It’s great for giving ceilings extra light reflectiveness, brightening a room.
Gloss is highly reflective with lots of sheen, and generally harder to apply due to the slow drying times (which can cause dripping and unevenness when applied without professional equipment). It’s easy to clean, but the high degree of sheen will make any dents or bumps stand out dramatically. Use it sparingly (such as on trim, or on brand new, flawless ceilings) and only on surfaces which have been carefully sanded and prepped.
2. Composition The main difference between water-based paint and oil-based paint is the substance used to carry the pretty pigments in liquid for application. In both cases, these liquids evaporate while drying to leave a solid coat of colour on your walls and surfaces. Water-based paint Latex and acrylic paints use water to dissolve the mixture of pigments and binders (that is, the glues that hold the pigments together), which creates less of an odour during application. These paints are usually easy to touch up, hold colour well over time, and are less flammable. Oil-based paint Alkyd paints use pigment and resin dissolved in a thinner, which dries to a harder coating but creates far more fumes during application than waterbased paint does. These paints generally create a smoother and more level finish, with fewer brush and roller marks.
3. Top Tips Knowing what type of paint to select is of course only half the battle. Once you’ve found a beautiful finish, you have to select an equally striking colour. There are infinite hues from which to choose, and every space calls out for a unique scheme. Look at the big picture
Although every room in your house is unique, the happiest homes see each space living in harmony. Consider the view from a long hallway to get a sense of how rooms relate. When you look down a corridor, notice what connected areas you can see through the doorways. These spaces don’t have to match, but they should coordinate. Look at paint chips for different rooms next to each other to see if they add up to one beautiful picture. The bigger, the better
Professionals will have a painter apply large “colour strikes” (wide test stripes) in a room to see a few options in person before making a final selection. If this sounds like too drastic of an experiment for you, you should still go bigger than a tiny paint chip to get a real feel for the hue at room scale. Purchase a plywood plank and some small cans of a few options, and paint yourself a tester you can move around; or look for paint companies that offer large-format paint chips (such as Benjamin Moore’s Big Chips from bigchips.ca). Start small
One of the safest ways to take a risk with colour is by starting out small. If you love a colour you aren’t sure you can live with, make your first leap into colour in a smaller room that you don’t spend as much time in, such as a foyer, a walk-in closet or powder room. These in-an-out spaces suit a strong colour, and if you really love the hue you can carry it out to the main areas later (or go a shade lighter).

There are certain colours I return to time and time again, because they work in almost any space without fail. If you find a favourite colour, don’t be ashamed of using it in every room. Each space can be made unique by applying different accents for contrast in your furnishings, fabrics and art – the noncommittal accessories that add interest. I frequently recommend Benjamin Moore’s OC-23 Classic Gray as a neutral with depth that makes any space sing. Pair this with their 2121-70 Chantilly Lace (a very clean and pure white) and HC-168 Chelsea Gray (a sumptuous essential grey) for crisp ceilings and rich accents, and you’ll have a foolproof scheme, stress-free. But with a little proactive planning, the holidays don’t have to derail your entire fitness regime. The key is to start early, so that when those events do roll around, you’re already ahead of the game. If you’re a regular fitness star, now is the time to amp up your workouts with some additional cardio and maybe an extra yoga or cross-training session each week. If you’ve been letting your fitness slip, then make an effort to get back into a regular routine of three to five training sessions a week, with a mix of cardio and resistance training. 5 tips to combat post-workout pain
› Always warm up your muscles by doing a short cardio warm-up for
five to 10 minutes before starting any exercise program. › Rock n’ Roll – Roll your muscles out on a foam roller pre and post workout. It will reduce the lactic acid effect and help speed up recovery. › Stretch – It’s tempting to skip a post-workout stretch, but just a few minutes of stretching can increase flexibility and mobility while your muscles are still warm. › Soak it up – If you’re really feeling the burn, relax your muscles with a warm epsom salt bath. This drugstore find will help reduce inflammation, relieve pain, and relax your body. Candles optional. › Ice – It’s a chilly alternative, but icing the area can help reduce swelling and speed recovery by up to 20 per cent according to some studies.

t’s that time of the year – friends are gathering, family is visiting, the food is cooking, and you are hosting that highly anticipated holiday event. In our house, the holiday party is a not-to-miss affair. I take this season very seriously and expect nothing less from my guests. It’s the one time of the year when everyone clears their schedules and unites together. Plan your holiday décor in advance. Decorating for the holidays goes beyond just dressing your tree and hanging the lights. It also means setting your festive table, decorating your entrance, and creating a holiday atmosphere around your home – especially if you are expecting guests. Prepare yourself for the amount of guests coming, the length of their stay, and how many events you’ll be hosting. If you’re not hosting but rather attending, you still may want to dress your home for the holidays. The same principles apply to decorating your home from day to day, as they do to decorating your home for the holidays. The most important rule of design is consistency. Allow your holiday décor to reflect a new season and embrace the spirit of the holidays.

When it comes to tabletop décor, a real statement comes from adding volume and height with various vignettes. Want to try a new spin on traditional hues? You can incorporate royal jewel tones like emerald green and deep amethyst with silver accents and create your own classic design. However, if it’s fresh and modern décor you’re ready to implement, try black and white punctuated with crystal accessories or gold finishes. Incorporate things that are simple with something special. It could be your grandmother’s antique china mixed in with modern flatware, or historic family ornaments displayed in new apothecary glass vases. When it comes to tabletop décor, a real statement comes from adding volume and height with various vignettes. If you want to leave your dining table strictly for tableware, then decorate around the room or on the buffet table. You can add one large centrepiece in the middle and several smaller ones around the room or across the table. While flowers are typically thought of as common centrepieces, we like to add contemporary details like birch trees cut down to size, faux antlers, lots of candles and even fur throws on dining seats. When Kevin Bautista decided it was time to buy his first home, he did a lot of research. 06 Add to this your estimated monthly heating costs and monthly property taxes. 07 If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream condo.
