B

uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Why transit is crucial to housing

As we tackle transportation and infrastructure challenges, proximity to transit is increasingly key

I

f you’ve been following the debate over transit expansion in the GTA, you’re likely well aware of just how important a topic this is to the city and its residents. It’s not about political agendas, a mayor combating the TTC chair or one party against another. The transit issue is critical to the future of the city. This is why various home building associations and other organizations see some promise with the latest federal budget tabled on March 21, in which Finance Minister Jim Flaherty promised increased funding for infrastructure improvement. Proximity and access to transit and amenities – from health care to schools to shopping to recreation – are critical for builders and buyers alike. Development charges for developers to build new communities, and help fund infrastructure growth, need to be reasonable, so as to deliver new-home prices to buyers that are affordable. It will take months, if not years, for new funding to reach municipalities, and that’s assuming cities such as Toronto can agree on a transit expansion plan. In the meantime, prospective homebuyers would be wise to pay careful attention to these matters, and to make honest assessments of how well equipped your potential new-home communities are in this regard.

Specific development charges rates vary across municipalities but the combined residential rates can range from $12,000 to over $63,000 per home. The over-arching legislation that exists to regulate the collection of these funds is the Province of Ontario’s Development Charge Act. The Act sets out a process for municipalities so that they can pass their own Development Charges By-laws. These by-laws are accompanied by a background study, which outlines the estimated amount, type and location of development within a municipality, and the related calculations of how the new development will affect municipal services like water, wastewater and roads. Nurseries (sheridannurseries.com) has been Geranium Homes’ supplier of choice for beautiful outdoor planters as well as seasonal decor for our model homes and sales centres. As we approach the season for warm weather, I spoke with Brenda Luckhardt, business-to-business marketing and development manager for Sheridan about making plans for spring. To get you in the mood for gardening season, bring some of the outdoors inside. Luckhardt says that outdoor plants are now transitioning out of dormancy and it is possible to force blooms ahead of their normal period if brought indoors. Good choices include pussy willow, forsythia, flowering cherry and crab apples. Cut branches are often found in Gardening Centres. Luckhardt also suggests “Fresh herbs provide a taste of summer all winter. When kept in a sunny window, they can be transferred to the garden once the threat of frost is gone.” Novice gardeners will discover many gardening websites, blogs and videos to fuel their inner green thumb. Luckhardt recommends you also visit your local nursery for information about product and care tips suited specifically for our own hardiness zone. I asked Luckhardt about new plants making an appearance this year. “People are always excited about adding something new to their collections. Sheridan is celebrating its 100th anniversary and has introduced many namesakes to mark the occasion: delicately fragrant floribunda rose Sheridan’s Anniversary Blush; a floriferous ninebark Mahogany Magic; Hosta Flash Forward; and a re-blooming Dwarf Lilac Purple Be Dazzled,” she says.

Many of these plants were featured at Canada Blooms in mid-March. Popular colours in gardens often follow the pantone colour of the year. This year is Emerald Green, which works with any flower hue. You only have to walk through a shopping mall to see the return of bright and bold colours in clothing and accessories. Luckhardt explains that this also translates into gardens, with more people favouring strong colour over pastels. White is always a garden staple and looks especially striking in shade. She adds that in an online survey, Proven Winners – a developer of new annuals, perennials and flowering shrubs – learned that purple annuals won over traditional red and ever popular pink. Expect to see some new purple plants in the next few years. As Geranium is a new-home builder, I was keen to ask what landscape planning suggestions Luckhardt would offer to the first residents of a house. She responds, “Any time of year is a good time to start to plan a garden. New-home owners are fortunate to have a blank slate to work with. Creating a landscape plan can save both money and time in the long run, as plants purchased will be chosen to thrive in a specific location. The garden can be phased as your budget permits. Of course, a design should ensure the garden will look good in all seasons.” If you’ve never owned a home with a garden before, you might not have the tools you’ll need to get you started. Luckhardt recommends investing in tools of the highest quality, even if it means buying fewer at first. “At a minimum, a new gardener should start out with a sharp digging spade, a fan rake, a garden fork, a hand trowel and a pair of bypass secateurs,” says Luckhardt. Whether you are a young couple

or individual purchasing a new home for the first time, a resale buyer moving in the market or an empty nester purchasing a retirement condominium, the very action of this significant investment in real estate represents a major life change. There are a number of issues that you should consider at this time in order to ensure that your “house is in order.” 1. How will I hold the “title?”

When your lawyer goes to the Registry Office to hand over all of your money to the builder in order to buy your home, he receives, in return, a document called a deed or transfer, which he registers by filing with the government; the document has your name is on it to show you own the home. This action gives you title to the property. If more than one person is buying the property it is necessary to decide how they will hold title together. There are two ways people can hold title together. The first is generally the way we hold title with our spouses or children, which is called “joint tenancy.” To hold title as joint tenants really means that upon the death of one of the parties, the remaining party automatically becomes the owner of the whole property without having to inherit it or have it pass through an estate. The reason is simply that all owners on title own the whole property rather than a part each. The other way title can be held is as “tenants in common.” This means that each party only owns the percentage allocated to them, although the physical part owned is not described. Upon the death of a tenant in common, his or her percentage ownership goes to their heirs in accordance with their will or law. Therefore, remember to discuss this issue when you go to see your lawyer. 2. What about a will? A power of attorney?

Do you have a will? If you do, is it up to date and does it represent your current situation or state of affairs? It is important, especially if you have young children, to have your wills completed; not so much for the money, but for a clear resolution of the issue of custody if something happens to both parents. care of who will look after children, keeps the government out of your affairs, allows for an orderly disposition of everything from your favourite cuff links or earrings to your realty, stocks and bonds, and will allow you to determine how you are to be cremated, buried or quick frozen. A power of attorney is used when you are physically or mentally incapacitated – there are two kinds. The first is for your body, such as what care will you or will you not receive? Your representative will determine that. The other is for the management of your financial affairs. Now is the time to create a will. Speak to your lawyer and ensure that this important matter is dealt with. 3. What about insurance?

You will need insurance for the house. This a great time to look at life and disability insurance. It is also a good time to determine if you should be insuring your mortgage in case something happens to the major wage earner; and to ensure that the future is taken care of. So there you have it, this is the time to take care of all of these kinds of things to get your house in order. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. The Canadian Home Builders’

Association (CHBA) recently honoured leadership and accomplishment among its membership with the presentation of awards at the 70th CHBA National Conference. The Beaver Award, presented to the outstanding builder member of the year, went to Rick Gratton of the CHBA-Calgary Region. Karen Kinsley, President of Canada Mortgage and Housing Corp. (CMHC) won the Maple Leaf Award as the outstanding nonbuilder member for 2012. Jane Morgan of the CHBA-Newfoundland & Labrador won the prestigious Gordon S. Shipp Award in recognition of leadership, dedication, and continuous lengthy service to the CHBA at the national level. The Colonel Boss Trophy, presented to the home builders’ association making the greatest progress and achievement compared to the previous year, went to the Regina and Region HBA. The Community Service Award for the betterment of the way of life of people in its community went to the CHBA of Central Nova. The Harry J. Long Memorial Trophy for the highest increase in membership was awarded to the Building Industry and Land Development Association (BILD) of Toronto. The Dave Bell Memorial Award for the promotion of education and training programs for members and consumers went to the CHBA-British Columbia. The Canadian Renovators’ Council Award for a significant contribution to the renovation industry and leadership within the Association went to Juanita Carhart of the CHBA-Sussex, New Brunswick. The William M. McCance Award for outstanding contribution to the home building industry in the technical area went to Thomas

The R-2000 Builder of the Year Award, recognizing outstanding leadership in the construction of R-2000 homes, was presented to Steven Crowell of the Annapolis Valley HBA. The Riley Brethour Award, recognizing contributions at the national level in marketing and sales was presented to Jack Baillie of the Waterloo Region HBA. Executive Officers’ Council Awards

The Dave Stupart Award of Honour for the Executive Officer of the Year (full-time) went to Stu Niebergall of the Regina & Region HBA. The award for the Executive Officer of the Year (part-time) went to Jan Field of the CHBA-Fraser Valley. The Ken McKinlay Award for excellence in communication for associations of more than 100 members went to Victoria Belbin of the CHBANewfoundland & Labrador. The award for associations with fewer than 100 members went to Stacy Cooper of the Guelph & District HBA. The Susan Chambers Award of Recognition for the initiation and development of non-dues sources of revenue was presented to Donna Moore of the CHBA-Calgary Region.

Follow these steps to see if you’ll qualify for a mortgage on your dream home

Calculate the combined monthly before-tax income of you and your spouse.

Multiply this figure by the amount you need to borrow. Divide by 1,000.

Divide by three. This figure is the monthly payment you can afford to make on your home.

Add to this your estimated monthly heating costs and monthly property taxes.

Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.
