How to find the right home?
Knowing what to look for – and where – are crucial parts of your new-home search
O
nce you’ve decided to buy a new home, the excitement begins to build immediately. Where to buy? What type of home? Is now the right time? The answers to such questions will vary from person to person, depending on individual circumstances and needs. Choosing the type of home you can afford, and what finishes and design features you want, might be the easiest part of the process. A little more challenging, but nonetheless equally important, are matters such as finding a community in proximity to amenities such as shopping and schools, commuting times and transit options, and if your new home will still be suitable in three, five or 10 years. As for the timing of your purchase, it’s natural to wonder whether now is the best time, given all the discussion about market conditions. But if your employment and finances are secure, you’re best served looking at the long term – say seven years. Where are new-home prices likely to be then? Higher or lower? And if you missed out on building equity by delaying your purchase, would you be better off? Another factor to consider is your new-home warranty. This issue, on page 40, we introduce a new monthly column – the Tarion Report, by Howard Bogach, president of Tarion Warranty Corp., the company charged with protecting the rights of new-home buyers. With his contribution and other related content, we hope you’ll begin to determine your own answers to these questions.

BILD presents Member of the Year and Chair’s Award of Merit Two members of the Building
Industr y and Land Development Association (BILD) have been recognized for their tremendous contribution to both the industry and the Association in 2012. With 400 guests in attendance at the annual Chair’s Dinner on Feb. 6, 2013, outgoing BILD Chair Paul Golini presented the prestigious BILD Member of the Year award to Cindy Lloyd and the Ch a i r ’s Awa rd of Mer it to Gary Gregoris. Cindy Lloyd, advertising sales manager at the Toronto Star and BILD board member was named BILD Member of the Year for her volunteerism, participation and commitment. Lloyd is behind such Association successes as the award-winning fundraiser “Race for Humanity,” and “Shift Happens,” an eight-part civic awareness newspaper series. “Cindy has gone above and beyond expectations as a member of the BILD Board of Directors, showing that she can accomplish anything she puts her mind to and it’s always in the best interest of the Association and the industry,” says Golini. Grey Gregoris, senior vice-president of land at Mattamy Homes was awarded the Chair’s Award of Merit. This award is bestowed upon a member whose contribution has made a significant difference to the Association and the industry. “Gary is a long-standing BILD Board member and he has dedicated years of volunteer service on the advocacy side of the Association,” says Golini. Last year, my wife and I welcomed her elderly parents into our home. They lived in north Simcoe and we are in Richmond Hill. They loved their home; unfortunately they can no longer maintain it on their own. We can financially and physically help them in their senior years. Can we deduct the money we give them for living expenses? Where and how on our tax return? Ron and Beth, Richmond Hill

The Baby Boomer generation may have to put condo living on hold for several years. Many boomers have the financial responsibility of not just university kids but aging parents too. Our generation (myself included) is blessed with having the people most close to us at home – children and parents. Unfortunately, neither Mr. Harper nor Mr. McGuinty provide a deduction for your financial assistance. However, they do provide a “caregiver” tax credit. You may qualify to claim a $4,223 federal tax credit and a similar provincial amount. This will reduce your federal and provincial income taxes by $633 and $210 respectively. You should note, parents must be at least 65 years old and mentally or physically dependant on adult children.

My kids attend pre-school and elementary private institutions. The cost is astronomical but my wife and I believe it is best for our kids. How much of the tuition may I deduct and how? Wong, Markham

Generally, private school tuition is not tax deductible. An attempt was made several years past to deduct private school tuition; however it was politically unpopular and was reversed the following year. Fees to education institutions may be deductible as childcare and claimed by the lower income spouse. A receipt must be provided by the school for the portion of the fees that are considered “childcare.” Additionally, depending if there is some religious affiliation, part of the fees may be allocated as a charitable donation. Again, the institution must provide receipts and qualify for charitable status.

I recently sold a real estate investment property. How much income tax will I pay? I calculated I made approximately $80,000. Karim, Mississauga

Generally, real estate that is sold for more than its cost may result in a capital gain for the individual. Fifty per cent of the gain must be included in your income tax return in the year of sale. Using your figures and assuming you have other income, such as from employment, we can use a 40-per-cent tax rate. Therefore, the $80,000 capital gain is reported. Forty thousand (50% of the gain) must be included in income. This is taxed at 40 per cent. Your tax obligation on the gain is $16,000 (40,000 x 40%) to Canada Revenue Agency. Consult your accountant/tax advisor before committing to pay any income taxes.

investment you ever make. Think about that... Why, you ask? The answer is that in my 35 years of practicing law, I have seen young couples spend more time researching a new telephone than a new home! The most important advice I can give, and if you take anything from this article, it is this: research everything ahead of time, such as prospective builders, areas, amenities, property taxes, lawyers, your financial ability, zoning, bylaws and neighbours. And don’t allow yourself to be pressured by anyone. What can you afford?
Review your available cash for deposit and annual income to pay a mortgage and expenses. Once you have done that, speak to the mortgage specialists at the bank you deal with and speak to a reputable mortgage broker. Companies such as the Mortgage Centre in Mississauga and Mortgage Providers in Toronto have the experience and integrity to get you the best deal. Find out how much money you can borrow and how much of a deposit you’ll need to put down. This will allow you to focus on homes you can afford. Get a pre-approval in writing so you have something to rely on, because especially today, it is critical that you do not get caught up in the rush of buying a house that is beyond your budget.

Ensure that you arrange a pre-agreed fee with the solicitor. Get the fees locked in. Also, make sure you get a free offer review. Then have your lawyer provide you a list of disbursements – those monies expended on your behalf necessary to properly search and close the transaction. This is where some lawyers may try to charge large fax, mail and photocopy fees. Make your lawyer justify all expenditures that don’t make sense. Miscellaneous
Do you want a condo or a freehold?
Condo living provides a carefree lifestyle – someone else cuts the grass and shovels the snow – but you pay additional monthly common expenses and sometimes others determine how the amenities, if not your unit itself, can be used. Freehold provides the freedom to do what you want, but maintenance and upkeep fall on your shoulders. The choices are boundless. Once you determine what kind of home you want, you need to decide new or resale. If new, the offers are long and filled with clauses that could cost you money or result in long delays. Be sure to see an experienced real estate lawyer familiar with these kinds of agreements before it is final and no longer conditional. Research the builder and go to other sites the company has done and ask people about quality and after-sales service. Find the right lawyer

Do you have a will? If you do, is it up to date and does it represent your current situation and state of affairs? A will prevents sibling disputes, clarifies who will look after children, keeps the government out of your affairs, allows for an orderly disposition of everything from possessions to your realty, stocks and bonds, and will help guide your funeral arrangements. You will also need insurance for the home. This is the right time to look at life and disability insurance, to determine if you should be insuring your mortgage in case something happens to the major wage-earner. As you can see, there is a lot to consider when buying your first home. Being prepared will help you enjoy the experience and find that dream home.

Welcome to my first column in New Home Guide.
I’m excited to have this opportunity to share information about your home’s warranty. If you have questions about what you read or there’s a topic you’d like me to cover, please drop us at note on our Facebook page at facebook. com/TarionWarrantyCorp. When buying a new home, there are many decisions to make: downtown or suburbs, two bedroom or three, hardwood or laminate. But the one decision you don’t have to make is about your new home’s warranty. That’s because almost every new home sold in Ontario comes with a builder’s warranty, backed by Tarion. The warranty process starts before your builder even breaks ground, and lasts for seven years from when your new home is completed and ready for possession. Although it is often lumped into one warranty for simplicity’s sake, in reality, just about all new homes in Ontario come with deposit and delayed closing protection, in addition to three separate warranties that provide different types of coverage at different points in the life cycle of your home. Your deposit protection and delayed closing protection begins before you move in. Deposits are protected up to a maximum of $40,000 for freehold homes in the event that your builder goes bankrupt, breaches the purchase agreement or in situations where you are legally entitled to back out of the purchase agreement before closing. Deposits made on condominiums are protected for similar circumstances, up to a maximum of $20,000. Deposit amounts exceeding that are protected under the Condominium Act. The delayed closing and occupancy provision means your builder guarantees that your home will be ready for move-in either by a date specified in the purchase agreement or by a date that has been properly extended if circumstances occur that delay the home’s completion. In many cases, your builder will be required to compensate you if a delay occurs. The one-, two- and seven-year warranties begin when your home is 40 New home guide GTA | marCH 2 - 16, 2013

complete and ready for possession. The oneyear warranty covers defects in work and material, protects against unauthorized substitutions and ensures your home is fit for habitation and constructed according to the Ontario Building Code. The first-year warranty includes almost everything inside and outside your home that was provided by the builder, from flooring to drywall to heating and air conditioning systems, and is in place for one year from your home’s date of possession. The two-year warranty protects against water penetration through the basement or foundation walls; defects in materials that affect windows, doors and caulking and defects in work that result in water penetration into the building envelope. It also covers defects in work or materials in the electrical, plumbing and heating delivery and distribution systems, and defects in work or materials that result in t he det ach ment, d isplacement or deterioration of exterior cladding, such as brickwork, aluminum or vinyl siding. It continues to provide protection against violations of the Ontario Building Code that affect health and safety and applies for two years, as of date of possession. The seven-year warranty, referred to as the Major Structural Defect Warranty, provides coverage for any defect in work or materials that results in failure of a structural, load-bearing element of the building or one that would reduce the expected life span of a structural element. It also includes protection against a defect that adversely affects the use of the home. If you’re looking to buy a condo, you’ll also have extra warranty coverage for the common elements of your condominium.

Heathwood Homes’ and The Heron Group’s Bob Finnigan
When he was in his teens sweep-
ing floors on Heathwood Homes community sites with Hugh Heron’s son Alan, little did Bob Finnigan know that he was grooming himself for a brilliant career in the new home industry. “I got my feet wet back then,” he says, “and I gained an appreciation for the feeling of accomplishment that home building brings.” Today, Finnigan is the COO Housing at The Heron Group of Companies. He served as president of BILD in 2007, president of the Ontario Home Builders’ Association in 2010, and has twice served on the Canadian Home Builders’ Association executive, currently sitting as secretary. “Interacting with other industry profession-
als brings out different ways of approaching things like product ideas and costing. This exposure has rounded out my knowledge base.” Finnigan says that the corporate philosophy guiding his professional activities comes from Hugh Heron. “Hugh often points out that we work for our customers, the new-home buyer. And, once they buy our homes, a good experience will often lead to their friends and family members becoming customers too. In total, we have eight partners in The Heron Group. We communicate, listen and respond without egos getting in the way. It works very well.” Before joining Heron in the 1980s, Finnigan worked in the real estate departments of several large corporations. This experience and his educational background in geography enable him to understand the value of location when it comes to building and developing. He is also the consummate researcher, having traveled extensively and visited hundreds of sales offices and developments. “A few years ago, I walked into a new sales office just outside Chicago and felt the look and feel was just for what we had in mind for Traditions in Milton. I took a few pictures, confirmed our thoughts with my partners and sent it to our marketing agency, and they worked their magic.” According to Finnigan, the market in each area impacts design. “A weaker market is the mother of invention. I went to California last spring, and I was surprised at the transformation from when I’d been there five years before. Having dealt with the shock of no sales and high prices, they have reinvented themselves by bringing more costeffective stacked townhomes, condo singles and unique five-plexes onto the market.” Finnigan says that a typical workday for him depends on the stages of the communities Heathwood has on the go. “I work with the production, land and marketing teams, and I am also involved in our Two Men and a Truck Canada franchise business. I do a lot of product and price finetuning, researching statistics and looking at other sales offices and sites in the areas where we’re building.” What’s his favourite part of the job? “It’s when we start building the houses. One of my strengths is being able to picture rooms in my mind in 3-D, and we pour over the designs dozens of times. I love to see how the finished co n ti n u e d o n p ag e 4 4 . . .

Every time we hear about a save, it really tugs at our hearts.” A seasoned industry veteran, Finnigan is frustrated with the mixed media messages about real estate in the GTA. “The condominium market has flourished under government policy that has restricted the amount of lowrise land. I don’t believe we’re in any kind of bursting real estate bubble, but I do hope to see an easing of our land supply in the next couple years. It will help normalize things. I also predict that we’ll see more intimate condominium buildings of six or fewer floors with family-sized suites become popular in the next few years.” As for his personal life, energetic Finnigan says he enjoys skiing and golfing with his family. “I’m still the best golfer of the group, but on the ski hill, my two teenage daughters get to the bottom a lot faster than I do.” From sweeping floors to helping steer the ship at The Heron Group with Hugh Heron – that’s quite the career advancement. In the last couple of years, there has been
a lot of coverage in the financial press about mortgage brokers. Despite all of the positive exposure in business and news publications, there still seems to be a lot of confusion from consumers about how this service works. Mortgage brokering or mortgage consulting is not a new industry, but is one that has been experiencing explosive growth over the last five to 10 years. As it stands currently, more than 21 per cent of all mortgage business in Canada is originated through mortgage brokers. While this figure, representing billions of dollars in mortgages, seems impressive, it is next to nothing when you consider that in the U.S., more than 65 per cent of mortgages are negotiated by mortgage brokers. In the past, mortgage brokers were used by individuals who may not have been able to get credit through other channels. They would arrange hard-to-qualify mortgages for a fee. Today this is not the case. The number of mortgage brokers who work on hard-to-place mortgages is now only a small portion of the market. In addition to searching out the lowest rate, mortgage brokers now focus on a consulting role, showing consumers how to become mortgage free quicker, how to decide between terms, conditions and how to crunch the numbers on the many mortgage gimmicks in the marketplace. How did this come to be, you ask? This is not the mortgage market of 10 or even five years ago. What most people don’t know is there are more than 100 lenders in Canada that would all like to have your mortgage business. Henry Ford, founder of Ford Motor Company, famously proclaimed people could have any colour of Model T they liked – as long as it was black. This may be a good way to view a mortgage representative that works for one financial institution. The people who work for these institutions simply cannot offer the level of variety a consultant or broker can. While the manager at a financial institution bases bonuses and salaries on the profitability of the products and services of the branch, mortgage brokers or consultants build their businesses on knowing where to get competitive rates and by providing value-added service. Some of the bigger mortgage consultants in Toronto single-handedly arrange more mortgages than many entire branches. How do they get these rates? One of the advantages the mortgage broker has, is access to volume discounts the consumer typically doesn’t get. When a mortgage broker sends a significant amount of business to various lenders every month, those lenders are going to make sure they work to keep the relationship strong. The financial institutions do not have to gather the paperwork, pay a salaried employee, or maintain an expensive branch infrastructure. By using mortgage brokers to generate mortgage business, they have to pay only the individuals who are producing deals. Really, it is a win-win situation for all involved. As the Canadian economy increasingly echoes the strengths of successful products and services from the U.S., I truly believe the growth in this industry is only just beginning. Still, I would like to bring up an important point – as with any industry, the cream rises to the top. Make sure you select the right financial professional to help you make your mortgage decisions. Where once upon a time a woman was expected to move from her parents’ place into the marital home, modern reality is much different. People are dating longer, getting married older. Couples aren’t waiting to tie the knot before they begin living together. But whether renting, owning, cohabitating or waiting to move out from mom and dad’s, for a large number of couples, the logistics and living arrangements after the wedding are big decisions. Because of their employment situation, the couple continues to spend some time apart. And since they’re not together, they continue to rent – but Kari hopes they’ll be together very soon, and hopes a purchase, somewhere closer to her, is in the near future. When they are able to balance location and careers, a condo near mom might be the perfect answer if they choose an urban location. If they settle on the suburbs, the choice more likely would be a new home. Cash wedding gifts provided a nice down payment, making homeownership possible. While mother may think she knows best, the market more so dictates what new couples can afford. Lifestyle choices also come into play. While the GTA still offers many affordable options, a downtown condo and a Burlington two-storey detached home may carry a similar price tag. The answer to the cohabitation question has to respond to lifestyle needs and wants. It may take a compromise on commute. It may be the need for space to start a family. It may be the idea of enjoying the honeymoon period with something smaller and then buying larger in the future. Or it may be a combination of both. With many couples waiting until later for their first marriage, or moving onto their second marriage, those who are more established financially and in their careers have different options. ›› Taxable income thresholds in all three Ontario provincial tax brackets were increased by 3.3 per cent in 2012, reflecting changes to Canada’s consumer price index (CPI) in Ontario. All indexed nonrefundable tax credits also increased by 3.3 per cent. New high income tax bracket
›› The Ontario government has introduced a new tax bracket. Beginning in 2012, individuals will be taxed at a rate of 12.16 per cent on that portion of their income in excess of $500,000 annually. That will increase to 13.16 per cent in 2013. ›› T his is supposed to be a temporary tax bracket until Ontario’s deficit has been eliminated in several years. Ontario Trillium Benefit
›› Effective July 2012, the Ontario Trillium Benefit combines payments from the Ontario sales tax credit, Ontario energy and property tax credit, and Northern Ontario energy credit. Despite what you often hear, buying a home isn’t only
about location, location, location. True, this is the time-tested first rule of real estate, but there are other determining factors you must consider as part of your selection process. Indeed, there’s a new rule of thumb for buying real estate. Location First, what does that old adage really mean? Of course, we’d all love a highend home in the best neighbourhood. But that’s not always possible. For your own enjoyment while you live in your home as well as for future resale potential, proximity to transportation, shopping, schools and other amenities is among the key determinants that affect your property’s appeal and ultimately its value. After all, those are the qualities potential buyers look for when searching for a home; the more of them your home has when you go to sell, the more desirable it will be to a greater number of people. This equates to demand – multiple offers and a higher price. Information Whether you’re a first-time homeowner, “buying up” to accommodate a growing family or “right-sizing” as an empty nester, education is critical. And these days, with digital media and mobile technology, all the information you need is at your fingertips. Timing Though your home is your primary residence, it is also an investment. Where you buy is usually determined largely by where you want to live, work and play.
