New home treasures

As the saying goes, one man’s trash is another man’s treasure. But does it apply in real estate?

A

few weeks ago, an item hit the news: “Forsaken Detroit homes for sale for as little as $1.” And digital media being what it is in 2013, within hours the story had been picked up by outlets across the continent, and republished, repurposed, regurgitated and retweeted ad nauseam. “What? Homes for sale for $1? Let’s buy 10,” seemed to be a common refrain from many people, speculating – some, perhaps, not in jest – that this was their opportunity to become real estate moguls. While interesting reading and entertaining thinking, such scenarios usually offer little real potential. People seem to forget why these properties might be available for next to nothing in the first place: foreclosure, located in a bankrupt city with high unemployment, abandoned by owners and now occupied by squatters, and so on. Even if you really were able to buy a house for $1, what would you do with it? Would you move there? If not, how would you “manage” the property, fix it up, rent it out, pay the taxes – all in a way that made financial sense? And how many years (or decades) would you have to wait to sell it to recoup those investments of time, energy and money? In the real world, such easy riches are but a dream. In the GTA and elsewhere in Ontario and Canada, there are no homes for sale for $1 – for good reason.

Who should pay for much-needed

Sewer and water pipes, roads, transit, parks and community centres. These are all critical to the health and safety of our neighbourhoods. It’s the building and land development industry that plans, designs and builds new communities across the GTA. The infrastructure that goes under and above ground is a top priority. It is installed in partnership with the local government and it creates jobs and wages that trickle down into the local economy. You may have read about Toronto city council’s development charges discussion and the potential for rates to double. The City of Toronto is not the only one reviewing its development charge rates; other municipalities in the GTA are also looking for ways to pay for this critical infrastructure. That said, I am dedicating my next few columns to break down the complex issue of development charges, what they are, and who is really paying the price when rates increase. What they are: The province’s Development Charge Act is the over-arching legislation and municipalities pass their own Development Charges Bylaws to govern how they collect funds on new development. These by-laws are accompanied by a background study, which outlines the estimated amount, type and location of development within a municipality, and the related calculations of how the new development will affect municipal services. There are mandatory public meetings that must take place and when approved, a municipality can impose charges against land that is ready to be newly-developed or re-developed. What they pay for: Provincial legislation also regulates how revenue from these charges can be used. The revenue pays for increased capital costs related to hard and soft services that come as a result of more people and businesses moving to the municipality. For example, the revenue could go toward the construction of new sewer and road systems that might not have been required before, but now with potential development in the area, there is an increased need for these municipal services. The revenue could also be put toward soft services like building municipal recreation centres and libraries. Who is affected by rate increases: Development charges are just one of the many government taxes on new development. tax and fees associated with building permits, utilities, and parkland dedication. While it is part of the cost of building new communities, when the rates increase between when a home was sold and the date of occupancy, the new homebuyer could be responsible for paying part of it. Is it fair that new homeowners in the GTA are the only ones paying for new and upgraded infrastructure? No, it is not. Won’t all of the residents – new and old – be using it? The answer is yes. In my next column, I’ll explore this last point in more detail and examine other mechanisms municipalities can use to offset the cost of critical infrastructure that all of our neighbourhoods need.

by howard bogach When purchasing a new home or condominium, it isn’t unusual for homebuyers to negotiate a “side agreement” with their builder. By this, I mean, the builder offers something beyond what is in the Agreement of Purchase and Sale (APS), such as an upgrade or something in lieu of another item. A builder can also offer a supplementary warranty that is over and above the statutory warranties. These agreements can be attractive to homebuyers as they may be offered at a discount, or simply as an “extra.” While most homebuyers would see this as a bonus, it can also be extremely frustrating if the builder does not honour the side agreement.

To protect yourself, remember that if it’s not included in the APS, it’s not covered by Tarion. New home warranty versus a supplementary warranty or agreement Tarion warranty protection ensures your new home meets the structural requirements and health and safety standards of the Ontario Building Code. The warranty includes deposit protection or financial loss, delayed closing compensation, and a one-year, two-year and seven-year warranty that provide coverage for specific items and conditions. While your builder provides the warranty, Tarion backstops it by getting involved at the homeowner’s request if your builder does not honour his/her statutory warranty obligations. Your builder may offer services that are above and beyond the new home warranty, which Tarion does not have authority to get involved with. Over the years, Tarion has seen examples of frustrated homeowners who have approached us for help when either their builder has failed to come through on a side agreement or there is a misunderstanding between parties. It is always disappointing to tell them that Tarion cannot force a builder to honour an arrangement that falls outside of their APS. 16 New home guide GTA | aug 31 - sep 14, 2013

Examples of side agreements not covered by Tarion: One of the most common scenarios we see is upgraded electrical components such as wiring for pot lights or pre-wiring for home theatres. Many homeowners negotiate with the builder to wire the home before the drywall has been completed. However, in cases where the upgrades weren’t included in the APS, Tarion wasn’t able to intervene when an issue arose. Over the years, we’ve also received complaints from homeowners who haven’t received items their builders promised, such as finished basements, backyard decks and extended warranties on heating and ventilation systems or foundation waterproofing. My best advice to homeowners is to never accept an upgrade or modification to your new home without having it included in your APS. If you want to add something to your home after your APS is signed, you may be able to have it included in the APS in the form of an amendment. I recommend making these changes with the help of a lawyer to ensure it is done properly. This way, the builder’s agreement will be backed by Tarion and you have somewhere to turn should you need assistance. The importance of keeping a

dynamic public face The value of an ongoing commitment to a public

relations (PR) strategy is difficult to quantify and explain for anyone in the position of marketing director, as I am for Geranium Homes. To communicate a company’s goals, achievements and offerings, word has to get out via the media, correspondence and a variety of events and marketing materials. People need to be aware of Geranium Homes in order for them to research our homes and communities, and they have to trust us enough to consider purchasing. We think of public relations as the “gatekeeper” of our corporate image – a function that challenges us to adhere to our corporate values while also helping to establish protocols for communication, supports customer service and even impacts how we treat our employees. For the past five years, Geranium has worked with Toni Pettit of The Morrison Group to spearhead our PR function. Pettit has over 25 years of experience in the new home building and related industries. Her management of our public relations builds and sustains awareness of our company and assists us in maintaining a good reputation among our customers. Second quarter sales results are promising

and right on track, with 50.5 per cent of the annual Trimart Forecast already achieved. June 2013 was an outstanding month for the sale of new lowrise homes. This was combined with a much needed record breaking increase in inventory, showing a 34-per-cent surge on year over year sales. The Total Market Area (TMA) sales are slightly down 6.8 per cent compared to May 2013, achieving 1,721 new home sales for the month of June. However, this is the third highest June sales recorded in the last six years. This month the largest gains occurred in the east (94.7 per cent) region of the GTA, largely due to new openings by Emery Homes, Highmark Homes, Golden Falcon Homes coupled with continued success from Minto Homes. The TMA lowrise lot inventory also witnessed recording breaking numbers by reaching over the 12,000 level for the first time in the last 29 months. Compared to same month last year, there were double the number grand openings and releases (39) throughout the market. The June sales and inventory achieved 34 per cent and 30 per cent, respectively. The lowrise new home sales growth in GTA isn’t an isolated incident. Canadian housing starts were stronger than expected in June with the seasonally adjusted annualized rate of 199,586 residential starts, which was higher than 187,000 starts expected. Furthermore, Canada Mortgage and Housing Corp. also revised May starts higher, to 204,616 from the 200,178 originally reported. The latest data comes exactly one year after tough new mortgage rules aimed at cooling the market came into effect. Historically, the GTA’s lowrise new home market has been resilient to market changes and the latest report shows the market is rebounding from last year’s government-induced slowdown. The 2013 charts demonstrate the strong upward trend in sales and inventory and resilience towards market changes. The equity solution How Canadians can cash in – without cashing out by peter kinch You hear a lot of talk these days – from media and government – about debt and how the average Canadian has too much of it. Although it may well be true that many Canadians need to rein in their spending habits, there is a flip side that doesn’t get talked about enough: a record number of Canadian homeowners are sitting on an unprecedented amount of home equity. Given today’s economic environment, the mere mention of spending home equity is considered taboo – especially in light of the recent sub-prime mortgage crisis in the United States.

This scenario presents an interesting dilemma. The proverbial elephant in the room is home equity. Could it be a solution to the most pressing concerns of Canadians as they near their retirement years – or is it part of the problem? The pendulum has swung quite a bit on this topic over the past five years. We’ve gone from the free-wheeling days leading up to 2008, where those investing in real estate thought they could do no wrong, to an about-face, where spending home equity was akin to an evil deed. And, like most things in life, the truth lies somewhere in the middle.

None of that, however, changes a few fundamental facts: 1. In spite of all the talk about debt, many Canadians are sitting on an unprecedented amount of home equity. 2. A large number of those Canadians sitting on their latent equity have two pressing concerns: a. Will I have enough money when I retire? b. How will my children ever be able to afford to buy their own house?

First and foremost, we need to address some of the issues that face most Canadians today: • It is true that many Canadians are carrying too much debt and need to find a way to spend less than they make. • It is also true that many Canadians are sitting on an unprecedented amount of home equity. • Yet a record number of Canadians are also concerned about their ability to have enough money to retire. • Few working Canadians have faith in their pensions. • A record number of Canadians are now self-employed and have no pension plan. • Few working Canadians are confident in the ability for CPP and OAP to take care of them when they retire. • Canadians are living longer than ever. Add this up and it begs the question: Can home equity be part of the solution? The concept of using your home equity to invest has fallen out of vogue in the past few years, but in many respects, we have thrown the baby out with the bathwater. Sure, the idea of spending your home equity to buy investments equates to getting further in debt – but perhaps we need to define debt. Is it possible to have good debt and bad debt? Bad debt is easy to define – any debt that is used to purchase an item that adds no value to your bottom line (lifestyle expenses such as a car, boat or vacation). Good debt is any debt that is used to increase your net worth (a house, a rental property or other investment intended to make money). When you use credit to subsidize lifestyle, you are simply spending beyond your means and arguably buying items that may not fit into your family budget. The only return on this type of expenditure is immediate personal gratification. However, the potential long-term consequences of this type of expenditure could be increased debt without the ability to pay it off. This is exactly the type of debt the government is concerned about. They don’t want Canadians to look at their houses as personal ATMs – especially at a time when interest rates are at record lows. The real concern is what would happen if a great number of Canadians were to access home equity, go further in debt at a time of low interest rates, only to see those rates increase. If the only thing those individuals had to show for their debt were depreciating consumer goods and a YouTube video of their last vacation, then the government’s concerns would be completely justified. In fact, you should be very cautious of increasing home or consumer debt in today’s economic environment. Interest rates have nowhere to go but up, and any use of home equity should only be undertaken after an analysis of both the long-term benefits and consequences. However, this example should not be confused with the ability to utilize home equity to increase personal wealth, address pension concerns or assist adult children with getting started on their road to homeownership. The key is to analyze the long-term benefits versus potential consequences. It is entirely feasible to utilize home equity in such a way as to improve your personal financial situation over the long-term – even if interest rates were to rise. This process would involve increasing personal debt initially but only through the acquisition of an asset that would create a long-term financial benefit. An example of this would be to access a portion of your home equity for the down payment on the purchase of a rental property that, over time, would shift from a deficit to an asset that could provide a supplement to your pension plan. Many people reading this might still say, “There is no way I’m touching my 42 New home guide GTA | aug 31 - sep 14, 2013

home equity.” I completely understand that emotion, but to that I would ask: Are you 100 per cent comfortable that your current pension plan is sufficient and that you will not have any need to supplement it at the point of retirement in order to live the lifestyle you desire? If the answer is yes, then by all means, you should not, nor do you have to, touch your home equity. Your focus would be to stay the current course. However, If the answer is no, then it begs another question: What is your plan to resolve this? A significant number of Canadians fall into the second category and fit the following description: “I know that our current pension plan is insufficient to accomplish our retirement goals and I know that we are sitting on a lot of untapped equity that could be used to purchase some investments. But I’m simply not comfortable with risking any of that equity in an investment venture. What if we ended up losing it all? Then where would we be?” You would be shocked at how common this scenario is and how often that conversation is played out at dinner tables across this country. There are three major considerations: 1. The need to address retirement goals 2. The realization that equity could be the solution 3. The fear attached to taking on more debt As you explore your own personal situation, consider these factors, and how equity might be part of the solution.

The humble chair by laura stein

Each and every day, all over the world,

millions upon millions of people do the same thing they have been doing for thousands of years: park their posteriors in a chair. Chairs have graced the earth since ancient times and are a ubiquitous part of our physical and social landscape. But have you ever thought of a chair as a fashion accessory? A museum-worthy masterpiece? A commentary on socio-political values? For every chair in which someone has sat, there has been someone else who spent hours hunched over a worktable drafting and designing. While some chairs have been fairly forgettable, other designs have been so forward-thinking and revolutionary that they changed the course of furniture design as a whole, and influenced an entire era. Today these chairs are considered classics and cultural icons, and can be found everywhere from your local café to the Museum of Modern Art.

Red-and-Blue Chair, designed by Gerrit Reitveld, 1918, The Netherlands Gerrit Reitveld is considered one of the most influential furniture designers of the 20th Century. A member of Dutch artistic movement De Stijl (“The Style”), Reitveld was interested in the most abstract expression of design, breaking it down to its simplest, purest form of shape and colour. Made of pine and plywood, this chair is often referred to as a three-dimensional version of a Mondrian painting, and is part of the permanent collection at The Museum of Modern Art.

Louis Ghost Chair, Philippe Starck, 2002, Paris Modeled on the classic Louis XV oval-back chair, this chair was introduced by Kartell in 2002 and soon became a classic in its own right. Formed from a single piece of injectionmolded transparent polycarbonate, it is strong and suited for indoor or outdoor use. Morris Chair, designed by Gustav Stickley, circa 1901, Syracuse, NY Influenced by legendary English designer William Morris, this chair is an iconic example of the American Arts and Crafts movement of the early 20th Century. Barcelona Chair, designed by Ludwig Mies van der Rohe, 1929, Berlin Originally designed for the German Pavillion at the 1929 International Exposition in Barcelona, this chair is one of the most recognizable of the modern period. Made of chrome-plated steel and button-tufted leather, the chair has been produced by Knoll since 1953. To tell an original from a knock-off, look for Mies van der Rohe’s signature stamped on the inside of the frame. This bentwood chair is considered to be one of the most successful product designs of all time. Thonet developed a process of steaming wood until it was pliable, then manipulating it into shape. Because a single piece of wood could be bent into almost any configuration, no joinery and far fewer pieces of wood were required to create the furniture. Simple screws held the pieces together, which could be flat-packed for shipping and assembled on-site…long before IKEA came around. Husband and wife team Charles and Ray Eames produced furniture for the masses made from newly available products such as plastic, molded plywood and fiberglass. Building industry raises $36,000

toward affordable homes for low-income families Close to 600 builders, developers, sales and marketing professionals united recently to help the Building Industry and Land Development Association (BILD) raise more than $36,000 for Habitat for Humanity Toronto. BILD members have raised more than $570,000 for the charity since 2003. The funds were collected as part of the Association’s annual Race for Humanity – an award-winning scavenger hunt challenge for industry professionals – and Charity BBQ, on July 18. The combined events celebrate BILD’s decade-long partnership with Habitat for Humanity Toronto, which saw the Association support the construction of 10 homes for 10 families. “This wonderful partnership is just one example of the industry’s commitment to making the GTA a better place to live through volunteerism, philanthropy and sponsorship,” says BILD president and CEO, Bryan Tuckey. “I’m excited to be a part of this celebration today, and I feel privileged to work in an industry that gives so much to the communities that we all live in.” Sunita Sanichar, who received the keys to her BILDsponsored Habitat home in 2012, addressed the group in the company of her two children. She thanked the Association’s members for their generosity, referencing the positive effect home ownership has had on the lives of her children, one of whom has autism. “We’re so proud of our long-standing partnership with BILD,” says Ene Underwood, CEO of Habitat for Humanity Toronto. “Over the past 10 years, BILD and its

Whether you are a young couple

or individual purchasing a new home for the first time, a resale buyer moving in the market or an empty nester purchasing a retirement condominium, the very action of this significant investment in real estate represents a major life change. There are a number of issues that you should consider at this time in order to ensure that your “house is in order.” 1. How will I hold the “title?”

When your lawyer goes to the Registry Office to hand over all of your money to the builder in order to buy your home, he receives, in return, a document called a deed or transfer, which he registers by filing with the government; the document has your name is on it to show you own the home. This action gives you title to the property. If more than one person is buying the property it is necessary to decide how they will hold title together. There are two ways people can hold title together. The first is generally the way we hold title with our spouses or children, which is called “joint tenancy.” To hold title as joint tenants really means that upon the death of one of the parties, the remaining party automatically becomes the owner of the whole property without having to inherit it or have it pass through an estate. The reason is simply that all owners on title own the whole property rather than a part each. The other way title can be held is as “tenants in common.” This means that each party only owns the percentage allocated to them, although the physical part owned is not described. Upon the death of a tenant in common, his or her percentage ownership goes to their heirs in accordance with their will or law. Therefore, remember to discuss this issue when you go to see your lawyer. 2. What about a will? A power of attorney?

Do you have a will? If you do, is it up to date and does it represent your current situation or state of affairs? It is important, especially if you have young children, to have your wills completed; not so much for the money, but for a clear resolution of the issue of custody if something happens to both parents. care of who will look after children, keeps the government out of your affairs, allows for an orderly disposition of everything from your favourite cuff links or earrings to your realty, stocks and bonds, and will allow you to determine how you are to be cremated, buried or quick frozen. A power of attorney is used when you are physically or mentally incapacitated – there are two kinds. The first is for your body, such as what care will you or will you not receive? Your representative will determine that. The other is for the management of your financial affairs. Now is the time to create a will. Speak to your lawyer and ensure that this important matter is dealt with. 3. What about insurance?

You will need insurance for the house. This a great time to look at life and disability insurance. It is also a good time to determine if you should be insuring your mortgage in case something happens to the major wage earner; and to ensure that the future is taken care of. So there you have it, this is the time to take care of all of these kinds of things to get your house in order. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. The Ontario Home Builders’ Association

(OHBA) welcomes the recent announcement by Minister of Municipal Affairs and Housing Linda Jeffrey that the provincial government intends to launch consultations on Ontario’s land-use planning system and growth-related infrastructure financing. “Currently, new neighbours are being forced to finance massive infrastructure projects and urban renewal across Ontario. The Development Charges Act should be renamed the New Neighbour Tax,” says OHBA Chief Operating Officer Joe Vaccaro. OHBA recognizes that the time is right for the province, municipalities and industry to make affordability and fairness a cornerstone of Ontario’s planning system. “This is an opportunity to have a fact-based discussion about how Ontario’s lengthy and complex public planning system is challenging housing affordability and adding to the costs of new communities for Ontarians,” says Vaccaro. Minister Jeffrey also announced that the provincial government would launch a consultation to evaluate the Development Charges Act and other related taxes, fees and charges that municipalities levy onto the costs of new homes. OHBA has, for several years, expressed serious concerns that increasing government-imposed charges are driving up the cost of housing. Increasing prices for housing is progressively impacting the ability for Ontarians to purchase appropriate housing to suit their needs. This is limiting opportunities for economic growth while reducing our competitiveness with other jurisdictions. “By placing the new neighbours at the centre of this discussion in terms of affordability and fairness, we welcome the opportunity to have a detailed discussion on the impact of development charges, parkland dedication fees, section 37 agreements and voluntary charges on new communities. at the Sixth Annual Kylemore Kares Golf Tournament Two hundred golfers teed off on Aug. 21 at the Sixth Annual Kylemore Kares Charity Golf Tournament held at prestigious Angus Glen Golf Club in Markham. Since its inaugural year, the tournament has expanded to now use both of Angus Glen’s 18-hole championship courses. “The tournament always sells out quickly due to the support we receive from our trades, consultants and suppliers,” says Kylemore Communities’ President Patrick O’Hanlon. “We added the evening dinner event a few years ago so non-golfers can join us in supporting this great fundraising day.” Golfers enjoyed on-course food and beverage stations provided by local restaurants: The School Fine Dining, The Unionville Arms, Jakes on Main Street, Unionville Co. for a safe and smooth move One of the best ways to ensure the move to

your new home goes smoothly is to plan it well in advance. The Canadian Association of Movers (CAM) stresses consumers get an early start, giving them time to find the best mover for them – and to ensure they don’t get caught hiring a rogue mover at the last minute. Pitfalls to planning poorly or leaving booking until very late are that you risk getting limited choices for movers, unreliable estimates, empty promises and poor service. Here are 10 points to help ensure a smooth move: DOs 1. DO hire a reputable mover. Check with your provincial government, the Better Business Bureau and/or the Canadian Association of Movers before you contract a mover. 2. DO get three on-site estimates – in writing. An in-home estimate is a more accurate estimate – and that means fewer disputes later on, during or after the move. 3. DO validate any estimate that is significantly different from the others. Check the mover’s reputation and validate their affiliations. 4. DO read Industry Canada’s Consumer Checklist for Choosing a Moving Company on CAM’s website, mover.net. CAM has important information on moving for consumers. 5. DO ask how your goods are protected against loss or damage and insured while in transit. You may wish to request additional cargo protection that is based on your valuation of your shipment. And always get it in writing.

DON’Ts 1. DON’T make your decision based on the mover’s advertisement or salesman’s promises. Glossy ads, slick websites and verbal promises won’t ensure a good move. Always get promises in writing. 2. DON’T make your decision based on the lowest price or the company waiving the tax. Low prices are often altered on moving day with additional fees and only a disreputable mover will avoid collecting tax. 3. DON’T allow any company to do an over-the-phone estimate. A phone estimate is not binding unless it is followed up in writing and is often unreliable because the mover does not have all of the necessary information. 4. DON’T accept the references a company provides at face value. References can be a marketing strategy so they should not be your deciding factor. 5. DON’T accept any verbal agreement. A verbal commitment cannot be proven in a dispute. Always get promises in writing. You have a responsibility to protect yourself. Find out about your rights and responsibilities. There are consumer protection laws to protect you, but it’s far easier to get a reputable mover than to try and get a remedy after the move.

Lowrise prices hit record high while sales remain slow

sold two to three years ago and are not an accurate representation of today's new homes market,” says BILD President and CEO Bryan Tuckey. “Sales activity in 2013 has been low and we will start to see the effect of that in two to three years.” Tuckey also stressed the importance of differentiating between the new homes market, which consists of new developments sold in pre-construction, and the resale market, which represents existing properties sold by homeowners. Sales of ground-related housing continued to slide as a result of limited supply and reduced affordability. At 783 sales in July, the low-rise market has fallen 45 per cent below the 10-year average. Meanwhile, the RealNet New Home Price Index reached a new record in the lowrise sector, bringing the average price of a lowrise home in the GTA to $645,854. The highrise price index decreased slightly to $430,930 with the price gap hitting a record high of $214,924.

Sales of new homes and condominiums in

the GTA remained low as prices continued to climb at a record pace in the ground-related sector, according to the Building Industry and Land Development Association. According to RealNet Canada Inc., BILD’s official source for new home market intelligence, new home sales in July totaled the lowest in 10 years while year-to-date sales added to the second-lowest in a decade. While highrise sales fell 34 per cent below the 10-year average in July, condominium construction across the GTA is at a record high. As of July 31, there are 256 highrise developments – representing 66,126 new homes – currently under construction. More than 17,000 are expected to be completed by year's end. Part of the sales decline is reduced new inventory as a result of self-discipline by the industry. GTA developers introduced just two new projects into the market in July. “It’s important to understand that while we are experiencing record-high construction, these homes have been July 2013
