Three simple steps to success
S
hopping for a home online is a great way to narrow your search, but there’s nothing like visiting the sites, models and sales offices to get down to the nitty-gritty. Before you venture out, here are some pointers: First, be clear about what you want and expect in a new home and in your builder. Remember, the range of prices in the new-home market generally reflects differences in location, features and home styles. There’s no magic involved. If a builder’s pricing seems out of whack with others in the area, ask for an explanation. Higher prices could mean better quality materials, finishings, features and service. Make sure that the price you are paying will deliver the quality you want. Second, understand exactly what is included with the home you are buying and what is optional. Ask the sales representative to show you samples, and request a “spec” sheet that clearly lists what is included, as well as any upgrade options. Third, evaluate any promises that have been made during your visit. Is the builder prepared to put them in writing? Hearsay comments should not be included as part of your evaluation process. Sit down with your sales representative, ask questions and discuss your Agreement of Purchase and Sale in detail – then take it to a lawyer before it’s finalized.

Upgrades that make sense As you select builder upgrades when buying your new home, keep an eye toward the future

hinking of the long-term, or to any point in the future, may be difficult to do when you’re buying a new home. All the excitement of choosing a location, builder, type of home and, of course, the finishings, takes over and all you can think about is the here and now, and you can’t wait to move in. When it comes to selecting upgrades, however, experts suggest that it’s wise to keep an eye toward the future. Indeed, it’s hard to imagine selling a home you haven’t even moved into yet. But one day, quite likely, you will be in that position, and you will be glad you struck a balance between those little touches that made your home “home,” and those that might appeal to others. You may also be happy you exercised at least some caution when you’re at your builder’s decor centre. Without it, you could easily find yourself exceeding your budget – for the sake of a few luxuries that you could likely do without.

For most of my career, I worked for municipalities such
as North York, Toronto and York Region. I understand that in Ontario, this level of government has only three primary sources of revenue: property taxes, user fees and development charges. The problem is that the proportion of revenue from each of these sources has become increasingly unbalanced. Development charges are a tax on newhome buyers, and the money collected is subsidizing what could be coming from other revenue sources. My last column explained that development charges are funds used by municipalities to pay for new infrastructure like roads, transit, sewer and water pipes, parks and community centres. When a building permit is issued by a municipality for new homes and employment spaces, the charges are collected from the development industry. Ultimately, development charges are paid by the new-home buyers and businesses, and as the charges increase, affordability across the GTA decreases. We recently studied the affect of government fees and charges on the cost of new homes in six GTA municipalities. In the municipalities we looked at, development charges are the most significant government charge on new homes and since 2004, development charges had increased between 143 and 357 per cent. Property taxes, however, have increased nominally over the years and in some municipalities, not at all. According to the City of Toronto’s release about its 2013 property tax increase, “the two per cent residential property tax increase translates to an increase of $62.08 for the average residential household assessed at $474,368 in 2013, with the final 2013 municipal taxes on a typical home being $2,532.” In 2013, the development charge on a newly-built home in the city of Toronto ranges from $8,356 on a one-bedroom or bachelor apartment to $19,412 on a single- or semi-detached home. If these rates increase as proposed when city council’s executive committee votes on Sept. 24, the rates will range from $12,192 to $28,435 as of February 2014. In my last column, I asked: is it fair that new-home buyers in the GTA are the only ones disproportionately paying for new and upgraded infrastructure? I don’t think it’s fair.

New-home buyers are taking out mortgages and the ever-increasing development charges are adding thousands of dollars in interest. This is especially unfair when you consider that all residents will enjoy the new or upgraded roads, transit lines, sewer and water systems and parks that come with the development of new communities for years well beyond the life of those mortgages. In Toronto, specifically, there is existing infrastructure. When new developmentcomestoaneighbourhood, that infrastructure is upgraded because for the most part, it is old and needs replacing. Crumbling infrastructure needs to be replaced and new-home buyers will continue to pay their fair share. But this next generation of homeowners should not have the heaviest burden of carrying the costs of the infrastructure deficit left by generations past.

Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to finance our social security programs and create a more equitable taxation system. Almost 40 years since and it is still around. Don’t you feel more secure about your social security and equality in our tax system? Some countries such as Belize, Barbados, Cayman Islands, Egypt, and Hong Kong have no capital gains tax. On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit.

My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? Capital gains tax is charged on the profit realized from the sale of noninventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment.

financial investment you will ever make, and it’s understandable that you want to get it right. One of the biggest benefits of choosing to buy a newly built home is that it comes with a seven-year warranty from your builder that is backed by Tarion Warranty Corp. Make sure you understand the rights and responsibilities of your warranty, says Tarion, with these five tips: Review your purchase agreement with a lawyer
Review your ‘agreement of purchase and sale with a real estate lawyer before signing to ensure you understand exactly what is included in the price of the home. If you are buying a condo, review the disclosure statement to understand what items are part of your unit and what are considered common elements. Make sure anything that is agreed to verbally by your sales representative is reflected in writing.
Make sure that the form is complete, as it will serve as an official record of the condition of your home before you moved in. Complete your forms and submit them on time
If you need to make a warranty claim to Tarion, keep in mind that there are strict deadlines for submitting your warranty forms. The best way to stay on top of those deadlines is by registering for MyHome, an online service for homeowners operated by Tarion. It will remind you of your warranty periods and allows you to submit your forms online. Allow your builder access for repairs
Working with your builder to complete unfinished work and repairs is critical. Be sure to give your builder and their tradespeople access to your home during normal business hours, at a time mutually agreed upon in advance. Denying access will jeopardize your warranty rights.
Attend the pre-delivery inspection
Maintain your home
Your builder will schedule a pre-delivery inspection, or PDI, on or before the day you take possession. Make the most of this opportunity by learning about how to operate your home’s systems and properly care for your new home. List anything on the PDI form that may be damaged, incomplete, missing, or not working properly.
Attentive maintenance not only ensures that your property remains in good condition and working order, it preserves your warranty coverage too. Most builders recognize the power of virtual reality (VR). The VR experience begins with reasonably accurate renderings of your home, inside and out. These visuals can show you what the interior and exterior design of your home will look like in a way that can’t be described by words alone. The next level is to add an interactive component to all these visuals, which not only animates the material, but allows us to further engage you through an interactive kiosk. That being said, the VR experience is not limited to displays, iPads and kiosks. There is also a lot to be said for the simplicity of a 3D site plan and/or building model that is used to give you better idea of what we intend to build. Built to scale, this method of display is also highly effective, and in fact, will likely never be replaced by fancy screens and the newest techie tool. The law of good faith (or the lack thereof) by Jayson Schwarz
The Supreme Court of Canada has said that good faith is
not a requirement by either side in the negotiation of a contract. They went on to say that once the contract is signed there is an obligation to perform in good faith. What does this mean to you, the homebuyer?

01 The most important thing to remember is that if it is not in writing, in the Agreement of Purchase and Sale, it is not binding on either side. 02 It does not matter what the agent says or promises (see 1 above). 03 It does not matter what is written in the brochure or advertised at the sales office (see 1 above). 04 Every Agreement should be reviewed by a lawyer who knows real estate before it is binding. 05 Only your lawyer has a legal, moral and ethical requirement to protect and put you first. 06 Every Agreement should be conditional on the lawyer’s review and the condition must be in writing, and keep it that simple. Some Agreements have condition clauses that are all mumbo-jumbo and do not let you really change anything. Also, make sure some time for review is allotted and sufficient. Okay, the Agreement is signed, reviewed, amended and ready. Now what? The parties must thereafter act in good faith to complete the contract in accordance with the terms of the Agreement. Remember, most builders and their sales people are honest, caring individuals who want to deliver a quality product. Just be careful not to bite into the bad apple in the bunch. Happy home hunting!

According to Phil Dorner, president of the Ontario Real Estate Association, while that initial feeling is important, buyers should keep in mind that there are several other factors to consider before making a final decision “Although your initial feeling about a property is a powerful force, make sure to follow these five steps to help ensure that you aren’t going to be faced with unwelcome surprises,” says Dorner. Here are four important steps for prospective buyers to take before making any decisions:
Talk to the neighbours: The best way to get an idea of what it would be like to live in a particular neighbourhood is to talk to someone who already lives there. Chat with neighbours about the community, schools, commute and any potential surprises that you should know about. Work with a local Realtor: Look for a realtor who works in the area and knows the ins and outs of the community. Asking friends, family and colleagues for references is a great place to start. Another good way to find a realtor active in the area is to go to open houses in the neighbourhood. Get a home inspection: In Ontario, a home inspection reports on the condition of the roof, structure, foundation, drainage, heating, cooling, plumbing, insulation, walls, doors and electrical system. The cost of a home inspection can vary so do your research and make sure to choose a qualified home inspector who will also inform you of the scope and limitations of the inspection. Check with the city: Visit your local building department and find out if any new developments are planned. These rugs are hand crafted with various complex knotting techniques to leave a dense, soft surface of exposed fibres. The higher the “knot-count,” the denser the weave, and the finer the rug. › Machine-made rugs can be created in a number of ways. Tufted rugs usually glue synthetic fibres to a backing, a bond which can degrade over time. Machine knotted rugs better simulate hand-made versions and tend to last longer than tufting. Lastly, woven rugs use looms to interlock the yarns to the backing. The quality will depend completely on the quality of the materials used.

Selecting Your Area Rug
The look of an area rug is both classic and contemporary, mixing the crisp sleekness of a wood or stone floor below, with a warm and inviting stretch of carpet on top. Of course, this can often require a double investment. I believe getting the best of both worlds is worth it, so here are a few tips for choosing your area rug the right way: › As a general guide, you should budget the same for your rug and your sofa. Both will take a lot of wear, and be a feature you enjoy every day, so the investment should be about the same. › A rea rugs are a great way to bring a splash of colour, pattern and/or texture, which can be moved or replaced seasonally as a way to keep the décor fresh. Don’t be scared to go bold, as you can always move or temporarily store it later for a change. › I f a room has one major seating group, a rug can anchor the seating area, or fill almost the whole room. ›Y our area rug should reach the furniture it’s grouping together, rather than float in the middle. Get a size big enough to at least tuck under the front legs of sofas and chairs. ›A dining room rug should anchor the dining chairs even when they have people sitting in them (usually about two ft. from the edge of the table). › Rugs tend to come in standard sizes, so you can measure your space in advance and have a pretty good idea of what to look for. Very common: 4 by 6 ft., 5 by 7 ft., 6 by 9 ft., 8 by 10 ft., 9 by 12 ft. and 12 by 14 ft. Carpet Tiles

Historically, the township of Markham was an agricultural community that did not begin to take shape until after Second World War. As the Toronto core began to expand outward after the war, Markham slowly changed into an urban community. The construction of Hwy. 404 in the 1970s further accelerated the transformation, helping Markham grow into the city it is today. Markham is the fourth largest community in the Greater Toronto Area, with a population just tipping 300,000. Markham officially changed its status from a town to city on July 1, 2012 due to its continuous growth. Not surprising to current residents, the area is dominated by the Chinese who make up 38.3 per cent of the city’s population. Markham has also experienced a huge real estate boom in the past decade; in July 2013, homes in Markham sold for an average price of $655,820, much higher than GTA average of $513,246. This growth has kick-started infrastructure improvements along Hwy. 7, namely the Viva Bus Rapid Transit Line (BRT). The federal and municipal governments have recognized the growth of York, particularly Markham, and contributed $85 million towards a $1.4-billion dollar expansion of VivaNext Rapidway projects. The new BRT will run west along Hwy. 7 toward Unionville GO station. These rapidways have dedicated centre lanes on Hwy. 7 for existing Viva buses to connect to neighbouring transit systems such as GO Transit, Brampton’s Zum and TTC. Completion of the Markham portion of the BRT is estimated to be late 2014. 114 New home guide GTA | september 14 - 28, 2013
Main Street Unionville is a designated Heritage Conservation District that was founded in 1794. Business began to open up in the area in the late 1800s after the construction of the railway in 1872. Subdivisions began construction around Main Street in the late 1960s after the revival of the beautiful Victorian buildings in this community. Today, Main Street is considered a prized local tourist destination with renowned restaurants, pubs, bakeries, candy shops, beautiful architecture and scenic trails and parks ideal for a nice afternoon stroll. The Unionville Festival is a crowd pleaser that attracts thousands to Main Street annually. There are 18 community centres in Markham, including the recently opened Cornell Community Centre and Library, connected to the Stouffville hospital. The centre’s triple gymnasium, aquatics centre, library, health and fitness centre, indoor track, rehearsal hall, mature Downtown Markham Viva Station
For teens interested in pursuing the arts, Unionville High School offers a program of eight specialized courses that focus on dance, drama, music (piano, strings, vocal, winds, brass, percussion), or visual arts. Admission to the Arts Unionville Program in grade nine is limited upon successful completion of the grade eight program, which is available only to students residing within the area of Unionville H.S. It is extremely competitive to be accepted into the program, as Unionville is regarded as one of the premier Main Street Unionville high schools in the region. Athletic teens also have their own school in Markham. Bill Crothers Secondary adult and youth centres, as well as an indoor childrenâ&#x20AC;&#x2122;s playground combine School, one of the newest in York Region, is an athletic-based high school with three to form a campus lifestyle. Amid all the ongoing talk of
mortgage rates, market conditions, high levels of household debt and economic uncertainty, good news can be found in RBC Economics Research’s latest Housing Trends and Affordability report. While affordability in the Canadian housing market deteriorated marginally in the second quarter of 2013, thanks primarily to mortgage rates, home prices and household incomes remaining at status quo, affordability in Toronto is holding its own. “Homebuyers seemed unfazed by the slight deterioration in affordability,” says Craig Wright, senior vice-president and chief economist, RBC. “We saw the market regain some momentum in the second quarter with home resales increasing 6.4 per cent. Resales should stabilize close to the recent not-too-hot, not-too-cold levels in the near-term, barring any further changes in housing policy by the federal government.” Exceptionally low mortgage rates have been the chief factor in keeping homeownership costs relatively affordable, RBC says. The Bank of Canada again held its trendsetting overnight rate at one per cent on Sept. 4. RBC anticipates the BoC will keep the rate unchanged at one per cent through the remainder of 2013 and will gradually begin raising it starting in mid-2014. This should largely mitigate risks of any serious deterioration in affordability levels, RBC says. The way RBC’s affordability measures work is, the higher the measure, the more difficult it is to afford a home. For example,

Despite affordability that appears a little stretched, homebuying activity in Toronto staged a healthy comeback so far this year, RBC says.
