uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

What’s in a development charge? Future homebuying ability could be at risk if fees continue to rise unchecked
I
f you’re a regular – or even new – reader of New Home Guide, you’re likely becoming more familiar with this term – development charges. Indeed, the Building Industry and Land Development Association (BILD) is writing a series of columns on the matter, the latest installment from President and CEO Bryan Tuckey on page 14 of this issue. Other industry voices are speaking out on the matter, in increasingly vocal fashion. But just what are development charges, and why, as a prospective new-home buyer, should you care? In short, the fees are those applied by various levels of government when new homes are built, to pay for new infrastructure such as roads, transit and other necessities. The answer to the second question is more important: you should care because they’re rising exponentially, have been for years, and they’re occupying an increasingly high portion of new-home costs. You may not know, for example, that these fees – which are passed on to homebuyers – are higher outside the downtown core, where you think you would be able to find savings. So, what can you do about it all? Aside from joining the industry’s lobbying for government to wrestle control of the increases, buying sooner than later will help you avoid higher development charges. At press time, for example, Toronto City Council was voting on another sizeable increase, to be implemented next year. That, and educating yourself on the issue as you go through the homebuying process.

by BRYAN TUCKEY NOT ALL THINGS ARE EQUAL WHEN IT comes to building a home or a place of employment across the GTA. Location matters. Land values vary and are heavily based on location, in addition to proximity to amenities and services. Construction costs also need to be considered because materials and labour costs differ depending on the type of development. Another contributor to the cost of building communities in the GTA is the myriad of government fees and charges applied by federal, provincial and municipal governments. To put some facts around these fees and charges, BILD commissioned a report earlier this year called, Government Charges and Fees on New Homes in the GTA. It was completed by Altus Group Economic Consulting and you can read it in its entirety on the BILD blog. The study looked at more than just development charges, but it concluded that they are the most significant government charge on new homes. Since 2004, development charges have increased between 143 and 357 per cent across the GTA. Right now, the development charge on a newly-built home in the city of Toronto range from $8,356 on a onebedroom or bachelor apartment to $19,412 on a singleor semi-detached home. If these rates increase as proposed when City Council’s executive committee votes (scheduled for Sept. 24), the rates will range from $12,192 to $28,435 as of February 2014. Outside the city of Toronto in the GTA municipalities, development charges are set by and paid to both the municipality and the region. Let’s take Markham as an example. The city charges between $9,985 and $19,950,

depending on the type of home, and the combined city and regional development charges range from $60,057 for a detached home to $31,251 for a condominium. One of the reasons for higher rates in the GTA is because most of the infrastructure needed is brand new, whereas in the city of Toronto there is existing infrastructure in place. Toronto rates should also be considered in the context with other fees and charges that GTA residents don’t pay such as land transfer tax to both the province of Ontario and the city, as well as community benefit fees that come from the application of Section 37 of the Planning Act. What this all boils down to is affordability and the ability of the next generation, your children and anyone who chooses to live in the GTA to purchase a new home. Development charges are a tax. The rates have increased exponentially and they have shifted the burden of paying for critical infrastructure onto the newest residents and businesses moving into a neighbourhood.

AUTUMN IS UPON US AND THAT means winter isn’t far behind. As the weather begins to cool and the leaves start to fall, you should start to prepare your home for the cold winter ahead. I AM INCREASINGLY FACED WITH CLIENTS WHO ARE INTENT
on retiring their mortgage as quickly as possible. While most mortgages today are amortized over 25 years, below are the tips that I give my clients who want to be mortgage-free as quickly as possible. If you follow all the suggestions below, your mortgage will be gone quicker than you think. 01 Never get an open mortgage at a fixed rate unless you plan on paying it off within its term. Today’s closed mortgages generally offer 10 to 20 per cent prepayment privileges, and can usually be obtained at one per cent or more off the posted rate. Open mortgages at fixed rates carry higher interest. Why pay higher interest unless you are going to exceed this 10- to 20-per-cent prepayment? You can always make bigger lump sum payments at renewal time with no penalty. 02 Use accelerated weekly or bi-weekly payments. Accelerated weekly payments are equivalent to one-quarter of your monthly payment. Accelerated bi-weekly payments are equivalent to half your monthly payment. Both of these methods enable you to make one extra monthly payment a year. The impact of this alone reduces your amortization from 25 to less than 21 years. 03 Give your mortgage the same raise that you get each year. If your income goes up 10 per cent, so should your mortgage payment. This extra increase in payment will go directly towards principal repayment. 04 Give your mortgage a portion of any bonus or extra income. If you spend 30 per cent of your income on your mortgage, then 30 per cent of any extra income should also go to your mortgage in the form of a prepayment. This bonus portion will go straight towards principal repayment. 05 Keep your payments the same, even if you renew at a lower rate. Since you know you can afford to pay at this level, don’t decrease your payment when you negotiate a lower rate. The difference in payments between your new rate and the old rate will go directly to the principal. 06 Use your income tax return to put a lump sum payment towards your mortgage. This is extra money that is not used in your monthly budget. Don’t indulge – make it really benefit you. 07 Use extra money from your budget. Most financially sound people have a budget that they live by. If you have a little bit extra then apply it 34 NEW HOME GUIDE GTA | SEP 28 - OCT 12, 2013
to your mortgage. Minimum prepayments can be as little as $100. 08 Round up your mortgage payments. Why not round off that $656 bi-weekly to $660, or $675? You will be amazed at the difference. 09 Consider a variable rate mortgage. While the fluctuation will keep some people awake at night, those who can endure the rate adjustments can save money. Some variable rate, or adjustable rate mortgages are up to 0.5 per cent below prime. 10 Seek independent financial advice. While some bankers do look out for your best interest, they work for the bank, not you. Their branch, organization and shareholders all have a financial interest in lending at higher rates, and it is in their best interest for you to keep your mortgage for a long time. Talk to your financial planner, mortgage consultant, or talk to a financially savvy friend. I know that these steps take discipline and dedication, but the old adage still holds true – a penny saved is a penny earned! The one thing that most financially successful people have in common is discipline. It might not feel fulfilling now, but believe me when I say that this short-term sacrifice will result in long-term gain. Just think of what you can buy when your mortgage is all gone. There are many investment vehicles that can give you healthy returns. You do not necessarily have to buy a home to increase your wealth. However, a home is one of the only tax-free investments still available to the middle class. Buying a home is a long-term commitment and investment. Today’s historically low interest rates make purchasing a home extremely appealing – particularly if your rent paid is greater than $1,000 per month. Why should you pay someone else’s mortgage?
CONSIDER THE FOLLOWING: ›› Determine what you can afford and stick to that price. All too often, buyers tour several homes and the only one they desire happens to be thousands of dollars over their budget. Remember, keep your head out of the clouds. Commit to a mortgage, not a stress asylum. ›› Shop and negotiate with several financial institutions for the best interest rate, terms and conditions. You may be surprised at how competitive the banks are for your mortgage business. Shopping for a mortgage can be as easy as a few clicks of your mouse. 36 NEW HOME GUIDE GTA | SEP 28 - OCT 12, 2013
›› Set a formal plan to help save for a first home. Sit down, plan the steps necessary to achieve your goals, and follow through! ›› Improve/maintain your credit rating by paying all your bills on time. One-day-late payments are still considered late. This could influence your negotiating power for the best mortgage. ›› Make sure current monthly mortgage payments are manageable and will continue to be so even when interest rates rise in the next several years and payments increase. ›› Put down as much as possible to avoid taking out a high-ratio mortgage that incurs additional cost and interest. A five-per-cent down payment on a home leaves little equity. ›› Set aside an additional three per cent of the purchase price of the house for closing costs such as Land Transfer Tax, legal fees and disbursements, moving costs and other incidentals. Speak to your lawyer who will be able to give you the heads up on what to expect. ›› Take advantage of the first-time Home Buyers Plan (HBP) to use your Registered Retirement Savings Plan (RRSP) as part of the down payment. An individual and spouse, provided they qualify, may withdraw up to $25,000 each from their RRSP, taxfree, for a total of up to $50,000 toward your home and other purchase-related costs. If you have never used the HBP, contribute your savings for the home into your RRSPs and take advantage of the tax deduction. Then, use these savings for a down payment. You will have 15 years to repay the amounts to your RRSP, starting after the second year of your withdrawal. Continue to follow the real estate market trends and buy when you are ready, not when the market is ready for you.

Compute your commute BEFORE YOU BUY by HUGH HERON AS THE CROW FLIES IS A GREAT WAY TO LOOK AT GETTING
from point A to point B – but crows don’t buy homes and commute via roads and bridges. For most new home shoppers, location tops their list of must-haves. If you are looking at homes outside of your current vicinity and you don’t work from home, pay special attention to your commute from the neighbourhoods you are considering. This is an important aspect of your purchase decision, and it deserves careful attention. You may think you can estimate from a map, but remember that every route has its own idiosyncrasies, and time of day can make a huge difference. For example, early every morning, I do the 45-minute drive to my club. A few months ago, I had to drive to an address near it, and it took me two hours because it was later in the day. So let’s say you have narrowed your search to two new home communities, A and B, and you work at C. Drive from A and B to C and compare the times, but do this experiment in both off times and rush hour. The point is, be realistic when you look at locations, especially if you have done your preliminary research using maps. Plotting routes using straight lines on a map is unproductive. Roads twist and turn, wind around lakes and ravines, and depending on the route to your workplace, A could in fact be farther away than B or vice versa. Even if one of them is closer in kilometres, once you experience the drive, you may find it takes longer for a variety of reasons such as areas that bottleneck or have slower speed limits. If you are considering taking public transportation to work, do some in-person commuting research. Test out your commute by car and by bus and/or subway. You may find that using public transit is preferable

– there’s something to be said for not having to worry about dealing with traffic and finding a parking spot. In the event that a community is perfect in every way except for the commute, do some creative thinking and explore your options. Maybe you can drive to a GO station and take the train. Ask your employer about the possibility of flex hours that would allow you to travel before or after rush hour. With today’s advanced technology, perhaps you can work from home at least part of the week. Why not ask? If you decide that driving is your preferred commuting method, consider a fuel-efficient vehicle or car-pooling, which qualifies you for the high-occupancy vehicle lanes on the highway. The trend today is toward lessening the use of vehicles. Sharing the driving responsibility with others allows time for chatting on the way to and from work, and of course, saves on fuel costs and wear and tear on each person’s vehicle. I’ve known new-home buyers to forget all about commuting time when they choose a new area to live in. They glance at the map, estimate distance quickly, and often end up with a far longer commute than they expected. Of course, there are those fortunate people who work from home full time. Their daily commute involves a walk from the bedroom to the home office, with a stop at the kitchen on the way, so they can go to work as the crow flies. With phone, fax, email, Internet, cell phones, personal digital assistants, hand-held wireless devices, teleconferencing capabilities and so on, an increasing number of people look at regular commuting as a thing of the past.

Ontario economy set for growth DESPITE CHALLENGES IN EXPORTS AND MANUFACTURING: RBC AFTER SEEING ENCOURAGING SIGNS EARLIER
this year, Ontario’s economic momentum failed to pick up as expected in recent months, according to the latest RBC Economics Provincial Outlook. With little evidence strengthening activity so far this year, RBC has revised its forecast for provincial real GDP growth to 1.3 per cent in 2013, down from a previously expected 1.7 per cent. Still, RBC projects the pace of growth to accelerate in 2014. “We continue to anticipate exports to be the prime source of economic growth in Ontario, even though we saw merchandise trade virtually stall in recent months,” says Craig Wright, senior vice-president and chief economist, RBC. “As the U.S. economy recovers further, demand for Ontario’s exports will rise and contribute real GDP growth of 2.8 per cent in 2014.” The RBC report notes that among the more positive economic developments in Ontario during the first half of 2013 were a resilient housing sector and strong

We continue to anticipate exports to be the prime source of economic growth in Ontario, even though we saw merchandise trade virtually stall in recent months consumer spending on big-ticket items. However, the lacklustre demand for provincial merchandise exports and manufacturing production has contributed to a notable drag on growth so far in 2013. In the June Provincial Outlook, RBC expected auto plants and parts manufacturers in Ontario to ramp up production as demand and sales for light vehicles were up dramatically earlier in the year. RBC notes that motor vehicle production was down 7.9 per cent in the first eight months of 2013 relative to the same period a year ago, indicating that Ontario is losing ground to other jurisdictions, including the U.S. southern states and Mexico. Furthermore, exports of machinery, primary metals, industrial chemicals and paper fell year-over-year during the first half of 2013. Nonetheless, RBC remains confident that stronger U.S. economic activity will boost demand for Ontario goods and services during the remainder of this year and into next; this will set the stage for the external trade sector to contribute positively to growth. On the bright side, home building continued to be a steady source of economic activity in Ontario, with residential investment up 3.8 per cent year-over-year in the first half of 2013. RBC says that continued job growth was a key factor sustaining housing demand, however, slowing population growth and rising mortgage rates will weigh on housing starts this year and next. RBC forecasts housing starts to moderate from 76,700 units in 2012 to 61,000 units in 2013 and 57,500 units in 2014.

Lowrise new home sales show steady growth by LLOYD MARTIN & MARK JIN
TOTAL MARKET LOWRISE SALES YEAR TO DATE AS OF
August 2013 reached 11,716, which is 65 per cent of the annual Trimart forecast. The Total Market Area (TMA) witnessed steady sales gains in August achieving 1,187 sales for the month, marking the fourth highest sales recorded in last six years and a 36.1-per-cent increase on year-over-year sales. Additionally, TMA monthly sales for the last three months have been beating the previous year results. The new home market will carry on its healthy sales trend with more offerings for first-time buyers, retirees. Sales of higher density urban townhomes and four-storey residences continue to capture a larger market share.
Despite a slight increase in borrowing costs during the summer, new home sales in the GTA have remained resilient, especially with more builders offering affordable urban townhome product.

Sales gains in the TMA area and inventory remain strong during this seasonally slower time of the year, staying close to the 12,000 level. Overall, the lowrise new home market witnessed more stable results. The TMA shows an average of 2.4 sales per active site with all regions, realizing sales gains over the same month last year: the Central (80 per cent), the East (15.3 per cent), the North (28.1 per cent), the West (30.4 per cent) and the GTR (83.8 per cent). In summary, the market stability, positive housing star ts combined w ith stronger employment, plus the increased supply of new lowrise housing, will offer greater opportunity for consumers.

Provincially, the housing starts in the Ontario region were 2000 trending at 59,187 residences in August, compared to 58,292 in July. Canada Mortgage and Housing Corp. stated that the trend in total housing starts continued to be relatively stable 1500 for a sixth consecutive month. Nationally, Statistic Canada data showed Canadian employ- 1000 ment increasing by 59,200 in August 2013, beating market expectations for a 20,000 increase. WHEN BUYING A NEW HOME TARION WARRANTY CORP. IS WORKING TO FIND
new ways to help homebuyers research their home purchase, including streamlining the online information search process and revamping the Ontario New Home Builder Directory to include information on builders who are no longer registered. “While consumers need to research new home builders using a number of sources, we want to ensure we provide as much helpful information as possible,” says Howard Bogach, president and CEO of Tarion. Tarion is committed to continually improving transparency, providing consumers with information that will be of value when they are considering a new home purchase. Earlier initiatives have allowed consumers to search the Tarion website (tarion.com) to find out if a builder has had its licence refused or revoked, whether it has one or more chargeable conciliations against its name and the total dollars paid out in claims by Tarion. If a builder is part of an umbrella group of companies, consumers can learn

other names under which the builder may be operating and the communities in which it builds. “Tarion strives to set the gold standard for transparency against other jurisdictions, including BC, Alberta and the United Kingdom,” says Bogach. “However, we believe more can always be done to inform consumers while meeting legal, privacy and homeowner interests.” Tarion Warranty Corp. is a private corporation established in 1976 to serve as the regulator of the new home building industry in Ontario. In this role, Tarion licenses all new home and condominium builders. New home builders provide purchasers with warranty coverage that is guaranteed by Tarion. Tarion also establishes minimum time standards for aftersales service, and conciliates issues between homeowners and builders. As of the end of 2012, more than 381,000 homes in Ontario are protected under the warranty.

HOW CONSUMERS CAN TAKE STEPS TO
protect their goods in transit THE CANADIAN ASSOCIATION OF MOVERS
(CAM) recommends that consumers learn about the respective liability of movers and consumers during a move and take the necessary steps to protect their property. Moving a home filled with furniture and fragile property to a destination without any scratches, breakage or loss is the sign of a reputable mover. But damage to a customer’s goods can occur even with the best-trained movers. Now, imagine what happens to goods if they are moved carelessly by untrained, scam operators using poor equipment, without insurance. Who is responsible for loss or damage is the most hotly-contested issue in moving complaints. Consumers need to recognize the risks, understand who’s liable and take steps to protect themselves. Homeowner’s insurance probably does not cover your household goods in transit. It’s important that consumers understand what the mover will do in the event of a problem. The consumer must ask important questions and get the answers in writing. Ask what happens if a chair is broken, the contents of a box that you packed are damaged, the contents of a box that the mover packed are damaged or your fine artwork is lost. The liability for loss or damage is shared between the consumer and the mover. In law, a mover’s liability is only $0.60 per pound per article moved and the consumer assumes the remainder of the risk. This means that for a 50-pound TV, the mover’s liability is $30. This coverage is generally not sufficient to protect the customer. Household goods, on average, are worth $10 per pound or more.

A reputable mover will offer to accept the customer’s risk for a fee or include this coverage in the price of the move. The fee may be based on either the value that the customer declares for the goods or the $10 per pound average. The mover is not liable for loss of or damage to contents of customer-packed boxes unless there is negligence by the mover. If the consumer has to file a claim for lost or damaged articles, it’s the mover’s option whether to arrange for repair or replacement within limits of the mover’s liability. A mover is only required to replace or repair the lost or damaged piece or pieces of a set – not the complete set. The mover is not liable for damage to mechanical, electronic or other operations of articles such as radios, clocks, appliances and musical instruments, irrespective of who packed or unpacked them, unless the mover performed or arranged for servicing and preparation of these articles prior to the move. Neither is the mover liable for deterioration of or damage to perishables like food or plants. Remember that your computer is replaceable but the data it contains is not. So back it up and, at minimum, carry the backup with you if not the entire computer. Movers are liable only for goods that are disclosed to the mover on the face of the contract – the Bill of Lading. If items are carried by the mover without knowledge and the customer claims loss or damage, the mover cannot be held liable. Consumers should not put jewelry, money, stocks/ bonds and important documents in with the household shipment, but should carry these themselves. Items of extraordinary value should be appraised before shipping to ensure that their valuation is understood by both the mover and consumer. Remember that you must ask for an explanation of your risks and the steps the mover will take to reduce the risk of loss or damage. It’s easier to fix a problem before it happens than to try to get compensation after the fact. Get all your agreements with the mover in writing. And finally, your best protection in reducing your risk is to hire a reputable mover. DON’T LET NEW HOME LOVE AFFAIR

WHEN IT COMES TO THAT NEW DREAM HOME, love can be blind. Buyers are often willing to spend tens of thousands of dollars on luxury upgrades such as tile floors and marble countertops, while ignoring the heating, ventilation and air conditioning (HVAC) systems that make the house comfortable. And this limited view can, in a worst case, turn your dream into a nightmare. “A home is usually the largest investment in a person’s life. Yet most buyers don’t even think about the HVAC system. They just assume that things will work properly. Sadly, some find out that’s not always so,” says Warren Heeley, president of the Heating, Refrigeration and Air Conditioning Institute of Canada (HRAI). “If you’re concerned only about what the house looks like, you’ve probably lost sight of the fundamentals. You need to check out the mechanical systems as well, or you could end up owning a gorgeous home that is unpleasant to live in,” warns Karen Somerville, president of Canadians for Properly Built Homes (CPBH). Industry and consumer groups join forces HRAI and a small group of allied heating industry associations have joined forces with the consumer protection group CPBH to raise public awareness about the problems – and solutions – related to poorly performing HVAC systems in newly built homes. According to CPBH, heating and cooling troubles are among the most commonly cited problems in newly built homes, and can include: extreme temperatures (house is too hot or too cold), significant temperature variances (in different parts of the house), stale/stuffy air, poor ventilation, extreme humidity or dryness, and health issues related to indoor air quality. The building code does not ensure home comfort Newly built homes are supposed to meet the building code, and purchasers therefore assume that their HVAC will deliver the proper level of home comfort. Wrong on two counts. First, the building code sets minimum standards to ensure safety, but there is nothing requiring a minimum level of comfort. are lobbying government for improvements in the building code that would raise HVAC standards, but this is a long process. Secondly, measures to ensure comfort in the home will only be achieved if home buyers protect themselves and place specific demands on builders. So what can new home buyers do to ensure that these systems have been properly designed, installed and commissioned? Here are some steps you can take to protect yourself r )BWF ZPVS MBXZFS JODMVEF B DMBVTF JO UIF QVSDIBTF BHSFFment indicating that you want the right to have the HVAC inspected (and tested if necessary) by your own independent HVAC expert, before the drywall is put up, and if you are not satisfied with the HVAC system, you can get out of the deal. Minto launches Kingmeadow IN OSHAWA TO OVERWHELMING RESPONSE
AFTER UNPRECEDENTED SALES OF ITS FIRST PHASE, MINTO
recently held a VIP opening to launch the second phase of its Kingmeadow homes and townhomes in Oshawa. Since the successful event, 36 new homes have been purchased, exceeding Minto’s initial sales projections. Indeed, proximity and access to a variety of amenities and essentials – from transit to health care to schools to shopping to recreation – are critical determining factors for builders and buyers alike, for lifestyle and comfort while living there, as well as resale potential down the road. It’s an important topic we’ve written about before in Fundamentally Speaking and elsewhere in New Home Guide. On page 48 of this issue, for example, Hugh Heron, president and of Heathwood Homes, discusses how important it is to “compute your commute” before you buy a new home. It’s also a topic home building associations across the country are paying close attention to, as development charges and other fees rise to prohibitively high levels. Consider, for example, as BILD President and CEO Bryan Tuckey writes on page 14, development charges imposed by local and regional municipalities can reach more than $60,000 per home – costs that are passed directly on to new-home buyers – before a shovel even hits the ground. The latest federal budget provides some hope in this regard, in that it contains measures to increase support for national infrastructure. Says Canadian Home Builders’ Association (CHBA) President Deep Shergill: “It’s an opportunity to restore fiscal integrity at the municipal level and fairness for younger generations. At present, many municipalities are financing community infrastructure by transferring the costs into the 128 NEW HOME GUIDE GTA | SEP 28 - OCT 12, 2013
mortgages of new-home buyers, amounting to more than $5 billion a year.” Municipalities across Canada are lobbying Ottawa to make sure they get their share of available funds to address road and transit needs. In Toronto, for example, the TTC is campaigning for the federal government to kick in a large chunk for the city’s transit plan, including a subway expansion. Faced with such infrastructure and funding challenges, municipalities typically are also considering other options – including new taxes, road tolls and other fees – to help pay for what’s needed. For homeowners and prospective new homebuyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever. With continuing immigration, general growth and construction expansion – all happening at a quicker pace than infrastructure improvements – our highways and transit systems will all be tested until everything catches up. Consider, for example, the population of the GTA continues to increase by about 100,000 people per year. Research suggests that by 2031, there could be three million more people living in the area – bringing with them an additional 1.5 million vehicles. As you’re out there shopping for your new home, look around to see how far you are from the nearest highway or rapid transit system that affords you a reasonable commute; and how close you are to health care, schools, shopping and recreation. These communities will be at a premium, now and in future.
