Buying a brand-new condo offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future — but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important than in the case of the new-condo purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a condo is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new condo. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Reviewing the documents will give you a sense of how the strata community is functioning and help you make good decisions about your investment for years to come. ›› BYLAWS AND RULES Most strata corporations have their own unique bylaws and

rules. While they usually follow a standard format, the bylaws and rules will dictate how you can use both common property and your own strata lot. Bylaws and rules can govern everything from age, pet and rental restrictions, to the type of renovations that you can do and whether you are allowed to have a barbeque. These are important things to be aware of.
›› MEETING MINUTES Strata councils provide minutes from their regular council
meetings to owners. These minutes will typically include any decisions made by the strata council, any updates regarding building repairs and maintenance as well as fines or other disciplinary actions taken against owners. Annual or Special General Meeting minutes provide information on larger decisions that require owner approval. These decisions are usually related to raising money for repairs through special levies or withdrawals from the building savings account or changes to the bylaws. ›› FINANCIAL STATEMENTS Strata corporations must prepare budgets and financial

k, the title of this article may be a little misleading, but I had to grab your attention. I want to tell you about a really important step in your house hunting process that can save you thousands of dollars, heartache and stress. When you make on offer on a condo, your Realtor will usually make your contract subject to reviewing a big bundle of strata corporation documents, including financial statements, meeting minutes, bylaws, rules, an information certificate and any depreciation reports. Going through this material can be time consuming and a little dry, but it is always worth doing. It can be tempting to ask your Realtor to go
statements every year. These documents tell how much revenue the strata corporation generates, how it spends its money and whether the strata corporation is proactive in its maintenance and repair of the common property and common assets. Always look to see how much money the strata corporation has in its Contingency Reserve Fund. This is the strata corporation’s savings account. If savings are less than 25% of the total contributions by owners over the previous year, it means that the building may not be saving enough money. This is particularly true with older buildings that have had time to build up savings. ›› DEPRECIATION REPORT This document includes detailed information about the
strata corporation and it’s projected repair and maintenance expenditures over a 30-year period. It must also include at least three different cash-flow funding models. By comparing the information in the depreciation report to the meeting minutes, financial statements and budgets, you can make an educated guess about whether the owners in the strata corporation are investing in their future and whether you will have to pay special levies in the coming years. ›› CAVEAT EMPTOR At law, the old maxim of “buyer beware” still holds true. Strata
corporations have an obligation produce a wealth of useful information, but it can only protect you if you take the time to use it to your advantage.

epending on when in a condominium’s development process you purchase a suite, you will have to wait some period of time for your move-in date. If you purchase early from plans, you benefit from the optimum selection and, of course, the lowest prices. But the biggest advantage to buying early in the process is the equity you earn

over the time span of construction, which can vary if weather does not cooperate, or unexpected labour or materials shortages occur. Another benefit of buying early in the process, especially for first-time buyers, is having time to save additional money toward your down payment. I have known young professionals who have taken the equivalent of their maintenance fee and banked it each month to use toward the deposit. This provides extra funds for the down payment and gets you used to budgeting for your eventual carrying costs. In addition to saving money during your condo wait, you can make the most of the time by considering the design of your décor and layout. You have room dimensions, so plan your colour schemes and finishes, so that when you have your colour selection appointment, you will have a good idea of the look you want. Look critically at your furnishings and accessories, and decide what to bring to your new home and what to give away or sell. This is particularly appropriate for the more mature buyer. I have met several empty-nesters who spent years making the decision to sell their long-time family home and buy a condo suite. When they were finally sure they wanted to take advantage of carefree single-level living in a residence with wonderful amenities, they were actually happy to have time to make the transition psychologically, as well as physically. They also appreciated the opportunity to pare down possessions gradually in preparation for occupancy. This may involve passing along family heirlooms to younger generations and figuring out which items will fit into your new living space. Remember, too, that if you are among the first to move into your condo, you may have to wait a while before the building is totally complete. The upper floors are finished after the lower ones, and some of the amenities may not be entirely ready for use. This is a similar scenario to moving into a house in a lowrise community where homeowners have to experience some dust and dirt before all the driveways and landscaping are installed. A condominium is built from the ground up, so keep that in mind when you see tradespeople going up and down on the elevators. Residents do receive things like snow removal, lawn mowing, concierge service and the like right away, which is a big part of what maintenance fees cover. Be realistic about your move, and be patient before and after you move in. As you wait for your suite to be ready, you can use time to your benefit by becoming even more prepared for a wonderful move-in day. Enjoy the wait – and remember that your investment will most likely increase in value by the time you move in. Whether you buy from plans when the sales office opens, an inventory suite when the condo is complete, or any time in between, the main thing is that the timing is right for you.

lanning to scoot south for a little adventure this summer? Hopping across the country to see family and friends for a break? Taking a short drive to do some shopping south of the border? I’m willing to bet dogs-to-donuts that you haven’t bought travel insurance. You probably think you don’t need it. Don and Peg didn’t think so either. They knew their provincial health insurance would cover them if they got sick. Then Don tripped on the stairs and hauled Peg down with him. Don broke his hip and Peg her shoulder. They were all the way in Australia, had to cut their three-week dream vacation short. That left their daughters back home in Canada scrambling for money to help. If you have extra coverage on that fancy-pants premium credit card in your wallet, you might think you’re immune. And if you have a health plan at work, you might think you’re insured to the eyeteeth. Maybe not, even if you’re just going from one province to another. Check with your provincial plan to see what the restrictions or omissions are. You’ll have to call since most of the web sites are totally useless when it comes to describing what covered and what’s not. Check your directory’s blue pages for the Ministry of Health in your province.

Buying insurance is more complex than you might think. Different plans offer different benefits and restrictions. One thing that can limit your coverage is a “pre-existing condition.” It could be a past medical condition that required consultation, prescription drugs, hospitalization or treatment. Or it could be an ongoing health condition. When “pre-ex conditions” are covered, there is usually a stability period. Most travel health policies will out-and-out exclude any childbirth or pregnancy complications if you travel in your last trimester. Some won’t cover anything for which you were treated for up to six months before your trip – think ulcer, back problems, depression. Some plans won’t cover a medical condition for which you’re already being medicated. Make sure you shop around since you’ll find big differences in price and in the quality of coverage offered.
While most holidays go smoothly, it makes sense to protect yourself just in case. Think about what a bummer it would be if you lost your luggage. Imagine the distress if you became ill in another country. There are a bunch of other types of insurance that go into a “travel insurance package.” Trip cancellation coverage protects you from losing the deposit if you have to cancel your trip because of a sickness or a death in the family, a natural disaster, jury duty, a cancelled conference – the list goes on. Default insurance protects your money when a tour operator or other service supplier goes out of business. It’s usually sold as part of a trip cancellation policy, but not always, so make sure you specify that you want it. Lost Baggage Insurance will pay when your checked-in baggage is delayed or lost while traveling on a common carrier or from a hotel. And Rental Vehicle Damage Insurance will cover damage or loss of a rented vehicle. Your personal property insurance may cover lost or stolen luggage. Your car insurance may provide collision and liability coverage for rented automobiles. Some credit cards offer baggage insurance. If you have a premium credit card that gives extra medical coverage automatically, make sure you read the fine print to verify what you’re covered for and under what conditions. Your employer’s health insurance coverage may extend to worldwide coverage. Again, read the fine print since a group plan may have dollar limitations that won’t cover you properly. While most holidays go smoothly, it makes sense to protect yourself just in case. Think about what a bummer it would be if you lost your luggage. “W
hat is your best five-year rate?” This is a very familiar question for your friendly neighbourhood real estate broker. The interest in a five-year rate is often the result of advertising campaigns from large lenders that have brainwashed consumers for decades — though if you look or listen closely at the end of all of these ads, you will always notice that “some conditions apply”. The great thing about this question is that it opens the door for some valuable educational dialogue. Your broker may then ask you, “Why do you want a five-year term?” or say, “Well, that depends, what is your Credit Score?” The fact is that you may or may not qualify for the “best” rate depending on your credit score and your full income or debt positions. Without starting the application process and gathering all of the facts, quoting a rate is a useless proposition.
Why a five-year term may not be right for you
The fact is that you may or may not qualify for the “best” rate depending on your credit score and your full income or debt positions. When someone is looking for a fiveyear term, it is often due to simply not knowing that there are more options out there. Perhaps their plan is to own a condo for two or three years and then upgrade to a larger home when they start a family, or they are buying this home as an investment to renovate and flip in six months to a year. Now add in the fact that sometimes the cheapest rate product offering is often paired with fewer options in the way of prepayment privileges, portability and higher penalty calculations via IRD or percentage of loan amount. Different scenarios and diverse family or investment plans do not always lend themselves to a five-year product. Our lives are often changing and throwing us curve balls in time increments that are shorter than five-year periods. These life events are what cause approximately 60 per cent of people in five-year terms to break their mortgage at or near the 38-month mark. So six out of ten people that thought they were getting the best “A” rate end up paying unnecessary prepayment penalties in the thousands!
Number Crunching Taking the best rate on a mortgage that does not suit your needs is not the best rate in the end. For example, a client takes out a mortgage today and breaks it at 38 months: DETAILS

The penalties on a fixed mortgage such as this ranged from $7,000 to $12,000, so $10,000 is used for illustration. When you add the penalty back into the mortgage balance and calculate backwards to see what the real interest rate paid was, you can see very easily how choosing the what you perceive as the “best rate” may not actually be to your benefit. Surprisingly, people often know more about the features and options offered by the different cars they are shopping for. Call your mortgage broker! They are there to educate you so that you can make an informed decision: your best decision based on their experience and your circumstances.

You’ve got to be creative in finding new places to store things, because closets and furniture will only get you so far. Take advantage of your condo’s height. Use the wall to store it all, and make a statement with decorative shelving and storage possibilities.
GO VERTICAL OR GO HOME. When you’ve run out of storage space, lie on the floor and look up. There is a limited amount of horizontal space (countertops, desks, tables and the floor) but vertical space is abundant and often overlooked. RBC POLL: NEW YEAR, NEW RESOLVE Saving for retirement outranks reducing debt in 2014 for Canadians
REVERSING LAST YEAR’S RANKINGS, more Canadians are citing saving for retirement as a top financial priority compared to those who are prioritizing paying off debt, according to the 24th Annual RBC RRSP Poll. Over half (52 per cent) are now focusing on increasing their retirement savings, with 48 per cent placing a priority on debt reduction, compared to 44 per cent and 54 per cent respectively in last year’s poll. This reversal of financial priorities is even more marked among middle-aged Canadians — those 35 to 54 years old — with almost two-thirds (62 per cent versus 52 per cent last year) focusing on saving for retirement ahead of reducing debt (52 per cent versus 56 per cent). “These findings indicate Canadians are more comfortable with how they are managing their debt and this is allowing them to focus more strongly on retirement savings this year,” explains Bill Hill, national retirement planning consultant, RBC. “To help ensure those savings will support the retirement they have in mind, we recommend they review their lifestyle and financial goals with a financial advisor as early as possible.” The annual RBC poll also found that RRSP ownership among those aged 35 to 54 has jumped to 68 per cent from last year’s 58 per cent. In addition, one-quarter (26 per cent) of middle-aged Canadians has determined they will need to save, on average, $545,000 for a comfortable retirement. “This is the age group that needs to be planning now for the lifestyle they want to have in retirement,” Hill emphasizes. “As Canadians who have already retired know, there is so much more to your retirement years than just the money you think you’ll need. The beginning of each new year is a good time to sit down with a financial advisor to explore all aspects of a successful retirement — you may well find you have more options than you are aware of today.”

2014 heralds in a seller’s market in Canada’s largest cities ACCORDING TO THE ROYAL LEPAGE HOUSE PRICE SURVEY AND MARKET SURVEY FORECAST RELEASED RECENTLY, the average price of a home in Canada increased between 1.2 per cent and 3.8 per cent in the fourth quarter of 2013. The survey showed year-over-year average price increases in the fourth quarter of 2013 of 3.6 per cent to $418,282 for standard two-storey homes and 3.8 per cent to $380,710 for detached bungalows, while the average price of a standard condominium rose 1.2 per cent to $246,530. Prices are expected to maintain healthy momentum into 2014, with Royal LePage projecting a 3.7 per cent increase nationally from 2013 and a shift to a seller’s market in the first portion of the year. “A few short months ago, the country’s housing market emerged from a year-long
correctional cycle of dramatically slowed sales volumes. Later 2013 was marked by a transition to buoyant sales volumes and above average price growth,” says Phil Soper, president and chief executive of Royal LePage. “In the absence of some calamitous event or material increase in mortgage financing costs, we expect this positive momentum to characterize 2014. In fact, we expect a market tipped decidedly in favour of sellers for the first half of the year, after which we project a shift to a more balanced market.” “We predict continued upward pressure on home prices as we move towards the all-important spring market. In addition to normal demand, housing prices in Canada this year will be influenced by buyers who put off purchase plans in the very soft spring of 2013,” continues Soper.

Royal LePage released a report in December 2013 analyzing the sustainability of condominium markets in Montreal, Toronto and Vancouver. “Talk of a ‘soft landing’ for Canada’s real estate market in the new year is misguided. We expect no landing, no slowdown and no correction in the near-term. Conditions are ripe for as strong a market as we saw in the post-recessionary rebound of the last decade.” Canada’s economy is expected to perk up in the year ahead, supported by increased business spending, improving employment and wage prospects and a pickup in exports propelled by a recovering U.S. economy and a lower Canadian dollar, among other factors. “We believe aggressive government intervention, such as further restrictions on first-time buyer’s access to insured mortgage financing, or significant increases in interest rates, is unlikely to occur in 2014,” says Soper. “Our forecast assumes a continuously improving economy, both at home and abroad.” While most indicators point to a strengthening housing market, some optimism has been overshadowed by fears of instability in Canada’s real estate market resulting from high volumes of condominium projects in major Canadian cities. In light of this growing discussion, Royal LePage released a report in December 2013 analyzing the sustainability of condominium markets in Montreal, Toronto and Vancouver. The report found that while actual condominium production across these three cities currently exceeds estimated near-term consumer requirements, strong condo market activity has been generated by important fundamentals including low interest rates, strong job creation in central areas of cities, evolving consumer preferences and conditions that can make condo ownership an effective investment opportunity. According to the report, this strong activity “is not sufficient evidence of a housing bubble,” but rather the result of positive economic forces and changes in demand patterns supportive of condominium living.
MEANWHILE IN VANCOUVER… Confidence crept back into the Vancouver market, with prices for all housing types seeing moderate growth. The average price for detached bungalows increased 4.0 per cent year-over-year to $1,041,300 and standard two-storey homes increased 3.3 per cent to $1,139,050, while condominiums rose 2.3 per cent to $492,500. The momentum of the real estate market is expected to carry over into the New Year, with prices projected to rise 4.4 per cent in 2014.

How to mix and match… tastefully // BY YANIC SIMARD WHEN IT COMES TO FASHION, patterns
are mixed together all of the time. So, you shouldn’t be fearful of combining patterns in a room to make it come to life. The trick is to do it tastefully – without creating a décor disaster. Here, I share my tips for combining patterns the right way: Begin Bold Start with one strong
pattern – strong could mean thick lines, a particularly busy pattern, or very saturated colours – and build upon it. Balance of Scale The goal is for your patterns to complement one another, not work against one other; try to have an even mix of busy and subtle. Soften Prints with Solids A fabrics without a pattern acts as a staple to

Textile Tips: 1 Choose soft furnishings that will work in any room of your home, so that when

If it’s for drapery, a lesser rub count is suitable. Also, fabric with a higher thread count means a tighter weave, which is key to having fabric maintain its shape over time. ›› CLEAN-ABILITY Fabrics made of natural fibres will absorb stains much quicker than man-made fabrics, but they will clean up better. Fabrics made with man-made fibres are typically soil-resistant but don’t clean up as well.
My Favourite Patterns: GINGHAM This printed or dyed fabric,
which dates back to the 17th century, is known for its checked patterns of white and a single bold colour (you’ll often catch me wearing this pattern). The size of the checks can vary in size, and the checks can appear in horizontal rows and vertical columns, or sometimes diagonally. PINSTRIPE A classic pattern consisting of very thin stripes running in parallel. It is most recognized in men’s suits and is very striking in home décor. CHEVRON A repetitive pattern comprised of sharp ledges that look like the letter “V” (sometimes called herringbone or zigzag). This is on trend right now.

Follow these steps to see if you’ll qualify for a mortgage on your dream condo 01 Calculate the combined monthly before-tax income of you and your spouse. 02 Divide by three. This figure is the monthly payment you can afford to make on your condo. 03 Take the total price of the condo and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.
04 Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers take the 25-year amortization.) 05 Multiply this figure by the amount you need to borrow. Divide by 1,000.
06 Add to this your estimated monthly heating costs and monthly property taxes. 07 If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream condo.
