The agreement of purchase and sale

“Get it in writing” before you sign on the dotted line

B

uying a brand-new home or condo offers an opportunity to get the home you really want. It can be a dream come true and an investment for the future, but don’t forget, it’s also a legal transaction. The phrase “get it in writing” has never been more important in the case of the newhome or condo purchase, since it outlines everything your new place will have in, on and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms between you and your developer and/or builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a new condo or home is much more complicated than a resale transaction where the property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one developer to another and from province to province. Before you sign a contract, review it carefully with the representative your buying from and ask questions to make sure you fully understand what’s in it. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document, so seeking the services of an experienced lawyer is an important step toward ensuring that your dream home becomes a reality.

Or temporary adjustment to new mortgage rules?

T

here is, as always it seems, some debate about the rise and fall of the price of real estate in the Vancouver market. Although some see a recent lowering of prices as an indication that the bubble has burst in our market, many experts attribute the change to last year’s change in mortgage rules, which Bill Binnie, broker and owner of Royal LePage North Shore, suggests “have affected a number of buyer groups. First-time buyers can’t enter the market as easily and investors are less able to meet the new equity requirements” in this issue’s Royal LePage survey, “Vancouver home prices continue to inch downward in the second quarter of 2013.” The majority seem to believe that this is a small blip in a generally positive turn. It seems, to me, undeniable that the need to build new residential properties will continue to grow alongside Vancouver’s ever-increasing population. Supply has by no means eclipsed demand in our city, and the developments that continue to contribute to our city are a boon to homebuyers, who have come to expect the very best. Developers are keenly aware of these expectations and continue to outdo themselves when it comes to the quality of design and the extent of luxury features attached to their projects. There really is something for everyone in Vancouver’s housing market, and at New Home Guide we’re happy to set homebuyers off on the right foot, whether they are buying their first home or the home they plan on retiring in.

Balanced conditions provide a

The Greater Vancouver housing market continues to maintain a relative balance between the number of homes for sale and the number of people looking to purchase a home in the region today. The Real Estate Board of Greater Vancouver (REBGV) reports that residential property sales in Greater Vancouver reached 2,642 on the Multiple Listing Service (MLS) in June 2013. This represents an 11.9 per cent increase compared to the 2,362 sales recorded in June 2012, and an 8.3 per cent decline compared to the 2,882 sales in May 2013. The MLS Home Price Index composite benchmark price for all residential properties in Greater Vancouver is currently $601,900. This represents a decline of 3 per cent compared to this time last year and an increase of 2.3 per cent compared to January 2013. Sales of detached properties reached 1,102 in June 2013, an increase of 19.7 per cent from the 921 detached sales recorded in June 2012, and a 25.1 per cent decrease from the 1,471 units sold in June 2011. The benchmark price for detached properties decreased 4.3 per cent from June 2012 to $919,900. Sales of apartment properties reached 1,068 in June 2013, an increase of 4.1 per cent compared to the 1,026 sales in June 2012, and a decrease of 15.6 per cent compared to the 1,266 sales in June 2011. The benchmark price of an apartment property decreased 1.9 per cent from June 2012 to $369,100. Attached property sales in June 2013 totalled 472, an increase of 13.7 per cent compared to the 415 sales in June 2012, and a 10.1 per cent decrease from the 525 attached properties sold in June 2011. The benchmark price of an attached unit decreased 2.4 per cent between June 2012 and 2013 to $457,000. was solidified when I started interior design school at BCIT. I’ve always been fascinated by residential design and highly influenced by my surroundings. DD: What do you love most about what you do? AE: I love the whole process of a design project. From listening to my clients’ hopes and dreams for their space in the initial meeting, to the conceptual work, to seeing it all come together is all a thrill for me. The most rewarding part is when a client is blown away by the end result of the project and is just so happy with their new space. It always makes me realize how much I truly love my job.

New Home Guide Editor Diane Duflot sat down recently with Amanda Evans, principal designer at Vancouver’s Twenty One Two Designs Inc. to find out what makes her tick as a designer. We thought our readers might want to know about her sources of inspiration, her recent projects and, perhaps most importantly, how she builds a collaborative relationship with her clients. DD: Can you tell me what first brought you to a career in interior design? AE: As a kid, I was always so interested in rearranging my bedroom, doing mini makeovers and loved to watch decorating shows. DD: What’s the proudest moment of your career? Is there a project that you think of as your absolute best? AE: The proudest moment of my career happened a few weeks ago. I had a launch party at Once A Tree Furniture for a showcase bedroom that I designed down to the very last detail and revealed it to my family, friends, clients and leaders in the industry. I am so honoured to be able to participate in their Designer Showcase series and to have my design on display for the summer of 2013. I think it’s my best work to date. DD: How do you get a feel for your client’s wants and needs? AE: I Listen! It’s so important for me to really listen to what my client is saying, especially in the initial consultation. I ask a lot of questions, but also I sit back and let them talk, so I can hear what they’re saying about what needs to be fixed, what needs to change and what they currently admire and dislike about their home. I listen to them tell me about what they love, whether it be a certain colour, look, feel or source of inspiration. Taking a tour around a client’s home during the consultation also gives me special insight into how they live their life and tidbits about their lifestyle. I ask myself — what do I see? Collectibles? Outdoor equipment? Pattern? Texture? Colours? This, combined with the answers they’ve provided me, is what really gets the ball rolling for me when putting together a design plan. DD: Where do you find your inspiration? Who/What inspires you? AE: I find inspiration all over, really. I am very inspired by textiles. I usually start a project with fabric and pull my concept and colour scheme from there. I’m also inspired by fashion, travel and other designers. I look up to Kelly Wearstler, Tommy Smythe, Nate Berkus, Nam Dang Mitchell, Kelly Deck, Sarah Richardson, Windsor Smith and many more.


DD: Is there anything that you’re particularly excited about for Summer 2013? AE: I’m excited to have my showcase on display at Once A Tree Furniture at 750 SW Marine Drive in Vancouver! I have gotten some great feedback so far and it was such a thrill to see it all come together! DD: Do you have any upcoming projects you’re particularly enthusiastic about? AE: Each and every new project is an adventure! I have such a passion for residential design and will soon be getting into multiresidential projects as well. DD: You take a multi-sensory approach to interior design. Can you explain for our readers what you mean by that? AE: When I’m in a client’s space I think about all of the senses and everything I’m feeling, hearing, and seeing in their home in its current state. When I’m putting together a design package for them, I keep all of the senses in mind and ask myself questions like: How does the texture of this area rug feel under bare feet? How will this lighting affect watching TV or reading? Great design is very multisensory and has to not only look beautiful but be functional and approachable in everyday life. DD: I know you’ve recently completed staging a client’s home in Dundarave. Can you tell more about that project? AE: When a previous client approached me to stage this stunning home I jumped at the chance! The colour scheme of the furniture and décor was kept neutral to compliment the awe-inspiring architectural features and natural light in the home. My main focus was mixing different textures to add interest and really pull the living room décor together while keeping the space calm and restful.

AE: Never stop learning. Always be on top of the latest trends, technology, and products. Always treat your trades with the utmost respect. Kindness, enthusiasm and listening go a long, long way. And never leave home without a tape measure!

DD: What do you see as common decorating mistakes made by homeowners? AE: There a few that come to mind but I would say the top mistake is hiring a designer halfway through a renovation when key decisions have already been made. It’s best to plan together from the beginning. Hiring a designer can save you money, time, effort, costly mistakes and sleepless nights! rying to get through life without a budget is like trying to drive a car with no steering wheel. You can lurch your way along, jamming on the breaks every time a threat looms, or you can put the pedal to the metal, but the whole time you’re careening down the road you’ll be worrying about what you’re going to hit. And if you’ve got any passengers, there’ll be some mess to clean up when you finally reach your destination. Anyone that I know who lives on a budget couldn’t get by without it. And it seems it’s only the people who refuse to make a plan who end up bellyaching about getting to the end of the money before they get to the end of the month.

If you were building a house, you wouldn’t dream of using an architect who declared, “Relax. I’ve done this before. I promise I’ll put everything in the right place.” Noooo. You’d insist on seeing some drawings. And here’s why you should, as the architect of your financial house, draw up a budget. Whether paper-based or electronic, the discipline of managing your budget will help to keep you organized. Annual

bills, like car insurance, won’t surprise you, sending shock waves through your cash flow. And unexpected expenses, which have a category in a spending plan, won’t throw you for a loop. A spending plan is made up of two parts: income and expenses. Income is the money that comes in: your salary, commission, dividends or interest income, alimony, child support, pension, or disability income. It doesn’t include money you think you might get. So, if your bonus is not guaranteed, don’t include it in your budget. Keep it in reserve to boost your RRSP or take you to the sunshine next winter. Expenses are the items you have to pay for monthly. (Divide annual bills, such as insurance, by 12 to come up with a monthly amount.) The best way to figure out your expenses is to look at what you’ve been spending. Collect your bank statements, credit card bills, and whatever other records you have of where your money went over the past year. Put each bill in an appropriate category — i.e., utilities, food, clothing, childcare, gifts — total the figures for each category and divide by 12. That’s your monthly average. Add the categories together. That’s what you’ve been spending. If you think you can keep flying by the seat of your pants forever, good luck with that. If you’ve decided to take control of your financial future, congratulations. Create a budget that balances and you’ve taken the first step to making your money work for you.

Majority of newcomers to Canada not confident in their financial knowledge “60 per cent of newcomers who arrived in Canada in the past year say that they lack financial knowledge, including how to establish and build credit during their first year living in Canada, according to the RBC Newcomer Financial Attitudes Poll. After living in Canada between two and five years, 92 per cent of newer Canadians found their understanding of borrowing options improved. “We have an opportunity to improve financial understanding for newcomers to Canada when they first arrive and we have a role to play in making sure that they are getting the right advice from day one,” said Paul Sy, director, Multicultural Markets, RBC. “Building a strong credit score is important to helping you get established in Canada, particularly when the time comes to buy a car or a family home.” During their first year in Canada, few newcomers believe that using a credit card helps them establish a credit rating (nine per cent) or makes life more convenient (12 per cent). W hether you live alone or have a full house, there’s no reason you can’t be organized. The difference is, when it’s just you on your own, it takes discipline, while when living with others, everyone has to do their part. You should be able to teach organizational systems and delegate responsibilities so that everyone in the family has a part in keeping the house in order, whether it’s your spouse putting the mail and paid bills in the right folders or the kids putting their toys back in the right place. You shouldn’t have to be the drill sergeant — repeating the same requests week in and week out. Everyone needs to learn to do their part and work together to keep the house in top shape. The “go-to” bin Provide a personalized “go-to” bin for each member of the family for things that don’t belong in the room. It keeps items together but out of sight until they’re returned to their proper place. Reserve a few minutes every day, perhaps before dinner, to do the “dash.” Each person empties his or her bin by returning the contents to the right place.

The “in-box” Complementing the “go-to” bin, create a family mail centre to manage paper flow. Create in-boxes for each member of the family. These can be anything from wallmounted pockets to magazine holders on a shelf. Keep them easily accessible. When paperwork comes into your home, sort it into each family member’s box. Items that need to be signed for school go into a parent’s box. Someone else’s clutter got you down? We’ve all heard that opposites attract, but if your partner’s organizing style is drastically different from yours, it can be frustrating for both of you. Before you are tempted to try and change your behaviour (or his/hers), keep in mind that the change will be short-lived when done for someone else’s approval, but will last if you do it because you value the relationship. Has your dining room table become a dumping ground? In many homes, seldom-used flat surfaces often become drop zones for mail, books and any other items that don’t have a home. To save your table from becoming a breeding ground for clutter, bring out the china and silverware and set it for a formal dinner. It will be nicer to look at than a mountain of clutter and will actually prevent people from piling their possessions on it. Leave the house with everything you need Clear a shelf in a bookcase near the back entrance and designate the area as a special place to corral items each family member must have to leave the house. For kids, it will serve as home to permission slips, lunch boxes, homework, library books and projects. For adults, it will hold handbags, briefcases, car keys and dry cleaning. Add a different-coloured plastic dishpan for each family member or use attractive square baskets clearly labeled with each person’s name. When family members come home, they can toss their belongings into their basket until they need them again the next morning.


His and hers filing systems minimize conflict If you share a filing system with your spouse, how’s that working for you? Often, couples have different organizing styles. To keep the peace, consider having separate filing systems. If you pay the household bills, keep those documents in your filing system and if your partner takes care of household repairs and receipts, they can keep track of that in their own filing system. Another option is to acknowledge your differences and assign the task of filing and retrieving documents solely to the person who is most comfortable with it. On schedule Keep a family calendar to keep track of everyone’s activities. Designate a central location where everyone can see it. Let each family member choose a colour and have each person enter their activities (if they are old enough) on the schedule using their colour. Preparation Reduce stress and frustration in the mornings by preparing the night before, when you’re not feeling as rushed. Decide what you are going to wear, make sure it’s clean and pressed, and lay it out with any accessories you plan to wear with it. It only takes a few minutes but will save you so much time and aggravation in the morning. Encourage your spouse and children to start this habit too, and enjoy more morning time together.

Soften Prints with Solids A fabric without a pattern acts as a staple to all schemes. It’s sort of like the bread to a sandwich — things won’t look (or taste) good without it.

Pull the colours, lines, shapes and feel from the pattern on the fabric. 3 When selecting a fabric, keep its application in mind and consider these two important details: ›› Durability Look at the rub count — if the textile you’re considering is for upholstery and a piece that will be used often, the higher rub count the better. If it’s for drapery, a lesser rub count is suitable. Also, fabric with a higher thread count means a tighter weave, which is key to having fabric maintain its shape over time. ›› Clean-ability fabrics made of natural fibres will absorb stains much quicker than man-made fabrics, and they will clean up better. Fabrics made with man-made fibres are typically soil-resistant but don’t clean up as well.

One Colour, Different Shades A more simplified way of mixing patterns is to keep it monochromatic. Select patterns of one colour but choose varied shades (for example, light blue mixed with medium and dark blue). Don’t overcoordinate. You want to avoid having your fabrics too “matchy-matchy.” If you’re using the same or a similar pattern in more than one area, limit it to two places and have them spread far enough apart. My favourite patterns: Gingham This printed or dyed fabric, which dates back to the 17th century, is known for its checked patterns of white and a single bold colour (you’ll often catch me wearing this pattern). The size of the checks can vary in size, and the checks can appear in horizontal rows and vertical columns, or sometimes diagonally. Pinstripe A classic pattern consisting of very thin stripes running in parallel. It is most recognized in men’s suits and is very striking in home décor. Chevron A repetitive pattern comprised of sharp edges that look like the letter “V” (sometimes called herringbone or zigzag). This is on trend right now.

Vancouver home prices continue to inch downward in the second quarter of 2013 The Royal LePage House Price Survey and Market Survey Forecast released today showed year-over-year price decreases across all housing types surveyed in Vancouver. Standard condominium prices decreased by 3.3 per cent year-over-year to $490,475, while detached bungalows decreased 3.2 per cent to $1,052,500. Standard two-storey home prices also saw a moderate drop of 2.3 per cent to $1,151,250. Interestingly, however, this represents an upward trend when compared to the first quarter of 2013, where price decreases were greater than five per cent across the board. “The recent changes in mortgage rules have affected a number of buyer groups,” said Bill Binnie, broker and owner of Royal LePage North Shore. “First-time buyers can’t enter the market as easily and investors are less able to meet the new equity requirements.” According to brokers in the region, the political and economic environment also contributed to sluggish prices early in the quarter. “Buyers were uncertain about the economic outlook in the lead up to the recent provincial election,” said Chris Simmons, broker and owner of Royal LePage Westside. “Tightened immigration policies have also been a factor. Our market is largely fuelled by immigration and reductions quickly show up in prices and activity levels.” Looking ahead, Royal LePage forecasts that home prices in Vancouver will rise by approximately 2.0 per cent in 2013. “Buyers are starting to gain more confidence in the economic and political future,” added Binnie. “As they start to re-enter the market, prices will begin to rise again.” Nationally, in the second quarter, standard two-storey homes and detached bungalows both showed a year-over-year average price increase of 2.7 per cent to $419,614 and $386,547, respectively. Average prices for standard condominiums showed a more modest increase during the same period, rising 1.2 per cent to $248,750. Royal LePage forecasts that house prices will see modest gains throughout the remainder of 2013, projecting a 3.0 per cent increase for the full year when compared to 2012. Dialogue concerning the direction of Canada’s housing market has remained front and centre in recent months. Changes to Canada’s mortgage lending rules in mid-2012 coupled with concerns about consumer debt levels, housing affordability in cities like Toronto and Vancouver and continued international economic uncertainty have prompted a number of analysts to forecast large downward price adjustments. “As we have stated consistently since the current market downturn began late in the second quarter of 2012, this is a normal cyclical correction which brings fewer 66 metro vancouver new home guide | jul 26 - aug 9, 2013

Those hoping their predictions of a bursting bubble and cataclysmic drops in home values will come true are out of luck again,” said Phil Soper, president and chief executive of Royal LePage. “Price appreciation in most markets across the country has been well below the longterm average for Canada and will remain so through to the end of the year.
