Catawbas plan pre-launch summer opening for Casino Federal judge rejects Cherokee’s lawsuit, paving way for casino to move forward by MICHAEL E. POWELL Editor

In a recent media release to Community First Media, the Catawba Nation announced it plans to fast-track the summer 2021 opening of the Catawba Two Kings Casino Resort project in Kings Mountain. Calling the opening a “prelaunch”, their plan calls for the facility to have 500 slot machines. On April 16, the Catawba Nation received more good news when a federal ruling favored the U.S. Department of the Interior’s action in taking land into trust for the Catawba Nation, rejecting a lawsuit by the Eastern Band of the Cherokee. That decision was given last week by U.S. District Court Judge James E. Boasberg in a 50-plus page opinion sent out to the media from the Catawba Nation. See CASINO, Page 2

Former CHS Ironmen baseball head coach Henry Jones was one of eight Class of 2020 inductees to join the NCHSAA Hall of Fame according to information listed on the sports organization’s web site. Just last week, former
players and now coaches in their own right, CHS head basketball coach and AD Scott Harrill, CHS head baseball coach and former Jones player and assistant coach Scott Heavner, and former CHS baseball player and current assistant coach Brian Kiser attended the ceremony in Cary, N.C., when Coach Jones received his honor. Though the class was formally introduced at a luncheon on Wednesday, Oct. 9, 2019, at the NCHSAA offices in Chapel Hill, the
formal induction ceremony and banquet was held on Saturday, April 24, 2021, at the Embassy Suites in Cary. Said Coach Harrill of Coach Jones, “Coach Jones was my baseball coach and athletic director in high school, then I worked under him as a basketball coach while he was the AD. He is a great friend. Coach Jones has impacted more lives over his coaching career than most ever will. “It was not always about wins and losses (with him), but about relationships that
he built with his players and athletes. Coach Jones is very deserving of the honor of being selected in to the NCHSAA Hall of Fame. The Ironmen family is very proud of him. If you look at his coaching tree, you can see the impact he had on so many to go into teaching and coaching. Martha Eaker CHERRYVILLE – Mrs. Martha Leatherman Eaker, 78, passed away on Thursday, April 22, 2021 at Atrium Health – Cleveland in Shelby. Martha was born on March 3, 1943 in Cleveland County, NC, a daughter of the late Hillard Leatherman and Margaret Smith Leatherman. She retired as a secretary for Judge W. J. Allran. In addition to her parents, she was preceded in death by her niece, Allison Bennett Hovis. Survivors include her husband of 59 years, Richard Eaker, of the home; a son, Chris Eaker of Raleigh; a sister, Lynn Bennett and husband Rocky of Cherryville; nieces and nephews; Kevin Bennett (Lutricia), Wesley Bennett (Kristen), Kyle Bennett; Kim Huffman (Dustin), Dana Helms, and Kenny Helms (Carrie). Also surviving are a number of great-nieces and nephews. To honor Mrs. Eaker’s request, services and burial will be private. Memorials may be made to the donor’s choice. Governor Cooper outlines timeline for lifting state’s COVID-19 restrictions Governor Roy Cooper and North Carolina Department of Health and Human Services Secretary Mandy K. Cohen, M.D. laid out a timeline for lifting current pandemic restrictions last week. With stable trends and continued vaccination success, the state expects to lift mandatory social distancing, capacity, and mass gathering restrictions by June 1. The Governor plans to issue an executive order soon outlining safety restrictions for the month of May. “Each shot in an arm is a step closer to putting this pandemic in the rearview mirror,” said Governor Cooper. “North Carolinians have
shown up for each other throughout this entire pandemic and we need to keep up that commitment by getting our vaccines.” North Carolina continues to focus on distributing vaccines quickly and equitably. This fast and fair approach to getting shots in arms is the best way to beat this pandemic, protect one another, boost the economy and make it possible for restrictions to be lifted. To date, the state has administered over 6.5 million vaccines. 46.9 percent of adults are at least partially vaccinated, and 35.1 percent are fully vaccinated. More than 76 percent of people 65
and older have had at least one shot. With vaccine now widely available across the state – often with no wait for an appointment, all North Carolinians 16 and older can plan to take their shot. The state anticipates lifting the mask mandate and easing other public health recommendations, once two thirds of adult North Carolinians have received at least one vaccine dose and if trends remain stable. “We are at an exciting moment. We now have enough vaccine for everyone,” said Secretary Cohen. “If you are 16 and older, it is your turn to join the more
than 3.6 million North Carolinians who have already taken their first shot. It’s up to you to get us to the two thirds goal as quickly as possible so we can live with this virus and begin to put this pandemic behind us.” Gov. Cooper and Sec. In an earlier CF Media article, Chief Harris said, “With the completion of our compact with the State of North Carolina, the Catawba Nation is eager to open the casino as quickly as possible to begin bringing economic benefits and jobs to the state and region.” The Catawba are working with consultants Delaware North, as well as developer Skyboat Gaming, on the summer ‘prelaunch’ facility. The 17-acre casino site is off Dixon School Rd., in Kings Mountain, and is
near Interstate 85 and about 35 miles west of Charlotte. The total $273 million casino resort project is expected to create 2,600 permanent jobs at full buildout and thousands of construction jobs in the region. Cleveland County Commis-sioner Johnny Hutchins said, “This project will prove to be a long-lasting and sustainable economic engine for the residents of Cleveland County.” The Catawba can now conduct Class III gaming, including operating slot machines and table games. Earlier this year, the Catawba Compact was approved by Gov. Roy Cooper, as well as N.C.
Secretary of State Elaine Marshall and Attorney General Josh Stein. These and other actions, noted Chief Harris, recognize the Catawba Nation’s historical and ancestral ties to its aboriginal lands throughout North Carolina. Also, the compact with the

First Outdoor Outreach program a success! by TRACI POLLITT Cherryville Branch Manager
Our first outdoor outreach program was a success! I went to visit the students at Kingdom Kids Preschool last week. There were a few challenges, such as a good breeze, a lot of shade, and a sound speaker that wasn’t quite up to the crowd. It’s all part of the learning process! The program was kept short, running just about 15 minutes, but was enjoyed by all. It marked the beginning of the library being out and about again after an absence of over one year – and what a year it’s been! We are going to host our first in-person program here on Friday, May 14 with the return of
our crafting get-together known as Hooks, Needles & Thread. This program is for adults and registration is required. You’ll find it listed on the Gaston County Public Library Calendar of Events, as well as the link for registration. If you prefer, you can call us to register as well. As programs slowly come back, our thoughts turn to summer and our annual Summer Reading program. Last summer was...interesting. Our doors were closed, curbside became our means of providing service, and we have never been so grateful for phones! We had to become quick navigators of virtual programming, learning to record and edit clips, attempting Facebook

Remembering my mother on her special day Mother’s Day in this time of COVID is coming up (May 9). My darling wife tells me she wishes she could have met my mother. I agree. I wish she could have too. Of course, she would then wonder how someone as selfish as me could come from such a sweet little lady as my mom, but that’s another story. Alas, my memories of my mother are few. There are snippets I remember of her before her and my father’s untimely deaths, but only a few. See, while I should have been busy making more memories with them and trying my best to remember all I could, I was too busy being self-absorbed; too busy being what I was… a kid. Thing is, I never saw their demise coming. There was no way I could have. Were that possible I would have done anything within my power to savor each moment, or try to change fate or the future by stopping the wreck. I would have done literally anything to prolong the few years (15) I had with her

and with him. That is, of course, a fantasy; the stuff about which movies and television shows are made. I have written in the past about my mom and dad, to honor them whenever their special days, or a birthday comes around. Truth is that’s the only way I can do it nowadays. I can’t pick up a phone and call them. Nor can I send them an email or Skype with them. There is no Facebook in heaven. But that’s okay. I know where they are today. I know they are smiling down not only on me and my little family, but are smiling down also
on the Family Powell, including the new addition (a baby girl) who is scheduled to arrive (we hope and pray) the month of May. Bottom line for all this sentimentalism? Whoever is your family this Mother’s Day; whoever and/or wherever your mother is, call her, text her, Skype with her, or, assuming you can do so, just walk out your door, get in your car and drive over and wish her a great Mother’s Day. She’ll appreciate it no matter how she carries on. How do I know this? Because the one memory I do have of my mom’s reaction to me wishing her a happy Mother’s Day happened the year before she died. I drew her a Mother’s Day card and gave it to her. She had this funny little way of touching her top lip with her tongue and tearing up when she was happy. That’s what she did when she saw it. Power, Parler, and the problem of Big Tech by DR. BRIAN DELLINGER Guest columnist Over the course of 2020, the previously minor social media application Parler rose to national prominence. The site served as a smaller, right-leaning mirror to Twitter, attracting an audience that included (among others) both U.S. senators and QAnon conspiracy theorists. Where Twitter forbade referring to a transgender person by biological sex, Parler reportedly banned users for mocking Republican congressman Devin Nunes. By the end of the year, the app had hit nearly three million daily users. That changed after the
Jan. 6 attacks on the Capitol, amid allegations that the app provided a haven for insurrectionist sentiments. Responses were swift and comprehensive. On Jan. 8, Google announced that it was removing Parler from its Google Play Store. Similar notices quickly arrived from Amazon, Apple, and other technology companies. The app could no longer access most mobile stores for download, authenticate its existing users, or even host any actual content. Any existing posts were lost. In effect, over the course of 48 hours, it functionally ceased to exist. It is sometimes difficult to assess conservative claims
of “big tech censorship.” On one hand, Parler’s erasure came only a day after Facebook suspended the account of President Donald Trump, and the same day that Twitter joined in that ban. On the other, the bans followed Trump’s defense of the Capitol attacks as “the things … that happen when a sacred landslide election victory is … stripped away.” To ban a sitting president is a drastic step, but it is hardly less extreme for that president to praise thugs who stormed the congressional building. Likewise, to the extent that claims of Parler’s complicity in the attacks are merited, its erasure, too, is justified. Yet these bans come

We are thankful for our good doctors and all who help us with our medical needs. It’s important for us to listen to what they say, ask our questions and then determine the right thing to do. The Gaston County Board of Education received the following “good news” for the month of April 2021: ▪ The five finalists for Gaston County Schools Central Office Administrator of the Year are Brett Buchanan, Career and Technical Education; Chad Duncan, Athletics; Shannon Hullett, Academic Services; Curtis Poplin, Technology; and Alan Sprout, Technology. ▪ The five finalists for Gaston County Schools New Teacher of the Year are Hayley Bigelow, Holbrook Middle; Elizabeth Inzana, Hunter Huss High School; Madison Szucs, Robinson Elementary; Vekiza Williams, Woodhill Elementary; and Olivia Wylie, Stanley Middle. ▪ The five finalists for Gaston County Schools Teacher Assistant of the Year are Jenny Emerson, Cherryville Elementary; Dana Hannifin, Springfield Elementary; Wanda Marlowe, Catawba Heights Elementary; Giana McGuire, Pinewood Elementary; and Peyton Walls, Stanley Middle. ▪ Abbie Clark of Costner Elementary and W.C. Stuart W. Cramer High School senior Molly Matthews earned “Best in Show” for her award-winning piece titled “Everyday,” and Southwest Middle School student Camila Bonilla earned “Best in Show” for her award-winning piece titled “In My Dreams.” In addition, North Gaston High School student Maria Casanova received the James C. Biggers Award for her piece titled “Woman.” The Director’s Choice Awards were awarded to Cherryville High School student Drake Lytton for his painting titled “Basketball Basquiat” and Grier Middle School student Kaylee Rojas for her piece titled “Starry Starry Night.” ▪ The Gaston County Schools Career and Manufacturing Expo was held virtually this year at each middle school and high school. Students were able to hear about local career opportunities from Blum, Lanxess, Daimler, Dixon Quick Coupling, and GSM Services. The annual program is co-sponsored by the Gaston Business Association and Gaston College. ▪ Middle school and high school students in Gaston County Schools are participating in the Students@ Work program, which is a partnership with the N.C. Department of Public Instruction and the N.C. Business Committee for Education. Throughout the month, students are engaging in virtual programs to learn about potential career opportunities in Gaston County. ▪ The “Do the Right Thing” award winners for March are James McPherson of Page Primary, Jannah Perdomo of York Chester Middle School, and Zoe Espinoza of East Gaston High School. Cramer High School were selected as nominees for the best actor and best actress awards in this year’s Blumey Awards, a program that recognizes students in the Charlotte region for their outstanding achievements in theater arts. ▪ Stuart W. Cramer High School raised more $150 for the American Foundation for Suicide Prevention. ▪ The following Stuart W. Cramer High School athletic teams qualified for the Scholar-Athlete Team distinction that is awarded by the N.C. High School Athletic Association: boys’ soccer, boys’ and girls’ basketball, boys’ and girls’ swimming, boys’ and girls’ cross country, volleyball, and cheerleading. The academic honor is based on the combined grade point average for team members. ▪ Classroom Central in Charlotte provided 150 boxes of school supplies for teachers in Gaston County Schools. Each box included pencils, pens, copy paper, crayons, color pencils, folders, notebooks, and more. The donated supplies were valued at approximately $24,000. Carr Elementary School hosted a curbside pickup event for teachers to receive the supplies. ▪ Gardner Park Elementary fifth grader Kordak Denovese received a scholarship to attend the Junior National Leadership Conference in Washington, D.C. The program gives students an opportunity to engage in hands-on leadership activities and learn how to develop action plans to solve problems in their community. ▪ East Gaston High School teacher Brian Johnson was selected as one of five finalists for Regeneron’s STEM (science, technology, engineering, mathematics) education and outreach effort. The Advancing Science Research Teaching (ASRT) program is designed to equip high school teachers with the knowledge, insight, and resources needed to increase research opportunities for students through the traditional STEM classroom setting, club programs, and related activities. ▪ East Gaston High School senior Callie Payne received a $110,000 scholarship to attend Lees-McRae College. ▪ Forestview High School senior Valerie Farfan is one of four finalists for the George and Patricia Barnard Scholarship. She also is a finalist for the Wayne F. Shovelin Scholarship and accepted the Beaver Scholarship for Health Education to attend Appalachian State University. ▪ Forestview High School senior Foster Rouse received his Eagle Scout honor. For his Eagle Scout project, he adapted toys for children with special needs and donated them to the Gaston County Schools Exceptional Children Department. ▪ Gaston Early College High School student Chloe Yurick was accepted to attend Seton Hall University and received a $75,000 scholarship. ▪ In appreciation of their hard work and support of students, Lingerfeldt Elementary teachers and staff received coffee and doughnuts from Miss Gastonia Julia DeSerio and Miss Gaston County’s Outstanding Teen Alexandria Foy, who is a student at Stuart W. Cramer High School. ▪ North Belmont Elementary teacher Vanessa Hairston was selected to participate in the Kenan Fellows Program for Teacher Leadership at N.C. State University.
▪ Pinewood Elementary teacher Rebecca O’Bryon is one of 30 educators from the United States who will be traveling to Nairobi, Kenya to visit award-winning educators and learn about the Kenyan educational system. While there, she will spend time with teachers who are making a difference in some of the most impoverished villages in the world. ▪ Rankin Elementary students and staff collected 7,564 nonperishable items as part of the school’s “Stock the Shelves with Kind Words” food drive. LeeAnn Pearson’s second grade class collected the most items with 1,544. Here is McNeill’s essay on his Star Teacher choice, Mr. Robert “Lance” Holt. McNeill wrote, “The teacher that has had the greatest impact on my life is the one and only Mr. Robert Holt. Mr. Holt is one of the most genuine teachers I have ever had the pleasure of being the student of. From making what some would call a boring class, to his intuitive and interactive lessons, he engages his students with games in order for them to learn and enjoy the class. I have observed this virtue in two different classes: American History I and AP American History, where his students seem to excel, resulting in high scores in class and on the AP Final Exam. Not only is he a great teacher, but he is also an exceptional role model. “My freshman year, Mr. Holt became a track coach, even though he had no prior knowledge of the sport. He did this from his heart for his students and sacrificed his own time to provide more for the

Mr. Holt is a great teacher and a great man, and I am happy to have had the opportunity to be his student.” For his part, Mr. Holt said of being chosen by Mr. McNeill, “I am honored to be among the Star Teachers of Gaston County, especially since I was chosen by such an incredible young man. Chase was my student last year in AP U.S. History, and it should be no surprise that he excelled. Ironmen win first two games of baseball season Former coach Henry Jones throws out pitch at first home game since COVID-19 shutdown by MICHAEL E. POWELL Editor michael@cfmedia.info The Ironmen baseball team is off to a good start, winning their first two games – one an away game; the other at home at Fraley Field – of the 2021 season. The away game, played last Tuesday (April 27) at Ashbrook, was an 11-9 win, and a win for starter Kanon Willis. Head coach Scott Heavner used three pitchers in this matchup: Willis; Trip Creason; and Eli Newsome. For the Ironmen, Landon Hahn was 2-5, with 2 RBIs; Will Fowler was 2-4, with 2 RBIs; and Collin Robinson was 3-4, with 2 RBIs. Five
other Ironmen batters had a hit each. Against Christ the King This game, which the Ironmen won 9-0, was the first game played at Fraley Field since March 2020 when the coronavirus pretty much shut everything down across the world, from economies to sports. To start things off, former CHS Ironmen baseball head coach Henry Jones tossed out the first pitch to current Ironmen head coach Scott Heavner. Coach Jones was recently inducted as part of the Class of 2020 NCHSAA Sports Hall of Fame, in a recent ceremony in Cary, N.C. The Ironmen had nine runs off of eight hits; had one error, and left 10 men on base in this matchup. The Ironmen played Highland Tech at Gastonia’s Sims Park on Tuesday, May 4, and will be away again at Thomas Jefferson Classical Academy on Friday, May7. CHS Ironmen track teams do well at recent meet by MICHAEL E. POWELL Editor michael@cfmedia.info Cherryville Ironmen men’s and women’s track coaches Justin W. Willyoung and Houston Gilmore were pleased with their teams’ showing this past week as the men placed first in their meet and the women places a solid second. Coach Willyoung, Head Men’s Track and Field Coach, noted the team scores for the boys were as follows: CHS– 105; HighlandTech – 61; Christ the King – 33; and Bessemer City – 18, while the scores for the girls were Christ the King – 66; CHS – 53; Highland Tech – 49; and BCHS – 7. Said Coach Willyoung, “The boys top performers were Jackson Owens in the 400-meter dash, first place; 4 by 100-meter relay, first place); 4 by 200-meter relay, first place; and 4 by 400-meter relay, second place.” Others in the men’s team doing well were: Jack Mulvey – High Jump, first place; Long Jump, first place; and Triple Jump, first place; Chase McNeil – 4 by 100-meter relay, first place; 4 by 200-meter
relay, first place; 4 by 400-meter relay, second place; and 400-meter dash, second place; Matt Torres – 4 by 100-meter relay, first place; 4 by 200-meter relay, first place; 4 by 400-meter relay, second place; and third place in the 400-meter dash. Anthony Roberts – 4 by 200meter relay, first place; second place in the High jump; Long Jump, second place; and Triple Jump, second place; Scott Stroupe – 3,200-meter, first place; and 1,600 meter, third place; Markize Heard – 300 hurdles, first place; 110 hurdles, second place; and third place in the Long Jump. Marlon Gomez-Alamillo took first place in the 4 by 100-meter relay and second place in the 4 by 400-meter relay. Zamir Dunbar placed third in the 200-meter dash, while Gage Price placed third in the shot put and third in the discus. Coach Willyoung noted there was “…no shortage of heart or character (last week) for the Ironmen.” He continued, “As a team we had a goal of proving this season that we are not to be underesti-
mated and here to win and that’s exactly what we did all day on the track and in the field. Event after event our athletes showed up in top form and held nothing back, we could not be more proud of these kids or the effort they showed. “Mentally, they came prepared and pushed through the heat and pain to accomplish exactly what we set out to do. We had a lot of first and second place finishes out there but what we are most proud of is the effort and teamwork that our kids displayed and the support they showed each other and the other teams.” Willyoung noted juniors Jackson Owens and Jack Mulvey were three-event winners for the boys team and helped to put many points on the board in the victory. He added senior Chase McNeill showed much “grit” coming off a fractured lower leg from soccer season. “He had to run different events than he is accustomed too while easing himself back into shape and filled in admirably in all four events,” said Willyoung. Freshman Marlon Gomez-Ala-
millo showed, noted coach Willyoung, a “ton of heart” by stepping up in the 4 by 400-meter relay and keeping his team in the race, allowing Owens to run down the other team and secure secnd place in a tough race. Sophomore Kam Bolin and senior Markize Heard impressed with solid performances in the hurdle events, said Willyoung, who added, “Sophomore Scott Stroupe set the pace in the boys 3200 and never lost his lead, cruising to an easy victory in the event. He also ran a personal best 1,600meter time on the day. “(Senior) Gage Price turned in a solid performance in the throws adding two third-place finishes while senior Matt Torres, who is one of the most versatile members of the team, did a great job leading off our relays and helping us secure victories in two of his four events.” Junior Anthony Roberts secured three second place finishes in the jumps, said Coach, and was a member of the winning 4 by 200meter relay team. Said Coach Willyoung, “It’s going to be fun to watch Jack and
Anthony in the jumps this year, as both have the ability to win each event on any given day.” In Lady Ironmen track action, Coach Houston Gilmore said his top performing girls are Rylee Grace Burgis, who placed first in the High Jump, Long Jump, and the 4 by 200 relay, and second place in the 4 by 100-relay. Others of the ladies who did well at the recent meet were Callista Spencer – first place, 4 by 200 relay; second in the 4 by100; and third in the 100- and 200-meter dash. Izzy Wilson placed first in the 4 by 200 relay and second in the 4 by 100 relay, while Sarah Rayfield placed first in the 300 hurdles, and second in the 100 hurdles. Ceniya Powell placed first in the 4 by 200 relay and Gabbi McCorkle placed first in the shot put. Coach Gilmore said, “The meet on the girls’ side was definitely a team effort. I am proud of the effort that each girl gave on every event. We had great showings from multiple competitors. We had a lot of top-place finishers in different events. I look forward to us continuing our upward tra-
jectory for this season.” In conclusion, Coach Willyoung noted juniors Rylee Grace Burgis and Callista Spencer led the way for the girls’ team placing in four events each. Said Willyoung, “Rylee Grace is in her first year of high school track and is already on pace to finish among the top in the region in a few of her events. She has been a welcome addition to the team. Callista ran strong, as always, and we are eager to see her continue to improve. Senior Izzy Wilson, who missed last season due to a torn ACL, came back strong this year to regain her place in the relays, she worked hard and helped us score valuable points. “Freshmen Ceniya Powell and Sarah Rayfield stepped up and put forth some strong efforts on the track, while sophomore Gabbi McCorkle had a great day and strong showing in the throws, taking first place in the shot put.” Both coaches said they have a great deal of new and young members on the girls’ squad that are all looking to contribute after a strong showing last week.

JONES From Page 1 According to the “bio” of him on the NCHSAA web site, Coach Jones, who graduated from Shelby High School, then later from Gardner-Webb University, “…began his teaching and coaching career in Gaston County’s Cherryville High School in 1973.” He served, it was noted, “…as the school’s head coach in numerous sports including, basketball, football, and cross country, during his tenure from 1973 until 2005 but made his most notable contributions in baseball. “Jones led the Ironmen baseball program to six State Championships in three different decades (1980, 1982, 1992, 1993, 1998, and 2001) and a runner-up finish in
1997 while appearing in the post-season 24 out of 28 years. “His teams won conference championships 11 times while posting a career record of 542-207,” and he was named Coach of the Year in the conference on eight different occasions as well as Gaston County Coach of the Year “numerous times.” Additionally, as per the NCHSAA web site, Coach Jones “…was selected as the 1982 Outstanding 2A Coach by the North Carolina Association of Broadcasters and won the 1993 North Carolina Baseball Coaches Association Coach of the Year Award and was given a Meritorious Service Award by that group in 1997.” For 25-plus years Jones was the athletic director at Cherryville, and in 1988, the NCHSAA honored him with the Region 6 award for Male

good incentive to throttle upstarts in this way: by doing so, they limit the competition. Such possibilities limit the strength of the usual free market response to corporate politicking: “If you don’t like it, build an alternative.” Parler’s troubles suggest that this solution is less viable than might be hoped. Developing a successful social media site is already a substantial challenge; to do so while also creating a new mobile storefront, authenticator, cloud service, and so on seems simply untenable. A solution to this problem, unfortunately, remains elusive. Some conservatives suggest that the above cases justify the repeal of Section 230 of the Communications Decency Act. Under Section 230, websites do not risk liability for deleting content, even where that content is protected by the First Amendment. Critics claim that the act was intended to target only broadly objectionable material, with the expectation that tech firms would be politically neutral in what they removed; this expectation, they say, clearly has not been met. As I have argued elsewhere, such arguments are misleading and wrongheaded. Section 230 explicitly protects removal of content for any reason, not merely a “reasonable person” standard of undesirability. Its repeal would not prevent Twitter from putting “content disputed” warnings on Tweets (since such labels are Twitter’s own speech, and so protected by the First Amendment); nor Amazon from simply refusing, like any retailer, to carry certain products; nor Google from doing business with whom it pleases. On
the other hand, repeal could place heavy burdens on new social media competitors, which may explain Facebook CEO Mark Zuckerberg’s support for replacing Section 230 protections. Above all, it seems bizarrely shortsighted for Republicans to urge greater government interference in social media in this moment. One questions whether they expect the Democrat-controlled Congress and presidency to be more friendly to conservative speech than the status quo. Perhaps the best of a set of bad options is to reconsider the role of antitrust laws. At issue in all the cases above is the ubiquity of the big tech firms: that decisions by a small group of companies can render information meaningfully unreachable or invisible. Amazon is at once a premier bookseller, accounting for over half of all American book sales, as well as a nearly $400 billion-a-year general retailer and the provider of a full third of all cloud infrastructure services. For its part, Google’s parent company Alphabet might simultaneously own the servers hosting a site, the ads running on it, the browser loading it and the physical cables transmitting it—and, of course, the search engine that located it. It controls a plurality of the market in several of these fields. Indeed, Google is already facing multiple lawsuits alleging anticompetitive behavior. Careful revision of antitrust law might allow reopening of these markets, with competition encouraging a range of stances, political and otherwise. At minimum, such changes seem less fraught than inviting the government into the business of judging neutrality.
