WEST MIDLANDS LawCare, the charity that supports the legal community interviewed a few lawyers in relation to mental health and well-being and received the following responses: “Right from the start when you’re training in law, you compete with your peers for placements and jobs and that competitive pressure is always there…..” Billing clients by the hour means those who stay in the office the longest gets the rewards and recognition……” “In law, everything’s black or white, right or wrong, and you’re always looking for problems, risks, loopholes and downsides. This can lead to a lot of negative emotion….”. GOLEGAL recommends the following 10 tips for lawyers who want to improve their mental health and these tips are supported by Birmingham Law Society:

PRESIDENT OF BIRMINGHAM LAW SOCIETY INEZ BROWN ON THE BIG ISSUES AFFECTING THE WEST MIDLANDS’ LEGAL PROFESSION IN 2020 / 2021 COVID19: 2020 was an extremely challenging year for the legal profession in Birmingham and these challenges have spilled into 2021. Normal business practices have been disrupted resulting in cancelled contractions and/or the need to renegotiate contracts. Many force majeure clauses have been invoked after being triggered by unforeseen circumstances that have prevented parties being able to fulfil contracts. Lawyers and the judicial system have embraced technology that has been accelerated by the pandemic. Virtual courts and remote hearings have helped to alleviate the burden of a clogged-up court system. Video conferencing has kept lawyers in touch with clients. The invention of DocuSign and so many other practical technological advances have helped to bring lawyers into the 21st century. At the beginning of COVID19 the Property Sector was brought to a standstill. However, by summer 2020 there was a boom in house sales, but this was assisted by the introduction of stamp duty holidays and additional government assistance. Interestingly, the Family Law Sector has continued to receive instructions during lockdown. I suspect that this is because of the effect of families being together due to remote working and children not attending school. Unfortunately spending so much time together has put a strain on many families together with increased financial pressures. The Private Client sector has also seen a four-fold increase in instructions in relation to wills; power of attorney; trusts and tax planning together with probate instructions. The Law Society of England and Wales conducted a survey in 2020 that suggests that firms are forecasting a 10-20% drop in revenue for the 2020/2021 financial year. The same survey suggests that the average number of lockup days for firms of all sizes is 155 days and that most firms expect those 155 days now to increase by 15-25 days. Birmingham Law Society has continued to engage with members during the pandemic with lawyers sharing knowledge on best practice during lockdown; arranging seminars and arranging fun virtual events to keep our spirits up. MENTAL HEALTH AND WELL-BEING: Prior to COVID19 legal professionals were thought to have higher levels of mental health issues and lower levels of wellbeing than the general population. Why – because the legal profession has a unique culture with pressures and expectations that have been exacerbated by COVID19.

Get to grips with your values – identify what your core values are in order to bring your life back into balance;

2.

Sleep – poor sleep is linked to mental health problems, anxiety and depression. Leave your phone in another room as blue light (that bright light emitted by our electronic devices) messes with our body’s ability to prepare for sleep;

3.

Keep active – lulls in mental health can leave you feeling sluggish and less inclined to exercise but try walking;

4.

Sing – yes, gentlemen, you too! There is nothing quite like belting out a good tune to lift your mood;

5.

Eat well – eating foods rich in complex carbohydrates, vitamins, minerals, protein and fatty acids is key to keeping your brain in good working order and therefore improving mental health;

6.

Meditate – this is not for everyone but many several successful lawyers and entrepreneurs meditate daily;

7.

Live within your means – try not to overspend and talk to someone if you are experiencing financial difficulties;

8.

Maintain your external relationships – make time for friends and family outside of the office because they matter, especially when things get difficult with work colleagues;

9.

Prioritise priorities – make a choice on your priorities as there are only a certain number of hours in a day. Plan to have a fulfilling life outside the office as this helps to maintain a good work life balance.

10.

Seek external support – by way of coaching, counselling, and mentorship that offer a confidential space to talk

Although Birmingham’s legal sector has been faced with many challenges it is still an attractive place to work. Chambers boasts that Birmingham still has one of the largest concentrations of legal services in the UK outside of London, second only to Manchester and Leeds. In addition, it houses several universities and LPC providers including the University of Birmingham; Birmingham City University; BPP and the University of Law. Birmingham continues to have fantastic transport links and the rapid growth of the financial and professional service sectors over the past years. Birmingham also has several local large firms such as Gowlings WLG; Gatleys, the first UK law firm to go public on the Stock Exchange; Browne Jacobson; Freeths; Irwin Mitchell, to name but a few. A host of major national firms, who also have international links have a significant presence in Birmingham including Squire Patton Boggs; Eversheds Sutherland; DLA Piper and Pinsent Masons. HS2 is set to provide event faster links to London, Manchester; Leeds; and Sheffield by 2026 which will make it an even more attractive place to set up a law firm. Finally, Birmingham is a major legal hub in the UK that offers lots of opportunities to aspiring lawyers.

LOOKING AHEAD: 2021 PREDICTIONS date. With the Democrats now taking control of the US Senate, Biden has a much freer hand to reverse the policies of the Trump Administration. This is likely to result in ESG topics gaining attention and greater momentum in US investment strategies. The new administration will almost certainly forge a better relationship with the EU and the UK especially on climate change. On top of this, Covid-19 has acted as an additional catalyst to accelerate that process, with a shift of focus to the fundamentals, such as how a business manages the welfare of employees and its communities.

Simon Boyle, Environmental Law Director at Landmark shares his views on what ESG trends we may see over the coming year: “We support firms in screening, and managing global material Environmental, Social and Governance (ESG) impacts - and it is looking clear that with the recent change of US Administration, this will have a real impact on the year ahead, particularly from a climate change and sustainability perspective. As is widely reported, the Trump Administration was sceptical regarding climate change and therefore pulled out of the Paris Agreement and promoted the use of fossil fuels rather than help transitioning the economy towards renewable energy. As a consequence, ESG issues were mostly driven by the EU. We believe this is likely to change over the coming year, with Joe Biden’s climate emergency plan being reported as the most ambitious by a US presidential candidate to

In addition, the EU Sustainable Disclosure Regulation applies from 10 March 2021, plus the UK’s Task Force on Climate-related Financial Disclosures (TCFD) announced it will mandate climate risk disclosures across major sections of the UK economy by 2025. These milestones highlight the increasing focus on regulatory frameworks to deliver ESG improvements.
