Nicole Poston knows what it’s like to work under pressure. As a former Army medic, she was a member of the medical staff for her unit traveling around Iraq for a year. As an emergency room nurse at Hillsdale Hospital she’s been part of a team that navigated three transfers via helicopter in just 45 minutes. New Year always brings with it opportunities that have previously gone untapped. These opportunities enable one to learn, see new things, discover hidden treasures in the community and hone new skills or perfect a craft or hobby. Consider resolving to take advantage of one or more of the many opportunities offered in the Adrian area. The Adrian Center for the Arts strives to showcase the visual arts in our region by providing studio space for serious artists as well as classes for the public. The ACA houses an arts community designed to reach and serve all of Lenawee County. It provides an environment in which all levels of arts education, from novice to master,

are nurtured. Many types of artists are supported – students, hobbyists and professionals. The ACA offers after-school activities and facilitates community functions, including: The Empty Bowls fundraiser, the Christmas Art Walk and Spring Fling. Upcoming events include: The Deer Antler Mount on January 14, Woodworking Basics on January 18, Rustic Wood Tool Caddy class for young adults on February 4, and Forging a Handmade Knife class on February 19. The Lenawee County Historical Museum is a living treasure trove of historical artifacts and items that tell the story of the history of Adrian and Lenawee County. Considerations Regarding A Prenuptial Agreement

As you prepare for your special day, you may want to consider whether a prenuptial agreement is desirable in your circumstances. People enter into prenuptial agreements for many reasons, such as to protect the inheritance of children born from a prior relationship, to ensure that a person either receives or is prohibited from receiving spousal support in the event of a divorce, or to preserve assets accumulated prior to the marriage by one or both parties. When a spouse passes away, the surviving spouse is entitled to certain property regardless of the deceased spouse’s will. With limited exceptions, the surviving spouse receives this property before any other person receives any property. By obtaining a prenuptial agreement, however, one or both parties can waive legal rights to this property. This result might be desirable to preserve an inheritance for children born from a prior relationship. In addition to addressing legal rights in probate estates, prenuptial agreements can also address spousal support issues. A party may want to eliminate the possibility that he or she could be liable for spousal support. On the other hand, if one of the parties anticipates sacrificing professional opportunities to stay home with the couple’s children, that party may want the protection of guaranteed spousal support. Prenuptial agreements can also address assets acquired prior to the marriage. If one or both parties bring significant property into the marriage, a prenuptial agreement may be desirable to make sure that the property is not lost in the event of divorce. An agreement can also take up the issue of how property acquired during the marriage would be divided.

Because prenuptial agreements address the possibility of divorce, contemplating and discussing a prenuptial agreement may raise concerns about the permanency of the marriage. These questions are beyond the scope of this article, but they are, of course, ones that the bride and groom will want to consider and discuss with each other. Michigan statutes permit prenuptial agreements, but require that they be in writing and executed before the marriage. According to established case law, if the validity of the prenuptial agreement is ever questioned in court, a number of factors will be considered. One such factor is whether the agreement was obtained through fraud, duress, mistake, misrepresentation, or nondisclosure of material fact. A second factor considers whether the agreement was unconscionable when executed. A third factor addresses how facts and circumstances may have changed since the agreement was executed to determine if enforcement is unfair and unreasonable. Engaged persons may be uncomfortable disclosing their personal information and financial assets to each other prior to getting married, but due to the risk that a court could later declare the prenuptial agreement invalid from lack of disclosure, it is wise and necessary to provide all personal and financial information to each other before a prenuptial agreement is signed. Because a prenuptial agreement is a complex legal document and can declared invalid by the court if it is prepared incorrectly, it is wise to retain a knowledgeable attorney to assist with the process of drafting and executing one.
