������������������ Bucks County Equestrian magazine has been reaching and serving eastern Pennsylvania and western New Jersey since its first issue in March of 2008. The publisher’s goal is to provide a quality medium for the equine community that features general topics of interest as well as highlights of people and topics from our region. Although centered around Bucks County, it was already serving an area beyond those limits. The great interest and support generated by readers (local hard copy readers as well as on-line readers from all over the country) and advertisers has created a great amount of growth in geographic range as well as page count. The publishers of Bucks County Equestrian have also branched into producing and managing Horse Expos, another avenue that is needed in this region. In January, an Equine Business Builder Seminar is planned as well. After experiencing all this growth and support, the publishers felt it was necessary to move to a more generic name that could encompass their entire menu of equine media products. After much consideration, Elite Equestrian was settled upon. “Horses are majestic animals, and anyone who is passionate about these noble creatures, no matter what their discipline, is an “elite equestrian”. For more than 30 years Dressage at Devon has been one of the most important dressage and sport horse breeding shows in North America. As the event has grown, the breed show has expanded to include nearly 70 classes and is considered one of the most prestigious sport horse shows outside of Europe. With world-class competitors, the event showcases the talents of horses such as Idocus, the 1994 Breed Show Grand Champion. The KWPN stallion competed in the Olympic Games and the World Cup Finals and returned to Dressage at Devon in 2006 to win the Grand Prix. He is also the sire of numerous Dressage at Devon winners. Williams’ presentation dubbed Saturday Nights at Devon With Rocher--The Rocher Experience, will detail his international Grand Prix experiences on Rocher, the charming black mare who had fans around the world. “I plan to cover aspects of the training I received with her, as well as competing in Europe,” Williams says of his Forum presentation. “I will also discuss things she taught me, including the importance of striving for a higher level of throughness and straightness. Finally, I want to describe how she touched my life and those of others.”

the USA Breeders’ Aw ar d

In 2003, the Dressage at Devon Committee developed the Born in the USA Breeders’ Awards to recognize and reward the achievements of American breeders. More than $25,000 in prize money has been awarded since the program’s inception. “We are very proud of the Born in the USA Breeders’ Awards,” says Lori Kaminski, President and CEO of Dressage at Devon. “American breeders have always supported Dressage at Devon and have made our breed show one of the largest in the world. These breeders are producing world-class horses and we wanted to showcase their accomplishments.” Horses of any breed that were conceived and born in the United States are eligible to receive a Born in the USA Breeders’ Award. The highest scoring horse from the open classes is the overall winner, and prize money and special awards are distributed in 14 categories. Complete rules can be found on the horse show website.

The Born in the USA Breeders’ Award winners are progressing from sport horse breeding classes to performance careers. One high profile Born in the USA Breeder’s Award winner is Hilltop Farm’s Cabana Boy, bred by Doug and Sharon Langer and shown by Christopher Hickey. The seven-year-old gelding, by Contucci out of Britannia (Bordeaux/ Weltmeyer), claimed the two-year-old colt/ gelding award in 2004 before continuing on to an impressive dressage career that has included two Markel/USEF National Young Horse Dressage Championships in 2007 and 2008. Cabana Boy continues to move up the levels and qualified for the 2009 U.S. National Dressage Championships at Prix St. Georges and Intermediaire I. Pikko del Cerro HU, by Pik L out of Rohweena (Rohdiamant/ Grundstein II), was the Born in the USA Overall Champion in 2005 with a score of 90.00% as a two-year-old. Last year he returned to earn the four and five year old stallion materiale award and finished fourth in the Markel/USEF National Young Horse Dressage Championship in the five year old division. The Pennsylvania Equine Activity Statue Does Not Protect You:

HOW TO PROTECT YOURSELF By Timothy M. White, Esquire

Any equine professional, horse enthusiast, or property owner who believes the Pennsylvania Equine Activity Statute (EAS) protects them is seriously mistaken. By its terms, the law offers little, if any, protection from liability for personal injuries beyond what is already available under general principles of negligence and the assumption of risk. Fortunately, there are some steps which can mitigate the changes of a successful lawsuit. The principles of negligence allow an injured person to recover damages, as compensation for the injury, if the injured person (plaintiff) proves the defendant owed the plaintiff a duty, the defendant breached the duty by failing to act reasonably under the circumstances, and that breach caused the injury. However, in athletic endeavors the doctrine of assumption of risk often provides a negligent party with a defense to a personal injury claim.

For example, a soccer player who is fouled and breaks his ankle cannot generally recover from the offender for the injury, because it resulted from an inherent risk of playing soccer, which the injured player knew was part of the game, and still chose to play. On the other hand, the player does not assume the risk of being intentionally punched in the face during the game.

The assumption of risk doctrine in the equine context, is well illustrated by considering the ever chaotic warm up ring. If a competitor, while warming up, fell and was injured because another rider failed to properly yield, the negligent rider, and even more likely the show operator may be able to defend a personal injury claim. However, in order to escape liability, the negligent rider, or the show operator, would have to prove that the injured competitor knew that another rider failing to yield was an inherent risk of riding in the warm up ring, and voluntarily assumed that risk by choosing to use the warm up ring. The Pennsylvania EAS does little to modify these principles or provide additional protections. First, the law does not apply to injuries to children. This is important, as people under eighteen make up a significant portion of the riding participants and spectators. Second, the statute does not apply unless there is strict compliance with its terms, which requires signs, three feet by two feet, in at least two locations that read:

YOU ASSUME THE RISK OF EQUINE ACTIVITIES PURSUANT TO PENNSYLVANIA LAW. Third, even if there are signs and the injured person is an adult, the statute only protects a defendant who can prove the injured person knowingly and voluntarily assumed the risk which led to the injury. Finally, the statute expressly states that its protections are to be strictly construed against providing any immunity. Therefore, even if the EAS applies, it provides no real measure of additional protection. The Pennsylvania EAS is lacking in a number of respects. The Pennsylvania EAS does not describe what risks are being assumed and what risks are not. The act applies to adult participants, but does not define who is considered a participant. Are spectators participants? What if that spectator is leaning on the rail at a show, does the proximity to danger make someone a participant? Moreover, the required signs use vague language and fail to inform the reader where to find the law.

Undoubtedly, the courts will be left to decide what risks are inherent in the activity, and who is a participant under the facts of each case. To date, no Pennsylvania appellate court has interpreted the EAS, leaving significant uncertainty and little guidance for equine enthusiasts in Pennsylvania. Therefore, equine professionals, horse enthusiasts, and property owners must protect themselves. Four steps that may provide some protection include: the use of a limited liability entity, maintenance of proper insurance coverage, the use of a well crafted release from liability form, and the development of and adherence to safety procedures to minimize risk. For some it may be advisable to form a limited liability entity, such as a corporation or limited liability company (LLC), under which to conduct equine operations. Where a limited liability entity is formed and respected, the entity’s creditors, including a successful plaintiff, may generally only recover damages from the

assets of the entity itself. This can provide significant protection to an equine enthusiast’s personal assets. Whether a limited liability entity is right for a particular situation is something to discuss with an attorney, who can help you with these decisions, and complete the proper documentation. It is extremely important to follow the required legal formalities throughout the entity’s existence, otherwise its separate legal identity may be ignored and the owner’s personal assets may be exposed to additional risk. Insurance for equine professionals, horse enthusiasts, and property owners is available from a number of companies. Policies are generally based on the scope of a particular individual or business’s activities and operations. There are policies designed for backyard horse owners, as well as for large commercial breeding and training programs. It is best to contact one of these companies to discuss the

coverage best suited for your situation. The lack of a strong EAS in Pennsylvania makes the release from liability form critical. A good release form will clearly spell out the inherent risks assumed by a participant or spectator. It will also expressly release the facility, the owner, the employees, and any independent contractors from liability for ordinary negligence. Pennsylvania law, however, treats releases with suspicion, narrowly construes the documents, and may invalidate a release if it finds its terms, or the circumstances surrounding its execution unfair. Therefore, the release must exclude any waiver of liability for recklessness or willful misconduct. If you do not have a release form, you should contact an Attorney to help you draft one. If you have one, it should be reviewed by an Attorney to ensure it complies with all applicable laws. This is particularly important if you “borrowed” your form from the internet or other common source.

Of course, the best defense against liability for injury or death is to avoid unsafe conditions in the first place. It is important to develop safety procedures and to make sure those procedures are followed every time. These procedures at a minimum should cover: how a rider or participant’s prior experience is recorded and evaluated, health records for the horses involved, riding and training logs, incident reports, notes on any vices or habits, and regular evaluations of a horses abilities and soundness. It should also address what to do if an accident or injury occurs. There are organizations and experts that can help you develop or evaluate your current procedures, and it is important to update your procedures regularly to incorporate industry best practices.

Parents, however, have their own rights with regard to injuries to minors, as they are the ones who would pay the medical bills for an injury. Also, one parent cannot sign away the rights of another parent, unless he or she is authorized to do so. What are the roles of the USEF and the USET Foundation?

Young Rider under the U.S.E.F. rules. Gold Medal winners are not allowed to continue to compete in the Talent Search classes, but may compete at the Finals. Started in 1956, by the U.S. Equestrian Team (now known as the U.S Equestrian Team Foundation), the U.S.E.T Medal Program awarded Gold, Silver and Bronze medals for wins in Talent Search classes. Today the Show Jumping Talent Search Program is part of the United States Equestrian Federation’s Show Jumping High-Performance Program. Lisa Holderby of Monmouth County, NJ tells the story of her experience of adopting a wild mustang from the Bureau of Land Management in a well told, fictionalized account. I think many of us have been enchanted by cowboy movies. Nothing captivates us more than the scene of powerful horses running, manes blowing in the wind, against a back drop of majestic mountains.

The Saucon Valley Conservancy will host its Third Annual Barn Tour on Saturday, September 12, 2009. SVC is an all volunteer non-profit organization founded in 1993. Home to two thoroughbreds, the owners of this lovely property have endeavored to make their home as environmentally friendly as possible. When they moved here, one of the ďŹ rst things the new owners noticed was that there were no worms and few birds. Their goal was to turn their newly acquired miniestate into a healthy farm. Consequently, the family has developed their pasture and gardens using no pesticides or herbicides. They import Lime from Lancaster County because it contains a higher amount of calcium. Rainwater is captured with the green barrel on the right side of the barn in the above photo. It is used to water plants. The signs set in on this page decorate the barn’s interior.

Historic Weathervanes The wind impacts those that farm the land and sail the seas.

As such, weathervanes have a big impact on our existence and our understanding of our place in nature. Weathervanes alerted citizens to changing weather patterns and varied wind direction. While barns are the typical locale for most of today’s weathervanes, the tradition of hosting a weathervane starts at the center of a community— at the community church. A ninth Century papal decree noted that all churches throughout Europe should show a cock on its dome or steeple. This resulted in the establishment of the “weather cocks”. Why a cock or rooster? The cock would act as a reminder of the prophecy that the cock would be silent on the morning after the Last Supper (Luke 22: 34-35).

Hence, weathervane figures of cocks or roosters have topped church steeples for centuries. Public & Private Weathervanes quickly popped up atop public buildings and private homesteads. For example, a grasshopper weathervane, in the early 1740s, adorned Boston’s Faneuil Hall. And statesmen, Paul Revere, President George Washington and President Thomas Jefferson all had weathervanes on their homes in Boston, Mount Vernon, and Monticello respectively. In the 19th Century, weathervanes were typically and traditionally sculpted in patriotic forms associated with Americana. Often weathervanes featured lady liberty, arrows, banners/flags, eagles, cows, and even famous race horses. Along the seashore, weathervanes with nautical motifs were popular and common in the form of sailing ships, fish, and sea gulls. By the 20th Century, weathervanes in the form of pigs, donkeys, goats, and other animals were

found atop various buildings.

Depending on condition and materials, many weathervanes command high prices on the secondary market. For instance, a somewhat traditional example of a copper weathervane from the 19th Century featuring a cow form sold for over $10,000. A unique weathervane made of gilded and molded copper in the form of a horse and jockey attributed to the J.W. Fiske firm of New York sold for $24,000 in 2007. And, to show the weathervane market’s prowess, in 2006, a rare molded copper Indian chief weathervane measuring 62 inches in height made by the Mott Iron Works of New York, circa 1900, sold for $5,840,000.

Anne Moss serves as Forum Coordinator and Dressage at Devon Committee member. She’s equally well-known for her incredible riding ability.
