All you need to know about pre-nuptial agreements
Traditionally, pre-nuptial agreements were entered into by the wealthy. However recently there has been a shift in cultural attitudes towards marriage, with couples increasingly getting married later in life and already owning property or having built up significant assets from inheritance, investments or savings during their working career.
What is a pre-nuptial agreement?
A pre-nuptial agreement is an agreement made by a couple before they marry or enter into a civil partnership. It sets out how a couple proposes to divide their assets should they divorce or following a breakdown in the civil partnership.
Are pre-nuptial agreements legally binding?
The short answer is no, however, the court will place significant weight on the terms of a pre-nuptial agreement provided it was correctly entered into, the terms were fair and it provides for the parties’ needs. It should always be assumed, when entering into a pre-nuptial agreement, that the parties will be held to it.
Points to consider when entering into a pre-nuptial agreement
In order to stand the best chance of a pre-nuptial agreement being upheld in court, certain criteria need to be met:
Each party had the right to obtain independent legal advice
Material disclosure exchanged by the parties
There was no fraud, duress or misrepresentation in reaching the agreement
That the agreement was fundamentally fair at the time it was entered into
Early preparation is vital - it is advisable for pre-nuptial agreements to be signed at least 28 days before the marriage/civil partnership to ensure there has been no duress.
