Bergen Swamp Preservation Society awards two “Partner-in Preservation” awards The Bergen Swamp Preservation Society (BSPS) awarded two “Partner-in-Preservation” Awards at the Society’s annual meeting held October 26. The “Partner-in-Preservation” award is given to an individual or organization for partnering with the Bergen Swamp Preservation Society (BSPS) to preserve and protect the native flora and fauna of New York State. The corporate award was received by Peggy Swapceinski, executive director of the Gillam-Grant Community Center (GGCC), Bergen. The GGCC was recognized for their support of the Bergen Swamp property in Byron and Bergen. The GGCC provided the meeting place to begin and end the Bergen Swamp spring pilgrimage tour of orchids. For over 20 years the GGCC served as custodian of BSPS document archives. Recently, the GGCC hosted a community “meet and

greet” produced by the Seneca Park Zoo and the BSPS. A live Eastern Massasauga rattlesnake and a live spotted turtle were displayed to a crowd of over a hundred. These two indigenous reptile species are listed as endangered by New York State and can still be found in the Bergen Swamp. The Gillam-Grant Community Center was nominated for this award by Society trustee John Adamski of Brighton. The individual award was received by Joseph Whitcomb, a long serving trustee. Whitcomb, who resides in Newark, was awarded for his long service on behalf of the Zurich Bog property in Arcadia, NY and to the Society. Whitcomb served the BSPS for over 40 years as a Society trustee, president, Zurich Bog Property chairperson and as a personal inspiration to the current trustees. Whitcomb laid the first Black Locust boardwalk trail into Zurich Bog. This trail enabled visitor access to the orchids and carnivorous plants found in this National Natural Landmark. Whitcomb oversaw the acquisition of four additional parcels of land to the BSPS Zurich Bog property. The most recent was an 18 acre parcel of land that he personally purchased and gifted to the BSPS for preservation and protection of the native wetland plants. Joseph Whitcomb was nominated for this award by Society trustee Lee Drake Sr. of Bloomfield. The Bergen Swamp Preservation Society is the first and oldest private ecological preservation land trust in the United States. The Society was chartered in 1936 by the New York State Department of Education as a “Living Museum.” Since its charter, the Society has operated by volunteers with a membership of 400 persons and corporations. The Society owns and manages five separate properties in upstate New York. Two of the Society’s properties are recognized by Federal Department of Interior as National Natural Landmarks: the Bergen Swamp

New way to dispose of electronic appliances Assemblyman Steve Hawley (R,C,I-Batavia) is advising residents about the new way consumers are required to dispose of electronic equipment. Starting January 1, 2015, the New York State Electronic Equipment Recycling and Reuse Act will require that consumers dispose of electronic equipment by either returning it to either the manufacturer or a designated New York State Waste Collection Site.

“There is now a new way that consumers are required to dispose of their electronic equipment. I want to make sure that residents are aware of this change to the law so they are in compliance,” said Hawley. “The new way electronics must be disposed of is simple and easy to understand and costs the consumer nothing. Under this law, there are two ways to dispose of electronics. The first way is the use the newlyrequired product manufacturer ’s take-back program. A listing of manufacturers and how to contact them about the take-back program can be found at http://www.dec.ny.gov/chemical/82084. html. The second way you can drop off your electronics is at a designated New York State Waste Collection Site. A list of collection sites can be found at http://www.dec.ny.gov/docs/materials_ minerals_pdf/ewcolsites.pdf. Call ahead to make sure the specific collection site is able to take back your specific piece of electronic equipment. Tops Plaza project needs full form SEQR Tire shop proposed for canal side by Kristina Gabalski The Village of Spencerport Planning Board’s regular meeting December 2 included two major projects of interest to residents: the Mavis Discount Tire shop proposed for the Tops Plaza and a subdivision with 80 residential units proposed on land the village annexed from the Town of Ogden. The Mavis Tire project has hit a snag in the environmental impact assessment process, meaning it will not move forward until after the first of the year. Tops Plaza owner David Pelusio of Pelusio Spencerport, LLC, and Kris Schultz of Schultz Associates attended the December 2 Planning Board meeting to continue discussion of the site plan with board members. During the presentation, which addressed concerns that surfaced during the November 4 regular meeting of the Planning Board, Kris Schultz explained that because the Erie Canal is now listed on the National Register of Historic Places, the long or full State Environmental Quality Assessment Review (SEQR) must be filled out. The Planning Board had already decided to act as lead agency when the process to complete the short form SEQR was begun. Schultz explained that the board needed to rescind that lead agency status in order to send out requests to inquire if any other interested parties - which now include the NYS Canal Corp and the NYS Thruway would be interested in serving as lead agency for the long form environmental assessment. Schultz had hoped the Board could move the process along December 2, but the Board’s attorney, Eric Stowe, raised some questions over the completed long form and the board decided to table action until their next meeting in January. “The board can’t take action without the SEQR being complete,” Stowe said. The 6,700 square feet Mavis Tire is proposed for 26 Slayton Avenue next to the WEMOCO building. It would back-up to the canal path and include eight bays. Schultz expressed confidence that the project would make its way through the environmental assessment process. “This is redeveloping a site ... in a plaza, replacing blacktop with a building. There are no utility issues ... wetland or flood plains,” he said.
Stowe, however, said he felt the proximity to the canal might be enough of an obstacle to prevent obtaining approval. He cited another case where a historic property was located across a four-lane roadway from proposed development. The development was considered to be too close or, “substantially contiguous,” in that case, Stowe said. Regarding the second issue on the agenda, the Planning Board voted 4-1 to pass on to the Village Board the review of the application for proposed re-zoning of Village Pines Section 3 from R-1 to Planned Residential District (PRD) zoning. Andrew Spencer of BME Associates presented a conceptual plan for the 34 1/2 acre subdivision proposed in the Luther Jacobs neighborhood area - between Rts. 31 and 531. Coventry Drive would provide the main access, Spencer said. The subdivision would be located just north of Route 531. The land has been annexed into the village and the development proposed includes 80 units - 42 single family homes and 38 townhouses. Thirteen acres would be left as open space. Spencer said back in 2005, the project received re-zoning to a senior citizen district when it was part of the Town of Ogden. That project never came to fruition. The proposal “... follows the village comprehensive plan and existing codes,” Spencer said. Planning Board members did express some concerns before their vote. “The lot size is very small,” Denny Marra said. He noted that the small lots might not be attractive to buyers. Bill Rutter also expressed concerns over the density of the build, which he said was, “high for the acreage. I’m also concerned about putting something up that there is no demand for.” Rutter was the only opposing vote in sending the proposal to the Village Board, which was expected to review the re-zoning application at its December 3 meeting. Planning Board members also expressed concerns over traffic, the impact on utilities (electric would come from RG&E) and poor water pressure in the area. Planning Board member Craig Byham said the Village Board would hold a public hearing on the re-zoning at a future date. If the re-zoning is eventually approved, the proposal would come back to the Planning Board for further review.
New Horizons Bands perform Holiday Concert The Eastman Community Music School’s New Horizons Band will present a free holiday concert at 2 p.m. Sunday, December 14 at the U of R Advancement Center (formerly St. Agnes HS). The 75-minute program will feature traditional and popular music of the holiday season. The bands are part of the New Horizons adult music education program sponsored by the Eastman Community Music School.The first New Horizons program was formed in 1991 at Eastman under the guidance of Roy Ernst, now professor emeritus. Members include those with little or no musical experience, those who have postponed participating in an ensemble due to career and family, and seasoned musicians. The program has grown internationally to more than 225 chapters in the United States, Canada, Ireland, South Africa, France, Italy, Australia, Netherlands, England, New Zealand, and Iceland. Originally designed for seniors, New Horizons now ac-
cepts adults of all ages and any level of experience. More than 250 people are involved in the local program, which includes three levels of band, two jazz bands, string and full orchestras, small ensembles, and a chorus. The ensembles perform annually at the Xerox International Jazz Festival in June as well as in Kilbourn Hall and Kodak Hall at the Eastman Theatre. The Clarinet Choir has been selected to perform at the International ClarinetFest in both Austin, Texas and Baton Rouge, Louisiana. During the year, the band presents community outreach concerts in area schools, senior living centers, and community festivals. by Kristina Gabalski It’s a business that just turned one-year old, but it’s rooted in family ties and traditions that go back decades. Jim’s Ground Round restaurant, located at 1205 Spencerport Road (Route 31) in Gates is owned and operated by Jimmy, Kyle and Lindsay Nucelli - all siblings and children of Jim Nucelli who ran Jim and Ralph’s with his brother on Elmgrove Road for nearly 30 years. In the tradition of their father, the Nucelli siblings opened Jim’s Ground Round in October of 2013, about three months after Jim and Ralph’s closed it’s doors. The menu at Jim’s Ground Round features pressed ground round burgers, sandwiches, salads, wraps, wings, kids’ meals, and more, including milkshakes. “All of our sauces are homemade,” Lindsay says, “Our meat sauces, soups, and chili are all homemade. Our meatballs are made by hand.” “Our burgers are pressed with a pie plate,” Kyle adds. The steak bomber is a customer favorite, Lindsay says. “The burgers get a lot of praise ... and the wings.” Customers also enjoy the friendly service - both Kyle and Lindsay say - “People tell us they are always served by friendly faces.” Q. How did you get started? The three siblings, who range in age from 21-26, say they wanted to continue the restaurant tradition begun by their dad. “A lot of people were disappointed when Jim and Ralph’s closed,” Kyle and Lindsay explain. The three are working to pattern the restaurant more specifically on the original Jim’s Ground Round, which their dad ran on Buffalo Rd., before going into business with his brother. They say they really enjoy working together and interacting with their customers. “We know a ton of our customers by name,” Kyle says. “We like the smaller atmosphere where we can be closer to the customers,” Lindsay notes. Q. How is business? “The business is doing great,” Kyle says, “it’s busier and busier each week.” “People come in and say, we didn’t know you were here,” Lindsay says, and adds that the restaurant recently expanded its available seating by adding booths.

Q. How about the future? The Nucellis say they are around for the long run. “As long as our customers stay with us, we are here to stay,” Lindsay says. There is room for the business to expand at its current location, if the Nucellis decide to do so. Q. Any advice for a person thinking about going into business? “You have to get along with the people you get into business with,” Kyle says. “You have to love people,” Lindsay observes, “that’s what it’s all about.” They both add that you also have to be willing to put in long hours. Jim’s Ground Round is open Monday through Thursday from 11 a.m. to 9 p.m. and Friday and Saturday from 11 a.m. to 9:30 p.m.
Q. Was there a big learning curve in opening your own place? “The cooking and service were natural,” Kyle and Lindsay say. All three siblings had helped out for years at their dad’s restaurant, but being involved in the financial side of the business was a bit more challenging. “We all have our part in the business,” they explain. For example, Kyle knows the recipes and Lindsay handles the money matters as well as the decorating. Jimmy was busy behind the scenes in the kitchen during this interview and focuses on customer service. The Nucellis credit their dad for showing them what it is like to work hard. “He dedicated himself to other people,” they say.

Ogden officials discuss recent state audit by Kristina Gabalski Ogden officials say they agree with the findings of a recent State Comptroller’s audit which found internal controls over financial management and court operations are not adequate and have contributed to the town levying more property taxes than necessary. “We agreed with the audit,” Supervisor Gay Lenhard says. “We are not unhappy at all. We’re doing what they’re asking us to do.” The state recommended that the town develop longterm financial plans, policies and procedures to govern developing and monitoring the budget estimates and the amount of unexpected surplus funds to maintain; and ensure the supervisor provides all Board members with accurate and complete monthly financial reports which are to be used to monitor the town’s financial position and budget status throughout the fiscal year. The town has provided the state with a Corrective Action Plan which is already being implemented, according to officials. Taxes have been reduced in the 2015 budget for residents who live outside the Village of Spencerport from $5.70 to $5.53/$1,000. Supervisor Gay Lenhard and Paula Parker, Director of Finance, say the part-town (town outside the village or TOV) fund will have a zero levy and the highway fund has been significantly reduced in the 2015 budget. “The Board has been responsible,” says Parker. “Taxes have been very stable since 2009. The town has stayed within the tax cap since it started.” She explains that the town is working to develop a fund balance policy which includes reasons why a designated amount is necessary. The town will then stay within those amounts. “We will systematically review the policy over the next 3 to 5 years and slowly correct it in the way it was created - over time,” Parker says. “We will continue on the road to reduce taxes, reduce expenditures and use the surplus in the part-town and highway funds. The general fund needs an adequate balance for the needs of the community.” The audit was critical of the town’s $4 million in unexpended surplus funds in the town-outside-the village (TOV) funds and town-wide drainage fund as well as $1 million in TOV reserve funds, which the state says should have been used for authorized purposes or to reduce property taxes. The audit also found the town had underestimated sales tax revenue by more than $1.8 million. Parker and Lenhard explain that under state law, there is very little flexibility in how revenues are used. Sales tax revenue must go into the TOV or highway funds, it
cannot go into the general fund. Parker says the general fund (the town-wide tax base including the Village of Spencerport) must be used to fund police, the library, building maintenance, highway buildings, the court system, recreation, highway administration, the town clerk, nutrition/seniors, and park acquisition and development of land. “We can’t take from the highway or part-town (TOV) to put in the general fund because they are different tax bases,” Parker says. “We can’t use it for what we want to use it for,” Supervisor Lenhard adds regarding surpluses in the part-town and highway funds. As a result of adjustments made since the audit, Village of Spencerport taxes will be increased from $3.68 to 3.98/$1,000. Supervisor Lenhard says the town should have been watching that area more carefully. “We could have raised (taxes) more incrementally,” she says, noting the increase is a large one. “We are continuing to smooth everything out,” Finance Director Parker says. “We will have to keep raising village taxes until it gets fair.” The town has no debt service and the audit found no instances of missing funds. Lenhard says the town’s record-keeping has made audits easier for the state. “In the end, people will see some rebates and the town will be in a good position to meet state constraints,” Parker says. She explains that the town does have some flexibility in moving funds between the part-town (TOV) and highways funds and observes that, “apportionment between the part-town (TOV) and highway funds might have been better,” in the past. Parker says the town is also working on resolutions for reserve funds that will bring them up-to-date as well as establish a more formalized plan for funding and usage of reserves. The state audit additionally found that Ogden Town Court justices failed to implement corrective action to address issues identified by the annual external audit, allowing errors to occur and remain uncorrected and resulting in the poor accountability practices continuing unabated. Both elected town justices have submitted a separate Corrective Action Plan to the state and Parker says, “... the judges are committed to working with the clerks. There are now fail-safes in place ... (the clerks) understand what the state wants them to do.”
Ogden’s Parks and Recreation Department receives GVRPS awards The Town of Ogden Parks and Recreation Department was honored with two awards at the annual Genesee Valley Recreation and Parks Society (GVRPS) Conference and Awards Banquet on November 21. GVRPS is the local chapter of the New York State Recreation and Park Society and is comprised of Recreation and Park professionals from Chemung, Genesee, Livingston, Monroe, Ontario, Schuyler, Seneca, Steuben, Wayne, Wyoming, and Yates counties. Nick Berlin was presented with the “Young Professional Award.” This award “recognizes excellence by a young professional having less than five years’ experience in the field of recreation, parks, conservation and/or leisure ser-
vices. Individual should excel in leadership, professionalism, and the promotion of the leisure field.” Berlin has been Recreation Supervisor with the department since February, 2011. He is responsible for the planning and promotion of seasonal programs and special events. The Town was also honored with the “Outstanding Facility Award” for the design and development of Boetcher Lodge. This is awarded to “a governmental agency or organization that has shown outstanding and unique achievement in parks and recreation facility design and development.” Boetcher Lodge reopened in January, 2014 after an arson fire destroyed the original building. Newman Riga Library Director begins new chapter Donna Haire expert at knowing good books by Terra Osterling Donna Haire, Director of the Newman Riga Public Library, was a nine-year-old in the small village of Laupahoehoe, Hawaii when the idea of what a public library should be like was planted in her mind. The small store-front library started by her fourth grade teacher may be years and miles from the Newman Riga Public Library, but Churchville area library patrons owe it a debt of gratitude. Donna Haire, Library Director since 1984, will retire at the end of this year, leaving a legacy shaped by that early experience with good books and a librarian who truly cared. In Laupahoehoe, the library, says Haire, “Made such a difference in our lives, and I thought that’s how a library should be.” After thirty years at Newman Riga, Donna Haire’s focus on making a difference through customer service has not only sustained the library, it has defined it. Haire landed in the area by way of a VISTA posting in downtown Rochester. She worked in a sweat-equity housing program helping families to navigate the business of a household and life. Haire and her husband, also a VISTA volunteer, liked the area enough to return for good. She then went to work doing marketing research for Monroe Savings Bank. Upon moving to Churchville in 1979, Haire says she felt drawn to the little library. “It spoke my name from the minute I saw it, and I thought it was the prettiest building in town,” she recalls. “I said to myself, ‘one day I’m going to work in that building.’ ” When an ad appeared in the newspaper for the library director position, she immediately applied. Haire was hired by Dick Stowe, a 25year Newman Riga Library Board trustee who is now retired. “Donna Haire offers a nice mix of skills,” says Stowe. “She has an unusual capability to deal with the academic part of the library director job, as well as the management part. And, Donna knows how to provide a great product with a personal touch.” Building expansion was already in the air when Haire started, and leading a library under construction presented obvious challenges. That was just the beginning for a library on the verge of a new millennium. Automated book checkout, computers for patron use, and transitioning from card catalogs to a computerized system were next. “Donna had some complicated and sometimes difficult situations that she coped with,” remarks Stowe about that era of change. Advances in technology and how they changed running and using a library, were, says Haire, akin to going from horse and buggy to moon travel. “The availability of the internet is the best thing that could happen to any small

Photograph by Walter Horylev. library,” says Haire. “The World Wide Web expanded the walls for the patron, and created far more business independence for the library.” Sue Davis, a longtime library board member and current treasurer, says that Haire is known for her frugal management of the library, remarking, “She is a wizard at staying within budget.” Making a connection Budget-conscious library management is second only to Haire’s mission of connecting people with both information and literature. Chiefly, she says, by helping library patrons to learn throughout their
lives, including how to conduct life more efficiently. Haire attributes Newman Riga’s success to this focus on good books and patrons’ needs. The concept of reader advisory, Haire’s specialty, is perhaps the greatest secret weapon of small libraries. Haire has insisted that each new book be carefully vetted, and she knows the books as well as the patrons. This boutique service keeps patrons coming back, and may be why statistics on libraries.org show that Newman Riga circulates far more books in proportion to the town’s population than all other west side libraries. “I know that if I go to the library, I don’t

It got stuck on the way down and remained for two days while we figured out what we were going to do about it. •Back in the old days, in the summer reading program, children would take out books and return them and give an oral book report to me. Because I was the chief cook and bottle washer, and we had a leak in the bathroom, I had to fix it. I was trying with all my strength to turn the water off as a little boy, 8 or 9, proceeded to deliver his oral book report without skipping a beat. It went on and on while I kept trying to shut off the water. He’s now in his 30s but I see his mother occasionally and remind her of that story.” Photo and text by Walter Horylev.
even need to go to the bookshelf,” says Davis. “To walk in and to have Donna ready to recommend a book for any patron is a great asset for the library; her knowledge and her care for patrons is something that will be hard to replace.” Haire has been especially good at connecting with children, potential converts for this librarian’s self-described literature evangelism. Her own first-hand early library experience taught her that children respond well to an adult listening to and caring about their thoughts on a book, so she has always made it a point to ask. One young patron recently read Pippi Longstocking. Haire was tickled that the girl enjoyed the book because ‘[Pippi] was bad, and she got in trouble.’ Haire also made it a point to tap local talent for family friendly library programs: magicians, clowns, a classical guitarist who used Newman Riga as a venue to prepare for national tours, many author lectures and book signings, and the display case that highlights the skills and interests of community members. Plus, she designed the fiercely competitive and prize-laden summer reading programs. Reflecting on the day-to-day of 30 years, Haire says, “It’s a calming routine when I walk in each morning, quietly making order out of chaos. I love the feel and even the smell of the library.” She speaks poignantly of the days when her afternoons were full of researchers of all ages. The innovations of internet research, Haire says, have funneled patrons away from learning about authoritative resources in library-based research. Libraries, she hopes, will try, in the face of change, to maintain a dedication to education. “I only know how to work,” Haire says of retirement, having not allowed herself time to think about next steps. She has no major travel plans, but will continue her hobby of visiting and photographing small libraries that exude character. Summing up her career at Newman Riga Public Library, Haire says, “This has been the job of a lifetime, and I couldn’t imagine any job more suited to me. But, I know it’s time for a new chapter. I just don’t know what the book is.” On the job Newman Riga Public Library has been Donna Haire’s home away from home, and the people and memories of three decades include: •A construction supplier came to deliver rebar, approaching the library desk asking for the truck to be unloaded. Haire somehow worked it out without having to do it herself. •Spending hours one Christmas Eve looking for an escaped hamster that was intended to surprise her children the next morning, sure that her flashlight beam would draw the police. •Raising Stanley the cardinal after he was orphaned by a cat prowling library grounds. •In the early days of the online purchasing, a truck filled with thousands of books pulled up to make a delivery after she accidentally ordered too many copies. •Tracking down Clifford Stoll, a Buffalo native and nationally famous bestselling author, hoping to arrange his visit to the library, but missing his return call when an unknowing new-hire said Haire was (as usual) ‘busy with a patron.’ •A longtime patron routinely approaching the desk to cheekily order a cheeseburger and soft drink. Learning of Haire’s retirement, she said he remarked that the food service had never been very good and he hopes the new director can cook. Marlene was born in Gary, Indiana to the late Francis and Esther (Yakopec) Heydorn. She attended Purdue University where she obtained a Bachelor of Science degree, and met her husband, the late Arnold “Arnie” Sullivan of Albion. After marrying, Marlene relocated to Spencerport where she resided for almost 42 years. Marlene is survived by two children, Scott (Cindy) Sullivan of Waterport, and Lee Sullivan of Lyndonville; and one granddaughter, Amanda Sullivan of Durham, North Carolina. As per Marlene’s wishes, there will be no services. Burial will be at Mount Albion Cemetery at the convenience of the family. Churchville Veterinary Hospital donates to pet friendly environment - New to the Village of Churchville is a dog watering station at the Village Office near the Memorial Park for all four-legged friends to stop and have a drink thanks to the Churchville Veterinary Hospital in the village. Also on the West Shore trail a doggie clean up bag station is now in place compliments of the Churchville Veterinary Hospital. The trail is frequently used by humans and their pets.
