AUCTION TERMS AND CONDITIONS Procedure: Property shall be sold Subject to Confirmation of Bid by Seller. Down Payment: 10% Down day of auction with the balance due at closing in 30 days or less. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, be sure you have arranged financing, if needed, and are capable of paying the balance at closing. Title: Closing cost should be paid as set out in attached contract. Possession: Possession given a closing in 30 days or less. Mineral Rights: The sale shall include100% of the mineral rights owned by the sellers. Easements: Sale of the property is subject to any and all easements on record. Acreage: All acreage is approximate and has been estimated based on current legal descriptions and/or aerial photos. Taxes: Buyer will pay all 2018 property taxes and thereafter. Survey: Any need for a survey shall be determined solely by the sellers. At sellers’ expense, sellers shall provide a survey for any parcel where there is no existing legal description or where the tract divisions create new boundaries. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres. If a survey is required it will be paid for by the seller.
