Guiding the Home Purchase Process
THE OFFER
In Rhode Island, offers are made using a Purchase and Sales Agreement. Along with the agreement, you will need to provide a deposit to show your earnest intent to purchase the property. Typically, deposits range from $1,000 to 5% of the sale price, though they may be higher for upscale properties or in competitive situations. The offer will contain the following:
• Your offering price
• Total earnest money deposit
• Closing date
• Mortgage contingency deadline (if applicable)
• Personal property to remain (i.e., appliances, fixtures, etc.)
• Professional service fee
• Any other applicable contingencies appropriate for the transaction
If the offer is acceptable to the seller, they will sign the Purchase and Sales Agreement and return it to your agent or provide a counteroffer.
THE INSPECTIONS
The inspection contingency allows the buyer to have a licensed inspector examine the property within 10 days (excluding weekends and holidays) from the date of the fully executed Purchase and Sales Agreement. During this period, the buyer can identify any issues with the property and provide the seller with a written request for repairs or credits. Both parties must then agree to these requests in writing within the inspection period. If necessary, they may mutually agree to extend this timeframe.
If the buyer and seller cannot reach an agreement on the requested repairs or credits, the buyer has the right to terminate the agreement by providing written notice before the inspection period expires. If the inspection period passes without any written termination, all inspections are assumed satisfactory, and the buyer agrees to proceed with the purchase. Should the buyer fail to close the transaction or terminate the agreement based on the inspection contingency, the seller may retain the buyer’s earnest money deposit.
THE CLOSING
The closing is generally held at an attorney’s office but can be arranged at any mutually agreed-upon location. At the closing, you will need to provide the funds as directed by the lender’s attorney. Bring your personal checkbook for any potential adjustment amounts, and ensure you have a valid form of identification. Numerous documents will be presented for your signature, which your attorney will review, explain, and approve. After approximately one to two hours, and once the deed is recorded, you will be declared the proud owner(s) of your new home! Unless negotiated beforehand, you cannot move in until the deed is officially recorded.
