ne of history’s most solemn days, Memorial Day is an American holiday that honors the men and women who died while serving in the United States military.

Originally known as Decoration Day, it originated in the years following the Civil War and became an official federal holiday in 1971.

In May 1868, Gen. John A. Logan, the commander-in-chief of the Union veterans’ group known as the Grand Army of the Republic, issued a decree that May 30 should become a nationwide day of commemoration for the more than 620,000 soldiers killed in the recently ended Civil War. On Decoration Day, as Logan dubbed it, Americans should lay flowers and decorate the graves of the war dead “whose bodies now lie in almost every city, village and hamlet churchyard in the land.” According to legend, Logan chose May 30 because it was a rare day that didn’t fall on the anniversary of a Civil War battle, though some historians believe the date was selected to ensure that flowers across the country would be in full bloom.

Today Memorial Day is celebrated on the last Monday of May. The American flag should be hung at half-staff until noon on Memorial Day, then raised to the top of the staff. And since 2000, when the U.S. Congress passed legislation, all Americans are encouraged to pause for a National Moment of Remembrance at 3 p.m. local time.

Washington County Administrator Molloy O’Rourke received the Dr. Robert A. Barrett Award for Management Excellence from the Minnesota City/County Management Association (MCMA). The annual award acknowledges an MCMA member who is an exemplary role model, leader and mentor in the profession of local government management. The award was presented May 2 during the MCMA’s annual conference.

O’Rourke has been Washington County’s administrator since 2011 and was selected for the Barrett Award based on nominations by county commissioners and staff members. They cited her visionary leadership of county staff, setting high standards and modeling the values of public service.

O’Rourke has also worked to increase the diversity of the county workforce and mold other managers into a highfunctioning leadership team.

The Rice Creek Watershed District (RCWD) Board of Managers accepted the resignation of longtime District Administrator Phil Belfiori.

Earlier this spring, Belfiori made the decision to pursue other opportunities.

The Board of Managers has begun the search process for the next district administrator.

Nick Tomczik has accepted the role of interim district administrator during this time. Tomczik will oversee the district’s activities, including the continued development of the watershed management plan, budgeting, permitting and regulatory efforts and project implementation.

PUBLIC SAFETY BRIEFS K-9 Xander will retire, go to trainer’s home Washington County Sheriff’s Office K-9 Xander retired April 28 after seven years of service.

The Sheriff’s Office asked May 7 that the county board transfer ownership of the dog to Deputy Bradley Volk, who has been Xander’s trainer. Volk agreed to accept ownership of Xander at no cost to the county. He also agreed to accept full responsibility for the cost and care of Xander as well as liability and responsibility for him. Xander had many successes in Washington County and the Sheriff’s Office thanked Xander and Deputy Volk for their dedicated service to the K-9 division.

Hugo woman receives drug charge Kristina Marie Schultz, 36, of Hugo, has been charged with fifth-degree possession of schedule 1,2,3,4 -not small amount of marijuana. On March 17, Washington County Sheriff deputies were dispatched to a residential address along 10th Avenue in Newport on a report of an apartment fire. According to the criminal complaint, deputies entered the apartment to find the sole occupant, Schultz, who explained she awoke to find a fire in the kitchen.

Schultz told deputies she placed the bags that were on fire in a garbage can, which she placed in the bathroom. As deputies started to head toward the bathroom to ensure the flames were extinguished, Schultz became defensive.

Once in the bathroom, a deputy observed a tray with a glass pipe commonly used to ingest methamphetamine and later observed syringes throughout the apartment. One syringe contained a clear liquid. The deputy also saw a burnt silver spoon with gray residue resembling heroin in the apartment.

Schultz was then placed under arrest. Prior to leaving the apartment, a deputy located a clear plastic baggie in the kitchen, containing what the deputy believed to be methamphetamine. On May 18, a Washington County evidence technician field tested the confiscated substance, which tested positive for 0.3 grams of nethamphetamine, a Schedule II controlled substance.

The maximum sentence is four years and a $10,000 fine for possession of a controlled substance (other than heroin) in excess of 0.25 grams. Schultz was scheduled summoned to appear at 9 a.m. May 1 in the 10th Judicial District Court.

Love for Minnesota

ALE KURSCHNER WRITES an editor’s note in a past issue of Twin Cities Business to make the point of why Minnesota is the best place to live.

He comments that our state has many significant top 10 rankings, plus the theater of seasons.

For example, Minnesota is one of only 13 major metropolitan areas with five major sports teams.

Many of the major metropolitan areas are near lakes and beautiful locations. Few of them have anything quite as close as Lake Minnetonka. I would brag about White Bear Lake as well.

Other factors note that Minneapolis consistently ranks among the best cities for live theater, along with New York and Boston, but only the Mill City has more theater seats per capita than any other U.S. city after New York.

According to Travel and Leisure’s America’s Best Cities for Foodies, the Twin Cities comes in just behind four other cities, which are Houston; Providence, Rhode Island; Kansas City and Atlanta.

The Twin Cities also gets a high rating for the best chefs in the nation.

In Minnesota, we love our lakes and we love our boats. Kurschner says according to statistics we own 800,900 boats, the second percentage of boats per capita in the About the highest country after Florida.

In other areas of agriculture, we lead other states in sugar beets, second in wild rice, fourth in corn, soybeans and flax seeds.

The Minnesota State Fair season is around the corner and I think everyone knows we have the best and largest daily attendance of any other state fair in the country.

We might not have the best or most golf courses, but we have the most golfers per capita. We are still behind in bike trails, but we are also considered the second friendliest state.

I might add our taxes are quite high, the DNR is crazy with regulations and our motorists love to drive alone in a car.

We have plenty of deer for hunting. The Dakotas are more inviting for pheasants.

Fishing is still good in the state, but Ontario is becoming more and more inviting.

We have great parks, campsites and hiking trails and the year-round beauty of the seasons is breathtaking.

The air is clean except for occasional forest fire smoke from Western United States and Canada.

Don’t forget to take time and enjoy it.

NEWSPAPER HEADLINES CAN make you laugh. My publisher friend from Custer, S.D., Charley Najacht, sent me several that tickled my funny-bone.

IT’S IMPORTANT TO observe Memorial Day every year.

All of us are beneficiaries of those who have given the ultimate sacrifice to ensure our nation can continue to exist along with the many freedoms we enjoy.

On May 5, 1868, General John Logan suggested we observe Memorial Day by gathering “around the sacred remains and garland the passionless mounds around them with choicest flowers of springtime – let us in this solemn presence renew our pledges to aid and assist those whom they have left among us as sacred charges upon the Nation’s gratitude – the soldier’s and sailor’s widow and orphan.”

We so often have ignored this celebration of remembering our ancestors, our family members, our loved ones, our neighbors and our friends who have given so much in sacrifice.

We can continue this observance by visiting cemeteries, placing flags or flowers on the graves of our fallen heroes; also by visiting memorials and taking time to understand what they mean. It is also important to fly the U.S. flag, at least half-staff until noon.

In 1998, under the Defense Authorization Act, we’re encouraged to fly the POW/MIA Flag.

On Memorial Day the National Moment of Remembrance is at 3 p.m. to pause and think upon the true meaning of the day. It is also important to renew our pledge to aid the widows, widowers, and orphans of our fallen dead and to aid the disabled veterans.

May your Memorial Day this year have added meaning.

Fighting for Minnesota students

A

s the 2019 legislative session comes to an end, I’m working hard to make sure that the values of the people in our community are put first. When I was out door knocking, people told me over and over again that a great education for all Minnesota students was a top priority for them. I’ve heard many concerns about inadequate funding for schools, special education, Legislator student mental health, and Lingo early learning opportunities.

Ami Wazlawik These concerns should be refl flected d in i our state budget. I’ll continue to fight for Minnesota students and local schools in the final days of the session and beyond.

The House and Senate have each approved an E-12 education budget for the next two years. Members of both chambers are currently working together to resolve the differences between the two proposals and reach a compromise.

Though the final version of the E-12 education budget will likely look different by the time the session ends and this column is published, I want you to know what I stand for. This is a vision that I’ll continue to work for even if it isn’t fully adopted this year.

The E-12 education budget that my colleagues and I passed in the House invests in every student at every public school. It increases per-pupil funding by three percent in 2020 and another two percent in 2021. Over the next two years, funding for White Bear Lake schools would increase by approximately $767 per student.

Schools in Mahtomedi and Mounds View would see about $797 and $563 more for each student, respectively, and funding for Stillwater schools would increase by $587 per student. This increased funding would help schools support students inside and outside the classroom.

Our budget also freezes the special education cross subsidy for the next two years. Cross subsidies are gaps between the cost of providing special education services and what state and federal funding covers. Schools must use general funds to fill in the gaps.

That depletes funds and pits groups of students against one another.

Freezing the cross subsidy would benefit communities like White Bear Lake, where the cross subsidy increased 110% between 2002 and 2017, and ensure that schools are able to meet the needs of all students.

Keeping students safe and healthy is also an important part of the House budget. It provides grants to expand mental health services and crucial funding so schools can hire counselors, psychologists, social workers,

nurses, and other support staff.

One of my bills that was included in the budget would require establishing risk assessment teams to help school districts address threatening behavior and connect students with underlying behavioral or mental health issues to the resources they need to address them.

Our budget also helps the youngest Minnesotans get a great start in life through expanded access to voluntary early learning opportunities. It preserves access to preschool for 4,000 kids by making School Readiness Plus, which is set to expire this year, a permanent program. 2,000 more of our youngest learners would benefit from increased investment in and flexibility for early learning scholarships.

Our students are the future of Minnesota. In my years working in local public schools, I’ve seen the great potential of young Minnesotans firsthand. If we invest in each and every student, give teachers and staff tools to help them succeed, and connect students to the resources they need to thrive, there’s no limit to what our students can achieve.

LETTERS TO THE EDITOR Can a city require a resident to hook up to city water?

I believe that a city may impose just and equitable charges for the availability of water facilities but lacks the authority to require a property owner to use municipal water. In the absence of showing that the use of well water is injurious to public health, the city lacks the authority to require a private well owner to use water supplied by the city and desist from using a private well.

It’s the state of Minnesota that has authority to regulate the way in which a well is constructed. The DNR has the authority to regulate the amount of water pumped out of wells. To my knowledge, no federal

or state agency has the authority to prohibit a landowner from their riparian water rights to access water under their property. State of Minnesota Statute 412.211 gives the cities the right to regulate the use of wells. The defi nition of “regulate� is clearly defined in the Minnesota Supreme Court Case of ORR vs. City of Rochester. It states, “The power to regulate does not properly include the power to suppress or prohibit, for the very essence of regulation is the existence of something to be regulated.�

I believe the city has been misled by the influence of the League of Minnesota Cities. No one from the Department of Health has given any right to prohibit wells. They have simply become neutral on the

subject because there is no state or federal law stating any agency has the authority to prohibit wells.

“You can imagine how exciting it was to think that they kept all of these (remains) until all of our forensic studies advanced enough so that there could be a match after all of these years,” DeRaad added. “Everybody had lived for such a long time without getting closure; my mother and her mother never got it ... It’s bittersweet that this is finally happening.”

Sharon DeRaad never got to meet her Uncle Dante; he died during the Japanese attack on Pearl Harbor years before she was born. But this Memorial Day weekend, she’ll drive from Forest Lake to Virginia, Minnesota, to attend his funeral and witness his remains buried alongside those of her grandparents, nearly 80 years after his death.

Dante Sylvester Tini was among the 429 sailors and 2,403 Americans who died in the surprise attacks on Pearl Harbor that launched the start of the U.S.’s involvement in World War II. The son of Italian immigrants, Tini, then 19, joined the U.S. Navy after graduating from high school.

He served as a Radioman third class aboard the U.S.S. Oklahoma and was working in the ship’s hull when it capsized after being struck by Japanese torpedoes on Dec. 7, 1941, a date that has since lived in infamy for both the United States and the Tini family.

Two weeks after the attacks, Tini’s parents, Daniel and Rachel, received a telegram stating that he was missing in action. Rachel’s scream, family legend has it, could be heard throughout the neighborhood.

The sudden loss of a loved one is always a tragedy, but the lack of closure around Tini’s death, DeRaad said, made his family’s mourning all that much more difficult and drawn out.

“My mom, Alda, who was his sister, just grieved, grieved, grieved for a long time,” DeRaad said. “And my grandma never really got over it.”

Tini had been scheduled to return to Minnesota on Dec. 10 and sent many of his possessions back home in anticipation of his homecoming. Though his belongings, such as his harmonica and accordion, made the return trip safely, he never did.

Because Rachel only spoke Italian, Alda often assumed the role of translator, and she frequently found herself explaining Tini’s death to her mother over and over again.

“Things would come home, and my mom would have to explain to her mom that it didn’t mean that Dante was coming home, just that he had previously sent those things back,” DeRaad said. “For years, my nona (Italian for grandmother) never really fully grasped that her son would never, ever

come home, especially because the body was never found.”

Keeping memories alive Though DeRaad and her siblings never knew Tini personally, thanks to the stories their family members told throughout the years, they still feel connected to him.

“His memory was always kept alive at our family functions,” said Barb Maki, DeRaad’s sister.

“It was almost like you wanted to pull up an empty chair for him because it felt like he was going to come in and join at any minute.”

“My aunt (Alda) always said he was a really nice-looking Italian boy, and he had many, many girlfriends. He was a bit of a Casanova,” added Renee Proust, DeRaad and Maki’s cousin. “He certainly was never forgotten, thanks to all those stories.”

Scientific advancements lead to closure Tini’s parents and siblings never got the closure they yearned for, but thanks to advancements in forensic science, his nieces and nephews finally will.

Tini’s remains were among those recovered by Navy personnel between December 1941 and June 1944. Of the 429 casualties aboard the U.S.S. Oklahoma, only 35 were identified and later interred in the Halawa and Nu’uanua cemeteries in Hawaii.

The others were buried as “unknowns” in mass graves at the National Memorial Cemetery of the Pacific in Honolulu.

Thanks to advocacy on the part of a Pearl Harbor survivor, in the mid-2000s, the Defense POW/MIA Accounting Agency exhumed the remains of the Oklahoma’s unknown victims. In 2012, Tini’s nieces received calls from the U.S. Navy requesting DNA samples to match what could potentially be their uncle’s remains.

“Females tend to be a closer match than male, so they wanted the eldest of his nieces, which would be my sister Rachel, who lives in Albuquerque (New Mexico),” DeRaad said. “She sent a sample of her DNA in, and last summer she got a call saying that it was a one hundred percent match.”

Seventy-seven years since the telegram arrived announcing Tini was missing in action, his family was overwhelmed to finally have closure.

“Everybody cried,” Maki said.

“When we were contacted for our DNA six, seven years ago, we kind

Celebrating a life On Thursday, May 23, Tini’s remains will be flown into the Duluth airport. From there, they will be transported to his hometown of Virginia for what DeRaad called “a proper burial, finally.”

A visitation and funeral service will be held Saturday, May 25, at Holy Spirit Catholic Church. Afterwards, a memorial procession will pass Virginia’s VFW post, which is named in Tini’s honor, before his remains are laid to rest next to those of his mother and father.

“He will be buried next to his parents, which was his wish,” DeRaad said.

Though the service is mostly a long overdue memorial for Tini, it is also dedicated to all military service members, past and present.

“We’re looking to honor all veterans with this service; our uncle, of course, but also all veterans,” said Maki.

HUGO POLICE REPORTS The Washington County Sheriff’s Office reported the following incidents: • A Hugo woman, 24, was issued a citation at 7:52 a.m. May 3 in the area of Heritage Parkway N. and Enfield Avenue N. for speeding 35 mph in a 30 mph zone.

• A White Bear Lake man, 51, requested assistance in a civil dispute with a tenant in the 5100 block of Fairpoint Drive N. in Hugo at 9:39 a.m.

May 3. The Washington County deputy assisted the White Bear Lake landlord by taking digital video with a body-worn camera of the items a renter had left behind.

• A 15-year-old female was trespassed from the Water’s Edge Community Center at 5:45 p.m.

May 3. The complainant, an employee of the community center, said she asked the juvenile, who refused to listen, to stop climbing on a sign near the playground area. The employee also reported the juvenile wouldn’t stop yelling profanities.

• A Shoreview man, 35, was stopped by police in the area of Frenchman Road and Forest Lake Boulevard May 3. A Washington County Deputy observed the man almost get in an accident before pulling him over. The driver admitted he did not have a driver’s license and deputies found it to be revoked. The man was cited with duty to drive with due care-speed greater than reasonable, driving after revocation and for not having insurance.

• A disturbance was reported at 1:06 a.m. in the 5500 block of 146th Street N in Hugo May 5.

Police received a call of a possible fight behind a residence. The caller reported numerous individuals outside who were yelling at each other. Upon arrival, deputies didn’t find any disturbances or loud voices. The involved parties said there were no problems, and they were just hanging out.

• Deputies were dispatched to the 1400 block of Jardin Avenue in Hugo at 7:45 p.m. May 5 on a report of juveniles shooting BB guns toward houses in the area. An anonymous caller stated one of the juveniles had a large knife. Upon arrival, deputies spoke to a parent of one of the juveniles, who stated his son was out shooting airsoft guns in the field. All parties were advised of city ordinances regarding shooting fi rearms in the city.

• A resident who lives in the 1700 block of Ingersoll Ave N reported three of his garbage cans had been stolen May 5. He stated three of his Menards brand garbage cans were stolen from the end of his driveway between 3 and 4 p.m. May 5. Despite the presence of a security camera on the property, no footage of the theft was captured. There is no suspect information at this time.

• A 38-year-old man from Marine on St. Croix, struck a deer at 6:48 a.m. in the area of 170th Street N. and Jeffery Avenue N. May 6. The man said he had slight back and neck pain but declined medics. The car suffered heavy frontend damage.

The weekend will also serve as a family reunion of sorts, as Tini’s surviving extended family members will traverse the country to pay him their final respects.

“We have relatives coming in from Colorado, Arizona, New Mexico. The local hotel has booked a whole set of rooms in his honor. My children will meet cousins they haven’t seen in years,” DeRaad said. “Dante’s coming home has reunited all of our family.”

• A Hugo man, 52, was stopped by deputies at 7:32 p.m. in the area of Keystone Ave N and 140th Street N. May 6. While on routine patrol, a deputy found the license plate to be registered to an owner with a felony warrant for drugs.

The deputy observed the driver of the car to be male but was unsure if it was the person with the warrant. The deputy attempted to stop the car near the suspect’s residence, but the vehicle continued down a long driveway. The suspect was later located in the residence and taken into custody.

• Extra patrol was requested in the area of Falcon Avenue N. and 120th Street N. May 9. The complainant told deputies that Falcon Avenue is being used during morning/afternoon rush hours because the traffic on Highway 61 gets so backed up.

• A White Bear Township woman, 55, received a call from a Washington County deputy asking about alleged harassment of a 59-year-old Hugo man May 9. The man informed deputies that the suspect had sent him harassing text messages with insults. When deputies called the suspect, she admitted to sending the text message and said she would not bother the man again.

• Country Video Barn in Hugo reported an 18-year-old female from Hugo did not return two DVDs May 9. The owner stated he had made several phone calls and mailed a letter to inform the customer to bring the DVDs back to the store.

The deputy left a voicemail on the customer’s cell phone and will follow up on the case.

How to maximize your social security benefits without breaking the rules

he Social Security rule book is so long, complex and ever-changing that even Social Security employees don’t understand it all. And among the trickiest questions are those related to the death of a spouse. So we went to one of the most knowledgeable Social Security experts in the country and asked for answers to some of the thorniest questions that widowed Social Security recipients often ask. His answers can help you maximize your benefits without breaking tricky rules and potentially losing money…

My wife died after I started my Social Security benefits. Can I now suspend my benefits and claim widower’s benefits based on my late wife’s earnings so that my own benefits can increase until I claim them at age 70? (My benefits are larger than my wife’s.)

These sorts of situations come up all the time. Unfortunately, in this case the answer is no—once you begin taking your own retirement benefits, you cannot suspend them and claim a widower’s benefit instead.

There is one potential way around this.

If no more than 12 months has passed since you began receiving your benefits, you have the option of withdrawing your application for retirement benefits by filing form SSA521 and repaying all of the benefits you have thus far received (including any benefits paid

to your children or late wife based on your earnings history). If you do that, it’s like you never applied for your benefits in the first place, freeing you to claim widower’s benefits until you reach age 70, at which point your own benefits will reach their maximum level (aside from future cost-of-living adjustments). You are limited to no more than one application withdrawal of this type for your entire life.

My husband died decades ago when we were quite young. I’m now nearing retirement age. Can I collect widow’s benefits based on his earnings even though he was in the workforce only a few years?

You probably can. This comes as a surprise to some people because wage earners typically need at least 10 years in the workforce to qualify for Social Security retirement benefits, but different rules apply with the benefits of a widow or widower. The younger the age at which the spouse died, the less work history that is required. The system for calculating this is complex, but as few as six “credits” can be all that’s needed when a spouse dies young—and six credits can be earned in less than two full working years.

There are a few caveats worth noting, though. To be eligible for widow’s benefits, you must have been married to your late spouse for at least nine months prior to

Some may choose to give their time and abilities through volunteer service while others may provide financial support. Charitable giving provides an opportunity to engage both your head and your heart in making a difference. The following tips can help donors make the most of their charitable gifts: What’s the purpose and impact. Never give to an organization without first knowing its purpose and effectiveness. Does it align with your personal values and goals? The BBB Wise Giving Alliance or Charity Navigator can help you evaluate your options.

Budget for donations. Systematic gifts spread throughout the year may help donors give more than if they give a one-time gift based on their financial leftovers.

Keep good records. To deduct donations for tax purposes, people must keep an appropriate record of their contributions1. The type and value of one’s gift may require specific forms of acknowledgement from the recipient organization. For details, see Internal Revenue Service (IRS) Publication 526.

Take advantage of tax benefits. In order for a charitable donation to be tax-deductible, the charity must be recognized by the IRS as a qualified organization. Most organizations can confirm their status or you can verify independently at IRS.gov.

Give generously and wisely. From wills, living trusts, donor advised funds, charitable gift annuities, endowments and mini-foundations, to gifts of appreciated stock, retirement accounts or real estate, there are many vehicles through which individuals can make charitable gifts. Some of these are better for lifetime giving while others are better for giving through your estate at death.

Special care should be given when determining the option that meets one’s financial circumstances.

Gifting some assets to IRS-recognized charities may potentially reduce capital gains tax or income tax.

Life insurance may also be an excellent option to magnify a gift or to replace wealth for family after making a large planned gift to a charity.

Consult with experts. Always consult with a financial, legal and/or tax professional before putting a gifting plan into action.

When moved to make a difference, donors should remember there are many options for making a financial gift. Just be sure to explore the options and enlist the appropriate professional support along the way. By fully planning a charitable gift, a person can ensure their head and their heart are satisfied.

his death. (This nine-month requirement is waived if the spouse died in active military service or under certain other circumstances.) And you must not currently be remarried unless you did not remarry until you were at least 60 years old.

I’m about to reach my full retirement age of 66, but I had been planning to wait until age 70 to start Social Security to get as much as possible each month. However, my husband passed away, and my widow’s benefit would be larger than my own benefit.

Should I put off claiming my widow’s benefit until age 70, too?

No. Unlike your own benefit, widow’s benefits never grow any larger than they are when you reach your full retirement age.

There is no upside to delaying claiming a widow’s benefit any longer than that, and there is considerable downside to doing so—you would miss out on four years of monthly benefits.

I know my monthly Social Security retirement benefits will be less if I start collecting as soon as I become eligible at age 62 rather than wait until my full retirement age. But if I switch to a widow’s benefit based on my late husband’s benefit when I reach full retirement age, will that be reduced, too, because I started my own benefit early? He waited until his full retirement age before claiming.

Your plan to claim your own benefits now and switch to widow’s benefits later sounds reasonable. Here’s why: If you were to claim your widow’s benefit before you reach full retirement age, you would not receive your late husband’s full benefit even though he waited until his full retirement age to start claiming. Instead, it would be permanently reduced because you took it early. By waiting until your full retirement age to claim the widow’s benefit, you will receive his full benefit even though you started your own benefit early.

My first marriage ended with my husband’s death, and my second ended in divorce. Will I be able to claim a widow’s benefit based on my first husband’s earnings?

You probably can, as long as your first marriage lasted at least nine months. As you might already know, remarrying before you turn age 60 typically negates the right to claim a widow’s benefit based on an earlier marriage. But if you are no longer married, you once again are entitled to receive your widow’s benefit from your first marriage.

Social Security Marital Benefits Without the Wedding You might be entitled to widow’s or spousal Social Security benefits even if you never actually wed your partner. The Social Security Administration recognizes common-law marriages—marriages where there was no official marriage ceremony or license but the couple lived together for an extended period as if married. But it does so only if the common-law marriage is recognized under the laws of the state where the Social Security recipient and his/her partner reside, or previously resided together, or if common-law marriages were recognized by the state when they lived there. Commonlaw marriages are recognized in Alabama, Colorado, the District of Columbia, Iowa, Kansas, Montana, Oklahoma, Rhode Island, South Carolina, Texas and Utah. In several other states, common-law marriages that were entered into before specified dates are recognized. The burden of proof will be on you to establish that the relationship qualifies (or qualified, in the case of widowhood) as a common-law marriage.

Bottom line: There are people who qualify for valuable spousal and widow’s benefits despite the fact that they never officially wed—and many of them probably don’t realize it.

Everyone has made mistakes with money that he/she would rather forget—even some of the country’s shrewdest financial pros. Bottom Line Personal asked five money mavens to recount their most memorable blunders…and what lessons they learned that could be useful to investors and consumers of all ages. Here are their answers…

Mistake: I was so reluctant to sell a stock that I turned what should have been a minor loss into an enormous one. In the late 1990s, I invested $50,000 in Bibb Manufacturing Company, a centuryold textile maker that produced bedding and towels for Walmart and other retailers. I had studied the company for months and thought it was a bargain at $12 per share. But something unforeseen happened. The price of cotton soared, driving up costs for textile makers. The stock dipped below my purchase price, but I wasn’t going to be deterred by a little volatility. At every leg down, I didn’t want to admit that I was wrong or turn a loss on paper into a real one, so I came up with sophisticated rationalizations to hang on. By the time I dumped the stock at $6, half my investment was gone. The company never recovered, went bankrupt and was taken over by a competitor.

Lesson learned: Don’t make exceptions to a valuable rule. The rule that I violated: When a stock falls 10% below my purchase price, I sell it. No exceptions. Why 10%? That’s the point at which you must start gaining noticeably more (12% in this case) than you lost just to get back to even. My rule doesn’t always work out.

Sometimes stocks do bounce back strongly. But it guarantees that I never take a big loss, which is what really ruins investors’ long-term returns because it can take so long to recover.

Mistake: I wasn’t careful enough when I took the required minimum distribution (RMD) from my IRA—and I had to deal with a 50% penalty. A few years ago, I decided to use the money from my RMD, which I’ve been taking since age 70½ (as required by IRS rules), to contribute to my favorite charities.

I was careful to follow the rules, requesting that my IRA provider send me nine checks payable to nine different charities.

I mailed the checks to the charities well before the deadline of December 31, but I didn’t notice that one charity never sent me back a receipt.

In February of the following year, I received a surprise notice from the IRA provider. It turns out that one of the charities had never received (and therefore never cashed) its check, and my IRA provider had added the amount of the check back to my account. That meant I had a shortfall of $500 in my RMD for the year just ended.

I quickly got a new check and resent it to the charity, but by the time I did that, I owed the IRS a $250 penalty.

Lesson learned: You can’t rely on your financial adviser or brokerage to make sure that you take the correct RMDs from your IRAs and other retirement accounts—or even to tell you

if a requested distribution somehow fails. You should always do a final review in late December to make sure you are in compliance.

Good news: The IRS gives seniors a break if an RMD mistake is deemed to be legitimately beyond their control. (For directions on challenging an RMD compliance penalty, go to IRS.gov and search for “IRA Required Minimum Distributions FAQs.”) I appealed my penalty on the notion that a check sent through the US mail should not have failed to arrive. The IRS agreed, and I did not have to pay the penalty, although it cost me months of letter writing, documentation and aggravation.

Mistake: When I gave a close family member a large loan, I thought I was being smart by drawing up a promissory note—but I never considered what I would do if the family member couldn’t pay me back. A relative approached me for a six-figure loan he wanted to use to buy some property.

I’m well aware that big loans should be made “official” even among family members, so we went to an attorney and signed a formal loan agreement that said he would pay me back over three years at 6% interest.

Unfortunately, my relative got sick and wound up in and out of the hospital for two years, unable to make even minimum payments to me. Even worse, he couldn’t afford to pay the municipal taxes on the property and was at risk of having it confiscated by the city. I had to shell out another $20,000 just to cover his taxes. With the interest and principal payments, plus the additional property-tax loan, what he owed me ballooned.

But I wasn’t about to ruin relationships in the family by taking him to court and winning a judgment. My three-year loan has now turned into a 12-year loan that may never be fully paid back.

Lesson learned: No matter how businesslike you are, it’s not smart to loan money to family and friends unless you will be OK both financially and emotionally if you are not paid back. A study by Lending Tree found that people who lend money to their relatives get back an

Mistake: I bought a house for the wrong reasons. When I took a new job in Missouri in 2016, I wanted to take advantage of low mortgage interest rates before they might rise. I also wanted to avoid the expense and bother of putting my possessions in storage and having to do a major move twice.

Under time pressure before starting the new job, I chose a home after only two days of looking. The professional inspection turned up problems, but my real estate agent convinced me that the issues were minor. I convinced myself that they were manageable because I wanted to feel settled and secure. The house turned out to be a money pit requiring tens of thousands of dollars in repairs.

Lesson learned: For much of the past decade, buying instead of renting seemed like a nobrainer. But renting can be more financially efficient in the long run if it gives you the time to do a thorough search and evaluate the realistic costs of owning a home. Recently, rising mortgage rates and high home prices in many areas have made the decision to buy an even more complicated one. The monthly costs of buying and owning a home are up 14% over the past year, more than three times the annual increase in rent rates nationally.

Mistake: I got an exciting stock tip from a trusted friend and invested without doing my own research. Back in 2010, I invested in a Toronto company called Element 21 that dealt in rare-earth metals. These little-known industrial metals are essential components in electric cars and missile-guidance systems. My friend, who was a very successful businessman, told me that rare-earth metals stocks were about to soar. I was so intrigued that I bought nearly $12,000 worth of shares.

But it turns out that Element 21 was a sportsequipment company focused on developing golf clubs using alloys of a rare-earth metal called scandium. Scandium never did revolutionize the golfing industry…and I lost 95% of my investment.

Lesson learned: Do your own research about a stock before you invest—even if someone you trust says that it’s a good bet. At the very least, do an online search on the company, read some professional analysis of the stock and understand what could go wrong if you invest. This lets you judge the risk you are taking and whether that risk aligns with your personal goals and needs, something that well-meaning people who feed you stock tips may not be considering.

Centerville resident’s distinguished career as college, pro referee ending soon

June Courteau, whose 51-year career as a basketball official was capped by five years with a major NCAA position, will turn in her whistle at the end of this school year.

“I have always loved the game and put the game fi rst, because it should accept nothing less,” said Courteau in a feature story on the NCAA website.

A Centerville resident since 2005, she became the NCAA’s national coordinator of officiating in 2014.

Her retirement takes effect May 31.

Courteau, inducted into the Women’s Basketball Hall of Fame in 2016, was a women’s basketball official from 1968 through 2011, working 20 Division I championships, 12 Final Fours and five national championship games.

The North St. Paul native also officiated in the

She was Elsa Shorey when she played for Kwapick in U12A, U14A, and his first two seasons as school coach. They were state champions in U12 and were runner-up in U14.

With the Bears, she played on winning teams her last three seasons (46-26-8), and was one of the top two scorers, along with Emily Green, each year with around 30 points apiece. One special moment she remembers is a goal she scored on which her older sister, the goalie, made an assist.

Bruestle played hockey at Union College in Schenectady, New York, a Division I program in the ECAC. That’s where she met her husband Cal, who played basketball there.

Also holding a masters degree from Hamline, she is currently a social studies teacher at Andover High School and has applied for a position at White Bear Lake.

Bruestle, who has coached Robbinsdale Armstrong/Cooper the last three years, was named by activities director Brian Peloquin as successor to Jerry Kwapick, who stepped down after 10 seasons.

“We are very excited to welcome Elsa back to the White Bear Lake community,” said Peloquin, who interviewed four finalists. “It was clear to the hiring committee that Coach Shorey was the best candidate to lead our program.”

Bruestle said she’s eager to return to the team she grew up in. She takes over after a season in which the Bears reached the state tournament for the first time since 2003, but will graduate heavily.

“I know a few of the returning players from coaching them in programs such as Junior Festival and OS summer training,” Bruestle noted. “However, most are new to me. Fortunately I have two members of the coaching staff returning with me next season, which should help with a smooth transition and getting to know the kids.”

Those assistants are Katie Letourneau, who was her teammate with the Bears, and now teaches in the district, and Mark Domschot.

CENTERVILLE TIDBITS The Centerville City Council took the following action at its May 8 meeting: • Appointed Kathy Freiermuth to a vacant seat on the Parks and Recreation Committee and Jon Krueger to the vacant Planning and Zoning Commission seat. Councilwoman Michelle Lakso said a vacant position remains on the Park Board. Mayor Jeff Paar suggested the possibility of having a high school student serve on a commission for a younger perspective.

• Approved the consent agenda, which included an encroachment agreement for 7212 Mill Road to allow the property owners to construct/locate a shed within the city’s right of way/drainage utility easement.

• Held the first reading of an ordinance to create a new B-2 Main Street Commercial District, amend the text of the B-1 District and amend the table of allowed uses. Also held the first reading of an ordinance that would change certain properties from B-1 to B-2. Commercial areas include properties along Main Street and extending south into the city’ s business and industrial park along both 20th and 21st avenues.

City Administrator/Engineer Mark Statz explained that part of the rationale for the proposed changes is there are important differences between what is developed along Main Street and what is developed adjacent to the business and industrial park. The differences can be reflected in different zoning districts, even though both are guided “commercial” in the city’ s Land Use Plan. All existing parcels that front Main Street on either side would be in the new B-2 district and the others further south along 20th and 21st avenues abutting industrial zoning would remain B-1 (Commercial).

Jim Shuda, chief financial officer of Alex’s Lawn and Turf, shared his concerns with the council.

“My son Alex has run this company for 25 years, (and) he may go another 25 ... We really don’t want to be hindered. He also wants to stay afloat, he wants to stay profitable, and it is not easy,” Shuda said. “We will do anything and everything you guys want, but we really can’t be hindered to where we look at going out of business. Alex and I have a lot of money invested in it. I am all for you guys. I think you do a good job.

We do have legal representation here. We will do what we have to do.”

Paar explained it was only the first reading and wanted more clarification about what specifically in the ordinance would hinder the business. Shuda said he would not get into specifics. “I am just talking in general terms.”

• Approved a revision to the conditional use permit (CUP) for Bay View Villas. Statz explained there was only one change: to allow a swimming pool on lots greater than 20,000 square feet. City Attorney Kurt Glaser explained only one lot within the development would fit that requirement. Under the already approved planned unit development (PUD), no accessory structures are allowed: a swimming pool is classified as an accessory structure.

• Approved a resolution in support of nominating Paar for the C.C. Ludwig Award granted by the League of Minnesota Cities. Statz explained city staff and community members thought Paar was worthy of the award due to his length of service to the city.

Paar said, “I am greatly humbled and honored to be a part of that. Sometimes you do hear bad things, but I want to thank everyone for the nice letters and words.”

• Statz shared his administrator/engineer report. Statz announced the city received a Community Development Block Grant (CDBG) for water services in the downtown for those who qualify for financial assistance. Statz explained the city recently underwent an audit and “everything seemed like it was in order. There were no surprises.”

Student’s art featured in 2019 Fête des Lacs logo

Given the prospect of having her art featured as the new logo for the Fête des Lacs city festival, one eighth-grade art student used her skills and determination to land fi rst place. The ceremony unveiling her winning logo was held April 26.

Cadence Dempsey, a student in Ms. Herrick’s Centennial Middle School art class, will see her logo featured on posters for the 2019 Fête des Lacs festival as well as the 5K/8K T-shirt. Fête des Lacs, or “Festival of Lakes,” is a weeklong community event that honors the city’s Native American and French-Canadian history and promotes residents’ enjoyment of the city’s parks, lakes and trails.

“The art contest is a new Fête des Lacs event. The Centerville City Council has had longstanding objectives of incorporating the local schools, Wargo Nature Center and the lakes in the city’s annual celebration. The logo art contest is our fi rst real attempt

to include the students,” said resident and volunteer Patrick Branch, who came up with the idea for the contest.

Out of the 12 entries submitted for the contest, Dempsey’s art was chosen by the Parks and Recreation Committee. “We liked that it really hammered home the theme, “Tribute to the Troops.” We also have a long-running heritage with the Native Americans, which is shown by the little teepee.

So that was the award winner,” said Branch.

Branch added the committee had a couple minor things it wanted to change about the winning logo, and Dempsey was more than willing to make the changes. The committee wanted the theme words of “Tribute to the Troops” to be larger and more easy to read, as well as the 5K/8K run piece to be more visible on the logo.

Dempsey and the runner-up, Cinnia Chan, were presented with a $200 and $100 check, respectively, from Centerville Mayor Jeff Paar. Dairy Queen Dilly Bars were also given to all the students in their classes.

“This was a great idea, and the support we got from the school has been excellent. On top of that, the kids, wow, this is impressive,” Paar said.

Next year, the Fête des Lacs Committee will host two contests for the elementary and middle schools with fi rstand second-place winners.

The logo selected from one of those winners will be used for the 2020 T-shirt and poster art.

This year’s festivities will kick off with Music in the Park on July 16 and end on Sunday, July 21.

Grundhofer’s hosts ‘citizens’ of Garage Logic

A live podcast and brats were all the fans of Garage Logic needed May 10 at Grundhofer’s Old-Fashioned Meats.

Joe Soucheray is the creator and self-proclaimed mayor of Garage Logic. According to the podcast’s website, “Garage Logic is the seat of Gumption County, down the road from Diversityville, but not as far as Liberal Lakes. It’s a place where common sense prevails, the two-car garage is revered and cigar smoking is allowed (and lawyers aren’t).”

Since this is a well-rounded imaginary town, the website adds, “When you visit G.L., you’ll be greeted with the melodic harmonies of power tools at work and the sweet, aromatic blend of cigars and motor oil. For recreation, you can tee it up on Creature Path golf course, go fishing in Spoon Lake, or catch a Fighting Stogies game at the University of Garage Logic (where you can also enroll in a course on personal responsibility).”

This is the fi rst time Grundhofer’s has hosted the Garage Logic team. Grundhofer’s advertises on the podcast, and when owner Spencer Grundhofer was asked if he would host the event, he jumped at the chance.

It wound up being the perfect space for almost 300 fans of the podcast to meet and listen to a live taping. With more than 100 kinds of brats, including its world famous gummy bear brat, the citizens

VISIT WWW.READTHECITIZEN.COM FOR COMPLETE SET OF RULES: • The first three treasure hunt clues are published in The Citizen’s May 23 edition, on our website (www. readthecitizen.com) and in the 2019 Good Neighbor Days insert in The Citizen’s June 6 edition. These clues are informational in nature only. The hunt officially begins at 8 a.m. Thursday, June 6, with the posting of Clue #4, and not before.

• A new clue will be posted on The Citizen’s website (www.readthecitizen.com) during Good Neighbor Days, two times daily Thursday through Saturday, June 6-8, one at approximately 8 a.m. and one at approximately 5 p.m. each day. The final clue will be posted at approximately 8 a.m. Sunday, June 9. (If you’re parked on our website, don’t forget to hit the refresh button to update the page!) Clues will be posted online only.

• The Citizen reserves the right to discontinue the hunt at any time if public property is destroyed. Shovels are not needed to find Spike.

• If you find the Golden Spike, immediately call the Spike Hotline (651-407-1224) to report where it was found and to qualify for a $100 instant cash prize. The Citizen will also award an additional $500 in cash to the Spike finder. No purchase is necessary to win, nor is it necessary to complete a “Golden Ticket” to win the cash prizes.

• The Citizen will also award $75 in gift cards or certificates good at area businesses to the Spike finder if he/she has a completed “Golden Ticket” form officially stamped by all of the individual sponsors of the 2019 Hunt for the Golden Spike. Copies of the Golden Ticket forms may be clipped from the May 23 edition of The Citizen, from the Good Neighbor Days insert, or downloaded from The Citizen’s website (www.readthecitizen.com).

• Official sponsors are: City of Hugo, 14669 Fitzgerald Ave. N, Hugo; Hawaiian Tan (Hugo or Forest Lake) 14643 Mercantile Dr. N, Suite 107, Hugo, or 1500 Lake St. S., Forest Lake; Hugo American Legion, 5383 140th St. N., Hugo; Hugo Equipment Company, 13997 Forest Blvd. N., Hugo; and Wiseguys Pizza & Pub, 7095 20th Ave., Centerville.

• If Spike is not found by noon on Sunday, June 9, all prize money and gift certificates will be donated to the Hugo Good Neighbors Food Shelf.

• The completed Golden Ticket and the Golden Spike must be submitted to hunt organizers no later than 5 p.m.

Sunday, June 9, and at the same time the instant cash prize is awarded. Late Golden Tickets will not be accepted.

• If the Spike finder does not have a completed Golden Ticket, the gift certificates will be donated to the Hugo Good Neighbors Food Shelf.

• 2019 Spike hunt maps are ava ilable from official sponsors while supplies last, and a digital copy may be found on The Citizen’s website. PLEASE NOTE: Spike is NOT hidden on private property.

• All contestants agree that The Citizen, Press Publications, the Hugo Lions Club and their respective affiliate companies, parents, subsidiaries, advertising representatives and agents will have no liability whatsoever, and will be held harmless by contestants of any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prizes or participation in this contest.

• Except where legally prohibited, by accepting the prize the winner grants permission for The Citizen, Press Publications and those acting under its authority to use his or her name, photograph and/or likeness for advertising and/or publicity.

• All contest rules and decisions are final.
