LINO LAKES — A conversation during open mike ended with a threat of a lawsuit at the Feb. 10 City Council meeting.

Jamie Jensen is the developer of St. Clair Estates, a 35-lot single-family residential subdivision located north of Birch Street/CSAH 34 and east of Hokah Drive. The council approved the project’s preliminary plat in August 2016 and the final plat and development agreement in February 2017.

“I'm here because we have a number of issues that we are trying to work through, and it has almost felt like the situation has gotten kind of adversarial.

I feel like we put in a very nice project, but trying to close it up has been really difficult,” Jensen said.

“It seems so very difficult to get through these last few items and I wish that I had someone to talk to here who I could work through those with,” he continued. “I had been working with (Community Development Director) Mr. (Michael) Grochala, but that does not seem to work very well. I have a developer's personality and sometimes

Lexington resident Mark Peterson was recognized with a Civilian Service Award for his actions in 2019. Peterson recognized that an elderly Circle Pines resident needed considerable help. She was in declining health, living in less-than-desirable conditions and didn’t have any family that could be of assistance. Peterson worked closely with a community service officer and a variety of social service agencies to get the resident the help she needed.

The resident has since relocated to an assisted living facility in Blaine. Peterson was instrumental in getting the woman moved and situated in her new home, and made sure that her multiple pets were placed in proper care.

Larry Hutchinson received a Support and Service Award for 20 years of information technology (IT) support and service. “For over 20 years Larry Hutchinson (aka Hutch) has rendered information IT service and support to our department,” Chief James Coan said.

“He has kept us updated on technical advancements, has guided us through the complexities and challenges of computer technology/management and kept us safe and secure from intrusion and compromise.”

He continued, “Hutch has also assisted on countless important projects, including onboard squad computers and the body camera program.”

LINO LAKES CITY COUNCIL NOTES The Lino Lakes City Council took the following action at its Feb. 10 meeting: • Heard from Jamie Jensen, the developer of the residential subdivision St. Clair Estates. See the full story in this week's issue of the Quad Community Press.

• Appointed election judges for the presidential primary March 3.

• Appointed Zachary Beddow to the vacant community service officer (CSO) position within the Public Safety Department. Beddow's hourly rate of pay will be $18.06 and he will start in the position in mid-to-late February.

Mayor Rob Rafferty asked Police Chief John Swenson to provide some background on CSOs and what they do for the city. Swenson explained that CSOs are non-sworn positions occupied by individuals who are attending school to become a police officer. “It is a 20-hour per week position for us, and they do a whole host of duties, anything from bringing/dropping off evidence at the various labs that we use, prisoner

transport, handling animal control issues ...” he said. Swenson added that the CSOs often stay with the department and become sworn officers.

• Appointed Janele Waterman to the vacant administrative assistant position within the Community Development Department. Waterman's hourly rate of pay will be $24.59; she will start in the position in early March.

• Ordered the project, approved plans and specifications and authorized advertisement for bids for the Well House No. 1 rehabilitation project.

The project will provide necessary equipment upgrades and repairs to the existing well house. The budget for the project is $625,000 and funding will be provided from the water operating fund. The council will likely award a construction contract at its March 9 meeting and construction should begin in April, with substantial completion next fall.

• Held the second reading of a zoning ordinance text amendment to allow for small wireless facilities. Zoning ordinance section 1007.53 (antennas) does not address small wireless facilities, but City Code Chapter 305 does establish requirements. The amendment simply directs people to find more information about the topic in Chapter 305. The ordinance was adopted.

• Approved change order No. 2 and accepted an extension of the engineering construction services contract for the West Shadow Lake area improvement project. Construction of the project has been ongoing since October 2018. The 2019 construction season set a record for the number of rainfall events, a total of 39 days, which led to a difficult and delayed construction season. The contractor (Geislinger and Sons Inc.) was able to achieve substantial completion 2 1/2 months late but did not meet the final completion date of Nov. 1.

City Engineer Diane Hankee said that construction is almost complete, with the final lift of bituminous asphalt and boulevard restoration remaining.

The council granted the contractor an extension to the final completion date, now June 26.

Hankee explained that due to improved material management during construction, the contract was reduced by nearly $140,000. Because of the schedule extension, WSB has agreed to provide construction services for a fee not to exceed $65,700.

The overall project costs, including these changes, is projected to be about $6.33 million, approximately $525,000 under budget.

The next City Council meeting will be at 6:30 p.m. Monday, Feb. 24, at City Hall. There will also be a work session immediately beforehand at 6 p.m. in the Community Room.

Rationing toilet paper

A

friend of ours and his family recently moved to Hong Kong after taking a job with an international company. His new job requires him to frequently visit China and Vietnam. Wondering how the family of four was doing cooped up by the Coronavirus quarantines, we were delighted to see an update from them this week. She writes that her husband described the last flight back to Hong Kong from the U.S. as “a little eerie.” Now in Hong Kong, he has been working from home since he would be subject to a 14-day quarantine each time he travels. That would be 28 days round trip. The family has been juggling virtual schools, virtual workspace and a Wi-Fi band with overload. “In honor of the virus seeing its shadow, school is delayed another two weeks (now up to March 16).”

With some humor, she said “Now they are rationing toilet tissue to one square per visit — just kidding, just kidding.” She said, “Not going to lie, some days are way easier than others.” She mentioned they have enough supplies to bring him through another week as they seek humor in everyday life experiences and report they still enjoy the Hong Kong life.

This week they put on their masks and headed out to see a movie where everyone had their temperature checked before they entered. It was great to see they had confidence enough to go out and enjoy a movie as a family. As we enjoy our freedom to move about in the U.S., at this point without masks and temperature scans, let’s all say a prayer for those affected by the virus, and for our doctors, medical teams and scientists to find a vaccine or cure to bring this to an end quickly. To all our friends and families affected, we want you to know we’re keeping you in our thoughts and prayers.

Lakeside Club As a kid, I remember the bustling, smoked-filled dining room at the Lakeside Club. More than 30 years later, three generations of our family have dined there together. The restaurant was best known for its steaks. The spunk and personality of the sisters who owned and operated it in the later years was also a draw for patrons. Over the years the stories go, you “get what you get” when you dine at the Lakeside. I loved the history, the stories that went with the photos on the wall, the old printed list of members on track-fed paper, the nickel-plated grill and much more.

My wife and I wanted to go one last time last week, while our kids were at confirmation class.

Due to the packed dining room, wait list and line out the door, we grabbed the only spot available in the building - at the bar. We didn’t mind a longer than usual wait for drinks as we took in the atmosphere and conversation with Mike and Jill from Mahtomedi, who were sitting next to us at the bar. We learned they were regulars at the Lakeside and they were fun to talk to. Jill mentioned they had gone to the Lakeside Club three times that week because they wanted to eat different dishes. We talked to the bartender, Nick, the grandson of the owners, and asked for a few of the famous popovers. He said they were sold out by 6 p.m. The meal was great, meeting and getting to know new people, and what topped off the night was getting Sue’s signature wave when I asked for something extra. She looked at me from the other end of that bar, made so famous in the movie “Fargo,” and carefully adjusted her glasses with her middle finger. It was the perfect end. Thank you to the Mahmood family for being a hidden treasure in our community for more than 60 years.

You and the Lakeside will be missed!

Right control, right time, right pest

H

ome gardens can be a great source of food and fun for the gardener. But there are many pests that can make a gardener’s life difficult.

What’s the best way to manage these before they drive you mad? The answer is a method called Integrated Pest Management (IPM). You can create a healthier landscape and a healthier wallet by reducing the use of pesticides in the long term through IPM. Simply, IPM is using the right control, for the right pest, at the right time.

So, say you identify a problem with a plant in your garden. Before you go out and purchase something, the very first step is to identify what exactly is causing that problem. Is it bacterial fungal? Is it an insect or a rabbit?

Gardener’s or Identification is critical because if have a fungal problem and you Grapevine you spray an insecticide, you’ve wasted time, money and maybe affected Ash Barsody beneficial insects that weren’t causing a problem, for a product that won’t help the original issue. Do some research before you go to the store; check the University of Minnesota Extension website for “tomato diseases” and see what matches your plant’s symptoms. Anoka County Master Gardeners also offer plant and insect diagnostic clinics over the summer months where residents can bring in samples of plants and insects for our team to diagnose.

So you’ve identified your plant’s problem. Maybe it’s a tomato with spots and wilting leaves. The next thing

to determine might be, is this the time to treat this?

With this example, by the time the plant is showing signs of leaf spot, there isn’t a good cure. You can spray a fungicide to slow the inevitable, but it will cost you money and be minimally effective. Similarly, there are some insect pests that are only vulnerable during certain stages of their development, like Japanese beetle grubs. Spraying outside of that point of their life cycle will not have any effect.

For tomato leaf spot and many other common diseases, prevention is the name of the game. Proper plant location, watering technique, mulch application and garden sanitation can stop the spread of these diseases before they even start.

It’s also worth considering if it’s even worth treating the plant at all. If the damage you’re seeing is superficial and not spreading, it might be more worthwhile to leave it alone. Leaf miners strike plants like columbine, but mostly only cause minimal damage and don’t hurt the plant in the long run.

If you’ve gotten this far down the list and determined you know what your pest is and that it’s time to treat it, only then can you determine what to treat it with. We always advise choosing the least toxic option that will be effective. In many cases, picking insects off by hand or insecticidal soaps are sufficient control. If a stronger commercial product is what’s needed, then that’s what should be used. Often, if you implement these other controls beforehand, it doesn’t even need to get that far.

Whimsical Wigs will host its next workshop at 10 a.m. Feb. 29 at Lino Lakes City Hall in the public safety classroom. Monthly wig-making workshops are held the third Tuesday of the month, usually at Michael's in the Village of Blaine, and monthly crocheter get-togethers are the fi rst Tuesday of each month at 6 p.m. at Caribou Coffee in the Village of Blaine. Fairview Lakes Medical Center accepting scholarship applicants The Fairview Lakes Medical Center Volunteer Organization will award up to 30 $1,000 scholarships this spring to qualified candidates pursuing a career in the medical field. The application deadline is March 31. Applicants must be high school graduates enrolled in accredited post-secondary schools in the 2020-2021 school year.

Applicants must also reside in the Fairview Lakes Health Services region: Pine City to Lino Lakes/ Hugo; Hwy 65 to the Wisconsin border.

In Rehnelt’s 21 years in the Centennial School District, she developed the “Ramp Up to Readiness” program with the University of Minnesota to develop a College Readiness Program in schools and helped develop the Advancement Via Individual Determination (AVID) program. She has also been a counselor and site team member.

Rehnelt co-chaired the Career and Technical College Fair and helps with the College Fair to give students access to post-secondary discovery. She also works with around 500 students in grades 9-12 and has hosted informational sessions for parents and small group counseling sessions for juniors and seniors. She has received recognition from the Minnesota School Counselor Association twice, for essays written by students on how she has made a difference in their lives.

Learning about social justice Fourth, fifth and sixth graders sorted more than 500 pounds of cacao beans with an organization called “Enliven” Feb. 1 during Faith Formation at St. Joseph of the Lakes Catholic Church. By sorting the beans, they raised about $2,900 to go toward infrastructure improvements in poor villages in Nicaragua. After absorbing some teachings on justice and fairness, the students got to enjoy Fair Trade chocolate and sip hot cocoa.

Cougar skaters win conference finale; seeded 3rd in section

Centennial boys hockey takes a 13-12 record into Section 5AA starting Thursday, after winning their conference finale over Rogers 5-3 last Thursday.

The Cougars, seeded No. 3, face No. 6 Osseo at Champlin Ice Arena, 8 p.m. The winner will play Saturday, 7 p.m., against the winner of No. 2 Maple Grove vs. No. 7 Spring Lake Park. The section top seed is Champlin Park.

Against Rogers, Jake Pierson gave the Cougars 4-3 lead at 12:06 of the third period and AJ Carls made it 5-3 at 13:36. AJ Carls had two goals. Connor Thompson and Mason Wistrcill also scored. The Cougars had a 48-28 shots advantage over the Royals (12-11-1). Leo Troje was in goal.

The Cougars finished 8-4 in Northwest Suburban play for fourth place among 13 teams behind Andover (11-0-1), Blaine (11-1) and Maple Grove (10-2).

Jakob Bergeland, a sophomore from Centennial, is in his third year wrestling for the Minnesota Gophers.

Currently a sophomore in eligibility, Bergeland has a 17-7 record with four pins this season. He is 1-1 in Big Ten matches.

Bergeland is one of three Gophers competing at 149 pounds. Brayton Lee, a freshman from Indiana, usually has the slot in Big Ten matches, holding a 4-1 conference record.

Bergeland had a 22-8 record wrestling unattached during a redshirt year in 2018-19. Last season, he had 5-4 record, including 2-2 in the Big Ten, when an injury ended his season.

The Gophers are 4-4 in the Big Ten and 9-7 overall, with one conference match left, against Nebraska at Jakob Bergeland home Friday, 8 p.m.

At Centennial, Bergeland was a state champion his junior year, 2016, and compiled a 170-19 record.

Centennial girls basketball has lost four of its last seven games, including a 68-55 setback against Champlin Park on Friday. The Cougars are 18-6 after winning 14 of their first 16.

The Cougars beat Champlin Park 61-53 earlier in the season but the Rebels (8-14) got a decisive payback win as Miya Dubose hit 15 points, Maya Fitzpatrick 14, Gina Sefferud 13 and Amelia Valentino 11.

Jenna Guyer had 21 points and Jodi Anderson 17 (mostly at the free throw line) for the Cougars. On this night, they didn’t have much offense otherwise.

“We struggled to score — not sure if it was us having an off night, or their quick, physical defense,” Cougar coach Jamie Sobolik said. “Our decision-making was lacking and we struggled to stop them defensively.”

The Cougars clipped Coon Rapids 65-44 last Wednesday evening. Eleven players scored, led by Guyer with 16 and Anderson with 15.

The Cougars finish conference play this week. They play at Anoka on Tuesday night and will host Maple Grove on Friday.

Council set to vote on largest undertaking in city history CHRIS FRYE CONTRIBUTING WRITER

LEXINGTON — The City Council is set to vote Feb. 20 on a $60-70 million project, which could be the largest undertaking in the city’s history.

The council conducted the fi rst reading of the Lexington Loft Apartments (LLA) ordinance approving a planned unit development before a larger than normal crowd at its meeting Feb. 6. Several citizens chose to speak during the citizens forum, expressing concerns regarding parking, congestion and the overall impact of such a large project on a community as small as Lexington.

One individual respectfully expressed her disappointment that the council appeared to disregarded the feelings of what the people wanted and that this project was made to pass by changing the rules.

After the public spoke, the council attempted to address residents’ concerns as well as explain their individual thoughts on the project.

The biggest area of concern for the councilors was to dispel the notion that the council was disregarding what people wanted or that the rules were changed to make this project move forward.

City Attorney Kurt Glaser was asked to explain why the council changed the city’s code that required ordinance changes go from a 3/5 voting majority to a simple majority. Glaser stated that when this project came forward, it brought to the council’s attention that the city’s code that previously required a 3/5 voting majority was not consistent with state code and was in fact more stringent than the simple majority that the state’s code required.

In previous meetings it was made known that the state had made this

change years ago, however, Lexington had not made the change to its code to stay consistent with state law.

Mayor Mike Murphy also stated that he realized that the timing didn't look good, however, “We need to be consistent” - a sentiment shared by his fellow councilors who, while not all in agreement on the LLA project, were in agreement about the code change that was voted on and passed 4-0 (there being only four councilors at the time.)

In the lengthy deliberations, each councilor individually took time to express his or her reasons for, or in councilor John Hughes' case, against the project. Reasons for the project ranged from believing the project looked beautiful and that it was a luxury building; the city will get a brand new park; don’t want a low income project; it’s a great addition and that the council can’t just think of the people who have lived here forever

but that they have to think 40 years down the line.

Murphy said, “I’ve been really struggling about whether or not to approve this project. Nobody has reached out to me via email or phone, besides seeing a few people on Facebook. Very few people come to the meetings."

Councilor Hughes stated that he is against having a five-story building but more fervently stated that he is against allowing a project that doesn’t adhere to the city’s code. Hughes stated that this project, “is so far from the ordinances, why even have ordinances?”

If residents of Lexington wish to have their opinions known about the project, they will need to communicate those to council in some form or fashion before the project is voted on at the next council meeting Feb. 20.

ST. CLAIR ESTATES: Council heeds legal advice, refuses to release letter of credit

PUBLIC SAFETY BRIEFS Lino Lakes US Bank robbed Officers from the Lino Lakes Public Safety Department were dispatched to the US Bank located at 7984 Lake Drive at 9:17 a.m. Feb. 11 on a report of armed robbery.

Officers from Lino Lakes Public Safety and several surrounding jurisdictions located the two adult male suspects in the 1200 block of Larpenteur Avenue in Roseville a short time later and they were taken into custody with the assistance of Roseville Police Department, Minnesota State Patrol, Centennial Lakes Police Department, Blaine Police Department and the Ramsey County Sheriff's Office.

The department says there are no other suspects. The Lino Lakes Public Safety Department and the Federal Bureau of Investigation are investigating.

Lino Lakes man charged with assault, threats at area business Dennis Louis Babcock Jr., 38, has been charged two felonies and one gross misdemeanor for an incident that occurred Feb. 7 in Lino Lakes.

Babcock has been charged with making threats of violence, fourth-degree assault and third-degree criminal damage to property following the incident that took place at The Tavern on Main at 10:11 p.m.

According to the criminal complaint, the Lino Lakes Police Department was dispatched to the business after the bartender refused to serve Babcock and he became irate, threatening staff and patrons. Babcock reportedly resisted arrest; while taking him into custody, one officer was injured and a squad car door sustained damage.

Babcock's next court appearance will be March 12.

Grochala explained that the council took action in October 2019 to draw on St. Clair Estates’ development letter of credit to correct or complete required improvements, some of which included open space plantings and restoration, driveway repair and repair and landscaping of the filtration basin in the Enid Street Island.

“We are waiting for the construction season to start up ... we will complete those improvements. Once those improvements are done and the contractors are paid, the (remaining) dollars will be released to Mr. Jensen or Mr. Jensen's bank, depending on where it's intended to go,” Grochala said.

Jensen said, “Okay, and you realize that I will sue the city if you do any of those?”

Rafferty said, “I have nothing to add. We have been given direction by our legal counsel, and that is the direction we have to go.”

Jensen responded, “He can give you advice, you don't have to take it.”

Rafferty reiterated that the council and staff are going to take their attorney's advice.

that works great for development and not so good with people. So, I'd like to find someone else, if possible, to work through these things, address them and hopefully close out the project.”

Jensen added, “I believe it's a beautiful project, it's a credit to the city. It cost $3 million to put in ... We got 98% of it done before any of this came up, which is really inconvenient. The current direction seems to be, wait many months and then we will decide what to do then, and that really doesn't work. So, if we could do something, if I could meet with someone so we could make a plan, I would certainly appreciate that.”

Ultimately, Jensen's request was to ask the city to release his letter of credit. When a developer embarks on a development project under a development agreement, the city typically requires certain financial security to ensure the project complies with the development requirements. That security is usually in the form of a letter of credit issued by a bank to ensure that the improvements the developer promised to complete are done correctly. If the work is not done properly or is not completed, the city is entitled to draw funds from the bank up to the amount of the letter of credit and use the money to correct or complete the project.

Jensen is no stranger to city staff or the council.

He spoke during open mike back in November 2018 to request the return of his remaining escrow with the city. At that meeting, Grochala explained the city would not release the escrow until a list of outstanding items was completed, including the installation of streetlights; correcting erosion control problems; making repairs to sidewalks, curbs, catch basins; and more. After some heated back-and-forth between then-Mayor Jeff Reinert, the council, city staff and Jensen, Jensen stormed out of the council chambers.

At the Feb. 10 meeting, Mayor Rob Rafferty stated that the council and Jensen received a letter from the city attorney detailing “the direction they have to go.”

Jensen responded, “I received a letter from him too, and it said ‘Don't talk to anybody,’ which to me just says let this fester for longer and I told him that I was not willing to do that, that I thought that we should address it right now because there is nothing legally going on. We are not in court or anything like that, nobody is suing anybody, so we really don't need legal counsel on this ... I hope that you're not saying ‘Just forget it, we will wait several months and then maybe we will look at it again.’”

In a follow-up interview, City Attorney Jay Squires said the letter Rafferty was referring to was an email he sent to Mr. Jensen and the council. “I told Mr. Jensen there would be a settling of whatever is left on the balance of the letter of credit after the city completed correcting the work either he didn't do correctly or completing work that he didn't do at all in the development,” he said.

Squires added, “The city has the right to access the letter of credit and effect completion of that work of itself, which is what happened in this case.”

Centerville Feb. 5 on a report of theft.

• Police were requested to provide extra patrol around Eagle Park in Centerville Feb. 6 after recent vandalism incidents.

• Officers located a suspicious vehicle in the 400 block of Keith Road in Circle Pines Feb. 6 after park hours.

The driver admitted to officers that he was in possession of a small amount of marijuana.

Police subsequently searched the vehicle and found the suspected marijuana and paraphernalia.

• Police responded to the smell of a possible electric fi re in the 3800 block of Woodland Road in Lexington Feb.

7. Police evacuated all of the occupants of the home. Lexington Fire located a fi re in the attic of the home and was able to extinguish it with the help of neighboring departments.
