Council questions cheap rent for lakeside right of way BY DEBRA NEUTKENS EDITOR

WHITE BEAR LAKE — There is only one place to pump gas on White Bear Lake: Tally's Dockside. Whether they get to keep the service is a question city leaders will tackle as they consider changes to a generous lease agreement with the marina's owners. For years, the city has leased the end of Whitaker Street for $100 per month to Tally's owners Keith and Jan Dehnert. On that city right of way is an above-ground fuel tank that one City Councilman feels is a huge liability risk. If there was an accident on the piece of right of way, the city would get sued, noted Councilman Dan Jones. “We have accepted liability for that

gas tank at $1,200 a year.” The Whitaker Street lease came under discussion June 26 at the City Council meeting. City Manager Ellen Richter provided background, noting the Dehnerts purchased Tally's in 1990, expanded in 1999 to a 42-slip marina and entered into a lease agreement for the street end a few years later. In 2004, a request was granted to replace a 500-gallon gas tank with a 2,000-gallon tank. In 2005, rent was bumped up to $ 375 per month but in 2006, it was dropped back to $100. Richter said last fall an outside appraiser provided a figure of $483 per month as a fair price for 50 feet of lake frontage. As far as liability, the city could require the fuel tank be buried, but the cost is high — $ 90,000, Richter said. SEE LEASE, PAGE 8A

There was no way to tell that murder, intrigue, decades of court battles and eventually, a stage musical, were ahead when rookie reporter Joe Kimball set out to write an article about strawberry farmers in June 1977. His lifetime of work covering the aftermath of the famous Congdon murders in Duluth was essential to the creation of the musical “Glensheen,” which opens for its fourth season at the History Theatre in St. Paul this July. A White Bear Lake resident, Kimball had just graduated from the University of St. Thomas and taken a job with the Minneapolis Tribune. He was assigned a story about strawberry farmers in Askov and was driving up I-35 when he heard a news bulletin on the radio that changed the course of his entire career. A double homicide had been reported in Duluth, which sounded much more exciting than strawberries. He called an editor and was given permission to pursue the story. SEE GLENSHEEN, PAGE 9A
