Chamber Salutes Whittier Police Officers, Staff and Volunteers

13th Annual Silver Shield Awards Banquet and Appreciation Dinner Set for March 4th Honoring retirees for their outstanding service to the cities of Whittier and Santa Fe Springs will be the focal point of the 13th Annual Silver Shield Awards Banquet being held on Friday, March 4th at the Pacific Palms Conference Resort. There are 10 retirees being honored this year including Lt. Bill Webster, Lt. Wyatt Powell, Sgt. Dan Lowe, Communications Specialist Stephaine Walker, Corporal Marc Durant, Corporal Mike Hinson, Officer Ray Palmer, Officer Mike Karson, Code Enforcement Officer Gene Miller and former Chief Dave Singer. This special group of key Whittier Police employees represents over 200 years of service to the community. “These retirees have all helped to shape our department in their own unique ways,” stated Officer Mike Dekowski. This year’s program will recognize the contributions of retirees while at the same time highlighting real stories of bravery and above and beyond the call of duty moments of the active officers, civilian staff and volunteers. “Whittier is fortunate to have such a fine Police Department in our city. The Silver Shield Awards Banquet and Appreciation Dinner is designed to give individual businesses the opportunity to say thank you to those who keep our homes and businesses safe on a daily basis,” stated Chairman Doug Rowan of Financial Network. Individual tickets to the event can still be purchased for only $90 and include a 5:30 p.m. cocktail reception with dinner and awards beginning promptly at 6:30 p.m. This year guests of the event will also have the opportunity to purchase raffle tickets to win a cruise that has been generously donated by The Traveling Traveler. MAYOR’S MESSAGE

It has been my pleasure to serve as the 96th President of the Whittier Area Chamber of Commerce. 2010-2011 has been an interesting, challenging and successful year at the Whittier Chamber. We have much to be proud of over these past twelve months. We set out this year with a renewed focus on accountability and efficiency and have made tremendous strides in improving the business of the Whittier Area Chamber. We were able to streamline expenses, reassign responsibilities, bring in strong leadership and maintain the highest level of participation and success our events have ever seen. The strength and resilience of the Whittier Chamber starts Dean Harako with its strong membership. Thank you to all of the members for Pay Advance Payroll continuing to recognize the value in belonging to, participating in and supporting our Chamber. Equally important to the successes we so often experience here are the ladies of the Chamber. This past year our outstanding staff experienced the new business reality we have all been so painfully aware of: doing more, doing it better, doing it faster and doing it with less. Through the many challenges and changes we experienced on our path to running a better business, as President, I relied heavily on our staff to ensure that our events, Business Focus and membership continued with the quality we have all grown to expect from the Whittier Chamber. Thank you for rising to the challenge and exceeding the Board’s expectations. I’d also like to thank the Board of Directors. It takes strong leadership to make some of the difficult decisions that seemed ever present this past year. I believe that challenges seek those who are best equipped to handle them and each of our Board Members took a leadership role and filled much needed positions as we progressed throughout the year. Thank you for serving our business community. The Brainwaves Marketing team of Lyn Carty and Carol Crosby has been a key component to the success of the Whittier Chamber and it is exciting to have them back in the Executive Director role. Thank you for all of your efforts and support - we are truly lucky to have you. Finally, thank you to Mayor Nordbak and the Whittier City Council for continuing to see the value in the services provided by the Chamber. It is unusual to have such a strong Chamber and, even more so, to have such a supportive city government. Thank you once again. Being recognized as Business of the Month in February tells me that we have been, and will continue to stay, on the right track. May you all be touched by the luck of the Irish! The Silver Shield Awards dinner is finally here—Friday, March 4th! This is one of my favorite events because it is an opportunity for the community to celebrate the brave men and women of the Whittier Police Department. Thank you to the Whittier Chamber and the business community for your continued support of this event. The Chamber’s largest networking opportunity of the year is coming up quickly. Join your fellow Whittier businesses at the pirate-themed Business Expo on Thursday, March 24th from 4 – 7 p.m. at the Radisson Hotel in Uptown. The Business Expo is an Greg Nordbak, excellent way to showcase your business to over 1,000 community Whittier City Mayor members. This event is one of many networking opportunities conducted by the Chamber for the business community and it’s an easy way for you to establish new leads and contacts with potential customers. I always look forward to seeing how creative businesses get while incorporating the event’s theme. Another free service provided by the Chamber and the City is the Business Seminar Series. Last month, Dr. Renee Florsheim, who is a visiting professor at Whittier College, provided a great seminar on management and marketing for small businesses to a packed room of local Whittier businesses. This month, fellow Chamber member, Mr. Larry Cobb of Business Plan Preparation Services will be the guest speaker for the March 17th seminar—Planning for Success & the Business Plan. Mr. Cobb established his business over 12 years ago and has clients across the United States as well as some international clients. We are grateful to Mr. Cobb for participating with the City and Chamber to provide this valuable seminar. As business owners I imagine most of you already have a business plan, however, one of the key elements about business plans that we often forget is that they are not meant to be a onetime document. On the contrary, business plans are meant to assist business owners to plan for the future. So as markets change, it’s important to go back to your plan and make adjustments such as updating sales goals and especially the financial projections. If you are unable to attend the seminar on March 17th, there are many resources on the internet such as the U.S. Small Business Administration website, www.sba.gov. Also, the Whittier Public Library offers a large selection of books on business plans and other topics related to doing business. The Business Seminar Series is held the third Thursday of every month from September through June from 8 to 9:30 a.m. in the Whittier Central Library. Last, in case you were not yet aware, a new telephone system was implemented at City Hall last month, as well as the Whittier Police and Public Library. How’s your Security – Digitally Speaking?

What do you need to have if you want security? Insurance? Savings account? Family? Nice home? Good Police Deptartment? Investments? If you had all of these, you would be feeling safe, right? Have you thought about securing your computer? Your email? Your web site? There are a few things you should do that can protect you from being exposed to hackers, viruses, etc. 1. When software updates are available, DOWNLOAD AND INSTALL THEM!!! Do not wait. For some reason, everyone wants to Ross Gile, Digical skip them or update later. These updates are mostly created for security reasons. There are hackers out there who find vulnerabilities with operating systems (OS) such as Windows or Mac OS. Once they find security holes (aka bugs), the manufacturers of that software will fix their OS to close that vulnerability. SPEAKING OF HACKERS: There are good hackers and bad hackers. The good hackers are professional programmers who are hired by the OS developers to hack their own system. The bad hackers are those who do not have a life and just want to make us miserable. Personally, I’m glad both good and bad hackers are out there trying to break up web sites. If it weren’t for those high-tech hackers, the internet would not be as secure as it is today. Automatic Updates. Setup your OS so that it automatically downloads and installs the updates so you that you don’t have worry about it. Send email with SSL. Web pages that ask for your credit card info are encrypted, right? You remember the small yellow lock. Well, most email hosting providers now provide that same level of security for your email. Ask your email host if they have Email Hosting with SSL. Limit your login / password fields to 10 or 20 characters. Does your site have a login component? If so, these login fields can be a vulnerability to hackers because they can post malicious programming code into those input fields. Add a Captcha. You are familiar with these, right? These are those challenge type questions that ask you type to key in the letters from a graphic. Captchas are designed to differentiate between automated login hacking systems from humans trying to login. Have secured passwords. Do not use your birthday and other obvious information as your passwords. From www.lockdown.co.uk, here are some sample password ‘recovery’ times using a brute force method (btw… this is a site worth checking out): Any 4 digit combination: instant! 8 digits, numeric: instant! 8 digits, upper & lowercase alpha numeric: 25¼ days 8 digits, upper & lowercase alpha numeric with common symbol: 2¼ years

A One-Year Checklist to Retirement One of the biggest lessons of the recent economy is that many people who thought they were financially ready for retirement… weren’t. The amount of money, investments and government support you’ll need to retire comfortably is as individual as you are. Some people plan to work in retirement. Others have health issues or other financial responsibilities. However, one thing is true for every potential retiree. It makes sense to get customized advice from qualified financial, tax and estate planning professionals at least one year before Douglas M. Rowan, a retirement date is set. Here are some preparatory steps to take before CFP, CMFC you seek advice and finally set a retirement date. Figure out where the money is: The days of single-employer careers have rapidly declined for decades. Now, nearly 30 years into the world of widespread IRAs, 401(k) and other self-directed retirement plans, many potential retirees can’t reliably state where all their retirement resources are. Start pulling together all available paperwork tracking personal, government and employer-based retirement assets. It’s OK if you don’t know immediately whether you have enough to retire – experts can help you. What’s important right now is to identify everything you have to properly evaluate alternatives. Identify debt: If you have significant home or consumer debt, that’s a tough burden to take into retirement because most retirees find their income will be somewhat or significantly lower. That also goes for big car payments, tuition debt, medical debt or elder support. Debt is the first major reality check on retirement for most people. Adopt a downsizing budget: Too many people wait until retirement to learn how to live like retirees. If you have a budget, review it for unnecessary spending. If you’ve never made a budget, now’s the time, or at the very least, consider calculating your annual take home pay as a starting point to your budget. Budgeting simply means extinguishing debt, setting priorities and determining which current expenses can be cut or eliminated. You may be addressing plans to sell your current home in favor of a smaller one that can be bought for cash or minimally financed, or possibly you might decide to rent. You might want to try “going smaller” with vacations, cars, clothes and other needs or wants that can move to a lower price point. Try doing this while you’re working, bank the money you save and you’ll have excellent training wheels for retirement. Evaluate your support from the government: While both Social Security and Medicare programs remain an enormous help to many retirees, there’s always a chance of significant change, not to mention the continued discussion of moving the official retirement age well past 65. Definitely evaluate your government benefits, but do so in the context of what you’ve accumulated privately so you can maximize your government benefits when you need them. Consider healthcare and long-term care NOW: If you’re lucky, your health is in great shape. But family history and events out of the blue may change that. If you retire before age 65, you won’t qualify for Medicare unless you are officially disabled. That means that you’ll have the responsibility to maintain private insurance that adequately meets your needs without huge financial risks that can come from uninsured care or procedures. Even as healthcare reform adds certain protections for under-65 policyholders, it’s more important now than ever to give attention to health matters and whether your current insurance strategy

Tax tips Estate and Gift Tax Changes As you may already be aware, the 2010 Tax Relief Act enacted significant estate and gift tax changes. Before the new law, there was no estate tax for 2010, but some beneficiaries could have faced higher taxes because there were less favorable income tax basis rules. Also, under the prior law, estate and other transfer taxes were scheduled to rise substantially for post-2010 transfers. Overview of the new law. The 2010 Tax Relief Act provides Richard Scrivanich, temporary relief. Among other changes, it reduces estate, gift and Harvey & Parmelee generation-skipping transfer (GST) taxes for 2011 and 2012. It preserves LLP estate tax repeal for 2010, but in a roundabout way: estates wanting zero estate tax for 2010 must elect that option, along with the less favorable modified carryover basis rules that were set to apply for 2010. Otherwise, by default, the estate tax is revived for 2010, with a $5 million exemption, a top tax rate of 35%, and a step-up in basis. Also, for estates of decedents dying after December 31, 2010, a deceased spouse's unused exemption may be shifted to the surviving spouse. However, these generous rules are temporary—much harsher rules are slated to return after 2012. Lower rate and higher exemption for 2011 and 2012. For estates of individuals dying in 2009, the top estate tax rate was 45% and there was a $3.5 million exemption. The top rate was to rise to 55% for estates of individuals dying after 2010, and the exemption was to be $1 million. For 2011 and 2012, the 2010 Tax Relief Act reduces the top rate to 35%. It also increases the exemption to $5 million for 2011 with a further increase for inflation in 2012. But these changes are temporary. After 2012, the top rate will be 55%, and the exemption will be $1 million. Special tax saving choice for 2010. The 2010 Tax Relief Act allows estates of decedents who died in 2010 to choose between (1) estate tax (based on a $5 million exemption and 35% top rate) and a step-up in basis, or (2) no estate tax and modified carryover basis. Basis is the yardstick for measuring income tax gain or loss when an asset is sold. With a step-up in basis, pre-death gain is eliminated because the basis in the heir's hands is increased to the date of death value of the asset. On the other hand, with a modified carryover basis, an heir gets the decedent's original basis, plus certain increases, which can be substantial. Even so, if the decedent had a relatively low basis and significant assets, some pre-death gain may be taxed when the heir sells the property. These concerns factor into the special choice for 2010. The executor should make whichever choice would produce the lowest combined estate and income taxes for the estate and its beneficiaries. This would depend, among other factors, on the decedent's basis in the assets immediately before death and how soon the estate beneficiaries may sell the assets. Gift tax changes. Years ago, the gift tax and the estate tax were unified—they shared a single exemption and were subject to the same rates. This was not the case in recent years. For example, in 2010, the top gift tax rate was 35% and the exemption was $1 million. For gifts made after December 31, 2010, the gift tax and estate tax are reunified and an overall $5 million exemption applies. GST tax changes. The GST tax is an additional tax on gifts and bequests to grandchildren when their parents are still alive. The 2010 Tax Relief Act lowers GST taxes for 2011 and 2012 by increasing the exemption amount from $1 million to $5 million (as indexed after 2011) and reducing the rate from 55% to 35%.

Whittier Chamber Begins 97th Year of Service to the Business Community Fun Filled Installation Luncheon and Annual Meeting Set for April 7th

Thursday, March 31st will mark the conclusion of another successful year at the Whittier Area Chamber of Commerce and the end of the presidential term for Dean Harako of Pay Advance Payroll. “This has been a year of transition for the Chamber and I am proud of all we have accomplished under some pretty challenging circumstances,” stated Harako. “Although the economy has slightly affected our total number of members, it has not lead to a decline in overall attendance. In fact, this past year we saw an increase in member participation at almost all of our special events, and each month the Wake Up Whittier Networking Breakfast boasted nearly 200 Chamber guests in attendance!” Harako will pass the responsibility of leading the Chamber Dean Harako on to Ben Greer of GM Properties. Pay Advance Payroll “I am excited to lead the Whittier Outgoing President 2010-2011 Chamber and I am ready to take on whatever challenges and opportunities face our organization and the local business community in the coming year,” stated Greer. “Dean and the Chamber Board have worked hard to create a staffing structure that maximizes the talents of each of our employees. In addition, at our February Planning Conference the new Board designed a plan for the year that is fiscally responsible and focused on the Chamber’s mission. I really think everything is in place to have a very successful year,” added Greer. All members of the Whittier Chamber are invited to join us on Ben Greer Thursday, April 7th for our Installation Luncheon and Annual Meeting GM Properties where we will celebrate the past year and welcome Ben Greer as the 97th Incoming President “Commander in Chief” of the Whittier Area Chamber of Commerce. 2011-2012 Although exact details for this event are “top secret,” we can reveal the theme is MISSION POSSIBLE: From SURVIVING to THRIVING in 2011. The luncheon and program will be held from 11:30 a.m. – 1:30 p.m. at Fiesta Hall (across the Street from the Whittier Museum). Tickets are only $35 per person or, if you are interested in additional marketing for your business, you can purchase a table of 8 for only $340. The focus of the program will be to “advance the mission” of the Chamber by ensuring our members are “armed with the tools” for business success! One activity that will take place at this entertaining event is the installation of new representatives to the Chamber’s Board of Directors. A Fond Farewell to Retiring Board Members Many thanks go out to 5 distinguished leaders who will be stepping down from our Board of Directors at the end of our 96th year on March 31. As a group they served a combined total of 22 years on our Board in one capacity or another. It was a privilege to work with each of them and we will honestly miss their dedication, enthusiasm and leadership. All of our retiring board members have helped form our Chamber into what it has become today and we are grateful for all of their time and effort. As a Board member, they are expected to serve up to 3 two year terms and also participate on several different committees. The Board of Directors position is not a job to be entered into lightly and we appreciate anyone who has ever taken on this volunteer position. Please join us in thanking and honoring the following retiring Board members.

Virginia “Ginny” Ball, Woodruff Properties & Mary Kay Cosmetics

Ginny has been an active Chamber member since 1989. She joined the Board of Directors in 2005 and will be terming out after serving six years. She is a well respected member of our Board and is someone who is always willing to assist in any way possible. Ginny has been such an asset to the Whittier Chamber. Her knowledge of the Whittier community and especially the many nonprofit organizations for which she volunteers, has allowed her to bring a great perspective to the board. Ginny always knows what’s happening around town and has kept the Chamber’s Community Calendar accurate and up-to-date. Ginny was instrumental in starting the Whittier Association of Apartment Owners – a committee of the Chamber that educates apartment owners on everything from new laws to cost-effective ways to advertise. Ginny has participated on numerous committees over the years and she has a special fondness for the Student Chamber and the Silver Shield Awards Banquet. We will miss Ginny’s enthusiasm, dazzling smile and news on Whittier happenings.

Russell Castaneda-Calleros, Rio Hondo College

Russell’s job as the Director of Government & Community Relations at Rio Hondo College gave him the right background to serve as the Legislative Committee chair this past year. His extensive knowledge in the legislative arena and connections to local legislators enabled the Chamber to have healthy discussions and wonderful guest speakers at committee meetings. Russell is stepping off of the board due to family commitments and his new role as a Whittier Union High School District board member. Although he only served 2 years on the Chamber Board, he contributed regularly to monthly meetings and supported Chamber members at events such as ribbon cuttings and Wake Up Whittier Networking Breakfasts. We have appreciated the connection to Rio Hondo College over the years and we will especially miss Russell’s kindness and thoughtfulness. Thank you Russell for your hard work and commitment to the Chamber!

Cheryl Estep joined the Whittier Chamber Board in 2004 and has been a vital part of the growth and leadership of the organization. We were honored to have Cheryl serve as our Chamber’s 95th President in 2009-2010. She has served on just about every Chamber committee including Silver Shield, Economic Development, Legislative, Cosmic Bowling and Hathaway. Cheryl also served on the Executive Committee as VP of Special Events. Cheryl will be missed for her warmth, enthusiasm and professionalism at monthly board meetings. We are so pleased that she will continue to be active in the leadership of the Chamber as part of our Past Presidents Council that meets several times a year as Chamber advisors. Thank you, Cheryl, for your leadership and dedication to our organization!

John Peel, Concept 7

John Peel is a member of the Whittier Chamber in more ways than one. John is a Civic Member, as well as a Chamber member through his role as President of the Whittier High School Alumni Association, owner of Jolape Consulting, association with the Y’s Men Organization and as the Executive Director of Concept 7. So, although he will be leaving the Board, we fully expect to see him often at Chamber events networking and promoting the organizations he is affiliated with professionally. John’s many connections and overall experience in Human Resources made him the perfect Board Member to serve as the Chamber’s Vice President of Administration and Chair of the Personnel Committee. His leadership helped the Chamber transition in to a new staffing model over the past year that is proving to be very successful. John’s insight will be missed by the Board in the coming year, but we hope to keep him involved and active at Chamber events.

City of Whittier Department Head Fran Shields has been a Chamber fan for many years. Although she will be stepping down after only 2 years of service on the Chamber Board, we are hopeful that she will continue to support the Chamber as she has in the past through Special Events such as Silver Shield and the Hathaway Golf Classic. Fran’s love of Whittier made her an important addition to the Board of Directors. She will be missed for her willingness to lend a hand and her insight on City matters. Fran is a very special type of leader because she truly possesses a unique desire to see everything and everyone around her do better and succeed. Best of luck Fran in your new role as the City of Whittier’s Director of Parks, Recreation and Community Services. We will miss you!

Behavioral therapies can engage people in treatment, modify their attitudes and behaviors related to drug abuse and increase their life skills. If left untreated, however, its effects can last a lifetime. When members of the recovery community founded H.O.W. House in June of 1990, their mission was to provide a low cost sober living environment and recovery services to individuals with chemical addictions whom desire a safe, sober, supportive atmosphere in which to strengthen personal recovery and prepare for a healthy reentry into society. Located in South Whittier, the H.O.W. House is licensed by the State Dept. of Alcohol and Drug Programs as a recovery home for men 18 and over. The services include sober living, supportive lodging, weekly group meetings, monthly education sessions on some aspect of the recovery and/or the addiction process and recreational activities designed to help the resident learn how to enjoy their sobriety. Residents are housed in two main rooms and are provided with the following: food, cleaning supplies, linens, utilities, phones with a limited calling area, television with basic cable service, a washer, dryer and other common household items. H.O.W. House is a working house, meaning a resident is given one month to obtain a full time job or to start an educational or vocational program. If he is unable to work because of a doctor’s order and cannot participate in an educational or vocational program, he will be expected to perform thirty (30) hours per week of community service either for H.O.W. House or another charitable agency in the Whittier area. The H.O.W. House objective is to reinforce and strengthen each resident’s understanding and use of a recovery program and to assist in stabilizing one emotionally. The goal for each resident is that they leave the house sober, stable, employed and able to transition into an independent living situation that continues to be supportive to their alcohol and drug free life style. AROUND TOWN Local Dentist Challenges Business Community to Raise Funds for Hearing-Impaired Students

Dr. John Sudick invites the business community to join him in raising funds to help the hearing-impaired students who attend Oralingua School. “Computers and internet access make a big difference in learning and bringing knowledge and information into the eyes and minds of our hearing impaired kids at Oralingua,” explained Dr. Sudick. For just $600, local businesses can sponsor a new computer, 22” monitor and UPS which will be put into each classroom with a plaque featuring the company’s name. In addition, contributors will be invited to attend a special open house where they can see what this means to the kids and teachers at the school. Dr. Sudick’s hope is that the business community will pull together and be able to put a new computer in each of the 12 classrooms at Oralingua by the end of March. “As an additional incentive, for every $600 of funds contributed, I will personally donate $100 to upgrade the network capabilities in the school classrooms,” stated Dr. Sudick. Monies received above and beyond Dr. Sudick’s $7,200 fundraising goal for computers and the $1200 he will personally donate for network upgrades will go toward purchasing portable projection units for classroom size visibility of the computer screen. “I am excited to offer the opportunity for businesses to be part of a project that will bring the knowledge base of the internet, video and more learning opportunities to enrich the lives of children who do not have the full benefit of hearing and sound like you and me,” said Dr. Sudick. Symphony Association Announces Soloists at 43rd Annual Young Artists Competition

Two talented young musicians, a pianist and a clarinetist, won the Rio Hondo Symphony Association’s 43rd Annual Young Artists Competition in January during a concert at Whittier College. The winners are Vijay Venkatesh, a pianist from Laguna Niguel, and Chih-Chien Lin, a clarinetist from Los Angeles, who placed first among the woodwind, brass and percussion contestants. In addition to performing as soloists at the orchestra’s free “Highland Frolic” concert April 10th, each will receive a $1,000 cash prize. Each year the event is sponsored jointly by the Symphony Association and the Guild, which also provides the funds for the cash prizes. Whittier First Day to Honor Community Angels

The 2011 Whittier Community Angel Award and Dinner will be held on Friday, April 1st at 6 p.m. at the Whittier Area Community Church to honor organizations that have made a difference in our Whittier Community. Whittier Area First Day Coalition has invited over 60 Whittier area non-profit organizations to apply for the 2011 Whittier Community Angel Award. Shelter’s Right Hand Gears Up for Community 5K Walk

Registration is underway for the Shelter’s Right Hand 15th Annual “Stepping Out Against Domestic Violence” 5K Fitness Walk set for Saturday, April 30th. All Walk proceeds will benefit the Women’s and Children’s Crisis Shelter (WCCS), which has provided emergency shelter, transitional housing and other free services for victims of domestic violence and their children since 1977. Mobile Health Clinic Makes Regular Visits to The Whole Child

Free and low-cost medical services will now be available at The Whole Child, a Los Angeles mental health agency. The Care Force One mobile health clinic, provided by Presbyterian Intercommunity Hospital, will now offer its services to the families of The Whole Child, and anyone else needing care, the second Monday of each month between the hours of 8:30 a.m. and 3:30 p.m. The Mobile Health Clinic offers services to those who need them most: children and their families, the elderly and those who have difficulties accessing care with or without insurance. Services including sick call, child immunizations, flu vaccine, TB tests, blood pressure tests, school vaccinations, pregnancy tests, hearing and vision tests and sports, work and school physicals are available for free or low cost. Edison Scholars Program Expands Scholarships to Reach More Deserving Students

Activate Whittier Sponsors TV Health Lecture Series

Activate Whittier is partnering with Presbyterian Intercommunity Hospital (PIH) and Bright Health Physicians of PIH to provide an informative lecture series on Channel 3. Activate Whittier is an innovative, community-wide wellness program, designed to make it easy for residents to be as fit and healthy as they can be. Each month, a local doctor or health professional presents a lecture in the City Council Chambers at City Hall, which is taped live for rebroadcast. The lectures are open to the public and a question and answer session is held after the lecture. Topics cover a wide range of health issues. The first lecture will be presented at a community meeting at 6 p.m. Monday, March 21st, at Presbyterian Intercommunity Hospital, 12401Washington Boulevard. “Colon Cancer Prevention and Screening” will feature local Gastroenterologist Dr. Neal M. Shindel, heading an in-depth discussion on risk factors and strategies to prevent colon cancer. The program is free, but seating is limited and reservations are recommended. New portability feature. Under the 2010 Tax Relief Act, any exemption that remains unused as of the death of a spouse who dies after December 31, 2010 and before January 1, 2013 is generally available for use by the surviving spouse in addition to his or her own $5 million exemption for taxable transfers made during life or at death. Under prior law, the exemption of the first spouse to die would be lost if not used. This could happen where the spouse with resources below the exemption amount died before the richer spouse. One way to address that was to set up a trust for the poorer spouse. Now, the portability rule may make setting up a trust unnecessary in some cases. But there still may be other reasons to employ credit shelter trusts. For example, a credit shelter trust may protect appreciation occurring between the death of the first spouse and the death of the second spouse from being subject to estate tax. Such a trust also can protect against creditors. Plus, the transferred exemption may be lost if the surviving spouse remarries and is again widowed. Conclusion. The estate tax relief in the new law is substantial, but it is temporary. Estate planning to reduce taxes remains an important consideration. Even if taxes are not a concern because an estate is below the exemption level, it is important to have a proper estate plan to ensure that the needs of intended beneficiaries are met.
