City of Whittier staff and leaders will reflect on City accomplishments from the past year, discuss current economic concerns and review plans for the future, including steps to ensure the health and stability of Whittier, at the annual State of the City breakfast presented by the Whittier Area Chamber of Commerce. What does summertime mean to you? Is it a time for long days, warm nights and evening walks on the Greenway Trail or in Uptown? Does it also mean that there’s much to celebrate and enjoy in our great city as we approach mid-year? I think both! We recently had the opportunity to celebrate and learn more about many of the excellent service organizations in our chamber at May’s Wake Up Whittier, held at Whittier Hospital Medical Center. Whittier has such compassion for those in need, and the annual Salute to Service Wake Up Whittier provides an abundance of information, recognition and appreciation to these local service Sue Dean, organizations and nonprofits. Notary Signing I always look forward to our State of the City Address, which will Network be held this year on Thursday, June 7 at Whittier Area Community Church, with the event beginning at 8:30 a.m. The address will be presented by our Mayor, Owen Newcomer, and our City Manager, Jeff Collier. This event is full of information about our city and something you won’t want to miss. This month’s Wake Up Whittier will be held at Harmony Center for Spiritual Living in Uptown on Wednesday, June 20 with great networking and leads opportunities starting at 7:30 a.m. The Whittier Chamber partners with local businesses to host these monthly Wake Up Whittier events and always does an amazing job of bringing together over 200 people who are interested in meeting others and staying up-to-date on our current happenings, and of course leads, leads, leads! Be sure to take advantage of all that your membership has to offer! Our Tasty Tuesday events are just another way to meet and share opportunities with other local businesses. This month’s Tasty Tuesday will be on June 26 at 11:30 a.m., and will be hosted by healthy Uptown eatery Fenix 5-4. Since you “have to eat lunch somewhere” why not make it to your advantage and join in on this exceptional networking opportunity! Coming up quickly is our Shop Local Showcase, held at the Whittwood Town Center from 4 to 7 p.m. on Wednesday, July 11. The event, formerly referred to as the Fall Business Showcase, has moved to the summer and was a great success last year. Attendance will be free and open to the public making it a fantastic community event you can bring the whole family to. You’ll want to plan now, so be sure to watch for further details; whether you want to join us by hosting a table or booth, or just come by to collect information on local businesses, it’s sure to be a great networking event. Finally, I hope you all have a very special Father’s Day and enjoy making somez special memories with your family and friends this month!

It certainly has been a busy and exciting month for the city. First, kudos are in order to all who participated in the wonderful 125th Anniversary Celebration at this year’s Founders’ Day at Central Park. All the dance groups and entertainment, such as the Whittier High School Band and the East Whittier Middle School Jazz Band, were fabulous! A big thank you is also in order to the Whittier Historical Society, the Whittier Conservancy and all the community groups that participated. The Annual Health Fair and Police Open House was also a big success the following weekend with hundreds of children participating in the Kiddie-K Fun Run. The “jaws of life” and K-9 Owen Newcomer, demonstrations were quite popular with both parents and kids. If Whittier City Mayor you have children, this is a must-attend event next year. It’s wonderful to see business continue to pick up. Last month, Panda Express and Chipotle both opened for business at the Whittwood Town Center and it is expected that The Habit Burger Grill will open very soon. Also joining the Whittwood Town Center family is Sephora, which will be located inside JC Penney. Sephora will offer makeup, skincare, face & body tools and fragrances from more than 200 famous beauty brands. It’s great to see so much activity happening at the Whittwood Town Center! Whittier took the next step in the mineral extraction project in May when we delivered a check to the County of Los Angeles representing the appraised value of the land to be affected within the Preserve. As specified in Proposition A, the 1992 county initiative that provided funds to buy the property in 1995, the use of the land may be changed upon payment of compensation to the County Open Space District in an amount equal to the appraised value of the land. I have purposely kept this month’s update brief in hopes that you will join the City and the Chamber on Thursday, June 7 for the 2012 State of the City Address at the Whittier Area Community Church on Colima Road and Mar Vista Street. Rather than providing details about upcoming projects here, I encourage you to attend the State of the City Address to learn about all the exciting things happening around Whittier. A presentation on last year’s accomplishments, updates on current projects and information on what the community can expect for fiscal year 2012-13 will ensure an informative and exciting event for all. As in previous years, the audience will have an opportunity to ask questions of me and our City Manager Jeff Collier immediately following the presentation. LABOR LAW Voluntary Wage Assignment Differs from Court-Ordered Garnishment Are federal student loan wage garnishments and voluntary wage assignments considered the same as court-ordered garnishment notices? If an employee executes a voluntary wage assignment for the benefit of a particular creditor, this would not constitute a judgment garnishment notice that could be counted pursuant to Labor Code Section 2929. Employees who have defaulted on student loans create unique questions. The Higher Education Act (Title 20, U.S. Code Section 1095a) authorizes the Education Department as well as student loan guaranty agencies to collect defaulted federally financed student loans by means of an administrative order to the employer, and without the need for a court order. The administrative order requires the employer to withhold and pay over to the Education Department or the guarantor up to 15% of the debtor’s disposable pay. This federal law supersedes any state law governing wage garnishment. Employers should note that notices of garnishment are serious matters that can result in liability if ignored. If an employer fails to withhold or to pay over the amount the notice requires the employer to withhold, the judgment creditor may bring a civil action against the employer to recover the amount. Garnishment Defined The definition of garnishment in California Labor Code Section 2929 is: “any judicial procedure through which the wages of an employee are required to be withheld for the payment of any debt.” Section 2929 of the California Labor Code provides, in part, that “no employer may discharge any employee by reason of the fact that his wages have been subjected to garnishment for the payment of one judgment.” Sometimes employees will challenge the validity of garnishment notices by filing motions with the court to set the garnishments aside. It should be noted, however, that such a motion, before some action by the court, has no effect on the order received by the employer.

Assignments Unlike a garnishment wage order, an employer has no obligation to honor an assignment. Before simply deciding to honor the assignment, however, the employer should discuss the authorization with the employee and review it with counsel. Although the protections of Labor Code Section 2929 would not apply, the validity of the assignment is governed by the provisions of Labor Code Section 300. Labor Code Section 300 invalidates any assignment unless: • The assignment is contained in a separate written instrument signed by the employee. • The assignment must specifically identify the transaction to which the assignment relates. • If the employee is married, the written consent of the spouse must be attached to the assignment. TAX TIPS Simplified Employee Pensions (SEPs) If you are thinking about setting up a retirement plan for yourself and your employees, but are concerned about the financial commitment and administrative burdens involved in providing a traditional pension or profit-sharing plan, there is an alternative program you may want to consider– a “simplified employee pension,” or SEP. SEPs are intended as an alternative to “qualified” retirement plans, particularly for small businesses like yours. The relative ease of administration and the complete discretion you, as the employer, are Richard Scrivanich, permitted in deciding whether or not to make annual contributions, Harvey & Parmelee are features that are especially attractive. Here's how these plans work. LLP If you don't already have a qualified retirement plan, you can set up a SEP simply by using the IRS model SEP, Form 5305-SEP. By adopting this model SEP, which doesn't have to be filed with the IRS, you will have satisfied the SEP requirements. This means that you, as the employer, will get a current income tax deduction for contributions you make on behalf of your employees. Your employees will be taxed not when the contributions are made, but at a later date when distributions are made, usually at retirement. Depending on your specific needs, an individually-designed SEP—instead of the model SEP—may be appropriate for you. When you set up a SEP for yourself and your employees, you will make these deductible contributions to each employee's IRA, called a SEP-IRA, which must be IRS-approved. The maximum amount of deductible contributions that you can make to an employee's SEP-IRA, and that he or she can exclude from income, is the lesser of: (i) 25 percent of compensation, and (ii) $50,000 (for 2012). The deduction for your contributions to employees' SEP-IRAs isn't limited by the deduction ceiling applicable to an individual's own contribution to a regular IRA. Your employees control their individual IRAs and IRA investments, the earnings on which are tax-free. There are other requirements which you have to meet to be eligible to set up a SEP. Essentially, all regular employees must elect to participate in the program, and contributions can't discriminate in favor of the highly compensated employees. But these requirements are minor compared to the bookkeeping and other administrative burdens connected with traditional qualified pension and profit-sharing plans. The detailed records that traditional plans must maintain to comply with the complex nondiscrimination regulations aren't required for SEPs. And employers aren't required to file annual reports with IRS—Forms 5500— which, for a pension plan, could require the services of an actuary. What record-keeping is required can be done by a trustee of the SEP-IRAs—usually a bank or mutual fund. Another option for a business with 100 or fewer employees is a “savings incentive match plan for employees” (i.e., a “simple” plan). Under a simple plan, a “simple IRA” is established for each eligible employee, with the employer making matching contributions based on contributions elected by participating employees under a qualified salary reduction arrangement. The simple plan is subject to much less stringent requirements than traditional qualified retirement plans. Or, an employer can adopt a “simple” 401(k) plan, with similar features to a simple plan, and automatic passage of the otherwise complex nondiscrimination test for 401(k) plans. MEMBER SPOTLIGHT Paintless dent repair offers convenient alternative to costly body shop visits Dents are nothing new to Ron Meyer. WHAT’S COOL IN YOUR SCHOOL Whittier High School Alumni Association Pioneer High School’s Titan Tones win top honors at regional choral festival awards 2012 scholarships The Whittier High School Alumni Association’s Educational Foundation selected 12 students for its 2012 Alumni Scholarship Awards. All of the scholarship recipients were honored at the Alumni Association’s 13th annual Hall of Fame dinner and silent auction. “We’re delighted to be able to assist these brilliant young Whittier High School seniors as they begin their college careers,” said John Peel, of the Whittier High School Alumni Association. “It was wonderful to be able to honor their achievements at our Hall of Fame event.” Sergio Perez received the Vic Lopez Award, Andres Garcia took home the Kilinski “Believe It – Achieve It” Award and Christianne Pantoja was given the Maxine Milner Award. Marcos Gonzalez, Jr. and Isabel Macias each received a Nixon Scholarship. Wendy Carrillo was awarded an Alumni Scholarship of $2,000. David Acevedo, Yazmin Acosta, Andrew Armendaris, Alejandra Gonzalez, Monica Negrete and Giuliana Regina each were awarded an Alumni Scholarship of $1,000. This year’s Hall of Fame honorees were: Dr. Breene Murphy, class of 1942; Patricia Hofstetter, class of 1944; Marilyn Hofstetter, class of 1945; Dr. Rick Herold, class of 1951; Gus Velasco, class of 1958; Dr. Steve Gothold, class of 1959; and David Owens, class of 1973. The Alumni Association also honored Whittier High School’s faculty who work with students who are a part of the Academic Mentors/Senators program, through which junior and senior student leaders assist freshmen with the transition from middle school to high school. Pioneer High School’s varsity vocal ensemble, the Titan Tones, recently received its highest honors yet for the group’s vocal performances at the recent WorldStrides Heritage Performance Program’s regional choral festival held in San Francisco. The Titan Tones took the First Place Gold Award, the Outstanding Choral Group Award Trophy, for achieving the highest score in the choral category for the entire festival; and the Adjudicator's Award Trophy, for receiving a score of 95 percent and above from each of the festival’s judges. In addition, Pioneer students Dalia Cruces and Emilio Valdez each received Solo Maestro Awards for their solo performances. The ensemble’s award-winning performance earned the group a second invitation to perform in the WorldStrides’ Heritage Performance Program’s Festival of Gold at Carnegie Hall in New York City in April 2013. Last year, the group traveled to New York and received the highest scores at the National Heritage Festival of Gold. “These are the highest honors we have yet to receive at one event,” said Evan Mooney, director of the Titan Tones and chair of Pioneer High School’s visual and performing arts department. “We are on cloud nine.” Mooney said that Deke Sharon, a well-known singer, arranger, composer, as well as a vocal producer for the television vocal competition show, “The Voice,” was one of the judges at the event and has offered to arrange a song for the ensemble next year. “I am more than proud of our Titan Tones,” Mooney said. “I am humbled and honored by our fantastic students.” “I owe everything to Mr. Mooney, and I really want to thank him for everything he’s done for us,” said Emilio Valdez, a senior, who was also one of four Pioneer High School students to be chosen by audition to perform this year in the Southern California Vocal Association Honor Choir and the All-State Honor Choirs. "We are all so very proud of our Titan Tones and the level of excellence they have achieved," said Whittier Union High School District Superintendent Sandra Thorstenson. "We are also deeply grateful to Evan Mooney for his time, energy and commitment to his students. He is a masterful teacher and choral director who infuses his deep love, knowledge, and appreciation of music and the arts in all that he teaches. He is a true inspiration to his students." Founded in 1980, WorldStrides Heritage Performance Programs for choir are held throughout the United States and bring together high school musical ensembles to perform and compete for adjudicated rankings based on an international standard.

2012 Salute To Service Shelter’s Right Hand Shelter's Right Hand is the auxiliary for Women's and Children's Crisis Shelter (WCCS), whose mission is to serve victims of domestic violence by providing shelter, support services and coordinating agencies for wellness and prevention. Today's organization holds true to the five original charitable purposes: to grow membership, to recruit and train volunteers, to seek funds, to generate awareness and to assist in maintenance. Shelter's Right Hand successfully operates a thrift shop, Sacks on the Boulevard, at 12300 Washington Blvd. The thrift shop has an all-volunteer staff that welcomes donations and serves the community. The monies generated from sales go to support WCCS. Every spring Shelter’s Right Hand hosts its 5K Fitness Walk in Uptown Whittier. Women & Children’s Crisis Shelter The Women's & Children's Crisis Shelter, Inc. (WCCS) has been serving victims of domestic violence and their children since it was established in 1977. H o u s e , which stands for honesty, open-mindedness & willingness, provides temporary housing for men with a substance abuse problem while they stabilize their recovery and financial resources. H.O.W. House provides residential services for men overcoming an alcohol or other drug addiction and have been in operation since July of 1990. Located on a quiet residential street in South Whittier close to Telegraph and Victoria, their residents are housed in three three-bedroom houses with two men in each bedroom. Residents are required to attend regular 12-step meetings, an in-house process group meeting and to either work, go to school or do community service. East Whittier Arts Education Foundation The East Whittier Arts Education Foundation was established to increase community support for the arts (drama, music, visual arts and dance) in the 13 schools of the East Whittier City School District. Friends of Pio Pico The Friends of Pio Pico is the nonprofit arm of Pio Pico State Historic Park in Whittier. Pio Pico State Historic Park is one of California's oldest state historic parks and has been open to the public as a historic site since 1909, thanks to Whittier resident Harriet Russell Strong, who saved Pio Pico's historic adobe from destruction in 1907. History often repeats itself, and the park is slated for closure on July 1, 2012 due to state budget cuts. That's less than 60 days away! The only hope to save this historic treasure is to raise $80,000 to keep the park open. To date, the Friends of Pio Pico have raised about $10,000 and will be joining forces with the cities of Whittier and Pico Rivera to try to save the historic adobe of Pio Pico, the last governor of Mexican California. AROUND TOWN Local Starbucks partners lend helping hands in community Back in April, Starbucks Coffee partners reunited in doing a park clean up with the City of Whittier. Several employees from 12 stores, ranging from the city of Whittier all the way to Diamond Bar, gathered at Murphy Ranch Park located near La Serna High School in Friendly Hills. They began at 8 a.m. cleaning and re-beautifying the park while working alongside several city officials in making the entrance way for fire marshals to drive through in case of fire emergencies. The Starbucks Coffee team raked and helped trimmed trees to clear the path eliminating branches, trash and other waste from the area. The Starbucks Coffee team was giving back to their local community as part of April’s global month of service. Thank you to the Starbucks Coffee team for their service in working together and volunteering their time in the community.

Innovative program offered for divorced parents The Intercommunity Counseling Center announces a valuable opportunity for divorced or divorcing parents. The Cooperative Parenting and Divorce program, which began last month at ICC, will teach parents how to shield their children from parental conflict and establish a positive, long-term relationship as “co-parents.” The course also satisfies court requirements for cooperative parenting education. Cooperative Parenting and Divorce is an eight-week class which combines video, activities and group discussion to help parents refocus their attention on their children, rather than on the divorce. In some cases, divorced parents are encouraged to take the class at the same time. Program authors Susan Boyan and Ann Marie Termini are family therapists who were inspired to create the groundbreaking video-and-discussion program after observing the harmful effects of divorce on their child clients. Rather than attempt to “fix” the children, Boyan and Termini decided to go to the source of the problem: quarreling parents. “When people are in love, they see only the positive traits of the other person,” says Boyan. “Then, when they are no longer in love, the opposite happens, and they can no longer see any good in the other person. It becomes all or nothing.” Unfortunately for the children, who still love both parents, a great deal of psychological damage can occur during this time if the parents behave badly in front of them. Using video, activities and group discussion, Mohr guides parents through eight steps: Step 1 - Making the Commitment to Caring: Parents learn to recognize parental hostility and discover how conflict affects their child’s development Step 2 - Allowing My Child to Love Both Parents: Parents learn to create two homes, minimize stress at transitions and make it a positive experience for their child Step 3 - Changing My Long-Term Role: Parents discover how their anger and bitterness keeps them emotionally attached to one another, and learn ways to let go Step 4 - Choosing My Personal Path: Parents clarify their personal choices and identify a personal path. The term “realignment” is introduced to assist parents in creating a new role as co-parents Step 5 - Managing My Own Anger: Parents determine what anger is, its signals and triggers, constructive versus destructive anger and the consequences of harboring anger Step 6 - Taking Control of Conflict: Parents examine the cycle of conflict and practice defusing or resolving it Step 7 - Negotiating Agreement: Problem-solving techniques and business relationship skills are examined from a divorced parent’s position Step 8 - Co-Parenting Is Forever: Parents review their commitment to care, to be childfocused, to practice good communication and negotiation skills The Intercommunity Counseling Center, established in 1976, provides services for children and families, including individual, marriage and family counseling and classes in parenting and anger management. AROUND TOWN Tri-Cities Regional Occupational Program plans move to Pioneer High School Pioneer High School will be the new home of Tri-Cities Regional Tri-Cities Occupational Program Administrative Offices, Dental Clinic and classroom OP R ROP as of July 1 of this year. “This was a logical step for Tri-Cities ROP following direction from the Governing Board to implement cost saving efficiencies,” stated TCROP Executive Director David Bennett. The move will actually enhance support for high school students with the re-location of the clinic and a classroom to the high school campus. The majority of TCROP classes will continue to be offered on the six high school campuses, Cal High, El Rancho, La Serna, Pioneer, Santa Fe and Whittier. This summer, Tri-Cities ROP will offer the Recreational Leader class for high school students which will be taught by Jack Mahlstede, former Santa Fe High School football coach, and Mike Mendez, former Recreation Director for the City of Santa Fe Springs, and will begin Monday, June 18. The Recreational Leadership program prepares high school students for entry-level jobs in a variety of recreational situations. Students learn the skills and attitudes necessary to work in camps, parks and other recreational agencies. In addition to classroom instruction, students will participate in workplace learning at community classroom sites. High school students may earn between five to 10 high school credits. Emergency Medical Technician Pre-Certification Training will be offered to high school students who are 18 on the first day of class (June 18) and adults and will meet Mondays through Thursdays from 9 a.m. to 3:30 p.m. This class will include the EMT Basic and Expanded Scope of Practice required by the Los Angeles County Department of Health Services and Title 22 of the California Code of Regulations to prepare students to take and pass the State of California EMT Certifying Examination. Additionally, high school students who are 16 years of age may enroll in the Nurse Assistant Pre-Certification course which prepares students for the state Nurse Assistant Certification test. Students will train in basic nursing skills through classroom instruction and supervised clinical experience at a community site. Fundamentals of patient care; nursing and communication skills; disease organisms and infection control; basic anatomy and physiology; nutrition/diet therapy; and specialty nursing will also be taught. This class is also available to adults. In the fall, students from Pioneer High School will be able to enroll in a 5th and 6th period Introduction to Dental Assisting class, and the after school Introduction to Dental Assisting class will continue to be offered for high school students who attend any of the other Whittier Union High Schools or El Rancho High School. Whittier to host patriotic ceremony July 4 Whittier will commemorate Independence Day, Wednesday, July 4 with a Flag-Raising Ceremony and Freedom Walk at the Palm Park Greenway Trailhead, 5703 Palm Avenue. The event will begin with a flag-raising at 8 a.m., featuring patriotic entertainment by the Whittier High School Pep Band. Light refreshments will be served. • If the employee is a minor, the written consent of a parent or guardian must be attached to the assignment.

• The employee must attach a statement that no other assignment exists with regard to the same transaction.

• The assignment must be notarized and be accompanied by an itemized statement of the amount then due the assignee.

• The employer must not be in possession of any other wage assignment or earnings withholding order. Assignments are limited to not more than 50% of the employee’s disposable wages (see Labor Code Section 300(c)). This obviously places an obligation on the employer to review each assignment as the employer must accept responsibility for any wage deductions based on the employee’s assignment.
