Business safety, crime prevention are focus of new Chamber program
The threat of crime is part of doing business. No business is immune from the growing menace be ier ro of burglary, robbery, shoplifting, personal assaults, itt f Co m m e rc e & W h internal thefts, check forgery and computer and credit card fraud. Small businesses, in particular, suffer devastating effects from crime. This is why the Whittier Chamber is unveiling a new program that focuses on crime prevention and business safety. Called Business Watch Whittier, this program enlists the active participation of the Whittier business community in cooperation with the Whittier Police Department to reduce commercial crime in our community. It is a joint partnership between the Whittier Chamber, Whittier Police Department and the City of Whittier. Business Watch Whittier includes a special closed group facebook page that businesses can join that is dedicated to providing tips and a forum for sharing information on what you can do to create a safe, secure environment for your employees and your business. The purpose of this group is to actively reduce and prevent crime through cooperation and education. The goals of Business Watch Whittier are to: • Promote communication and understanding between the Whittier Police Department and the business community KE

• Actively reduce and prevent crime through cooperation and education • Provide education to merchants on ways to crime-proof their properties, watch over neighboring businesses and document and report suspicious activity • Provide a way to share information between businesses and alert everyone on crime trends • Eliminate opportunities for criminal activity • Network with other businesses The facebook group is the first step in getting this program off the ground. On the facebook page safety tips, local crime trends, and important alerts will be shared. We encourage you to use this group as a way to communicate with each other, get to know your business neighbors, and share information on what’s happening around you. In addition, participating businesses will receive static cling stickers that can be displayed on Business Watch Whittier members’ front doors or windows. Special workshops on how to make your business safer led by the Whittier Police Department are being planned for later in the year. Through participation in Business Watch Whittier, local businesses can enhance the safety of their business, deter and reduce crime, and take measures that can reduce the chances of becoming a victim of criminal activity. Whittier tragically lost one of our own on February 20. Officer Keith Boyer and Officer Patrick Hazell were both shot while responding to a routine traffic accident and Officer Boyer later died from his injuries. Officer Boyer worked at the Whittier Police Department for

Business Community to Honor Whittier Police Department Honoring individuals for their outstanding service to the cities of Whittier and Santa Fe Springs will be the focal point of the 19th Annual Silver Shield Awards Banquet being held on Friday, March 10 at the Pacific Palms Resort in the City of Industry. The Silver Shield Awards Ceremony will highlight the accomplishments and outstanding efforts of active officers, civilian staff and volunteers and honor the Whittier Police Department as they celebrate their Centennial year. This event will be significant in marking the beginning of the healing period for our Whittier Police Department family
and the community of Whittier as we celebrate the life of fallen Whittier Police Officer Keith Boyer who was killed in the line of duty on February 20 and recognize Officer Patrick Hazell who is recovering from a gunshot wound. Awards will be given in multiple categories to deserving individuals and retirees will be honored for their service to our community. “This year’s program will recognize the unique men and women of the Whittier Police Department and the extraordinary things they have done this past year to protect the cities of Whittier and Santa Fe Springs,” stated Community Relations
Officer John Scoggins. The Silver Shield event is designed to give businesses and individuals the opportunity to say thank you to our police department. “It is an honor for the Whittier Chamber to host this special event again this year,” stated Chamber Board President Chris Hardeman from DialMed Home Care. “We are proud of our partnership with the Whittier Police Department and it is our privilege to coordinate this event for the 19th year in a row to highlight all that they do for our community on a daily basis,” he explained. This is my final message as Chamber President. Stepping into this role was a new endeavor for me. Over the years I have led other organizations that each had a singular goal, but the Whittier Chamber is different. It has many goals: To build its member businesses by giving them opportunities to network, advertise, learn and educate. But what does that mean in a city that has thousands of businesses that each have unique goals and needs? So I asked myself, how does the Whittier Chamber help grow our local economy by thinking about every business in Whittier? This year we launched Business Watch Whittier, The Nonprofit Network, Chamber Chat, and Live Facebook feeds, each of which is available to any Whittier business. We also put in place an exciting new way for Chamber members to promote their business online, a program that will officially

During my time as Chamber President I focused on infrastructure, providing Chamber staff the technology necessary to be productive in today’s world. I focused on communicating via video, each month providing online video highlights of Chamber events, news, and opportunities. I focused on personnel, making sure the Whittier Chamber had the right people in place to run things efficiently. I am a strong advocate for Shopping LOCAL! If not you, then who? It is amazingly easy to shop online, but it is incredibly rewarding to support a small business in our community that provides a needed good or service. Next time you need something, please check the Whittier Chamber website first. I also advocated for the redevelopment of the Uptown District – the heart of Whittier. This year the city has held three community sessions to focus on the needs of Uptown, and though I had nothing to do with this, I was mighty glad these sessions take place. I look forward to a day, in the not-too-distant
In case you were not aware, you might be able to dispose of appreciated property without being taxed on the gain by exchanging it rather than selling it. You can defer tax on your gain through the “like-kind” exchange rules. A like-kind exchange is any exchange (1) of property held for investment or for productive use in your trade or business for (2) like-kind investment property or trade or business property. For these purposes, “like-kind” is very broadly defined. As long as the exchange is real estate (land and/or buildings) for real
estate, or personalty (non-real estate) for personalty, it should qualify. However, exchanges of some types of property (for example, inventory or shares of stock), do not qualify. Since not all property is eligible, you should consult with your tax adviser to make sure that the property involved in your exchange is indeed eligible for a tax-free like-kind exchange. Assuming the exchange qualifies, here’s how the tax rules work: If it’s a straight asset-for-asset exchange, you will not have to recognize any gain from the exchange. You will take the same “basis” (your cost for tax purposes) in your new property that you had in the old property. Even if you do not have to recognize any gain on the exchange, you still have to report the exchange on Form 8824. Frequently, however, the properties are not equal in value, so some cash
or other (non-like-kind) property is tossed into the deal. This cash or other property is known as “boot.” If boot is involved, you will have to recognize your gain, but only up to the amount of boot you receive in the exchange. In these situations, the basis you get in the likekind property you receive is equal to the basis you had in the property you gave up reduced by the amount of boot you received but increased by the amount of gain recognized. Example. Ted exchanges land (investment property) with a basis of $100,000 for a building (investment property) valued at $120,000 plus $15,000 in cash. Ted’s gain on the exchange is $35,000: he received $135,000 in value for an asset with a basis of $100,000. However, since it’s a like-kind exchange, he only has to Continued on page 15

As many of you know, our community suffered a tremendous loss last month when Whittier Police Officer Keith Boyer was shot and killed in the line of duty. Sadly, while responding to what appeared to be a routine traffic collision, the suspect opened fire on two of our officers, killing Officer Boyer and injuring Officer Patrick Hazell. The suspect, who earlier that morning had murdered his family member and stolen a car, was reportedly on probation and had been released from state prison in 2016. This senseless act of violence comes on the heels of a very controversial crime debate. You may have seen discussion on social media regarding a recent newspaper editorial on a lack of relationship between crime rates and imprisonment rates. The item noted that crime remains at historic lows nationally, with property crime declining more than 50 percent since 1991. Unfortunately that hasn’t been our experience in Whittier, nor has it been the experience elsewhere in Southern California. According to the FBI’s most recent
national crime statistics, violent crime decreased 5.3 percent and property crime decreased 0.6 percent since 2015. This has not been the case in California where our western region showed a 6.4 percent increase in violent crime, the highest regional increase in the nation. Our region was also the only area to post any increase in property crime (0.8 percent). Those statistics compare the first six months of 2016 to the first six months of 2015, as the FBI has not yet released statistics for all of 2016. Much of this can be attributed to Proposition 47 which has reduced sentencing from felony to misdemeanor for offenses including shoplifting, grand theft, receiving stolen property, forgery, fraud, and writing bad checks (when the value is $950 or less); and personal use of most illicit drugs. Although some studies have noted savings from this measure, opponents argue that Prop. 47 has already cost citizens of Los Angeles County nearly $250 million in property loss. So what does this mean for Whittier? After Prop. 47 was approved, property crime rates here increased 12 percent, followed by another 15 percent the following year — this after years of relatively low crime rates. Cities throughout California are experiencing similar increases in what some categorize as “low level crime,” minimizing the criminal action with a “non-violent” label. There’s nothing lowlevel about having your valuable and

sentimental items stolen from you in a potentially dangerous burglary incident. Prop. 47, joined by AB109 and Prop. 57, has created a perfect storm for increased victimization. The 2013 closure of 10 courts in L.A. County, including ours in Whittier, contributed to the problem by producing fewer criminal filings. In addition, statewide mental health and drug rehabilitation programs have seen a decline in enrollment as legal incentives, like shortened sentences for participation in an 18-month treatment program, no longer exist. It appears that the burden of these combined changes has shifted onto the local level — our communities. As I talk with mayors from other local cities, I hear confirmation that property crime in particular has increased in their communities and our residents and businesses are feeling it. The bottom line is that, regardless of what statistics say, how safe people feel is certainly one way we measure the impact of crime in our neighborhoods. The City of Whittier remains committed to providing a healthy and safe community through a balance of economic, social and recreational opportunities that encourage civic engagement. The Whittier Chamber has partnered in this effort by rallying its members and creating a Neighborhood Business Watch. We must continue looking out for each other and working together to combat the growing issue of crime in our city. Keeping your families safe remains a top priority and, as the saying goes, “if you see something, say something.” Later this month, the community is invited to attend the 19th Annual Silver Shield Awards Banquet and Appreciation Dinner in honor of the Whittier Police Department and fallen
Officer Keith Boyer. Whittier residents and businesses benefit greatly from the professionalism and excellence of the WPD and this is a great opportunity for us to say thank you and show our support for their tireless service. Crime Mapping Online Sharing crime information with the public and keeping residents, motorists, and businesses informed about criminal activity is a crucial element of working together to keep Whittier a safe city. The Whittier Police Department has teamed up with Crimereports.com to provide the community with up-to-date simple access to online crime information in the city. The online crime mapping system displays crimes which were reported to the Whittier Police Department. The user interface is very simple to navigate and allows the user to define specific date ranges, geographical locations, and crimes to display. For privacy reasons, address locations are rounded to the nearest block number. Each crime type has a different icon and when clicked, will provide the date and time of the incident. A great feature of the crime mapping system is the ability of residents and businesses to sign up for automatic crime alerts. Users are able to define a specific geographical area to be monitored and receive email notifications when a crime occurs in their area of California Sex Offender Registry. By clicking on of interest. Another feature of the crime mapping system is the the icon, users can see the address and photo of the ability to display on the map the exact living locations registrant along with identifying information. The maps are updated daily, directly from the of registered sex offenders, as contained in the State

WHAT’S COOL IN YOUR SCHOOL Rio Hondo College Foundation and community donors support students with nearly $64,000 in scholarships Seventy-six exceptional Rio Hondo College students received scholarship awards totaling nearly $64,000 from the Rio Hondo College Foundation at the Fall 2016 Scholarship Awards Reception on January 27. In all, the students received 104 separate awards that will provide assistance as they pursue their higher education journeys. “This is a tremendous outpouring of support for our students,” Superintendent/ President Teresa Dreyfuss said. “I thank the Rio Hondo College Foundation and its many generous patrons from our
community who have made possible these gifts and the promise they offer to our students.” Dreyfuss participated in the ceremony, as did Vice President of Student Services Henry Gee, Foundation Board President John Peel and Foundation Executive Director Howard Kummerman. Whittier City School District to be featured in art show The Whittier City School district is excited to announce a special art show at the Whittier Museum entitled “Whittier through the Eyes of a Child” reflecting the history and distinctiveness of Whittier. Pioneer High School opens enrollment for Escalante Summer Math Academy Pioneer High School is accepting applications for its 27th annual Escalante Summer Math Academy, which enables Whittier’s middle and high school students to get ahead on their math classes and prepare to take on advanced college-level courses. Named after famous educator Jaime Escalante, the six-week program, held at Pioneer High in June, offers students the opportunity to take classes in Algebra I, Geometry, Algebra II, Math Analysis or Calculus. Students who receive A’s or B’s earn 10 credits that will be transferred to their transcripts, enabling them to advance one course level. The academy will begin June 12 and conclude July 20 with an end-of-summer assembly. Classes will run from 8 a.m. to 2 p.m., with tutorials running until 3 p.m. Mondays through Thursdays. The program compresses a math class that is normally taught over an
entire school year into 150 hours. Classes will be taught by college professors, as well as college and high school level tutors to ensure student success. Renowned mathematics teacher Angelo Villavicencio will come out of retirement to teach calculus at this year’s academy. Angelo Villavicencio worked with Escalante in Garfield High S c h o o l ’s A P C a l c u l u s program, made famous by the 1988 film “Stand and Deliver.” A $40 program fee will cover student workbooks. Employers may cap PTO accrual if reasonable time frame given By Barbara Wilber - Labor Law Corner Our company provides a paid time off (PTO) policy to meet the paid sick leave requirement. The company plans to cap the PTO accrual at 48 hours, pursuant to the paid sick leave cap requirements. Is this cap OK? In most cases, employers will be unable to use the sick leave cap for PTO. A valid cap on vacation/PTO accruals is different than a sick leave cap and depends on the total amount of vacation/ PTO time an employee is allowed to accrue or earn in a year. Once you establish a PTO plan that provides time off for any purpose, including vacation and sick leave, the plan is treated the same as vested vacation pursuant to Labor Code 227.3. Capping Vacation, PTO Vacation/PTO vests as it is earned, and a “use-it-or-lose-it” policy, in which employees lose earned vacation that is not taken by a specific time, is prohibited (except for a limited optout provision applying to collective bargaining agreements and vacation plans subject to the federal Employee Retirement Income Security Act). However, a cap limiting the amount of vacation/PTO that accrues may be established, but the rules regarding this type of cap are different than the cap allowed by the mandated paid sick leave law. To be in compliance, an employer must merge the two laws and make sure its policy meets the stricter requirements
found in both regulations. Establishing a cap on earnings is optional for either sick leave or vacation/PTO. State Guidelines If an employer chooses to place a cap on the PTO earnings, follow the Division of Labor Standards Enforcement (DLSE) guidelines. The DLSE Enforcement Manual at Section 15.1.4.1 states: “DLSE has repeatedly found that vacation policies which provide that all vacation must be taken in the year it is earned (or in a very limited period following the accrual period) are unfair and will not be enforced by the Division. (See the detailed discussions of these issues at O.L. [Opinion Letter] 1991.01.07 and 1993.08.18).” ‘Reasonable Cap’ Criteria Any policy instituting a cap on accrued vacation/PTO must provide a reasonable time in which to use already-earned vacation. In the interest of meeting the “reasonable cap” criteria, employers often cap accrual at 1.5 or 2 times the annual earning rate. For example, if an employee earns 40 hours annually, the policy could establish a cap at 60 or 80 hours. As you can see, this requirement would not allow capping the vacation/PTO earnings at the amount accrued in one year as is allowed in the sick leave law. Before instituting a cap, review the DLSE opinion letters and visit HRCalifornia.com for guidance.

Ban the Box Law prohibits employers from asking about previous criminal activity In December 2016, Los Angeles Mayor Eric Garcetti signed into law Assembly Bill 218. The new bill titled Los Angeles Fair Chance Initiative for Hiring will prohibit employers in Los Angeles from inquiring about previous criminal activity until a conditional job offer has been made. This means that employers may no longer ask on an employment application or during the interview about previous criminal activity. The law also states that a background check can only be performed after the conditional job offer has been made. Furthermore, employers may not take adverse action (such as denial of employment) until a written assessment of the applicant’s criminal history has been completed, “that effectively links the specific aspects of the applicant’s criminal history with risks inherent in the duties of the employment position sought by the applicant.” The employer is also required to provide the applicant five days to submit information refuting the findings of the assessment, and must provide the applicant with written notice of the adverse action as well. Employers are also required to retain records of such adverse action assessments for a period of three years from the date of the initial application. The Fair Chance Ordinance currently doesn’t
affect businesses in the City of Whittier, however employers should be prepared to comply with some form of “Ban the Box” this year (it’s only a matter of time before employers in LA County will need to comply). If an employer is found to be in violation of the ordinance the Department will issue a written notice requiring the employer to cure the violation and may impose administrative fines of up to $2,000 per violation. An applicant or employee may also bring a civil action in court for violation of the ordinance within one year of completion of the administrative enforcement process. Penalties will be in effect starting July 1, 2017, employers should be pro-active and review their current hiring practices accordingly. Open Streets Events are one-day events in which streets are closed to vehicle traffic and residents are invited to enjoy their city on bike, foot, scooter, rollerblade, etc. Metro believes that closing streets to vehicular traffic allows citizens to see what is available in their city and how they are able to travel through it. The City of Whittier is calling their Open Streets event, “Whittier Walk & Roll.” Metro and Whittier hope to increase sustainable transportation (transit, bicycle, & pedestrian), provide opportunities for first time transit usage, highlight and promote cultural resources, and enhance our sense of community. AROUND TOWN Whittier Area Genealogical Society’s library seeking new home When the Whittier Area Genealogical Society (WAGS) was founded in 1981, part of its mission was to provide a genealogical library and its collection has grown to 3,000 volumes and has provided a useful resource for those interested in genealogy and family history. The library has been fortunate to have various homes, including the Santa Fe Springs Library, and until recently, the Wardman Library at Whittier College. The college found it needed the space being used by the WAGS collection for other priorities and the Society worked for several months to find a new home for their books. As the January deadline
approached, WAGS was forced to put their collection in storage. WAGS is still looking for a new home for their library collection.Suitable space would include a location that is accessible on a regular basis, has a minimum of 600 square feet for the books and a study area and is in the greater Whittier area. If you know of any library, church, business, non-profit organization or other entity which might have space available to house the collection, or if your business or organization has unused available space to donate, please contact Trish Garcia, the WAGS Library Director, at librarian@wagswhittier.org.
5K Walk in Uptown Whittier to benefit victims of domestic violence Registration is underway for the Shelter ’s Right Hand 21 st Annual Stepping Out Against Domestic Violence 5K Fitness Walk to benefit the Women’s and Children’s Crisis Shelter. On April 22, 2017, hundreds of community members are expected to step out in support of victims of domestic violence as we honor in memoriam, Jan McMahon, who faithfully served as the Thrift Shop manager for 17 years. From Central Park, walkers will follow a 3.1 mile scenic walk through historic residential and business districts of Uptown Whittier. The Shelter’s Right Hand is pleased to announce that Janice Hahn, Supervisor 4 th District, County of Los Angeles, Wells Fargo and Crawford’s Putty are the presenting sponsors of the Walk. New Century Singers Whittier presents annual fundraising event New Century Singers Whittier, a non-profit organization composed of 40 women who love to sing, will be presenting their annual fund-raising event, “What the World Needs Now Is Love”, on April 1, 2017. This event, filled with entertainment by the chorus members and catering by Herach and Ara, will be held at the Masonic Lodge Whittier, 7604 Greenleaf Ave., Whittier. There will also be a silent auction and opportunity prizes. Proceeds from this “loverly” event gives the chorus, also a member of a statewide organization CA Women’s Chorus, the opportunity to perform for special events such as club meetings, holiday celebrations and entertainment for retirement and assistedliving homes as well as provide scholarships to community college and university students enrolled in music programs. Tickets are $35 per guest and available through March 22. Doors open at 5 p.m. with dinner served at 6 p.m. Entertainment will follow. There will also be a silent auction and opportunity prizes. Children’s Hospital Orange County. “These donations are intended to improve the lives of children battling cancer,” says Donna Holmes, president of From Maddi’s Closet. “We have given $35,000 to Children’s Hospital Los Angeles and another $25,000 to Children’s Hospital Orange County, as well as supporting other programs.” Due to the generous support From Maddi’s Closet received from many individuals and organizations in the community, the organization was able to continue making significant contributions towards relieving the pain suffered by thousands of children. Although the number of children helped by From Maddi’s Closet is significant, the need is far greater. The Center for Cancer & Blood Diseases at Children’s Hospital Los Angeles deals with some 1,589 newly diagnosed patients annually, and treats some 5,164 patients. Some 1,054 patients are enrolled in 67 clinical trials. A total of 29,113 outpatient visits are received annually in the Hematology/Oncology and Infusion Center. In addition to helping children battling cancer today, From Maddi’s Closet also supports research efforts aimed at stopping the various forms of cancer afflicting children, which being made through the research institutions at both children’s hospitals.
