CONGRESS INVESTIGATES NIRVANA TRAGEDY Isang linggo matapos ang insidente sa Motorbanca Kim Nirvana-B, sinimulan ng Kongreso ang imbestigasyon. Ayon sa July 3 incident report ng MARINA, ang Nirvana-Bay 33.58 GT wooden-hulled passenger vessel with outriggers authorized to operate in: •

Pilar-Poro-Puertobello, San Franciso (all of Camotes-Cebu) – Danao City, Cebu and viceversa;

Puertobello, Tudela – Pilar, Camotes, Cebu to Ormoc City per Special Permit valid until 24 July 2015 with an authorized capacity of 178 passengers and 6 crew;

Owned/operated by Mr. Jorge Bung M. Zarco of Pilar, Camotes Cebu

Grounds.

Liabilities.

Qualifications. Kinuwestyon ng mga mambabatas ang kakayahan ni Warren Oliverio, kapitan ng bangka at licensed boat captain, major patron, high school graduate umano. Si Biazon din ang author ng HB 534 (Maritime Act of 2013) upang magtatag ng korte para sa mga kasong maritime or “…adjudication of admiralty disputes” on our waters.

Castelo ang MARINA Memorandum Circular 190 na nag-utos ng “Progressive/Gradual Phase Out of Wooden-Hulled Ships. ”Ito ay inihinto for economic reason and not for safety reason. “In other words, you are putting premium on economic reasons rather than the safety of passengers,” punto ni Castelo. Ang MC 190 ay aprobado noong 11 August 2003 ni dating MARINA Administrator Oscar Sevilla. Ayon kay Mejia, pinasuspinde ito ng DOTC sa susog ng Development Bank (DBP) at Board of Investments (BoI) “… develop the appropriate and affordable financing scheme and incentives for the acquisition of replacement ships by existing wooden-hulled operators. Insurance. As of press time, hindi pa nakakapagsumite ng marine protest ang kapitan ng motorbanca dahil agad na ikinulong matapos kasuhan ng murder. Non-bailable ang kasong murder at punishable up to 40 years imprisonment. Advisories. Gaya sa inaasahang paghihigpit matapos ang isang trahedya, inilabas ng MARINA noong July 6thAdvisory 2015-07, ipinag babawal gamitin ang “second (upper) deck for passenger accommodation and cargo stowage for all motor bancas.” Lahat ng may “second (upper) deck shall be immediately subjected to re-evaluation and reinspection” tungo sa: •

Review of approved plans including stability and load markings;

Conduct of re-inspection of motor bancas with second (upper) deck in coordination with the Maritime Regional Offices. Motor bancas who fail to comply with MC 65, MC 2007-04 and other regulations shall be restricted to single deck banca operation; and,

Check load markings, to verify calculations vis-a-vis its existing Certificate of Load Marking. A new certificate shall be re-issued to reflect the validated/verified calculation.

Pinasinayaan ang Navigator International Maritime Training and Assessment Center noong July 3, in simple ceremonies sa punong tanggapan nito sa Ermita, Manila. Matatag ang suporta ng mga Greek Shipowners, walang alinlangan sa kani-kanilang pahayag sa ginintuang hinaharap ng Navigator. His Excellency, Greek Ambassador to the Philippines, Nikolaos Kaimenakis, was among the notable wellwishers; isang patunay gaaano katanggap si Capt. Edgardo Flores sa komunidad ng mga Griyego. Lalong namangha ang karamihan nang magsalita si Capt. Flores nang fluent Greek (wala pa ngang halong

Kaya murder ang isinampang kaso sa kapitan at ibang crew ng Motorbanca Kim Nirvana-B. Kinuwestyon ang murder charge ng mga observers at mga mambabatas sa isang Congressional hearing. Ito’y sa pangambang baka maibasura lamang ang kaso dahil sa teknikalidad. Dapat sana, ipakita din ang malasakit sa ating mga marino. Karapat-dapat bang kasuhan sila ng murder at agarang ikulong? Plano ba nila at sinadyang pataubin ang bangka at patayin ang maraming pasahero? Ayon sa ilang survivors, nagawa pa nga ng kapitan at crew na makapagligtas ng ilang buhay. Kung may kapabayaan o pagkakamali, ang malinaw ay kasama rin sila sa mga sugatan at muntik nang mamatay nang dahil sa insidente. Subalit murder ang isinampa, kulong agad at nonbailable. Magandang paporma ng mga otoridad. Ngunit marahas para sa mga pamilyang binibuhay ng mga marino, kaya naghanap-buhay sa karagatang madalas may nakaambang trahedya. Sa mga maritime accidents, kadalasan isinisisi agad sa human error o pagkakamali ng kapitan para mapagtakpan ang pagkukulang ng iba. Pinakamarami o mahigit 30% ang mga marinong Pinoy sa world fleet, kilala sa pagiging mahuhusay. Subalit sa domestic, kinukwestyon ang kakayahan ng ating mga seamen lalo na mga kapitan na kadalasan ay hindi college graduate. Hindi ba dapat suriin din ang contributing factors gaya ng shipping regulations, mababang sweldo at kalidad ng mga sasakyang-pandagat? Mahigit 300,000 ang mga marinong Pinoy sa international vessels, kumpara sa mga 60,000 sa domestic ships.

JAPAN OFFERS DRAWINGS OF TANKERS, FIBERGLASS BOATS Ipinatalastas ng Embahada ng Pilipinas sa Tokyo nagkaroon na ng kasunduan ang Pilipinas at Japan, isang “cooperation arrangement to enhance the skills and capabilities of Filipino shipyards and shipowners.” Ito ay upang magkaruon ng kaalaman at kakayahan ang Pilipinas “to construct oil tankers and fiberglass reinforced plastic (FRP) boats for domestic use that are compliant with international safety and environmental standards.”

Noong March 23rd, naglagdaan ang Maritime Industry Authority (MARINA) at Maritime Bureau of the Ministry of Land, Infrastructure, Transport and Tourism of Japan (MLIT), sa Record of Discussions (RoD) on “Enhancement of Constructing Oil Tanker Vessels in the Philippines.” Sa ilalim ng nasabing RoD, magbibigay ang Japan sa Pilipinas ng technical cooperation at “design drawing of oil tanker” sa condition na ito ay gagawin sa Pilipinas at “classed by a Japanese ship classification society, the copyright holder of the

design drawing.” Ang Maritime Bureau ng Japan ay nag-alok din ng technical assistance sa paggawa ng fiberglass reinforced plastic (FRP) boats. Maaala-ala na may circular na ang MARINA tungkol sa pagpapalit sa FRP ng mga kahoy na bangka dito dahil ang FRP ay pinaniniwalaang “sturdier, environment-friendly and have longer service life compared to wooden fishing bancas.”

Sinasabing isa sa ikinukonsidera ni Duterte sa kanyang posibleng pagtakbo sa presidential election ang kahilingan ng mga OFWs para sa proteksyon ng kanilang mga pamilya habang sila ay nasa ibang bansa. Pinasalamatan naman ni Duterte sina Dr. Conrado Oca (AMOSUP President) at Vice Admiral Eduardo Ma. R. WALANG AMOR SA ANGKLA Tahasang binatikos ni Butch Elaba ang Angkla PartyList sa ginawa nitong huli na amendment sa Labor Code. Si Elaba ang pangulo ng Association of Marine Officers and Ratings (AMOR) na katapat ng Angkla PartyList sa politika ng mga marinero. Ipinagmamagaling naman ni Rep. Jesulito Manalo, first nominee ng Angkla, ang ginawa niyang amendment sa ikabubuti daw ng industriya. Umaangal kasi ang mga shipowners sa batas na bayad agad kapag napaglimi na tama ang claim ng seamen. Sa mga kasong nabaligtad ang desisyon ng hukuman dahil sa apela ng shipowner, at dapat isauli ng mariner ang pasiunang naibayad, wala halos nagbabalik. Milyon-milyong dolyar na ang hindi naisasauli ng mgamarinero sa mga shipowners. Kaya ang amendment ni Manalo ay escrow (ilagak) muna ang kabayaran sa isang Ahensya hanggang maging final na ang desisyon. Ngitngit sa pagsalungat si Elaba, “Imagine

COAST GUARD NAKIPAGKASUNDO SA GREAT SEAS Pumirma sa isang kasunduan ng pagtutulungan ang Coast Guard (PCG) sa Great Seas Mariners Training and Assessment Center (GSMTACI) noong July 8, ginanap sa PCG Headquarters, Port Area, Manila. The said agreement gives equal opportunities to both parties for enhancement and upgrading of theoretical and application of maritime skills ng kanilang mga tauhan. PCG will provide hands-on experience and actual training on the safe and efficient operation of the Coast Guard vessels. Bubuksan naman ng GSMTACI ang kanilang center sa mga PCG personnel na ibig mag-aral upang palawakin pa ang kanilang knowledge and skills in the maritime field. Sa gayun, mas gaganda ang pagganap ng PCG staff sa kani-kanilang mga tungkulin sa ahensya. Ang MoA ay nilagdaan nina PCG Commandant Rodolfo Isorena at Great Seas President Procis Aquino upang agad maisakatuparan.

MEJIA BINATIKOS Pinuna ang mga pagkukulang ni MARINA Administrator Max Mejia, lalo na’t wala siya sa bansa ng mangyari ang sakunang dagat sa Ormoc City. Tumaob ang ferry na biyaheng pa-Camotes, Cebu, na ikinasawi ng 62 pasahero. Ang hagupit ay mula kay Ben D. Kritz, isang kolumnista ng Manila Times at publisher at editor-in-chief ng GR Business Online. Nasa labas daw ng bansa si Mejia ng mga tatlong buwan sa pangangampanya upang mahalal na Secretary-General ng UN’s International Maritime Organization (IMO). Suporta nga ni DOTC Secretary Abaya, si Mejia daw ay “shoo-in” na mananalo dahil “the most qualified” sa anim na kandidato sa naturang pwesto. Nanalo si Ki-tack Lim ng South Korea, tagpas agad si Mejia sa first round pa lang ng botohan. Siya ang pinakamababa (only 3 votes

out of 40 IMO Council), marami sa mga IMO veterans ang nagtataka sa pagsali ni Mejia na wala namang experience sa IMO work. Si Mr. Lim ay delegado na sa IMO ng South Korea mula pa noong 1986, participating in maritime safety and environmental issues. Halos tatlong dekada na si Lim sa gawaing global maritime; si Mejia naman ay MARINA pa lamang ang hands-on experience maliban sa academics.
