MEASURING WEAR CHARGES

Husqvarna Ring Saw Diamond Blade

Using a micrometer, measure from the inside of the ring to the outside of the diamond segment. Repeat this in three random places around the blade. Add the three readings and divide the total by three. This will give you a “Blade Out” measurement. When the blade is returned, repeat these steps and subtract this total from the “Blade Out” total. This will be the total amount of wear to be charged to the customer. Note: Always measure in the center of the segment.

Concrete Chain Saw

Chains are either sold at the time of rental or measured as follows:

Using a micrometer that is measured in thousands, measure from the top of the segment to the top of the chain in 3 spots. This will give you blade out, repeat the process when it is returned. The difference between the In and Out measurement is the total use.

Walk Behind and Cutt-Of Saw Diamond Blades

Using the digimatic blade gauge, choose the proper sized arbor and bolt it in the hole marked with the diameter of the blade to be measured. Mark three arrows on the blade. Measure the three segments that the arrows point to. Add the three readings and divide the total by three. This will give you a “Blade Out” measurement. When the blade is returned, repeat these steps and subtract this total from the “Blade Out” total. This will be the total amount of wear to be charged to the customer. Note: Always measure in the center of the segment.

Crete Mower 20 Segment Diamond Blade

Using a rule that is marked in 16ths, measure the segment from the flat surface on the bottom of the blade. It should be recorded and sold in 16ths only. Do this when the blade is returned and subtract to get the total wear amount.

Abrasive Grinding Stones

Are sold to customer at time of rental. This is more beneficial to the customer.

Diamond Cutters

Using a rule that is marked in 16ths, measure the segment from the flat surface above it. It should be recorded and sold in 16ths only. Repeat this when the unit is returned and subtract to get the total wear amount.

Planer and Scarifier Teeth

Using a rule that is marked in 16ths, measure from bottom to top of the tooth. It should be recorded and sold in 16ths only. Repeat this when the unit is returned and subtract to get the total amount of wear. Note: Always check teeth for uneven wear.

Broom Bristles

Using a tape that is marked in inches, measure from the steel spacer to the tip of the bristles. Take one measurement at each end of the broom. This should be recorded and sold in inches only. Repeat this when the unit is returned and subtract to get the total amount of wear.

Roto Mill

No daily wear charge. Charge for broken teeth, non-rotating teeth and teeth with premature wear. Charges will be per tooth at time of rental return. Excessive wear will be billed as well.

Cut N Break Blades

$100.00 per day fee is billed, no wear charge as long as blade is returned un damaged.

Stump Grinders

No daily wear charges. Charges for broken, bent or excessive wear. Charges will be per tooth at the time of return.

ALL RENTERS MUST PROVIDE INSURANCE

OPTION #1 - RENTAL EQUIPMENT PROTECTION – ELECTION

Star Equipment requires all rentals to be covered by proper insurance prior to delivery. As an added benefit we are offering our customers the Rental Equipment Protection (REP) plan to protect your rental equipment. The REP is simple to use just tell our Rental Coordinator and they will handle the rest for you. An REP fee of 14% of the rental will apply. If you provide adequate proof of insurance, this charge will be removed from your rental fee if received prior to the end of the first rental period. (Ask your Rental Coordinator for requirements on Certificate of Insurance).

This policy has been implemented to protect rental customers from unknowingly being charged for items like loss of rents and diminished value in the event a loss occurs while on rent.

By using the REP program all requirements like loss of rents, and diminished value are waived and included in the REP. The deductible for any valid claim under the REP will be 10% of the insured valued with a maximum cap of $1,000.00.

Rental Equipment Protection waives responsibility for more types of loss than most damage waivers. A short list of what REP covers includes, but is not limited to:

Simply indicate on your rental agreement that you would like to take advantage of the Rental Equipment Protection. A fee of 14% is added to your rental and Star Equipment will take care of the rest.

Demolition Work Exception

The REP will not be allowed on equipment used for demolition work. You must provide insurance adequate to cover the insurance value of the equipment.

OPTION #2 – YOU PROVIDE INSURANCE

If you choose to supply Star Equipment with an insurance certificate as evidence of proper insurance coverage, the stipulated minimum insurance coverage’s are as follows:

• $1,000,000 General Liability

• $1,000,000 Property Damage AND

All Risk Leased Equipment – Loss or Damage

• Replacement value of equipment Leased or Rented ($100,000 minimum)

• Including boom coverage for all forklifts, cranes and boom trucks Leased or Rented

• Star Equipment Ltd. must be named as an Additional Insured/Loss Payee

CREDIT TERMS

For the purpose of inducing the extension of credit from Star Equipment Ltd, and/or any of their affiliates, subsidiaries, divisions, related or parent company’s CUSTOMER represents and warrants that the statements made and information contained herein or made a part of this agreement hereof, including any attachments submitted herewith and any future financial information submitted are complete, correct, and true, with the intent that strict reliance be placed thereon as the basis for the extension and continuation of credit. This Credit Application shall inure to the benefit of the COMPANY, and shall be binding on the es tate and/or successors-in-interest of the undersigned.

THE CUSTOMER ACKNOWLEDGES THAT IT HAS SPECIAL SKILL AND KNOWLEDGE IN THE SELECTION AND USE OF THE EQUIPMENT AND MATERIAL TO BE PURCHASED OR RENTED FROM COMPANY AND EXPRESSLY DISCLAIMS ANY RELIANCE UPON ANY STATEMENTS OR REPRESENTATIONS MADE OR TO BE MADE BY COMPANY REGARDING THE SALE OR RENTAL OF ANY MATERIAL OR EQUIPMENT. THE CUSTOMER ALSO WAIVES ANY LIABILITY UPON COMPANY FOR ANY DIRECT, SPECIAL, OR NONCONSEQUENTIAL DAMAGES THAT CUSTOMER MAY SUFFER. IN THE EVENT OF THEFT OR DAMAGE TO ANY EQUIPMENT THE CUSTOMER RENTS FROM COMPANY, THE CUSTOMER SHALL BE RESPONSIBLE TO PAY FOR THE REPAIR AND/OR REPLACEMENT OF SAID PROPERTY OR PARTS TO SAID PROPERTY AT THE REGULAR SHOP RATES AND PARTS CHARGES OF COMPANY, AS WELL AS ONGOING RENT UNTIL SUCH TIME AS COMPANY DEEMS DAMAGED EQUIPMENT READY TO RENT. IN THE EVENT THE CUSTOMER RENTS ANY EQUIPMENT THE CUSTOMER SHALL OBTAIN INSURANCE COVERING ALL RISK OF LOSS, THEFT OR DAMAGE FOR THE RENTED EQUIPMENT AND IN THE EVENT OF ANY SUCH LOSS, THE PROCEEDS OF SAID INSURANCE SHALL BE PAID TO AND ARE ASSIGNED TO COMPANY. COMPANY SHALL ALSO BE TREATED AS ADDITIONAL INSURED.

The CUSTOMER represents and warrants that the CUSTOMER is solvent and able to pay its debts as they become due, and that the information as set forth above and on the reverse side and/or any attachments submitted herewith and subsequently disclose the true state of the CUSTOMER’s fina ncial condition as of the date thereof. The CUSTOMER agrees to immediately notify COMPANY by certified mail of any material adverse change to the CUSTOMER’s financia l condition, any change in the form of ownership or identity of principals, in the event the CUSTOMER becomes; insolvent, is unable to pay debts as they bec ome due, becomes party to any litigation, and in advance of any sale, encumbrance or transfer of any real property owned. Until such notice is received in hand by COMP ANY, said information set forth above, on the reverse side and/or on any attachments submitted herewith is to be regarded as continuing true and accurate statement. In addition the CUSTOMER agrees to submit additional financial information to COMPANY upon request. The use of a purchase order is for the convenience of the CUSTOMER and absence of a purchase order shall not be a defense to responsibility for a charge unless the CUSTOMER does not receive the equipment, parts or service. This Agreement supersedes any preprinted terms in any purchase order

If credit is extended, Applicant acknowledges that Star Equipment requires payment upon receipt of invoice. Invoices are considered past due at 31 days. Equipment invoices are due upon delivery or as set out on the purchase agreement. In the event of failure to timely pay any invoice, A pplicant agrees to pay a service charge to Star Equipment on such delinquent invoice(s), at the maximum rate allowed by the laws and jurisdiction of the originating location stated on the invoice and collection costs and/or attorney fees in an amount that is not less than 25% of the outstanding balance owed. At the discretion of Star Equip ment, any account with a delinquent balance may the placed on a cash basis at any time, and the equipment picked up without notice. Star Equipment reserves the right to pursue remedies available to it under the party’s contracts at law or in equity. Applicant agrees to be bound by the terms and conditions as set forth in Star Equipment’s standard Rental and Sales agreements or similar document in use at the time of each rental or sales transaction in the jurisdiction where the purchase or rental occu rs, which terms and conditions are incorporated herein by reference and which constitute a part of the credit agreement, regardless of whether or not the agreement is execut ed by an authorized representative of Applicant. Star Equipment reserves the right to file preliminary notices for work done in states where these notices are required by state law in order to protect our lien rights.

Accepted Invoices: As to invoices accepted, or to which timely objection is not made prior to the due date as required, it s hall be presumed: that the invoice is accurate, that the goods or services referenced on the invoice were ordered by the applicant; that the goods or services were received by the applicant; that the prices charged are agreed and reasonable prices; that the invoice total is payable to Star Equipment; that the applicant agrees to pay the invoi ces within 30 days of the invoice date.

The CUSTOMER hereby grants to the company a security interest in all purchases made until such times as account has been paid in full. The CUSTOMER appoints any representative of COMPANY as CUSTOMER’S attorney-in-fact to sign and record UCC financing statement(s) to evidence CUSTOMER’S transactions. The CUSTOMER authorizes any of its employees to sign a rental or purchase agreement for such equipment and material and agrees to be bound by all the terms of said agreement. In the event the CUSTOMER directs COMPANY to deliver any equipment or material and the CUSTOMER does not have a represe ntative present at the time of delivery, the CUSTOMER authorizes COMPANY to leave the equipment or material at the designated place of delivery. Upon said d elivery, the CUSTOMER will be responsible for the equipment or material and shall be bound by the terms of COMPANY’s customary written rental or purchase agr eement.

All material equipment or parts are FOB COMPANY facilities or manufacturers facilities depending upon stocking of said materi al equipment and/or parts. In the event that material, equipment or parts are shipped or delivered to CUSTOMER when CUSTOMER is not present, CUSTOMER authorizes COMP ANY to deliver & leave material equipment or parts. Upon said delivery, the CUSTOMER will be responsible for material, equipment or parts.

The parties agree that this is the entire agreement and that no oral representation or agreement has been made which would modify this Credit Agreement or be a condition precedent or subsequent to the enforcement of this Agreement and that his Agreement may not be modified except by a writ ing signed by each of the parties. In the event that any provision herein shall be deemed void or unenforceable, that provision shall be deemed stricken from this agre ement and the remaining provisions herein shall be binding upon the parties.

You agree this Agreement shall be performed in Polk County, Iowa and this Agreement will be governed by the laws of the State of Iowa. YOU AGREE THAT ANY DISPUTE ARISING UNDER OR RELATED TO THIS AGREEMENT SHALL BE ADJUDICATED IN THE FEDERAL OR STATE COURT LOCATED IN POLK COUNTY, IOWA. PERSONAL JURISDICTION AND VENUE UNDER THIS AGREEMNT SHALL BE IN THE STATE OR FEDERAL COURT LOCATED IN DES MOINES, POLK COUNTY, IOWA. You agree that You will not sue Us for any claim more than one year after the event on which You base Your claim. You specifically agree to waive any right to transfer venue and that this agreement is knowing and voluntary and is an essential term to Our willingness to enter into this Agreement.

YOU AND WE EXPRESSLY WAIVE ANY RIGHTS TO TRAIL BY JURY ON ANY AND ALL CLAIMS RISING OUT OF OR RELATED TO THIS AGREEMENT. You agree that this jury waiver is knowing and voluntary and is an essential term to Our willingness to enter into this Agreement. IF THIS INSTRUMENT IS FAXED BACK TO COMPANY THE, CUSTOMER AND GUARANTOR MUST SIGN AND FAX THIS PAGE AS WELL.

RENTAL PAYMENT TERMS

All rentals are due in advance, unless prior arrangements are made. This applies to daily, weekly and long term rentals, and your rental invoice will be marked this way. Please pay special attention to this and make payment on receipt of invoice.

SORRY

NO DEBIT CARDS ON RENTALS

Star Equipment’s policy is that we do not accept payment on rentals with a bank debit card, check or cash. If you do not have an established open account with Star Equipment we will accept payment by CREDIT CARD ONLY. NO CASH. If the equipment you rent is returned damaged, then Star will have the ability to charge the damages on your credit card.

SALES TAX ON RENTAL EQUIPMENT

State sales tax is applicable on equipment rental used for maintenance or repair. Sales tax on new construction and reconstruction equipment rental may be exempt. Let the rental counter person know in advance and place a check mark in the appropriate sales tax exemption certificate box on the rental document.

RENTAL PERIOD

Rental Charges are Based on Time Out. Time charged will be from the time the equipment leaves to the time the equipment is returned. This includes: Saturdays, Sundays and Holidays.

OVERTIME CHARGES

Overtime charges will be assessed if equipment is used over: 8 hours/day, 40 hours per week or 176 hours in a 4 week period. If you are using equipment double or triple shifts per day, please let us know and we can start billing overtime from the first billing. A large overtime bill may occur on the final month billing if not billed from the start of the rental.

EQUIPMENT PICK-UP

It is your responsibility to notify Star Equipment when equipment is ready to be picked up. An after hours message on our call messaging system is not deemed proper notification. You must talk to the rental department for proper pickup notification.

EQUIPMENT RETURN

Equipment must be returned during normal business hours. Star Equipment opens at 7:00 a.m. and closes at 5:00 p.m. Monday thru Friday and 8:00 am to noon on Saturdays between May 15th and November 15th. Call our rental department for equipment return outside of normal business hours. An after hours service charge may apply.

EQUIPMENT CLEANING

Equipment will be delivered to you clean. If the equipment is returned excessively dirty, cleaning charges may apply. Star will charge cleaning at an hourly rate of $85.00. SAVE MONEY AND RETURN EQUIPMENT CLEAN.

EQUIPMENT DAMAGE

Star Equipment wants to provide each customer with safe, dependable and ready to use equipment to do their job. Customers returning equipment damaged, outside of normal wear will be billed for repairs. Dented sheet metal, bent booms, broken glass, cut tires are a few examples of billable repairs. SAVE MONEY AND TREAT THE EQUIPMENT AS IF YOU OWN IT. Rent continues until repairs have been made.

FUELING CHARGE

The equipment you rented was sent out with a full gas/diesel tank. Star will fuel the equipment when returned and bill fuel at $6.00 per gallon. SAVE MONEY AND RETURN EQUIPMENT FULLY FUELED.

RENTAL CONVERSION TO PURCHASE OPTION

Rental Equipment may be purchased and 70% of the rent paid may be applied to the purchase of most rental equipment.

• Sales tax will be figured on the stated value.

• All unpaid rent will be added to the conversion price and must be paid in full prior to acceptance of such.

• All maintenance done on the equipment during the rental period will be added to the conversion.

• Option to purchase does not exist on all equipment, and/or may terminate after six months.

• All warranties, if any, will be prorated starting at the time it went on rent.

• Long term lease programs are available, such as five year programs.
