Ngilu’s fate now in Tobiko’s hands The fate of suspended Lands Cabinet Secretary now lies in the hands of the Director of Public Prosecutions, Keriako Tobiko, who is expected to decide whether she will be charged in connection with the Karen land saga or not. The Ethics and Anti-Corruption Commission (EACC) has already recommended that she be prosecuted for various criminal offences relating to the 134 acre land parcel valued at Sh8 billion. Files containing the

recommendations on Ngilu and eight other officials of the Lands ministry have already been forwarded to the DPP who says he will make a decision “shortly”. “The files shall be independently reviewed and a decision made shortly,” Tobiko said in a statement to newsrooms early today, while confirming receipt. The land is currently at the center of a court case pitting businessman Horatius Da Gama Rose against former NSSF Managing Trustee Jos

Konzolo; both of whom claim its ownership. Only last month the EACC recommended the closure of an inquiry into allegations that Ngilu conspired with Likoni land owner Evanson Waitiki to inflate the cost of settling squatters on his land by Sh110 million. But the DPP is under pressure to confirm the charges against Ngilu with MPs blaming him for recommending the closure of cases against other Cabinet Secretaries.

“Our decision will be based on the threshold of evidence in the files and the law,” Tobiko added in his statement today. The DPP can either let Ngilu off the hook by declaring the evidence presented by the EACC as insufficient to sustain a trial or return the file with a directive to the EACC to conduct further investigations if he feels the evidence presented by the anti-graft body is inadequate. Should charges be confirmed

against her, Ngilu will become the second Cabinet Secretary to be taken to court to answer to corruption related cases, after Michael Kamau who is facing abuse of office charges. Ngilu has been under investigation for three allegations including her alleged involvement in the Waitiki farm saga and yet another parcel of land on State House Crescent. She has since been cleared of the former while the latter remains with EACC

Reconstitute EACC, Senators tell Uhuru Senators have called on President Uhuru Kenyatta to quickly constitute a panel to start the process of replacing Ethic and AntiCorruption Commissioners. Senators Mutula Kilonzo Jnr of Makueni and Nandi’s Stephen Sang, say the process of reconstituting the corruption watchdog needs to be hastened to ensure the fight against corruption is sustained. “I am requesting the President to constitute the panel that will vet the EACC as a matter of urgency,” Kilonzo said. The law requires that a panel to vet new commissioners is constituted within 14 days after the resignation of former members. However, it has been over one month since two of the remaining commissioners, Chairman Mumo Matemu and Vice Chairperson Irene Keino stepped aside and eventually quit. “The backdrop of not naming this selection panel is creating a gap in the fight against corruption,” he added.

President Uhuru Kenyatta, through his Chief of Staff Joseph Kinyua, had last week called on institutions required under law to comprise the selection panel to forward names of their nominees to the President in a deadline that expired four days ago. The Senators also raised concern over the constitution of the commission, warning that the delay in composing the panel was putting the current investigations being carried out by the commission in jeopardy as it would be subject to contention in court. “If they decide to go by the AGs advisory, the matter will be determined in court,” Sang’ said. “The fight against corruption looks like it is going to a dead end because those persons being taken to court will have an opportunity to challenge the decision as the law states that files should be forwarded by the commissioners and not the CEO as we have seen. The CEO does not have the mandate to run the commission,” Kilonzo added.

But EACC secretariat, led by CEO Halakhe Waqo, has continued with investigations into corruption cases after the exit of the commissioners. Attorney General Githu Muigai, in an advisory, said the commission could continue with its work even in the absence of commissioners.

But Kilonzo warned that it would be a tragedy if the cases were challenged and won and that it would dent the image of not only the investigating and prosecuting organs but also that of the Executive.

Highway accident claims seven lives Seven people were killed in a grisly road accident early today at Salama, along the Nairobi-Mombasa Highway. The accident involved a mini-bus, belonging to the Sema sacco, and a trailer. The matatu is said to have rammed into the trailer at about 6.30 am causing the accident. Six men and a woman are said to have died on the spot while several other passengers sustained serious injuries. “Six men and one lady died on the spot while several others were injured,” Traffic Commandant Charlton Mureithi (pictured right) said. Those who sustained injuries were admitted to hospitals in Machakos and Emali. The driver of the matatu has since disappeared and police say they are hunting for him.

“Again, human error and an I don’t care attitude of a reckless driver has cost the lives of innocent people,” Muriithi lamented. The traffic boss called on motorists to be careful while driving to avoid such incidents. He says traffic officers cannot be everywhere and urged for self-discipline and change of attitude. Sultan Hamud Traffic base commander Moses Jue on his part said the accident occurred at a notorious black spot and has warned motorists to exercise caution. “The vehicles are still there but efforts are being made to clear the road,” he stated. Three people also died at the spot last Friday in another accident.

Stress-free people have longer lives, new research has revealed. The age old assumption that stress is likely to kill a person is actually true. Scientists say that a positive attitude in the face of a crisis could significantly reduce soreness in the body. Based on a new study that measures how every day challenges can weaken the immune system, it isn’t the amount of stress a person faces each day that made the biggest impact. Instead, it is but how a person deals with stress that determines how long they will live. The data found that women are particularly at risk. The study sampled hundreds of adults who were exposed to stressful situations over the course of eight consecutive days. Blood samples of participants were taken during a separate clinic visit and tested for strange markers. The volunteers were then interviewed by phone every day for eight consecutive days. They were asked to rate their positive and negative emotions. Swelling, which was evident in the blood samples, occurred more often in people who were unable to brush off stressful events. This kind of frustration has been linked to illnesses like cancer and heart disease and appears to play a role in obesity among some patients. Experts from the US-based Pennsylvania State University advise those experiencing high levels of stress to take a breath and shake it off. Stressful events that can be ignored should be pushed aside, they argue. It could mean the difference between life and death.

The Council of Governors on Wednesday wrote to the Ethics and Anti-Corruption Commission secretariat asking it to investigate the Sh38 billion Managed Medical Equipment Services (MES) Project. In the letter, CoG Chairman Peter Munya said that while they succumbed to pressure to accept the leased medical equipment, they wanted assurance that its procurement was above board.

National Assembly Majority Leader Aden Duale has begun lobbying MPs to overturn a decision by the committee on Administration and National Security to reject Monica Juma as nominee to become Secretary to the Cabinet. Commenting after the committee chairman Asman Kamama submitted their report, Duale said the House will seek to overturn the recommendation. “This is very exciting and hot for some of us, but no problem we will find a way of handling it… that is why we are in leadership,” he said as he began lobbying MPs from both sides of the House. Mr Kamama explained that their rejection of Dr Juma was based on the fact that she displayed arrogance and insensitivity to the needs and concerns of the public and their elected leaders. “The nominee lacked demonstrable passion to serve the public and their elected leaders,” the committee said. The committee particularly took issue with a letter Juma wrote to the two Clerks of Parliament which they said was in bad faith and

aimed at denying MPs access to a public office. In the letter, Juma had complained about frequents visits by MPs to her office seeking favours. She is currently the PS in the Interior ministry. “The letter written by the nominee contravened the spirit of Article 1 of the Constitution of Kenya which provides that the sovereign power belongs to the people of the Kenya and shall be exercised through their democratically elected representatives. By denying elected representatives access to a public office, the nominee is denying Kenyans a chance to exercise their sovereign authority,” the committee said its report. During her vetting on Tuesday, Juma said the letter was only meant to ask MPs to do thing procedurally. The government has in the past successfully lobbied MPs to overturn such recommendations with Tourism Cabinet Secretary Phyllis Kandie being the first beneficiary after the committee on appointments rejected her nomination to the Cabinet in 2013.

Eating half a handful of nuts every day could substantially lower the risk of early death, a Dutch study suggests. Previous studies had already indicated a link with cardiovascular health, but this is the first to look at specific nuts and diseases. Maastricht University researchers found a 23 percent lower chance of death during the 10-year study in people eating at least 10g (0.3oz) of nuts a day. There was no benefit for peanut butter, which is high in salt and trans fats.

Man wounded in hostel attack A man was shot and wounded in a robbery in hostels near Catholic University in Nairobi. Police say they are looking for two suspects believed to be behind the attack in which money, seven laptops and other valuables were stolen. Witnesses said a gang walked into the hostels hosting students from the university and other tenants posing as visitors before they ordered those inside to lie down. It was during the robbery that a commotion broke out that left a tenant seriously wounded asn the gang escaped.

More than 3800 people are in quarantine as South Korea battles to contain the respiratory disease. A second South Korean clinic has been forced to close today, with staff, patients and visitors sent into quarantine, as the country attempts to curb the spread of the virus for a third week. Barclays announces plans to acquire stake in insurance company Barclays Africa Group has announced plans to acquire a controlling stake in Kenya’s First Assurance Ltd. The leading lender said on Wednesday that it had reached a deal totaling 2.8 billion shillings. This is the latest development involving local banks partnering with established insurance companies. In recent weeks, some lenders have announced plans to offer bancassurance, a service that allows lenders to link their clients to insurance providers. Lanz Zulu, Managing Executive for Barclays Africa’s Wealth Management and Insurance business lauded the move. He described the planned acquisition of First Assurance as a good strategic fit for the lender’s business. Zulu was speaking at a press conference in Nairobi.

Kenya’s plastic sector gains support from India

Pan Africa trains 600 financial advisors Pan Africa Asset Management (PAAM), an investment manager in Kenya, has embarked on a massive training programme that will help its clients access information about the stock market. As part of an ongoing effort to increase its footprint across the country, Pan Africa has announced that it will train 600 financial

advisors for its 16 branches. So far, 400 financial advisors have been trained in Nairobi, Kisumu, Kisii, Meru, Embu, Nakuru, and Eldoret, with another 200 expected to undergo training in the next one month. “We are developing a network of professionals who are able to respond to clients, giving

information on the securities market and ongoing support needed as they invest in our unit trust products,” says Justus Kariuki, Business Development Manager at Pan Africa Asset Management. “One of the reasons unit trust uptake remains slow is the low number of experts who are able to adequately assist public with

enquiries,” he adds. PAAM will also have quarterly unit trust refresher training to ensure the team is up to date with changes in the market. Kenyans have traditionally relied on real estate and business as a key investment. However over the last few years’ new investment habits have started to take root including the purchase of unit trusts.

Unit trusts are pooled resources of investors who have entrusted their money to a financial management fund, such as Pan Africa Asset Management. The money is put in various capital market investments on behalf of investors. All these investments are combined into a portfolio and then divided into equal units.

Local insurance firms suffer stiff competition from multinationals Kenya’s insurance industry is facing tough competition from multinational organisations looking to cash in on the growing sector. The insurance sector is therefore lobbying the government to come up with laws that will cushion it from losing business to multinationals. Construction of the Standard Gauge Railway for example covering 485km is estimated to cost Sh327 billion. Kenya will cover only 10 per cent of this cost with the Chinese Export-Import Bank financing the remaining 90 per cent of the project. The project is estimated to open opportunities for insurance covers in different capacities. UAP Holdings Group Managing Director, Dominic Kiarie says the country is losing on opportunities to insure big

infrastructure projects to multinationals. “It’s important for Kenyan firms to be protected, this will see intermediaries get a chance to underwrite those premiums, everything should be outsourced locally before its given to multinationals,” said Bima Intermediaries Chairman Washington Ndegea. He said Kenyan firms should be given first priority as they have the capacity to underwrite those projects locally. Kiarie said industry stakeholders are in talks with the regulator, hoping to see the proposal enforced. The Association of Kenya Insurers has also been in talks with the Kenya Revenue Authority to introduce a clause that would penalize importers who buy insurance from foreign firms.

Africa to set up largest free trade zone in the continent

Africa may soon be home to the continent’s, and possibly the world’s, largest free trade zone following an agreement between the Common Market for Eastern and Southern Africa (Comesa), East African Community (EAC) and Southern African Development Community (SADC). The three organisations have sent representatives to meet at Africa’s Third Tripartite Summit in Sharm El Sheikh in Egypt. Deputy President, William Ruto will represent President Uhuru Kenyatta at the Summit, whose aim is to ease the movement of goods, people and services across African countries. The meeting will witness the signing of Tripartite Free Trade Area agreement, which will bring together member countries to

promote economic and social development in the region. The deal hopes to create the infrastructure necessary for a single market with free movement of goods and services and will likely become the continent’s largest free trade zone. The agreement will require member states, including COMESA and East African Community nations to speed up the process by removing bottlenecks to trade. The countries will be asked to cooperate on customs matters and implement trade facilitation measures. Ethiopian Prime Minister, Haillemariam Desalegn, will take over as chairperson of the Tripartite Summit, a seat currently held by President Robert Mugabe of Zimbabwe.

As much as the story has become a social media sensation leading to funny memes, it is not a laughing matter. “If it had been a case of a man beating his wife, there would have been protests around the country,” says Nicholas Kamau, a businessman from Nyeri “but since it is men getting battered, no one cares.” And the trend seems to have caught on, barely a week after the incident was reported, another case from the same county made it to the headlines, this time a woman chopped off her man’s genitals because he accused her of stealing sh5, 000 from his coat as

he took a shower. The Nyeri OCPD, Charles Rotich, has warned the men of Nyeri to be careful and alert when dealing with their wives especially when they are angry. But these incidences of husband battery from Nyeri County are not new, women from the area have gained a bad reputation for beating their husbands to the extent of hacking their faces with a panga. In 2012, Simon Kiguta, who unfortunately has come to be known as the face of husband battery, was admitted in a hospital with deep panga cuts on his face. He accused his wife of mercilessly cutting his head with an intention

of killing him. “I was deep asleep when she attacked and was therefore defenseless.” Nderitu Njoka, the Maendeleo ya Wanaume chairman later launched a plea to Central Kenya women. “Men should be respected as family heads, in Central Kenya, and not reduced to the role of fathering children before they are dumped or battered mercilessly,” he said. Suffice to say, his words fell on deaf ears. Relationship expert, Chris Hart, attributes such cases to anger and frustration towards their spouse that has been building up for several years. “She may have reached her breaking point

and thought chopping off his manhood would be the best way to get back at him.” He adds that the hardest thing would be trying to repair the relationship. “It would take a lot for the man to forgive her,” he says, “the scare and scar will still be there and the memory will still be fresh.” As the men recuperate in hospital without their genitals, a silent warning has gone around in social media, do not date a Nyeri woman and if you must, do not piss her off.

It has now become the norm to introduce your new love interest on social media, and by so doing a silent agreement is passed: You are now an official item, and exclusive to each other. You have marked your territory and no one should come messing around. The first post about you and your significant other cements that. Now the whole world knows you have a new boyfriend or girlfriend. The dilemma comes in when things with the new love interest do not work out. Then you will have to pull down all the photos and mushy posts! But how many times will you keep on introducing a new love

interest to the world? Imagine if a new love interest comes in, then they have to deal with stumbling upon photos of you and an ex writing things like, “The love of my life” “my sweet tomato” etc? Awkward! Then there is always a couple that displays too much PDA on social media that sometimes it becomes too sickening to see it play out. One day they are happy showing off each other, another day they are busy posting quotes that seem to be targeting the other party because they had a disagreement. This can be uncomfortable for people on your friend’s list who may not necessarily want to know what is going on with your private life. In some relationships, one partner may want to shout and announce to the world while the

other one would not want the relationship displayed for all to see. Thus disagreements break out and people become impatient with each other because, the open partner may not understand why the more private partner is unwilling to post pictures of their relationship. Couples need to realise they have to keep certain things exclusive to only themselves and not announce them on social media. A relationship can be official without being posted and announced on social media. Announcing the relationship on social media does not allow for that platform where couples can easily talk and get to know each other. Things on line can move from zero to 100 in a jiffy. Be careful not to be online official and inwardly miserable.

World cup 2026 bids delayed The bidding process for the 2026 World Cup has been postponed amid allegations around the 2018 and 2022 tournaments. Fifa secretary general Jerome Valcke said it was “a nonsense” to begin the process in the current climate. The vote to decide who will host the 2026 World Cup is due to take place in Kuala Lumpur in May 2017. The United States are front-runners to stage the tournament, but Canada, Mexico and Colombia are also thought to be interested. Russia and Qatar were selected to host the 2018 and 2022 World Cups by a secret ballot of Fifa’s 22 executive members in December 2010. But Swiss prosecutors are now investigating alleged financial irregularities surrounding the bidding process. Both Russia and Qatar have denied any wrongdoing.

Blackpool boss banned from football

Blackpool chairman Karl Oyston has been banned from all football activity for six weeks and fined £40,000 for sending abusive texts to a fan. The punishment from the Football Association has been suspended for four weeks and will not start until 8 July. The 47-year-old was charged with misconduct by the FA in March after allegedly referring to Stephen Smith as a “retard” when the fan criticised him. Oyston admitted five charges of breaking FA Rule E3 last Thursday. The ban, which was handed out by an independent regulatory commission, will last until 18 August - 10 days after the start of the League One season. Oyston was also ordered to attend a mandatory education session and warned about his future conduct. He had previously admitted sending the “unacceptable” texts in response to “a barrage of abuse” he received after his phone number was put on social media. The annual sporting rich-list showed Mayweather - who also topped last year’s list earnt $300m (Sh29billion). Most of that came from his ‘super-fight’ with Manny Pacquiao, whose $160m (Sh16billion) takings made him the second-highest earner. Real Madrid forward Cristiano Ronaldo was third with $79.6m (Sh7.7billion). His Barcelona rival Lionel Messi is fourth on the list, while golfer Tiger Woods remains in the top 10 thanks to his $50m (Sh4.9billion) worth of endorsements after poor form and injury saw him earn just $600,000 (Sh58 million) in winnings.
