Ngilu to EACC: Let’s meet in court From Page 1 Suspended Lands Cabinet Secretary Charity Ngilu has dared the Ethics and Anti-Corruption Commission (EACC) to prosecute her over the Karen land saga, saying she is ready to face her accusers in court. Ngilu, who has previously accused the anti-corruption body of malice in their investigations of her role in land transactions involving the Sh8 billion parcel in Karen, maintained her innocence, and vowed to get vindication in court. “We will meet in court on Friday. I am sure I will be vindicated,” she said on Wednesday as she left the Integrity Center. Ngilu, accompanied by her lawyers, led by senior counsel Paul Muite, had gone to the EACC offices to

find out when she was required in court. The move came just moments after the DPP Keriako Tobiko ordered for her prosecution for blocking justice by ordering her offices not to assist investigations into the disputed 134-acre piece of land. The minister had been named in a corruption dossier that President Uhuru Kenyatta submitted to parliament in March, ordering that the individuals behind the scandal be investigated and charged. Ngilu, at the time, faced three counts of fraudulent land transactions involving the Waitiki land, the Karen land and another piece of land near State House Crescent Road. She has already been cleared of any

wrongdoing in the Waitiki case, while the third one is still being investigated. But she appeared relieved as she walked out of the revolving doors at Integrity Center. The charges against her have somehow lessened. “It is not a corruption charge…I decided to bring myself and make a statement and also yesterday said there is sufficient evidence to show that Ngilu had stood in the way of investigation into land saga,” she said. In a statement, Tobiko said he is relying on a recommendation by the EACC, which accuses Ngilu of ordering officials in her ministry to withhold documents during investigations. The commission had said that Ngilu told the officials not to

record statements with EACC investigators. “She is alleged to have obstructed/ hindered the collection of evidence regarding fraudulent transactions by directing ministry officer not to release documents to and record statements with EACC investigators,” the statement from the DPP read. That statement was backed by Kajiado South MP Moses ole Sakuda, who also accused Ngilu of obstructing their inquiries as a parliamentary committee. “In my own view there was a well calculated move by the CS to obstruct any investigations into this land. I say that because when the officers appeared before us they were reluctant to release any

information that we required,” Sakuda who is the vice chairman of the national Assembly’s Lands committee said. The Karen land is currently at the centre of a court battle between businessman Horatius Da Gama Rose and former NSSF Managing Trustee Jos Konzolo, both of whom are claiming its ownership. Should Ngilu be charged in court tomorrow, she will become the second Cabinet Secretary to be dragged to court over the graft cases, after Transport CS Michael Kamau. COURT STOPS Sh4.6 BILLION PAYMENT TO PRIVATE COMPANY The High Court has restrained two Government agencies and a Cabinet Secretary from depositing Sh4.6 billion into a private company’s account after a petitioner objected to a land acquisition deal citing double payment and a scheme to fleece the taxpayer. Mr Edmond Mukoya, through his lawyer Michael Osundwa, told the court that the money may be sank into individuals’ pockets if, the National Lands Commission, the Kenya Urban Roads Authority, the CS Minsitry of Lands and the Attorney General, who are key respondent in the case, are not restrained from making further payment to Afrison Export Import Limited, who sold LR No 209/7879/4 to the Government for the expansion of the General Service Unit camp in Nairobi. The petitioner says the transaction has been marred with irregularities and

flouting of laws governing compulsory acquisition of land as another government agency, the Kenya Urban Roads Authority (KURA) has made a stake over the same property, approved and effected part payments for Outering Road Improvement project. “The urgency of the matter has been necessitated by the agencies move to compulsorily acquire part of LR No 209/7879/4 and approve payments to the company for land already sold to the government and in the Office of the President’s docket, thus amounting to double payment,” Mr Osundwa told the court. He explained that the National Land Commission had previously acquired the 300 acre plot for the expansion of the para-military base “but with the assistance of sumptuous public officers, a fresh conspiracy had been hatched to sell

1.7 acres of it to KURA for the proposed Outering Road Improvement project.” “The parcel had already been bought by the office of the President under compulsory acquisition and an excess of Sh708.6 million already paid to the owners, they are at an advanced stage of approving further payments despite the fact that colossal sums of money had already been paid by the office of the president during the initial acquisition, amounting to double payment contrary to public policy,” the lawyer submitted. The petitioner claims he has moved to court to on behalf of members of the public and tax payer who stands to suffer if the money is paid to the company. He also wants the court to compel the state agencies involved to disclose the details involving the payments to Almasi limited and the valuation.

Members of the newly-inaugurated National Assembly of Nigeria are set to receive 8.64 billion naira (Sh4.25 billion) to spend on clothes. The money, described as a wardrobe allowance, will be split between both chambers of the National Assembly. The Nigerian government has revealed that 109 members of the Senate will receive 21.5 million naira (Sh10.6 million) each while the 360 members of the House of Representatives, the lower chamber, will each receive 17.5 million naira (Sh8.6 million). Aside from a wardrobe allowance, the National Assembly will also receive furniture and car loan allowances. Nigerians have expressed their displeasure regarding the move, taking the fight to social media. Earlier this week, Twitter was awash with sarcastic comments and angry 140-character rants about the legislators’ salaries. Some Nigerians have described the pay upgrade as a “robbery of the highest level.” Others have dubbed the move selfish and irresponsible, noting that teachers in the country earn a basic salary of 18,000 naira (Sh8,900) a month “yet they don’t go to school naked.”

Meru County launches ‘first of its kind’ investment plan Meru County today unveiled and investment vehicle that aims to put the region on par with Nairobi’s level of industrial development. Dubbed the Meru County Investment and Development Corp oration (MCIDC), the initiative seeks to coordinate development projects in the region and market opportunities available to investors in the county. It is the first such entity to be launched by a county. The new body was unveiled on behalf of Adan Mohammed, the Cabinet Secretary for Industrialization and Enterprise Development at the Intercontinental Hotel in Nairobi during an unveiling ceremony attended by some of the country’s top business leaders and policy makers. The CS said it will promote investments in all sectors in the county in partnership with the private sector. “The launch of MCIDC will provide a structured avenue for the county to link investment and development thus improving the lives of Meru residents,” he explained in a recently released statement. “My ministry is committed to working closely with the county government to promote investment and development,” he added. Meru Governor, Mr Peter Munyua said the County government was particularly keen on sectors like agriculture, energy, infrastructure and tourism, which have great potential to bring about economic growth for the county.

Briton in student murder charge renews bail plea A Briton who allegedly flew to Kenya to live with his internet lover and has been charged with her murder has renewed a request to be released on bail pending his trial. Carl Singleton through his lawyer Anthony Okulo now wants the court to review a ruling made against him on May 11 denying him bail on grounds that he may be tempted to leave the country before the case is determined. Justice Roslyn Kori had held that, faced with the possibility of a death sentence and having no fixed residence in the country, the foreigner may flee and prejudice justice. Yesterday the judge allowed a formal application to be presented before the court for consideration on June 23. The lawyer was directed to serve the director of public prosecutions with the renewed request for a reply before the hearing date. Singleton has denied killing Ashley Agum-

bi, a university of Nairobi student six months ago. The police initially did not have enough evidence to prefer the murder charges against the suspect but after investigations the charge was read out to him before a criminal court in Nairobi. Singleton has been profiled as an abuser who allegedly flushed her lovers’ diabetic drugs down a toilet drain before she reportedly developed medical complications and died. A few days before her death she had reported an assault at the Gachie police post. Mr Singleton, 42, a van driver, flew to Kenya to live with the 22 year-old after they met on Facebook. The charge against the suspect states that he murdered Ms Agumbi on 19 November 2014. The body of the deceased was found in the house they shared in Nairobi.

The United Nations High Commission for Refugees (UNHCR) now says it lacks the capacity to provide humanitarian assistance to millions of people displaced by war, conflict or persecution. This comes as the number of refugees reached a record high of nearly 60 million around the world in 2014. A UN report by the UN refugee agency says the number of people forced to flee their homes rose by 8.3 million from the previous year with the continuing conflict in Syria being seen as a major factor behind the record numbers. The “world is a mess” UNHCR head Antonio Guterres said. “The drama is that if people think that humanitarians can clean up the mess. It’s no longer possible. We have no capacities to pick up the pieces. More and more people are suffering, and unfortunately for many of them there is no chance to support them.” Guterres said that the number of displaced people had increased to 42,500 per day in 2014 from 32,000 the year before.

Kayole killings alarm police Police are investigating recent killings in Kayole after a man was last night shot dead as he walked into his house in the area. His killing occurred barely 12 hours after a house help was also killed in the same area yesterday morning. Police are now investigating the motive of the killers. The latest victim was shot at close range by gunmen who had been waiting at his gate. Police say the gang did not steal anything from the man and that they escaped soon after the shooting. The gang that killed the house help also escaped without stealing anything after shooting her.

Cross border clashes claim 14 lives in Mandera Nine people have been killed in Banisa, Mandera County in revenge attacks that followed the killing of five others on Tuesday. County Commissioner Alex Nkoyo people from a clan in Ethiopia attacked the Kenyan village early yesterday morning in a revenge mission. The industry Kenya’s plastic industry has the potential to create thousands of jobs but faces a huge challenge in terms of waste management and disposal. Laban Onditi, the Kenya National Chamber of Commerce and Industry National Vice Chairman, has therefore called on Small and Medium Enterprises (SMEs) to embrace engineering technology so as to enhance waste management in the country. He said talks are underway with the Government of India to offer training to about 40 Kenyans drawn from various sectors on best waste management practices.

Kenyas plastic sector gains support from India The initiative is part of a partnership between India, Kenya and the Central Institute of Plastics Engineering and Technology (CIPET), an autonomous Institution that offers training, education and research on plastics. While addressing exhibitors at the ongoing International Plastics and Packaging conference at the Kenyatta International Convention Centre (KICC), Onditi said the plastic industry plays an integral role in creating employment opportunities. The institute plans to set up a centre in Kenya to support the sector in East Africa. This comes at a time when the industry is expected

to register a growth rate of between 15 and 20 per cent in the coming years. It has emerged that the only way to meet such demand would be by creating new manufacturing facilities and capacities instead of depending on imports of finished products. The three day convention is targeting the country’s untapped plastic market and economic growth opportunities following the ongoing huge infrastructure investments. The engineering institute hopes also to tap into the sector which could be the backbone of small and medium enterprises as well create jobs for the youth.

Tea factories go cashless after KTDA, M-PESA deal The Kenya Tea Development Agency (KTDA) has partnered with Safaricom to roll out a cashless payment solution at all its 66 factories across the country. The factory door sales channel will now receive payments via M-PESA to address longstanding concerns regarding security of cash at the factory as its transactions are approximately Sh 1billion a year. “The adoption of M-PESA as the sole payment option at our factories lowers the overall inherent cash handling risks and will increase accountability. This move will translate into better revenue management, which will in turn lead to increased returns for our factories,” KTDA CEO Lerionka Tiampati said. Once a till number will be assigned to each payment point, all payments will be made using a cashless system where tea buyers will purchase the products using M-PESA as this will boost the economy of the country.

“The adoption of this system not only represents a technological convergence that provides much required solutions, but also underpins KTDA’s quest to be innovative in order to add value to our shareholders and help boost the county and national economies,” he added. As the country moves towards digital platform, KTDA recently adopted various innovative technologies such as Fiber Internet and Electronic Weighing solutions that have geared the performance of the Agency. It’s now clear that all departments including procurement and human resource has adopted Technology at the factory and its attendant efficiency will benefit farmers. “We believe this initiative will transform the entire payments cycle for farmers and KTDA factories. As we continue to deepen M-PESA’s utility beyond person-to-person payments, this partnership demonstrates the ability of the

Airline Banks on China-Africa Trade to Boost passenger Traffic China Southern Airlines, the largest airline in the People’s Republic of China, is focusing on growing passenger numbers with the rising number of Chinese travelers to Africa using Nairobi as its transportation hub. Trade between China and Africa specifically Kenya, has rapidly expanded to opening a window for airlines to grow their presence on key routes. “Kenya’s strategic position on the continent with Nairobi being a major commercial and transport hub, the airline anticipates sustained growth in traffic to and from Asia,” said Mr. Wells Zheng, China Southern Airlines Senior Vice President of Marketing. He said, he is expecting an increasing demand for air transportation through Nairobi to the whole continent as more Chinese expatriates and business

Centum records historical profits Financial services company, Centum Investment has recorded a 160 per cent rise in its net profit for the year ending March 2015. The company made a profit of Sh7.9 billion up from Sh3 billion the previous year. This is the first time in the company’s history that profitability has crossed above the Sh7 billion mark. Centum CEO James Mworia says the positive numbers were a result of investment income, attributable to gain in disposal of investments and fair value increase in investment property. The profits were also buoyed by as improved dividends from portfolio companies. During the financial year, Centum increased its shareholding in Almasi Beverages Limited, the leading Coca-Cola bottler in Kenya to 50.95 percent stake. Within the fast growing consumer goods space, Centum also established a new wholly-owned subsidiary, King Beverage Limited whose mandate is to market, sell and in future, produce alcohol. At the moment, King Beverage has an exclusive distribution license for the international beer, known as Carlsberg. In September 2014, a consortium consisting of Centum and Gulf Energy was awarded the tender to build 1,050 megawatts coal power plant in Manda Bay in Lamu County.

The game was unveiled on Tuesday to rave reviews from people who had a chance to see and experience the game for themselves. It took Andrew Kaggia, the game’s developer about one year from concept to execution to come up with Nairobi X. When growing up, Andrew played a lot of computer games and always wondered when Kenya will have its own video game. “With my background in computer animation and some programming knowledge, I decided to spend some time to develop a game that would be locally appealing. Thus Nairobi X was born, “says Andrew. The game is set in the year 2030 and the game’s plot revolves around an imminent attack on Nairobi by an unknown alien colony. in a special operation tasked to defend his country. “It feels good to finally release this game after such an intense period of development. I’m looking forward to people downloading and playing the game,” said Kaggia. Kaggia had been working on the game and had even refused to let his team see the final trailer until the day of the unveiling. In developing the game, Andrew was inspired by other games. “Two games that I’d say had major influence on Nairobi X are Halo and Battlefield,” The game features music from local artistes like JuaCali and Raj giving it that Kenyan stamp of authenticity. Avid gamers are always purchasing games that do not have familiar places. This game changes that. A gamer will be able to see that the game is made for them because the landmarks in the game represent actual places in Nairobi that one can recognise at a first glance. “My target audience ranges from the average Kenyan who plays candy crush all the way to the hard core gamer who spends several hours a day on PlayStation 4,” said Kaggia. Most games are not available on one platform or another. If it is available on phone it may not be

Nairobi X has changed this too. “Nairobi X is available on both PC and Mobile Phones and so my intention is to have as many people playing the game as possible,” said Kaggia. Had anyone ventured here before?Yes,there was once a video game made for Kenya called “Adventures of Nyangi” the game did not receive as much attention as this one has. “Adventures of Nyangi leans more towards the “adventure” genre while Nairobi X is more of “Tactical Action”. ’ I have a lot of respect for the developer of that game, ‘said Kaggia. Kaggia feels the video game industry in Kenya is growing rapidly in regards to consumers as well as content developers. His advice to up and coming game developers? “There’s an increasing demand for local gaming content and I believe that Kenyan game developers should all work together as opposed to seeing each other as competitors. Garissa TTC Flee From TerrorisTs Students from Garissa Teachers Training College on Tuesday fled from the institution fearing an imminent Al-Shabaab attack. The students travelled by bus to Jacob Kaimenyi’s office to express their grievances over security issues in and around the college. One of the students spoke of how they witness policemen engaging gunmen in running battles around the college, saying that it is a very scary experience and most of night preps are wasted as they are unable to study. The students are demanding a transfer from Garissa by the government to a safer place.

hat does your job entail? There is a lot of construction in it but in a nutshell: cost management of projects, feasibility studies, contract administration, valuation of sites, claims management, meetings with developers, contractors and other consultants on construction projects. How many hours do you work in a day? Between 8 and 12 hours. Most of my day is spent outside the office meeting clients (developers) and other consultants. It’s not unheard of having 8 hour meetings. What qualifications do you need for your job? Bachelors of Quantity Surveying (Previously B.A. Building Economics) and being registered by the Board of Architects and Quantity Surveyors (BORAQS). Was this your dream career? Yes it was. My older sister is also a Quantity Surveyor but she hasn’t practiced in years, as she is a Project Manager and Development Consultant. I was inspired by a former neighbor who became my boss in my first job after graduation. How did you start out? I was employed by Armstrong & Duncan

after University and worked for 3 years and after I passed my Professional Exams I started my own firm, ANM Consultants and run that for over 6 years. I then joined Integrated YMR Partnership as a Partner in 2011 after closing my firm. What achievements have you had so far? I was nominated Top 40 Under 40 Men in Kenya 2014, I’m involved in many large prestigious projects such as Two Rivers Mall, the new Pan African Insurance Headquarters, Pearl Marina in Uganda, Windsor Park Houses, Windsor Golf & Country Club, among others. I was also the youngest Director of Kenya Rugby Football Union in 2006 – 2010 and was also Vice Chairman of Kenya Rugby Union 2012 – 2014 and achieved great strides with the Kenya 7s and Kenya rugby in general. I also was Chairman of the Safaricom 7s (2012, 2013) which were extremely successful and profitable tournaments for the KRU. Any challenges you have experienced so far? Very demanding clients, but this is a plus. It pushes you to deliver. Does your job interfere with your social life?

Not at all. I have a daughter and dedicate a lot of time to her. I balance work, family and social life; with highly stressful jobs one has to have an outlet to keep your sanity. What is the best part of your job? Getting to see what was designed on paper becoming an actual building, and knowing you were integral to that happening. What is the worst part of your job? Working extremely hard on proposed projects that don’t actualize into reality. Any advice for people who want to venture in to your line of work? The middle distance star wobbled out of a race in Ostrava late last month, holding his leg in pain. “With a second opinion, I have been asked not to risk it,” said Rudisha. “The progress was good and I was ready to go, but it will be just a few days too soon,” Rudisha said on Wednesday. Rudisha, 26, is currently undergoing treatment in Europe. His coach said the injury “was just muscle spasm, which looked quite severe on television, but as we have established, it was not too serious.” Rudisha has struggled to return to form after battling a nagging knee injury, which forced him to miss the 2013 world championships in Moscow. His last memorable race was at the 2012 London Olympics when he stormed to a spectacular new world record of 1:40.91 in the 800 metres.

US baseball team accused of hacking INTO rivaL’S COMPUTERS The FBI is investigating the St Louis Cardinals on charges that the US baseball team hacked into the computers of a rival club to steal player data. The alleged cyber-attack against the Houston Astros is thought to be the first time a professional sports team has been hacked by another. Trade discussions and proprietary statistics were reportedly targeted. Major League Baseball has confirmed

the investigation. Baseballs officials told the Washington Post that the breach is being taken seriously in the sport, which is known for its data-heavy approach to managing players and schedules. The Cardinals said they were cooperating with authorities but did not comment further. The Astros said they would not comment while the investigation was ongoing.

The Cardinals, which currently have the best record in baseball, are one of the most popular teams in the sport. They have won the sport’s championship, the World Series, 11 times, last earning the title in 2011. Only the New York Yankees have won more. The Astros and the Cardinals were divisional rivals in the National League between 1994 and 2012.

Defender Jeison Murillo had got the only goal with a close-range finish in a packed goalmouth after 36 minutes. Brazil toiled hard, but struggled to carve out clear chances. Colombia play Peru in their final Group C game, with Brazil taking on Venezuela. Brazil, Colombia and Venezuela are level at the top of the table with three points each. It was the teams’ first competitive meeting since Brazil’s 2-1 victory in the world Cup quarter-finals last summer and the match began with the same pace and physicality that marked that encounter. After Colombia’s Teofile Gutierrez had been booked for a heavy challenge on Dani Alves, he was himself on the receiving end of a body-check that saw Fernandinho yellow-carded.
