Supremacy wars threaten devolution

C

onstant supremacy battles between Senators and Members of the National Assembly are now degenerating into a contest that could leave devolution scathed. The two houses of Parliament have been in engaged in verbal

wars over which house is superior to the other since the advent of the bicameral parliament. The latest of these wars was sparked by a row in the Division of Revenue Bill 2015, where senators ended up on the losing end, after MPs slashed the Sh1billion they had allocated to

themselves for monitoring devolution. And on Monday, senators held a special sitting over the matter and decided to look into ways of amending the constitution to give them more powers over the National Assembly.

Supremacy wars now threaten devolution From Page 1 “We believe that if we have to strengthen devolution, there must be certain constitutional amendments to strengthen this House and to make devolution stronger,” Elgeyo-Marakwet Senator Kipchumba Murkomen told the sitting as he moved a Motion that proposed the formation of a select committee to suggest amendments to the Constitution to be pursued

through a referendum. However, MPs have countered the move and backed their own referendum in which they now want the senate to be scrapped altogether. It is this kind of war which has now put devolution under threat. “The senate is the guardian of devolution and needs to be stronger with a bigger role in terms of legislation. Scrapping the senate is exposing devolution

to the machinations of national government,” says Mosis Odhiambo, president of the National Congress for Civil Societies. He says the senate needs even more law making powers to check on the National Assembly which he says needs to be checked. Governors too know the threat scrapping the senate would pose and have voiced their concerns. “The senate is a major stakeholder in devolution with bigger electoral

mandate. It is absurd that senators have less powers and this is partly responsible for bad laws which have caused numerous challenges for counties,” Council of Governors chairman Peter Munya said. He said the county bosses will meet next week and deliberate the concerns. “A powerful senate will guarantee counties’ interests and end these parochial tendency of supremacy

fights,” the Meru Governor said. The contests between MPs and Senators have derailed development in the grassroots with counties sometimes forced to go without money to run their affairs whenever the lawmakers disagree on what they need to get. President Uhuru Kenyatta early this month cautioned against such supremacy wars saying it is holding the nation at ransom.

President Uhuru Kenyatta’s order for the collection of data on all HIV positive children has run into opposition after activists went to court to force the Government to destroy any such records. The human rights activists argue that it violates the section of the constitution which prohibits the recording of details about people living with HIV. Uhuru made the directive in February when he told the ministry of Health to put such children on ARVs. “We now have the statistics of these children, we know where they are. We need to put them on ARVs,” he said when he launched All In, a global campaign aimed at reducing new HIV/Aids infections and Aids-related deaths among adolescents. In that directive, children were required to list their names, schools, guardians and relatives possibly affected by their condition. However, activist groups Kenya Legal and Ethical Issues Network (Kelin), Children of God Relief Institute (Nyumbani) and two

other parties have jointly filed a petition challenging the legality of the order. Kelin’s executive director, Allan Maleche, said the case would have far-reaching ramifications for HIV patients in terms of their privacy and confidentiality. “We are worried and strongly feel that the method that was used in the collection of the names will be problematic because it would directly link the person’s name and their HIV status, which would be contrary to the law,” Mr Maleche said. The activists fear the process used in collecting the data could push back the fight against stigmatisation. It still remains unclear what amount of data has been collected since the order was made. The directive also requested that personal information be collected for pregnant women with HIV. The case began on Wednesday and its second hearing was scheduled for July 10. An estimated 1.6 million Kenyans are living with HIV, placing the country fourth worldwide in HIV

infections. Over 260, 000 of those are adolescents while children aged 14 and below account for 190, 000. Currently, about 850,000 of them are on ARVs according to Health Cabinet Secretary James Macharia. Statistics say about three in every 10 new HIV infections in the country are among the youth aged 15-24 years. Kenya Aids Indicator Survey for last year showed that one in five teens had sex before they were 15 years old. Three females in 10 and about four males in ten in the age group do not use a condom in their first sex act, the survey added. According to the UN, 1.1 million children between the ages of zero and 17 years have been orphaned due to AIDs. About 9, 720 people between 10-24 years are said to have died of HIV/AIDS related infections in 2012 and President Kenyatta’s order was one of the plans to avert new infections and deaths among adolescents by at least 75 per cent in five years.

Kenya hunts for German al-Shabaab with Sh10 million reward on his head Police have issued a Sh10 million reward for the capture of a German national accused of taking part in last weekend’s al-Shabaab attack in Lamu County. Andreas Martin Muller (right), who has the alias Abu Nusaibah, is alleged to be one of the gunmen who attacked a military camp at Baure in Mpeketoni. 11 of the attackers were killed by KDF soldiers, who also lost two of their members in the shooting that ensued. Police believe Muller is hiding in Boni forest, where some of the attackers escaped to after the botched attack. Police, in a notice issued Wednesday, said he is armed and dangerous. Those with any information

that may lead to his capture can call National Police Service hotline 020 2199151 or APS headquarters hotline 0702 243877. The reward is part of a police campaign dubbed Kaa Chonjo Usinyamaze (“Be alert, Don’t Keep Quiet”), which was launched to combat the threat from terrorists. Another foreigner, Briton Thomas Evans, also took part in Sunday’s assault and was killed in the fighting. Sunday’s attack is part of a growing number of assaults by al-Shabaab in Kenya. In April, their militants killed 184 people in an attack on Garissa University College. The government has since placed a Sh20 million bounty on Mohamed Mohamud, alias

Dulyadin alias Gamadhere who is believed to have coordinated the attack. Muller was reported to have been on the run in Uganda in 2012. His family is also said to have written to him asking him to abandon his terrorist ways and hand himself over

to authorities. Kenyan authorities believe he is among the militants who escaped Sunday’s confrontation with gun-shot wounds. Security personnel have been combing Boni forest in pursuit of them.

The world is running out of water The world is running out of water. Warnings about global warming have been confirmed yet again as the earth continues to “dry up” while human kind selfishly depletes its resources. Using measurements taken by the US-based National Aeronautics and Space Administration’s (NASA) satellites, scientists found that water is running out in some of the globes driest regions. Following the discovery, an underground water basin known as the Arabian Aquifer System in the Middle East, was found to be the most stressed reserve in the world. It serves more than 60 million people in the region. The Indus Basin aquifer of northwestern India and Pakistan came second. These developments come at a time when Kenya has experienced erratic weather,

ranging from periods of drought to devastating floods. Populations across the globe are now consuming groundwater quickly without knowing when it might run out, two studies which were published earlier this week have confirmed. While all the water on earth may not be depleted, affected regions may be forced to rely solely on rainfall, which has, over time, become inconsistent. The research, which appeared in a publication dubbed the Water Resources Research journal, revealed that 13 of the planet’s 37 largest sources of underground water studied between 2003 and 2013 were being depleted. Parts of Northern Africa show that underground sources of water could run out within the next decade if nothing is done to curb the threat.

An MP has proposed a Bill that seeks to have the death penalty abolished. Oljororok MP John Waiganga has proposed amendments to the penal code where he wants death removed as a form of punishment. “The punishment is immoral, ineffective as a deterrent and has failed to adequately restore victims of crimes for which it is prescribed,” he said in proposals being scrutinized the parliament’s Justice and Legal Affairs Committee before it is put together as a Bill for presentation in the House.

Members of the National Assembly are now planning to have Monica Juma hounded out of office in a move that could deepen the woes of the Interior Principal Secretary. Legislators have already rejected Dr Juma’s promotion to become the Secretary to the Cabinet and chairman of the Parliamentary Committee on Administration and National Security Asman Kamama says they are not yet done with her. Kamama’s committee vetted Juma and recommended her rejection citing “lack of demonstrable passion the serve the public and their elected leaders”. He now says that rejection means MPs lack confidence in Juma and can no longer work with her. As such, they have asked President Uhuru Kenyatta to replace her. “I think the President should bring

somebody else. Parliament is telling him people have no confidence in her. When Parliament loses confidence in a person, we will not tell him what to do because he knows what to do,” Kamama told journalists this on Wednesday. He warned of a stand-off should the President insist on keeping Juma as Interior PS or dare re-nominate her to become Secretary to the Cabinet. President Kenyatta had already nominated Immigration director Gordon Kilahangwa to replace Juma at the Interior Ministry upon her becoming the Cabinet boss. However, it is now unclear what happens next with Juma staying put as CS after MPs rejected her. Kamama says they will meet the Public Service Commission, the Principal Secretaries employer, next week, to decide what to do regarding Dr Juma’s fate.

WOMAN tO AppeAr ON US $10 NOte The US $10 note is to be redesigned to feature a woman its treasury department has said. The woman that will appear on the note has not yet been decided. It will debut in 2020 to mark the 100th anniversary of the US constitution’s 19th amendment, which gave women the right to vote. “I am proud that the new 10 dollar note will be the first bill in more than a century to feature the portrait of a woman,” said Treasury Secretary Jacob Lew. The note is currently headlined by Alexander Hamilton, one of the founding fathers of the country, and has been since 1929. The US treasury will seek the public’s input in the selection, they are looking

for a champion of the democracy. It is not the first time that a woman has featured on US money. Susan B Anthony, a woman’s right activist and Sacagawea, a Native American appeared on dollar coins, but both coins quickly went out circulation. Women’s groups have recently pressed for more representation on US notes. Most recently, an independent group in March, held a contest to select a woman to headline the $20 note to replace the former US President Andrew Jackson. But the treasury says the main aim of the redesign is to add measures to keep off counterfeiters.

Meru County to hold second investment conference to spur development The Meru County government has announced plans for its second international investment conference, which seeks to transform the region, while creating employment for hundreds, and possibly thousands of residents. Following the launch of an initiative dubbed the Meru County Investment and Development Corporation (MCIDC) on Thursday, the government has taken steps to

woo both local and international investors. The conference, which will be held at the Kenya Methodist University Campus in Meru, comes at a time when the devolved government is actively seeking ways to boost the development of Counties that had been somewhat ignored in the recent past. The MCIDC, in tandem with the second conference running from

June 25 to June 27, is a statutory body established under the Meru County Investment and Development Act of 2014. The Act aims to enhance the competitiveness of Meru County as a leading investment destination in Kenya. It seeks to initiate Public Private Partnerships and joint ventures between the county government and investors for the benefit of Meru

residents. Power provider, KenGen is in the process of setting up systems that will boost the region’s, electricity producing capacity. “Meru County has a proven wind energy generation corridor,” explained Meru Governor, Peter Munya. Speaking to the media in Nairobi during an investment meeting, he said that KenGen is in the process

of developing a 400 Megawatt power plant. He noted that private investors have seen Meru’s potential, given that an unnamed financial backer was helping finance a wind power project in the Kangeta Hills. The Governor said that Meru County is positioning itself to become the “investment destination of choice.”

ho is Figa B? She is a new artiste in the music industry, a young entrepreneur who loves music, good company and positive energy. She is the next big thing. Briefly tell us how your journey in music started. I started music at a young age. I was very active in school and I was always involved in drama and music festivals. My mom sings in church so I kind of grew up admiring her. My passion was stimulated by the late Myles Munroe when he was a guest speaker on Jeff Koinange live. He spoke about living your dream, the purpose for which you were created and he really spoke to me, I recorded in November, shot it in December and released it in January. How would you describe your sound? I would describe it as Afrofusion with a ragga feel . It is very different from what is frequently heard. Tell us about your latest single Ugoro Dance and the inspiration behind it. Ugoro Dance is basically a dance and feel good track. “Ugoro” is gold in sheng so I just came up with a dance for it. It’s a song that has energy and

every time the beat goes you want to rise and dance. It has some Afro beat and coastal feel to it. The video was directed by Edward Martins and the audio produced by BigSoul. Where do you get inspiration for your music? Honestly, I grew up listening to Sun Downer (Radio KBC) and I got to listen to great vocalists and music legends whose music still lives on from Peter Catera, the late Whitney Houston, Elton John, Dolly Paton and many more. Of course Kenyan, East African and basically African music has evolved to great inspiration and we now appreciate our own. Who do you look up to in the music industry? I look up to Suzanna Owiyo, Achieng Abura, Sauti Sol and Wyre. They are among my favourite Kenyan artistes and their music inspires me to make mine better. I can’t

wait to meet Beyoncé though. Which artistes have you worked with and which ones would you like to work with? Being my first single, I have only worked with Dee Bouwy and I am already in studio working on a few other songs. I would love to work with Jaguar, Avril, Redsan and Sauti Sol. What are some of the challenges you faced while starting out? Music is a new venture for me and therefore being very new I have h a d doors closed

in my face. It is also not easy to get airplay. Sometimes so many people speak into your life in terms of advice and you don’t know which to take home. What more should fans expect from you? I have a new song dropping soon and a few collabos are also in the mix. Stay tuned!

UN Women Kenya, Chamber of Commerce enter gender equality advocacy partnership UN Women Kenya and the Kenya National Chamber of Commerce have formed a partnership that will encourage private sector companies to support women’s equality in the workplace and the community at large. The movement seeks to sensitize business leaders and get company heads to submit their signatures in support for their initiative dubbed Women’s Empowerment Principles. Capital Group Limited, Safaricom, Central Bank of Kenya are among more than 30 companies that have submitted their signatures in support of the initiative. Speaking at the movement’s launch, Kenya National Chambers of Commerce and industry Chairman Kiprono Kittony said his organisation is committed to ensure women are economically empowered. He said his group will push for policies that ensure women are accorded fair employment. UN Women Kenya Country Director, Zebib Kavuma said that the Principles underscore the opportunity to work with the private sector to collaborate with government-led economic initiatives, such as the UWEZO fund. The fund seeks to provide youth and women with access to loans and mentorship opportunities to enable them take advantage of the 30 per cent of government procurement preference for women, youth and persons with disabilities. The campaign comes at a time when an African Development Bank finding has ranked Kenya first for having the highest number of women in boards. BIZ NEWS Meru set to join list of the richest counties in Kenya The Board of the Meru County Investment and Development Corporation (MCIDC) has confirmed that their ongoing venture will have a positive effect on the livelihoods of Meru residents. The Corporation’s investment vehicle aims to not only create employment opportunities but raise the standard of living for the local population. Meru is currently the 5th richest County in Kenya, after Nairobi, Kiambu, Kirinyaga and Nyeri respectively. A report from the Kenya National Bureau of Statistics and the Society for International Development (SID) confirms that there is a huge disparity between counties when it comes to wealth distribution. Given the Meru County government’s ambitious initiative, it is likely that Meru may give a number of County’s a run for their money as the devolved government continues to take shape. “There is a lot of money out there that will be harnessed to drive some of these things that we seek to accomplish,” explained Mr Joel Imitira on behalf of the MCIDC. “We are doing it now in a more organized manner,” he said. Meru County is already seeking investment capital from financial institutions and is in talks with members of the Chinese government to help push the initiative. “We will be looking from resources whenever we can find them, Imitira added, “from local communities, from local organisations.” He was speaking during the MCIDC launch ceremony in Nairobi late this week.

Company targets smallholder farmers with unique greenhouses Kenya’s agro input companies are entering the smallholder farmers’ greenhouse market, long a preserve of large scale farmers, as farmers look for innovative year round ways to produce food without relying on rains. With three quarters of farms in Kenya being managed by smallholder farmers, who are now expressing appetite for modern farming techniques that shield them from failed rains, agro input companies seems to have noticed, listened and are now responding. Traditionally and for a long time, greenhouses

have been a preserve of large-scale farms and a few smallholder farmers who have the financial might. This has locked the bulk of farmers, who are a crucial constituency in food production and feeding a growing population. A typical greenhouse costs between Sh120, 000 and Sh250, 000 depending on size and materials used. Most of them occupy a considerable bigger space. The irony has been that even as the country focuses on breaking the hunger cycle by

empowering the smallholder farmers, no tangible interventions have been rolled out to ensure that farmers are mitigated against the vagaries of weather. “Our lands are barren now. We rely on rains. Of course we have been in the food production business for long and would want to continue doing it. We have heard about greenhouses but the costs are prohibitively high I cannot even imagine getting one even on credit,” said Jude Njamba a farmer in Gatanga. Now agro input companies have rolled out

various measures in making greenhouse synonymous with smallholder farmers. One such company is Elgon Kenya, which recently imported polythene sheets making machine from Israel becoming the first of its kind in the country. Traditionally import the polythene sheets or source them locally. “But in our case we have brought this machine here because we are keen on quality and price which have been the biggest concern for our farmers,” said Mr. Nelson Maina the communication officer at Elgon Kenya.

Gender transformation is not gender equality If you know, don’t think you always know. One plus one is two, but not necessarily two and therefore not always two. You can tell a man from a woman at face value because they posses characteristics diverse from one another, but not in Nyeri. If you go to Nyeri, for your information, be careful on what titles you use while addressing people you meet along the street. Titles such as “Uncle” or “Aunty” that we commonly use in referring to certain person are not used anyhow in this region. Why? A native friend told me it is

because of “Gender Equality”. In fact, he was logical in his reasoning that he almost persuaded me to believe him. What makes a man a man or a woman a woman? Is it ears, eyes, beards or is it because he wears trouser? I told him it is because of certain particular and distinct quality. And once that quality is uprooted, to him it is a sort of interdiction from uncle to aunty. To me I think this surgical procedure in Nyeri is more of gender transformation than gender equality. Worsening the situation, each member of the House of Representative will receive Sh. 10.6 billion for the wardrobe allowance. Just the other day, a house help lost her life in Kayole to gunmen who did not take anything from her as a man was also killed but not robbed in the same area. In Mandera, cross border clashes have claimed at least 14 lives including children in attack-revenge missions. Crossing the borders, multiple lives were lost in Chad after deadly blasts in the capital city. In USA, 9 people also lost their lives in a church after a gunman opened fire on them during worship. Marriage act should be reviewed to eliminate the ‘red tape’ I gladly support the move by MPs requesting the review of marriage registration laws by the government. It is surely a good idea to move the services to sub- locations. As long as the marriage is legal then what is there to witness? Instead the government should be thinking on how to increase marriage registration offices in various locations or even appoint qualified personnel to carry out the tasks. Wahome who is also the event’s is the FMNR Jury Member said a total of 52 riders have been entered for the continental extravaganza. The FIM Africa Cross Country is one of the major highlights of the 2015 Kenya Motorsport season which revved-off in February with the Kenya National Motocross Championship round 1. This will be the second time that Kenya will be staging this prestigious championship. The first time Kenya hosted the event was in 2011 when the cream of Africa’s best converged on the expansive Soysambu Conservancy bringing together top African riding nations including South Africa, Zambia and Zimbabwe. The event is not only restricted to two wheels- Kenyan quads bike riders Shazar Anwar, Vincent Boulanger and Zane Young are sure to treat spectators to some exhilarating displays of racing artistry.

Meanwhile, the organising team for the weekend event has been confirmed. The Jury President is Anne Troughton who has played a pivotal role in the development of virtually all forms of motor sports in Kenya including the rally-sport Motocross, Enduros and Raids. Alonso handed grid penalty McLaren’s Fernando Alonso will suffer a grid penalty at this weekend’s Austrian Grand Prix - and the Spaniard could be relegated as many as 20 places. That’s because engine supplier Honda will exceed the number of changes it is allowed to make to his car in order to improve reliability. Team-mate Jenson Button, world champion in 2009, could also be hit with a grid penalty for similar reasons. The Briton was also demoted at the last race in Canada. “As a result, we are expecting grid penalties.” Alonso admitted the weekend would be “tough” but insisted McLaren and Honda would be competitive before too long. The double world champion, who joined McLaren at the end of last season, said the team’s recovery was “only a matter of time”. McLaren and Honda have chosen to implement the changes in Austria because they do not think the track will suit their car’s strengths. The Red Bull Ring is predominantly composed of short corners and long straights, which exacerbates the weakness of the Honda power unit. They also wanted to avoid taking an engine penalty at the subsequent races in Britain and Hungary, which will suit the car better. There is one piece of good news for Alonso. He will benefit from a major aerodynamic upgrade to his car for Sunday’s race, the eighth on the calendar. However, the new shorter nose and revised front and rear wings will be available only to him because there is only one set. The last time McLaren only had new parts for one car, Button benefited. iger Woods’ struggles continued as he carded a 10-over-par 80 in the first round of the US Open at Chambers Bay. The 14-time major winner had a triple bogey seven and is 15 shots behind Dustin Johnson of America and Sweden’s Henrik Stenson who lead on five under. Johnson’s compatriot Patrick Reed is second on four under. Scotland’s Marc Warren is the leading Briton on two under, while world number one Rory McIlroy and 2013 champion Justin Rose finished two over. It marked Woods’ third round in the 80s this season and he equalled the worst major championship round of his career, bringing back
