Cord to publish new graft list MONDAY, JULY 13, 2015

Opposition leader Raila Odinga has accused unnamed persons of editing the corruption list that President Uhuru Kenyatta presented to parliament and has now threatened to reveal corrupt officials whose names were omitted. According to him, some individuals at the Independent Electoral and Boundaries Commission (IEBC) and others from the Treasury were deliberately omitted from the list of shame that was presented before the Parliament. “Cord will soon publish its list of corrupt individuals whose names were not included in the EACC list of shame. It is apparent that some were edited for unknown reasons,”

Odinga claimed last night during an interview on NTV. A total of 175 officials of both the national government and county governments were in the list of shame. Among them were five Cabinet Secretaries who were forced to step aside and pave way for investigations in the accusations. Of the five, both Charity Ngilu (Lands) and Michael Kamau (Transport) have been taken to court. Others were Principal Secretaries, Governors, Senators, MPs and other state officers. Mr Odinga however maintains that the government was just applying a cosmetic approach to deal with

the vice and that it has never been serious to take on corruption head on. He also faulted Thursday’s move by MPs to send the anti-graft body secretariat home saying it will scuttle the ongoing investigations into corruption cases. “The move is going to have serious implications in the ongoing investigations of corruption cases. I see a move here to kill any investigations,” he said. Asked whether the opposition had a hand in the matter since Mr Chris Wamalwa who moved the motion is also the deputy chief whip of the coalition, Odinga replied: “Cord did not discuss or take official position

Hon Wamalwa moved the motion in his private capacity as Kiminini MP.” The decision by MPs to send EACC secretariat packing has caused public uproar. The Bill is now awaiting Presidential assent although State House Spokesman Manoah Esipisu says President Kenyatta is yet to receive it from parliament. “Parliament has not yet transmitted

the instruments to the President for his assent,” he said adding that the president will “apply his mind” to make a decision when he receives it. The President has already been advised to reject the bill. Both the Commission on Administrative Justice and Transparency International accused MPs of usurping their powers. “Parliament can only recommend to the President to form a tribunal to investigate the secretariat but not sending them home as that is the duty of the Commissioners who are currently not in office,” executive director of Transparency International Samuel Kimeu said.

known in the language of the Constitution. In our view, such a fundamental change to the EACC cannot be done by legislative and would require a Constitutional amendment,” Commission on Administrative Justice Chairman Otiende Amollo opined. The changes, he argued, were ill-advised as the EACC would cease to be independent and risk interference from the Executive and Legislature. He explained that the amendments would require the Commissioners to be recruited by the Public Service Commission and not a selection panel that includes various stakeholders as has always been. That would strip the commissioners the security of

tenure put in place to safeguard their independence. Amollo also took issue with the amendment that would make the Commissioners part-time and increase their number to five, arguing that they needed to be fully committed to the anti-corruption cause. “Increasing the number while stating that Commissioners have little work and that they should address only policy matters reflects a contradiction of principles. If they have little work, why add the numbers and cost to the taxpayer?” He posed. The High Court is currently in possession of a petition challenging the existence of the EACC without Commissioners as is presently the case and Amollo made clear what the Ombudsman’s stand is on the

matter. “The Constitution by design does not give any powers or functions to the Secretary save for serving as Secretary and Chief Executive Officer to the Commission (read Commissioners). Being an appointee of the Commissioners, he or she is under their direct control. It would, therefore, be an affront to the Constitution to transfer the constitutional powers and functions of the Commissioners to the Secretary.” Amollo also cited, “little or no public participation in the legislative process leading to the passage of the bill,” as another reason it is bad law and why President Uhuru Kenyatta should not assent to it.

Don’t boycott 2017 elections, IEBC tells Cord The Independent Electoral and Boundaries Commission (IEBC) has urged the opposition not to boycott the 2017 elections, saying they can still consult over matters that are still unclear. IEBC Vicechairperson Lilian MahiriZaja, told the opposition that last week’s launch of the strategic plan by the commission does not signify the end of consultations. Zaja said the document is work in progress and the commission still takes in views of all political parties. “IEBC serves the public as a whole and not a section and therefore we can still consult and bring everyone on board in order not to boycott the 2017 General elections,” Zaja said. CORD has threatened to boycott the 2017 polls should the Independent Electoral and Boundaries Commission (IEBC) fail to review its Strategic Plan 2015 – 2020 launched on Thursday last week.

Food tastes better when you’re winning, experts say Victory is sweet, the latest research on the psychological effects of winning has revealed. Scientists have discovered that food tastes better when people experience success. A team of experts from the US-based College of Agriculture and Life Sciences studied hundreds of sports fans and determined that even bitter food seemed to appeal to them once their team won a match. “We determined how emotions arising from the outcome of college sports games influenced the perception of sweet, salty, bitter, sour and savory tastes,” said Assistant Professor of Food Science, Robin Dando. Together with his colleague, Corinna Noel, a Doctoral stu-

dent in the field of food science, published their work in a popular journal known as “Appetite”. Dando added: “Emotional manipulations in the form of pleasantly or unpleasantly perceived real-life events can influence the perception of taste.” The researchers reached their conclusion when a number of sports fans were given a sour snack and felt that it tasted better when their team won a match. The sour snack seemed to taste bitter when their team lost. The study shows that emotions experienced in everyday life. can change the way a person perceives the taste of food, implying a link to emotional eating, explained the researchers.

The Kenya National Union of Teachers (KNUT) members are considering a nationwide strike following Teachers Service Commission’s decision to appeal a court ruling that awarded tutors hefty salary increases. The decision to appeal the ruling has left the giant union outraged. KNUT Chairman, Mudzo Nzili, described it as a disappointment saying it is TSC that moved to court in the first place seeking to reach a pay agreement. He said that the action would leave the teachers with no other option but to go on strike. “As teachers we are really disappointed by the Teachers Service Commission decision to move to court to appeal the decision to award teachers a salary increment. It shows their insincerity.” He stated.

He accused the commission of insincerity while indicating its actions were tantamount to an attempt to use the Judiciary to further their own interests. “In the first place, they were the ones who moved to court thinking that things would go their way.” Nzili said. According to KNUT, TSC action is attempting to arm-twist the Judiciary to further their agenda by denying teachers their dues. “This is not acceptable and as a union, we will not take this lying down. We will continue fighting for our rights and nothing shall stop us,” he added. “If things get worse we may have to call for a National Governing Council meeting where the decision might be to go in strike again so that our concerns may be addressed.” He said.

A trial date for suspended Lands Cabinet Secretary Charity Ngilu (pictured) in a corruption case in which she is charged with obstructing investigations is yet to be set. Proceedings in the case have been shelved till August 12 as one of the suspects in the case has been reportedly flown out of the country for treatment. In the case Ms Ngilu (pictured above) is charged with obstructing investigations in to the Sh8 billion land scandal in Karen, Nairobi. She is charged alongside seven other lands official and a top city lawyer. On Monday when the suspects appeared for a mention of their case before an anti-corruption court in Milimani, it emerged that the second suspect in the case Mr Geofrey Swanya Birundi “has been flown to India for special treatment.” Ms Ngilu’s lawyer Kioko Kulikumi requested that the case be adjourned to August 12 “to confirm the health status of Mr Birundi.” The lawyer also protested at an apparent delay in supplying copies of an Investigations diary and a statement of the investigating officer to the defence team for the trial. “Without these crucial documents it is impossible for us to prepare our defence,” the lawyer said. The trial magistrate Mr Lawrence Mugambi ordered the prosecution to supply the documents before the proceedings resume in August. Ngilu has pleaded not guilty and is out on a cash bail of Sh1 million alongside the other suspects. A magistrate had declined to allow her case to be separated from that of her co-accused despite her lawyers arguing that the particulars of the accusations are dissimilar.

Extremism and immigrants top agenda in Italian PM visit Italian Prime Minister Matteo Renzi is expected to jet into the country tonight as Kenya continues to attract high profile guests that will climax with Obama’s visit in two weeks’ time. State House Spokesman Manoah Esipisu said Renzi is expected in the country on a maiden visit. He will hold talks with Mr Kenyatta before delivering a public lecture at the University of Nairobi Tuesday afternoon. The Italian leader will talk on “Challenges of Development; Building Bridges to Combat Extremism” at the university’s Taifa Hall from 2pm according to an advert by the institution. According to Esipisu, this is the keenest focus on Kenya that has been seen for quite some time. “It puts paid to the talk in some quarters that Kenya’s relationship with the outside world are in need of repair;

Veteran comedian Mzee Ojwang’ dies Famous comedian Benson Wanjau popularly known as Mzee Ojwang’ has died. Mzee Ojwang passed on yesterday at the Kenyatta National Hospital (KNH) where he had been admitted after being diagnosed with Pneumonia. “It is true that Mzee Ojwang was admitted to the hospital earlier in the day. He was suffering from pneumonia and sadly he passed on at about 7.30pm,” a source at the Hospital said last evening after news of his death broke. “He complained this morning and was rushed to KNH where he was diagnosed with pneumonia and admitted,” confirmed actor Mary Khavere, popularly known as Mama Kayai. Ojwang’ was 78-years old. Mzee Ojwang’ was in the news in March when he underwent eye surgery following contributions from well-wishers after the media highlighted the plight of the then ailing old man. A tweet by EU President, Donald Tusk confirmed: “Euro Summit has unanimously reached agreement. All ready to go for ESM programme for Greece with serious reforms & financial support.” “There will not be a ‘Grexit’,” said European Commission head Jean-Claude Juncker, referring to the fear that Greece would have to leave the euro. The agreement means the Greek government must go way beyond a reform proposal it submitted last week as it is expected to pass reforms demanded by the Eurozone by Wednesday. Parliaments in several Eurozone states also have to approve any new bailout. Eurozone leaders had been meeting in Brussels for about 17 hours, with talks continuing through the night. According to French

President, Francois Hollande, the objective was to keep the Eurozone united as a unit. The new bailout came after Greece agreed to enact deep economic reforms under close supervision by its creditors. The deal, if ratified, should prevent a chaotic Greek exit from the euro, an unprecedented event that would have shaken Europe to its core. Fast running out of money, Greece faced an awful choice: Accept the conditions demanded by the only people willing to lend it money, or crash out of the euro. Speculation about the currency should now fade, but it’s not clear how soon the money the country desperately needs will flow, and when its banks will reopen. The crisis talks followed an ultimatum Europe gave Greek Prime Minister Alexis Tsipras last week: Show us you’re serious about putting Greek finances in order, or you’re out of the euro.

The summit hopes to reaffirm an objective for rich nations to allocate 0.7 per cent of their wealth to development aid for the world’s poorest countries. “Many donors are questioning who should receive development aid,” explained Gail Hurley, a policy specialist with the United Nations Development Programme. Preparatory talks in New York have so far failed to yield an agreement on a common summit outcome. “They tell middle income countries ‘you’re wealthy, you can raise your own money, let’s focus on poor countries’,” Hurley added during a previous address.

Uasin Gishu dumps maize for chillies A four acre farm in Uasin Gishu stands out from the rest, capitalizing on pepper cultivation at a time when maize has disappointed farmers. Rupa Fruits and Vegetables Farm is revolutionizing farming practises by influencing farmers to grow pepper on their behalf and paying them well. What inspired pepper farming is poor output from maize farming caused by unreliable rainfall and maize disease, volatile market prices and exploitation of farmers by middlemen. Due to the fact that it is suitable for the conditions that favor maize production, the crop is doing well and it has invested in two varieties which turn either red or remain green upon its maturity. “Like everyone else in this area we were also maize farmers. But when markets failed and we couldn’t get anything of value from maize we decided to focus on pepper farming as a test and it never disappointed,” said Wilson Cheruiyot the manager at the farm. Apart from fast maturity of less than two months, the crop is not only resistant to diseases but also very expensive selling at Sh 350 per kilo with less farm inputs like fertilizers. Rupa Farm harvests 900 kilos each week making over Sh 300,000 in a weak, with harvesting happening year round with high demand for both varieties by different customers has increased the fortune for the company. Reports show that green pepper is favorable among consumers while red pepper is packaged for big companies and retail to be used in making chilli sauce. The project gives farmer’s free seedlings and it also help farmers to sell mature pepper on contract basis as a way of motivating farmers interested in chilli farming. “Pepper is one of the crops that has not been utilized in the country despite its growing local demand.

ho is Wizzler? I am a rapper and song writer from Naivasha. Briefly tell us how your journey in music started I have always loved music. When I was in Class six, I used to perform songs during the drama festivals and school functions. I went ahead and recorder my first song while I was in class seven. I have not looked back since. How would you describe your sound? My sound is street rap. Tell us about your latest single ‘No Time ‘ and the inspiration behind it. No Time talks about what I have been through in my life. I used to date a girl and I had a good thing going but apparently I was the only one working towards a long term plan and she wasn’t. So I felt it would be more beneficial if I focused on my music first then love later, thus ‘No Time.’ Where do you get inspiration for your music generally? Inspiration for my music comes from everything happening around me. Sometimes it is about family or friends or people I know. Who do you look up to in the music industry? I look up to King Kaka. I feel he has been able to cut a niche for himself and he is very hardworking. To me he is this person who is always

I also did not get support from my parents, they thought I was wasting my time and money doing something that would not benefit me. Highlights of your career so far? I was recently signed to Machali30 Entertainment and so far so good. I am happy with where my career is headed. What more should fans expect from you? I have a mixtape coming out soon. ne radiant Sunday Michael and Millicent exchanged vows in the presence of adoring family and friends. It was a dejavu moment for the duo who had had met at a similar church function some months earlier. “We met at a church in Nairobi during a mutual friend’s nuptials and became good friends. We started dating in August last year and since then everything fell into place.” Millicent told XAccess enthusiastically. The proposal was not the traditional one, Milicent explains further. ” He called me on the phone! Can you imagine that?” Apparently Michael was sure she would agree to his plans and decided to have the conversation on the telephone. Lucky for him the lady was already smitten. “I was very shocked since I was not expecting it, I asked him to wait for me to get over the shock. I later said yes.” She added. The aisle had lovely white drapery that complimented the white carpet that was specifically placed for the grand entrance of the bride. As is with the norm Michael walked into the church and waited at the alter together with his best man and officiating pastor. He was dressed in a black suit, white shirt, purple tie and a purple pocket flower. The bridal party marched through two different doors and met at the center of the aisle to exchange flowers. It was a beautiful sight. The bride’s maids were dressed in fuchsia chiffon dresses cinched with a silver belt. The silver foot wear completed the look. The groom’s men wore grey suit, fuchsia ties, and white shirts. The bride walked down the aisle with her parents side by side. She was dressed in a trumpet gown with beaded crystals and had the loveliest veil on. A soothing tune played in the background to usher her majestic walk down the aisle. Half way the aisle Michael and his parents went to meet his wife. The girl’s family were given a chance to officially handover the bride to the groom’s family then they marched to alter hand in hand and all smiles. The ceremony itself was

short and sweet. After a short sermon and songs, the officiating pastor took over. The couple stood at the alter and confessed their vows. Then came the signing of marriage documents to mark their unionit was now official Michael and Millicent had become one. The photo shoot was held at the Macushla resort In Karen while the guest were ushered to the reception at Brook Haven Academy also in Karen. The ceremony ended at 6pm as the newly married headed for their honeymoon in Dubai.

he agriculture, fisheries and food authority brought the swag na chai vibe to the Arboretum grounds during the Kenya Tea Festival sampling event that went down on Saturday. Graced by several notable entertainers, the event attracted revelers in other activities at the Arboretum who came to take a sneak peak of their favorite celebrities performing on stage. Offside host and comedian Obinna Ike Igwee was the master of ceremony, keeping the crowd engaged with his ceaseless humor and antics, while energizing them for acrobats and Zumba dancing which was part of the fun activities lined up

alongside musical performances. Despite being expectant, Size 8 delivered quite a performance and even invited one of her diehard fans on stage to help her perform tam tam as a substitute for absent Willy Paul. Also in attendance was Avril who thrilled the crowd by performing some of her best known songs, closing the entertainment segment with her latest hit with King Kaka, Naweza. The attendees did not go home empty handed as there were numerous prizes up for grabs for winners of the fun competitions held during the event including a dance and eating competition.It is safe to say that tea is now the new swag! Luo Festival

thrills but not without some stings…

he second edition of the Luo Festival went down on Saturday afternoon until Sunday morning at The Carnivore. X Access almost got no access when the event organizer informed us last minute that all media passes were only for Citizen. Now we love Citizen, but who does that? The Festival, we gathered, is all about celebrating the Luo culture and exposing others people to the different aspects of it. There was heavy traffic on Lang’ata Road because all the German machines were on the road with small spots of other nondescript cars here and there. The event started at 2pm but performances did not start until 6pm. Dancer Cheda kicked off the performances with the National Anthem. The dancer expressed the National Anthem through dance capturing the attention of everyone. The MCs of the night, Owago and Jalang’o kept the crowd amped up while the DJ played Luo songs for people to dance to. However, for a festival of such magnitude, the food was too expensive; one choma sausage for Sh 300? Ujaluo! Lady Maureen was next on stage

The Luo Festival was not without its share of madness. Comedian Sleepy and Awinja alongside other comedians were called to the stage by Owago to be introduced to the crowd. The comedian decided to let his feelings known and he proposed to the beautiful lass, Awinja. There have been rumours before about the two dating but they have never really been confirmed. X Access spotted the two getting cosy with each other in front of everyone. Are the two really together or was that just a publicity stunt?

One thing stood out, being Luo is all about a lifestyle, and it was evident last weekend.

Disruptive activism doing more harm than good I am concerned about the growing number of protests in Kenya that have become disorderly. I consider them to be unacceptable and I hope other Kenyan feels the same way. In recent years, Nairobi has come to be known as the “city of complaints”. The city takes pride in the beauty of the close wildlife-human interaction. Trouble however comes when the beasts of the wild stray from the park to attack residents of these areas to the extent of killing, as was the case last week when a man was mauled by hyenas in Rongai. Baboons and monkeys are also notorious for sneaking from the

park and causing chaos on Magadi road and in nearby homes. Chris Froome retains Tour de France lead after team time trial Chris Froome retained the overall leader’s yellow jersey after a closely fought team time trial on stage nine of the Tour de France in Brittany. Froome’s Team Sky were last out on the 28km route and finished in second, 0.62 seconds slower than BMC Racing. iverpool has reached an agreement with Manchester City over the £49m (Sh 7.8 billion) transfer of Raheem Sterling. An additional £4m (Sh634 million) in add-ons has also been negotiated, which would take the fee close to Liverpool’s £50million valuation. Liverpool are said to be satisfied with the obtainability of the proposed £4m (Sh634 million) in extras and are confident Sterling will meet the targets. Sterling will formally negotiate personal terms before undergoing a medical at City this week. The forward, who will become the most expensive English player ever, is under contract until 2017. He set to earn considerably more than the £100,000 Sh15.9 million) per-week deal he rejected at Anfield. The transfer of the 20-year-old England winger is subject to contract negotiations and a medical. Sterling had asked to leave Anfield and was the subject of two bids from City in June, which were
