elevangelist James Ng’ang’a has finally been charged following his involvement in a fatal road crash which left a woman dead and her husband seriously injured. The preacher was early today arraigned before senior

resident magistrate Tomothy Ole Tanchu of the Limuru Law Courts. He was charged with dangerous driving that led to the death of Mercy Njeri, conspiring to defeat justice by giving false information and failing to report an accident to the police.

He denied all the charges. However, he will remain in police custody until tomorrow when the court makes a determination on his bond application. He will be detained at the Gigiri police station. CONTINUED ON PAGE 2

House leaders in consensus meeting to extend deadline

Heads of the two major coalitions in the National Assembly met today morning in attempts to reach a consensus following yesterday’s aborted debate on the extension of deadlines for constitutional Bills which parliament must pass by August 27. The National Assembly is required to pass 28 pieces of legislation, a majority of which the constitution requires to be passed by next week, else the House risks being dissolved. Legislators from both sides of the House agreed on the need to extend the deadline but have differed over the duration of the extension. While those allied to the ruling Jubilee coalition are pushing for a one-year extension, their colleagues in the opposition argue a

year is too long and want the deadline pushed forward by not more than six months. Yesterday, debate on the extension was deferred as it was clear that the two-thirds majority required to approve the extension could not be raised. Speaker Justin Muturi postponed the debate and directed Majority Leader Aden Duale and Jakoyo Midiwo (minority chief whip) to convene a House leadership meeting to build consensus on the matter and report back to him today afternoon. “It is unfortunate that the drafters of the Constitution decided to put the Sword of Damocles on Parliament but this being the last set of the bills, it’s only fair that both sides of the House leadership meet and decide whether you want us to proceed with the

motion tomorrow (Thursday) so that you can decide either way and then the rest will follow, the consequences are outlined in Article 261 (of the Constitution),” Speaker Muturi told the House. The two leaders are expected to lobby their colleagues and whip them into supporting and agreed extension period when the motion is debated today. Midiwo had requested Mr Muturi to postpone debate after it emerged that there were less than 150 MPs in the House which falls below the 233 MPs threshold required to extend the deadline and save Parliament from being dissolved. “We have agreed that we have a consultative meeting which I am going to convene to agree on the period between six months, nine months or 12 months,” Duale explained.

The Higher Education Loans Board (HELB) will now have to document the capability of a student to pay for their university education if the body denies the student a loan. This is after an amendment before parliament was passed waiting the approval of parliament. The amendments further seek to guarantee loans access to students from poor backgrounds. Under the new amendments student will also be require swearing affidavits before being granted an interest waiver and exempted from late payment penalties. Parliament Wednesday approved changes to the Higher Education Loans Board Act, in a Bill sponsored by Kiharu MP Irungu Kangata. The Bill now awaits President Kenyatta’s assent. “All regular government sponsored undergraduate students in the universities shall upon application of the loan be entitled to an award unless the board is able to provide documentary evidence of student’s ability to pay fees without the loan,” Kangata stated in the amendments. “We want to make sure that any

student who is pursuing higher education, not just at the public universities, has a fair chance and access to HELB loans. That is one of the improvements that we will be making at the amendment stage. So, HELB has no money and is always languishing. It does not have enough money to give to the new generation of students who need that money desperately,” said Kibra MP Ken Okoth while supporting the amendments. He vowed to push the house to make adjustments to ensure that the grace period within which to start paying the loan is reasonable, perhaps a maximum of one year after one complete their studies. If the Act is signed into law, graduates will be required by law to notify HELB in writing on the lack of a source of income a year after receiving their degrees or diplomas, upon which the board will not levy penalties on the loan. “Where within one year of completion of his studies a loanee has not secured a source of income, the loanee shall notify the Board in writing and the Board shall not levy penalty on the loan,” the Bill reads.

Pastor Ng’ang’a’s lawyer Assa Nyakundi wanted his client to be released on bond, something that the Director of Public Prosecutions opposed. The DPP while insisting that the four be denied bond argued that they can interfere with evidence. He also feared that the two accused police officers might influence their juniors to intimidate witnesses. A determination on the bond request was not yet made by the time we went to press.

Ng’ang’a’s co-accused in the case Patrick Kahindi Baya who is the Limuru Traffic Commander, Simon Kuria and Inspector Christopher Nzioka were also charged alongside him. Both Baya and Nzioka are accused of covering up the case. They denied charges of neglecting their duties. The Neno Evangelism Centre preacher was arrested yesterday at around 12.30 pm in the company of his lawyers near the Serena Hotel and taken to the Traffic Police headquarters in Ruaraka before being transferred to the Gigiri Police Station where he spent the night in a police cell. Speaking to reporters shortly after Ng’ang’a was booked in, lawyer Cliff Ombeta described the manner in which his client was being handled as undignified. “We believe that this matter is simply a traffic matter. It is causing death by dangerous driving which we are denying. Why should it be given some kind of magnitude…what makes this so different?” He asked. The preacher, who is popularly known as Apostle Ng’ang’a, is said to have been driving his Range Rover car on the wrong side of the road when it crashed into a car in which Mercy Njeri and her husband were. The crash occurred at Tigoni in Limuru, Kiambu County late last month but only came to the limelight two weeks ago amid allegations of a cover-up involving police officers aimed at protecting the pastor. And today, there was a heavy police presence outside the court in Limuru as hundreds of the preacher’s followers flocked to hear the case.

Developing countries are not equipped to deal with harmful gases: Research

Kenya, like other Sub-Saharan African states, risk producing extremely dangerous amounts of harmful gases into the atmosphere. New research has revealed that developing countries do not have air quality management systems because of inadequate legislation, budgetary constraints and lack of political reforms. Developed countries on the other hand, at the behest of human rights groups like the United Nations (UN), have developed policies that monitor dangerous carbon emissions. A study, dubbed Industrial air pollution in rural Kenya has found that contaminated air in urban areas is just a tip of the ice-berg. The information, which was compiled by researchers Eunice Omanga, Lisa Ulmer, Zekarias Berhane and Michael Gatari, shows that “there is a major challenge in maintaining a balance between economic development and a sustainable environment.” While kenya’s pollution levels are not yet at a catastrophic

However, the National Environment Management Authority (NEMA) has done its part to support a set of guidelines, laws and regulations that prohibit the emission of air pollution. In fact, the NEMA-sanctioned Environmental Management and Co-ordination Act stipulates that “No person shall act in a way that directly or indirectly causes, or is likely to cause immediate or subsequent air pollution.” The report argues that pollution from industries raises health concerns for employees and neighbouring communities. It has been stated that contaminated air raises the risk of contracting lung-based diseases that can prove fatal.

Cabinet to decide on fate of GMO’s today Kenyans will today know whether the ban on Genetically Modified foods will be lifted. Health Cabinet Secretary James Macharia says that the Cabinet will make its decision public after meeting this week. The Cabinet normally meets on Thursdays. Kenya placed a ban on genetically modified foods in November 2012, however, Deputy President William Ruto announced last week that the government is considering lifting the embargo in two months’ time. Macharia says the findings of a taskforce meant to advise the Cabinet on the issue will also be released today. “Let the cabinet have chance to discuss, and then from there decide and make the results public. We have already made our own recommendations, which don’t look bad,” he said. Ruto’s announcement elicited different reactions from both pro-GMO crusaders and those opposed to genetic foods. Police are looking for a man who killed his two year old son in a domestic quarrel in Lungalunga, Nairobi. The man had had a quarrel with his wife over marital issues when he turned on the child and killed him. This woman had left the house briefly. She told police she came back and found the child lying in a pool of blood having been clobbered and the man was missing. Elsewhere, a bandit was shot dead by police in Jamhuri estate and a gun recovered from him. He was in the company of three others and had attacked an area resident when an alarm was raised. Police say the slain man is a suspect linked to several other robberies in the area.

‘No foreign role’ in Bangkok bomb Monday’s bombing in Thailand was “unlikely” to have been the work of an international terror group, the Thai government has said. Col Winthai Suvaree, a spokesman for the ruling military junta, said this was the preliminary conclusion reached by investigators. However, authorities say the prime suspect in the bombings was foreign. The attack on the Erawan Shrine in central Bangkok on Monday evening killed 20 people and injured scores. Police say that at least 10 people are suspected of involvement in the attack.

New sex scandal hits peacekeepers in CAR Members of the United Nations peacekeeping mission in the Central African Republic (CAR) have been accused of sexually abusing three young females, including a minor. A statement from the peacekeeping mission issued last evening said that UN headquarters was “immediately informed” of the most recent allegations and that “all available evidence” was being collected. The latest allegations follow the sacking last week of the UN’s CAR envoy amid multiple allegations of sexual abuse by peacekeepers.

Bomb targets Egypt’s security building

A state security building in northern Cairo was hit by a car bomb in the early hours of Thursday morning, Egypt’s Ministry of Interior says. Six policemen were said to have been injured by the explosion in the northern Shubra district of the city. There were no reports of any deaths. “A man suddenly stopped his car in front of the state security building, jumped out of it and fled on a motorbike that followed the car,” a ministry statement said. “The car exploded wounding six policemen,” it added.

South Sudan leader Kiir agrees ‘to sign peace deal’

South Sudan’s president has promised to sign a peace deal he had earlier snubbed, the US State Department says. Salva Kiir told US Secretary of State John Kerry he had decided to sign after “a couple more days of consultation”, a State Department spokesman said. His refusal on Monday to sign the deal to end an 18-month civil war was described as “mind-boggling” by the chief mediator. The US said the latest developments were “encouraging”. But it has submitted draft proposals for a UN arms embargo on South Sudan. The UN Security Council blacklisted six generals three from each side - in July, but member states were at the time unwilling to impose further sanctions. Fighting between government and rebel forces resumed following Mr Kiir’s failure to endorse

the deal on Monday. Nearly two million people have been left homeless since conflict broke out in the world’s newest state in 2013. Fighting erupted in that year after Mr Kiir accused rebel leader Riek Machar, his former deputy, of plotting a coup. Mr Machar signed the accord in Ethiopia’s capital, Addis Ababa, on Monday - the deadline set by mediators. Mr Kiir’s chief negotiator had said the deal was a sell-out that could not be implemented as the rebels were split. But Seyoum Mesfin, a negotiator with the regional body IGAD, told the BBC that all the government’s concerns had been addressed. He said the UN and African Union would be asked to “take over” if Mr Kiir failed to sign in 15 days. Rebel General James Koang Chuol said his troops had seized the key town of Pageri, near

Groups demonstrate over learning crisis in North Eastern region Civil society groups in North Eastern Kenya today held mass processions in Mandera, Wajir and Garissa counties to express their anger at failure by the government to address the education crisis in the region. The three counties have seen a mass exodus of non-local teachers who fled following continued attacks by terrorists targeting them. And the activists say they want the government to take the matter of insecurity seriously and restore confidence in teachers on their safety. “If that cannot be guaranteed then let the government devolve education so that county government can hire their own teachers. Things cannot continue like this,” Mohamoud Dagane, the programs officer for Rural Agency for Community Development and Assistance (Racida) said in Mandera today. And in Garissa, local human rights activist Ali Awdol said the education crisis has reached an alarming level with little concern from the government.

He led the procession from Garissa Primary School to the regional coordinator‘s office at the county headquarters where they presented their demands and recommendations. “We want to raise the plight of children from north eastern whom the government has totally ignored as far as their education is concerned,” he said. Nairobi Nurses mull strikiNg over delayed salaries Nairobi County Health workers have insisted that they will go on strike from September 1 if their grievances are not addressed. Addressing a press conference this morning the health workers accused the county government of Nairobi of avoiding a meeting with them to address the issue. Led by their Secretary General Eunice Ngare the health workers are complaining of delayed payments despite attempts to launch their complaints with the county government “Guarantee that salaries are paid in accordance with the laws and we will be talking from the same script,” Ngare said. They further demanded a harmonization of their salaries and allowances for the workers who were seconded from the central government to the county and those who were serving in the default local government. “These are not huge demands, promote and reappoint those officers who have qualified for the same and are overdue,” she added. He further called on the county government to reinstate their medical allowance to mitigate the dedication of new NHIF rates.

However, Makueni Senator Mutula Kilonzo Jnr faulted the proposal by Members of the

National Assembly to move the High Court to seek a determination on the duties of the Senate. ‘’If the National Assembly goes to court before taking the alternative dispute resolution contemplated in the article, they will have violated the Constitution and the person who authorised it,’’ Senator Kilonzo said. ‘’If he is the speaker of the National Assembly, then he will be liable for the legal

fees incurred,’’ he added. The Senate formed the committee to receive public views on the woes affecting the national carrier following a recorded net loss of Sh 10.5 billion despite the treasury advancing it with a Sh 4.5 billion loan. Bangkok blast could be bad for tourism, experts say Recent bombings in Bangkok may spell doom for the country’s tourism sector, experts have warned. At least 20 people died during a blast on Monday, while more than 120 were injured during the attack which took place at the Erawan shrine. Congestion eases at Mombasa port Congestion has been eased at the port of Mombasa and may soon become a thing of the past, recent data has revealed. Shipping activity at East Africa’s biggest port, rose by 11 per cent in the first half of 2015, Reuters reports. This was evident as vessel wait times fell, the national port authority said on Wednesday. Kenya Ports Authority Managing Director Gichiri Ndua stated that the performance showed a

certain level of progress in the assimilation of East African countries to ease the flow of trade in the region. The port is a major trade gateway into East Africa and handles most of the major imports that reach Kenya’s neighbouring countries. The ongoing construction of a Chinese-funded railway line, which will connect Mombasa to the Ugandan capital Kampala, will help in speeding the flow of goods while taking

f there is a topic more controversial than ethnicity in our country then it has to be abortion. The lines are often blurred on whether it is acceptable or not to procure or administer the procedure. With the advancement in local technology and access to health information, you would think that the number abortions procured locally would have gone down, at least those deemed unsafe. Sadly that is not the case. If anything, getting pregnant nowadays is not as scary an issue as it was several decades ago because one can always visit the doctor and be rid of the pregnancy in a matter of minutes. In a bid to reduce the rate of abortion, the government has instituted measures such as forbidding schools from expelling pregnant students as well as providing free maternity services in public hospitals. However, abortion rates only continue to soar in Kenya. This is puzzling because today, one cannot terminate a pregnancy on the basis of economic hardships because the economy has improved, or lack of partner support; several laws have been gazetted compelling the involvement of both parents in child support. This begs the question, why are the numbers rising? ell, today, we value reputation more than life and one getting pregnant at the wrong time as designated by the society is a major burn to their image. With the advent of cheap birth control methods, young girls and women are increasingly tempted to engage in unprotected sex. Sometimes the contraception used fails, and the woman’s only remaining hope is the easily available abortion doctors. Due to the lack of a definitive line on the legitimacy of abortions, many clinics have sprung up, carrying out their activities under the protective umbrella of the need to save the mother if she has a risky pregnancy. John Nyamu whose clinic was raided in 2004 for allegations of administering abortions illegally gives his interpretation of the new constitution regarding the legitimacy of abortion as follows: “Abortion is legal if the pregnancy endangers the life of the woman; as an emergency treatment; or when it endangers health, with health defined broadly: physical, social and mental.” Nyamu further explains that even though he suffered shame and humiliation when his clinic was raided, it was worth the sacrifice. “The publicity was an opening for people to realize the magnitude and consequences of unsafe abortion in Kenya; women were dying in great numbers. Before that, abortion was never spoken of in public.” According to the Incidence and Complications of Unsafe Abortion in Kenya: Key findings of a National Study report, close to 500, 000 abortions are procured annually. Most by relatively young women and sadly some quite unsafely. hen it was established that the internet and especially social media has the disadvantage of mechanizing conversations, the online community wittingly devised means to add a little human touch to virtual conversations, the most outstanding tactic being e-laughter. Yes, the term e-laughter actually exists! Many expressions such as LOL, haha, hehe and even some other unconventional ones like LMAO have been used to signify chortles. Since the social media boom in 2010, LOL has been considered the official e-laughter mode but according to a recent statistical report by Facebook, LOL is so yesterday. According to Mark Zuckerberg’s team, haha is the in virtual-laughing style, being used by more than 50% of the online community. Haha is followed by the many emoji that have mushroomed, which are used by about 30% of social media users while hehe is used by about 13% of these users. The pioneer e-laughter, LOL, is only used by less than 2% of the online community as of 2015. Psychological and age factors play an important role in deciding which mode to use to express mirth online. According to this report, young people and women prefer using emoji when tickled while men and

older people use hehe more often. The fact that hehe contains the adjective ‘he’ is partly considered a contributing factor as to why men prefer using hehe instead of haha; after all, haha is only a vowel sound different. This suggestion has however been termed as gender inappropriate because it portrays men as naturally egoistic. On average, laughter is expressed using 4 to 6 letters, although at one time, a Facebook user recorded a whopping 600 letter long haha. Basically, that is haha repeated successively 300 times. The lengthy elaughter is associated with sarcasm more than delight. The rise of haha to prominence in e-laughter has seen the term being incorporated in the prediction feature of typing apps on some mobile phones. For example, typing ‘ha’ on some smartphones may prompt the prediction feature to display haha. Some other e-laughter terms such as ROFL (rolling on the floor laughing) have become totally extinct. GIF (graphics interchange format) laughter is fast on the rise as it is more appealing to visual users due to the quality of being more lively and relatable. This is because GIFs possess animation features which make the viewer feel as if they are actually watching the person on the other end of the line laugh out loud.

Three teams; Egerton Wasps, Naftag Sharks and Masinde Muliro have all pulled out of the third round of the National Sevens Series, the Driftwood Sevens division two competition set for to take place in Mombasa this weekend. The withdrawal resulted into changes

in the fixtures. Egerton has since been replaced by Kenya School of Law who will tackle MKU Nairobi, Brumbies, Dedan Kimathi in pool G while Mombasa II moves to pool H after replacing Masinde Muliro. They will face South Coast Pirates, Taita Taveta and Masaku.

Kenyans fell short in IAAF elections, so what’s Kiplagat’S NEXT MOVE?

Kenyans fared badly during the 50th Congress of International Association of Athletics Federation (IAAF) elections, winning only two out of a possible six slots being grabbed by the four locals who had announced their interests in various seats. The losing Kenyan team was led by former Athletics Kenya (AK) president Isaiah Kiplagat, who took a three-month sabbatical from Riadha House just so as to step up efforts in acquiring one of the four vice-presidential posts, which he never did. That begs the question; what’s next for Kiplagat, who managed the least votes, 68 to be precise? He was not even close to his fellow African, Kalkaba Malboum from Cameroon whom he had persuaded in vain to step down for him ‘to increase Africa’s chances of securing one of the seats. “I am taking three months off to campaign for the IAAF seat. I will be back, but there is nothing I am coming to do anyway even if I lose the seat,” Kiplagat gave this contradicting statement during his official handover and his last public press conference at Riadha House back in April. Kiplagat appointed Jack Tuwei at the helm of AK’s top seat and even though his confirmation as the president was left in the hands of delegates, they are yet to do so. “I will still continue to be part of AK by virtue of being IAAF’s Council member,” added Kiplagat

who had headed AK for 22 years. Huge task for Chipu ahead

Kenya under-19 national men rugby team coach Paul Odera, is expecting a huge challenge in the Rugby Afrique Davion 1A tournament when his side face host Zimbabwe in the direct semi-final on August 26 in Harare. Odera who named ‘a balanced composition’ of the U-19 squad (christened Chipu) yesterday has predicted a very tough match against the hosts whom they have beaten twice in the last two encounters though Odera is pretty much aware of the threat

posed by the southerners. “It’s going to be a very tough match because we’ve beaten them twice, stunning them at home. I guarantee you they are going to be looking to make their way into the final, of course they are still smarting from the fact that we’ve beaten them in the last two years so beating them is going to be tough,” said Odera If Kenya fail to beat Zimbabwe, their goal will shift to staying on division 1A where they’ll meet either Namibia or Uganda though

Odera thinks Namibia will beat Uganda in the other semi-final match. “Getting into the final is going to be a huge challenge but this team is capable of doing it but they are under no illusions of the enormity of the tusk that is facing them when they get to Harare,” he said. “If we don’t make it to the final of course the goal shifts to staying on division 1A. It’s going to be very intense because we are talking of two finals - if we win we are playing in the final to win the tournament and if we lose

we are playing a final to stay up. It’s a very intense format,” added Odera. Going forward, Odera who is expected to depart the country on August 24 has called for early preparations next year. “Depending whether my contract is renewed or not, the future of Chipu is to start early preparations and to get the team play competitively before they travel to any tournament,” he concluded. Team Captain Tyson Okoth and Billy Odhiambo will try and give some depth in the squad.

Shufaa Changawa not sure what to expect in Congo, makes golden promises Kenya Open women’s singles and doubles tennis defending champion Shufaa Changawa has promised to bring home a medal when she makes her maiden debut at the African Games from September 4-19, 2015 in Congo Brazzaville. Shufaa fought to shake off a poor form in 2013 to register a double in last year’s Kenya Open where she, together with her brother, Ishmael Changawa made history when they became the first Kenyan family to have lifted a double (men and women’s singles and doubles). outh Africa’s justice minister has blocked the early release of athlete Oscar Pistorius from prison. The release had been slated this Friday. Pistorius was convicted for five years in jail after he was found guilty of manslaughter last year after shooting dead his girlfriend Reeva Steenkamp through a washroom door. According to South African law - all offenders convicted under the same law as Pistorius can be considered for correctional supervision once they have served at least one-sixth of their sentence. He and served 10 months of his term in jail and according to the

law, he is eligible for release under “correctional supervision”, having served a sixth of his sentence. But Michael Masutha justice minister said the decision by the parole board to free the athlete after serving 10 months of his five-year sentence was premature and without legal basis. It could now take months for the board to review its decision, legal sources told the BBC.
