resident Uhuru Kenyatta has invited US companies to take advantage of Kenya’s new policy on special economic zones saying it has removed the many restrictions previously affecting them. While addressing a meeting hosted by the consortium of US companies and the Corporate Council on Africa yesterday, President Kenyatta said the Special Economic Zones Act he enacted recently has revolutionised the business environment for industries operating in Kenya as it has done away with numerous restrictions that previously affected companies based in export processing zones. “Our new special economic zones law allows you to manufacture goods that you can sell to Kenya and export to the region as well as the rest of the world,” he told US investors. The special economic zones law provides incentives for industries to operate in designated zones including Naivasha, near the Ol Karia geothermal power plants. Companies that set up bases in the designated economic zones will be given special power tariffs that will enable them to reduce their cost of operations, said the President. President Kenyatta also said the Standard Gauge Railway, whose construction is underway between Mombasa and Nairobi, will soon be extended to Naivasha before it is finally stretched further to the western borders of the country. The SGR will enable the swift transit of goods between the port of Mombasa and the wider Eastern Africa region. CONTINUED ON PAGE 2

We can get money for El Nino but not teachers, CS Rotich tells MPs
National Treasury Cabinet Secretary Henry Rotich yesterday had a tough time convincing MPs why the government can get billions of shillings to set up an emergency kitty in preparation for El Nino yet it has refused to set aside money to pay striking teachers. The government has raised a total of Sh5 billion in emergency funds to counter the effects of El Nino rains expected to begin next month despite saying the government cannot raise the additional Sh17 billion required to effect a 50-60 percent pay rise for teachers. And yesterday, National Assembly Public Accounts Committee members put Rotich to task to explain the source of the El Nino kitty. The CS said it was unfair for the government to be accused of turning a ‘blind eye’ to the teachers’ demands yet it had out rightly stated that it did not have the monies to effect the 5060 percent pay rise as directed by the court. He explained that the monies required to cover the emergencies arising from the El Nino rains were less than what had been demanded by the teachers. Also, the government has sought assistance from development partners who
will cover for the deficit, he said in response to a question by Kitutu Masaba MP Timothy Bosire who had accused the government of defying the rule of law by failing to pay its workers (teachers). “The government’s response on emerging issues depends on the magnitude of monetary figures required. The scope of budget reorganisation to respond to El Nino was tight and we also approached for the donor community’s support through additional funding as soon as disasters occur,” said Rotich. Rotich who was accompanied by Treasury PS Kamau Thugge also stated that the Treasury had urged the Ministry of Roads and Public Works to realign its budget to ensure projects they are undertaking in counties that are El Nino prone are not affected. He maintained the government position that meeting the teachers increased salary demands is impossible as the economy would be adversely affected and the already soaring wage Bill would increase further. His response on the teachers’ issues did not however satisfy the committee members who accused the government of fighting teachers. Suba MP John Mbadi faulted
the Cabinet Secretary over the government’s inability to pay teachers saying the salary demands by teachers could easily be implemented through a Supplementary Budget which he said they were ready to implement if brought before the House. “I know if the government asks Treasury to get Sh20 billion by tomorrow, the money will be found. It is obvious, this has always been done through Supplementary Budgets,” said Mbadi. He further reminded the CS of the case in May this year when the Office of the President’s budgetary allocation was raised from Sh4 billion to Sh8.5 billion through a Supplementary Budget process that he said did not constrain the country’s budget. Mr Rotich also defended his ministry against claims by governors that it was intentionally withholding monies and delaying disbursement to the counties stating that there may have been delays but the matter has been resolved. He said already, July monies had been fully disbursed with August in the process of completion while those of September were still being processed. Last week, the Council of Governors

Supkem want Hajj victims compensated The Supreme Council of Kenya Muslims (SUPKEM) now wants families of those who were killed and injured following a stampede in Saudi Arabia during Hajj rituals to be compensated. The council chairman Abdulghafur El-Busaidy says the government of Saudi Arabia should take responsibility for the incidences since they knew the number of people who were to attend. Addressing journalists in Nairobi on Tuesday, El-Busaidy said at least six of the 6,000 Kenyan Muslim pilgrims who went for the rituals died while nine are still missing. “We want the Saudi Arabia government to compensate those who died and those who have been hurt,” he said. The council said it will release a report in two weeks’ time over the incidence that saw more than 700 pilgrims from across the world lose their lives. “We will let the world know what happened and what would not have happened,” he said while passing his condolences. “It will be our role to tell those controlling Hajj of what went wrong.” There have been claims that more than 1,000 people were killed in the stampede near Mecca last week. A Nigerian official told the BBC the bodies of 1,075 victims had been taken to
mortuaries in the city of Jeddah - higher than the official toll of 769. Other countries also said they had been sent the photos of some 1,090 bodies. But the Saudi officials said the photos included unidentified people who died at the Hajj - not just in the stampede. Spokesman Maj Gen Mansour al-Turki told the Associated Press that some were foreign nationals who lived in Saudi Arabia and carried out the Hajj without the required permits. The stampede was the second deadly incident to hit the pilgrims following a crane collapse in Mecca. The stampede broke out during the symbolic stoning of the devil ritual according to the Saudi civil defence service said. Bodies of pilgrims wearing traditional white clothing were left scattered by the crush, surrounded by discarded shoes, flattened water bottles and umbrellas that had been used for protection from the sun. Nearly two million people from across the globe were attending the Hajj, one of the largest annual gatherings in the world. The ritual emulates Prophet Abraham, who is said to have stoned the devil at three locations when he tried to dissuade Abraham from God’s order to sacrifice his son Ishmael.
Police reforms on course Owino assures Police spokesman Charles Owino has assured the public that police reforms are still on course and asked for more patience before full results can be realised. Speaking this morning, Owino said police reforms is not a one-day affair, but a process that involve other stakeholders. He singled out the National Police Service Commission (NPSC) and Independent Police Oversight Authority (IPOA) as some of the independent Constitution bodies involved in the reforms. “Police reforms is a process and not a one-day affair as people think, we cannot expect things to work immediately,”
Owino said. The police spokesman urged both the NPSC and IPOA to cooperate in order to quickly realise the reforms. IPOA chairman Macharia Njeru said the body has continuously pointed out the ills of the police and will work with the National Police Service to bring the necessary reforms. He, however, decried the much-needed reforms in the dervice will take time to be achieved owing to the previous culture in the police service. Owino was reacting to a recent report by the Kenya National Commission on Human Rights that indicated the rise on police brutality and abuse of human rights.

Pope ignored as US woman is executed A woman in the US state of Georgia has been executed despite a number of last-ditch appeals, including one by the Pope, to try and block her execution. Kelly Gissendaner, 47, was the first woman put to death in the southern US state in 70 years. Lawyers filed at least three appeals with the US Supreme Court to try and delay the sentence hours before she died, but all failed. Gissendaner planned her husband’s murder in 1997. Her former lover, who killed her husband, was given life in prison. Pope Francis, who
was recently on a US tour, urged the review board to reconsider. But on Tuesday afternoon, the board announced it was not granting clemency. And hours later, the US Supreme Court said it had rejected three applications for a stay of execution. Witnesses to the execution told a local Fox News affiliate she was singing Amazing Grace before she was given a lethal injection. The Pope’s appeal for Gissendaner’s life was made in a letter written by his diplomatic representative in
the US, Archbishop Carlo Maria Vigano, on Tuesday. The archbishop wrote that, while not wishing to minimise the gravity of the crime, he implored the board “to commute the sentence to one that would better express both justice and mercy”. The board also heard evidence from Gissendaner’s lawyers who said she had undergone a transformation in prison, offering support to troubled inmates and showing remorse for her own crime. Former Georgia Supreme Court
Chief Justice Norman Flether also made representations to say Gissendaner’s death sentence was disproportionate to the crime that she committed. She was convicted of murder in relation to the 1997 stabbing death of her thenhusband, Douglas Gissendaner. She did not actually kill him, but rather encouraged her lover, Gregory Owen, to commit the act. Owen later took a plea deal and testified against Gissendaner, and for his co-operation was sentenced to life in prison. He will become
eligible for parole in 2022. Douglas Gissendaner’s family said in a statement on Monday that Kelly Gissendaner’s sentence was appropriate. “She had no mercy, gave him no rights, no choices, nor the opportunity to live his life,” the family said. Gissendaner has had two previous execution dates. Officials were unable to carry out her sentence in February due to inclement weather, and the next date in March was cancelled after officials said the drug used in the lethal injection was cloudy.
Special crimes court to try S. Sudan warlords The African Union (AU) says a special court will be set up to try war crimes suspects in South Sudan, which has been hit by a brutal conflict since 2013. The move is aimed at promoting an “African solution” to the conflict in the world’s youngest state, which became independent in 2011, it said. An inquiry has found that both government and rebel forces have committed atrocities, the AU added. Despite the signing of a peace deal last month, conflict has continued. The formation of the court is part of the deal President Salva Kiir and rebel leader Riek Machar signed following intense diplomatic pressure from regional leaders, reports the BBC’s Emmanuel Igunza from the AU headquarters in Ethiopia’s capital, Addis Ababa. Thousands have been killed in the fighting over the last 21 months and more than 2.2 million people forced from their homes. South Sudan does not recognise the International Criminal Court (ICC), which investigates atrocities in member states or if a case is referred to it by the UN Security Council. The AU is also extremely critical of the ICC, accusing it of failing to operate impartially - a charge it denies. A special court, set up by Senegal with the AU’s backing, is currently trying Chad’s former President Hissene Habre for alleged atrocities committed during his rule. Seed selection tool for Kenyan farmers goes live The Kenya Agriculture and Livestock Research Organization (KIRLO) has partnered with the Kenya Plant Health Inspectorate Service (KEPHIS) to develop an online application that help farmers select seed. Dubbed ‘MbeguChoice’ the application was launched in June this year and has already boosted over 200 commercialized crop varieties both in English and Kiswahili

tool is benefiting less than one eighth of small holder farmers, the rest not having access to internet. According to a research by KIRLO, poor seed knowledge was a major drawback to production as most smallholder maize farmers in Kenya get a third returns from their farming activities signalling a 70 per cent loss yet they account for almost 75 per cent total maize produced in the country.
Changes in tax laws as Finance Bill becomes Act The Finance Bill, 2015 has finally become the Finance Act, 2015 after going through all the stages of a bill in the National Assembly and after receiving the president’s approval. Various amendments were made during its debate in Parliament following proposals by the Treasury Cabinet Secretary Henry Rotich during his presentation of the 2015/16 budget speech. Among the first amendments is a tenet that re-evaluates tax amnesty on rental income. The bill had initially proposed that individual landlords be allowed a 40 per cent deduction of expenditure in the absence of supporting documents to support such expenditure. This was proposed to enhance compliance and declaration of rental income by landlords, according to a statement by tax and audit group, Thakrar Financial Consultants who issued a statement concerning the new Act. Now, a new provision eliminates an earlier loophole that would have allowed landlords overstate their unsupported expenditure to qualify for the 40 per cent deduction on expenditure. The Act now introduces tax amnesty to both individual and

n the internet world, especially on twitter, the saying ‘every dog has its day’ makes most sense especially in the Kenyan virtual space. Many entities have had a taste of the #KOT bitter wrath, from individuals, corporates to international organizations and on Tuesday, Multichoice Kenya had the legendary bitter sweet experience; sweet because it was the corporate’s 20th birthday and bitter because Kenyans did not have the best birthday wishes for Multichoice. If anything, furious Kenyans who are still upset with Multichioce for having raised subscription fees recently, made it their business to raid the company’s #Mckat20. What started as an innocent hashtag to publicize Multichoice’s 20th anniversary of operations in Kenya ended up trending, but not exactly the way Multichoice would have liked it. Instead of congratulatory messages flowing in, Kenyans employed their trolling prowess, using the #MCKat20 as a means to vent and let out frustrations experienced using Multichoice platforms over the years. The hashtag begun trending after the company released a report detailing the aspects in which its operations have contributed to Kenya’s economic growth, and it picked pace after controversial blogger Robert Alai took to his twitter timeline to post the organization’s
achievements progressively as the report rolled out. According to the audit report, the firm contributed Sh151 million to Kenya’s GDP in 2014, with further breakdowns revealing multimillion investments in education, culture, supply chain expenditure, employment and local content production support. The Director General of the Communications Authority went as far as hailing the company for having helped in Kenya’s adherence to the global digital migration deadline. Irked Kenyans were however of the contrary opinion, asserting that Multichoice was employing coy publicity stunts to cover up how much their Kenyan clients have been suffering financially while consuming their digital TV services. Suppressed anger from the #boycottDSTVKe which trended last month came flowing back, with disgruntled Kenyans averring that there was nothing to celebrate about the subscription fee raise to Sh9400, which is equivalent to house rent in some decent Nairobi estates. Another pertinent issue was the withdrawal of channels from bouquets without notice and also laying off employees, despite the company stating in the report that it currently has more than 600 Kenyans in employment. By now everyone knows that Kenyans are a bad crowd to annoy, and the trolling of #mckat20 has proven that in addition, Kenyans never forget. SPORTS BRIEFS Oliseh names Super Eagles’ squad for CHAN Nigeria coach Sunday Oliseh has announced a 19-man squad for the country’s Championship of African Nations (CHAN) qualification match against Burkina Faso in October Sunshine Stars’ hotshot and leading NPFL scorer, Tunde Adeniji, Super Eagles regular Gbolahan Salami, Solomon Kwambe, Bature Yaro and Ezekiel Bassey got the nod. The players will report in Port Harcourt on Monday, October 4, ahead of the first leg clash against the Stallions of Burkina Faso slated for October 18. Wales faces Fiji in Rugby WC crunch tie Wales will be going all out for their fifth win against Fiji in one of the two fixtures tomorrow in the ongoing Rugby World Cup. Wales’ players have been warned by Coach Warren Gatland of a possible axe in this crucial match if they lack intensity at training. Wales stunned England 28-25 at Twickenham and would be on the brink of the last eight if they beat Fiji. Gatland says the players had “a bit of a rocket” because training on Tuesday was “a bit lighter”. “I said ‘if I see any body language or anything that’s not right, I will change you’,” said Gatland. Sharks names Innes as new rugby coach Australian Robert Innes has been appointed the new head coach of the newly promoted Bungoma Sharks RFC. Innes, a former player of Western Bulldogs and University of Queensland Rugby club took charge at the club last week to become the second Australian rugby coach after Mike Bishop of Kabras Sugar. His immediate assignment will be to lead Sharks to their maiden Kenya cup and Eric Shirley Shield tournaments this season. He will be assisted by former Bungoma RFC and Ulinzi RFC player Elphas Kahi. Petitioners accuse KBA of delaying case after another adjournment An appeal case in which former Kenya Bowling Association (KBA) chairman Charles Wambugu and Susan Kariuki are challenging their suspension from federation was adjourned for the second time at the Sport Dispute Tribunal hearing yesterday. The move did not go down well with the appellants who accused KBA of ‘delaying tactic’ in the case that has dragged on for close to six months since it was filed. Wambugu and former KBA member Kariuki moved to the tribunal to challenge their suspension after they took National Olympics Committee of Kenya (NOC-K) to court for wrongful dismissal from Team Kenya
delegation for 2014 Commonwealth Games. Wambugu was the Bawling team manager until he was replaced on the eleventh hour by current chairman Paul Wamae who withdrew as KBA lawyer in the case. KBA called for the adjournment of the case for the second time after they changed their lawyer, for the third time in a case whose hearing date was set for October 13. On September 4, the Tribunal ordered KBA to include Nyaga in the Kenyan squad for the Africa States Tournament (AST) slated for September 11 in Lusaka, Zambia. Nyaga moved to the tribunal after he learnt of his exclusion from the squad despite
coming top during the trials to AST, one of the most prestigious international lawn bowls competitions in the continent. The Association did not honour the court directive forcing Martin Nyaga to return to court seeking for monetary compensation. Nyaga who is also representing the petitioners in the appeal number two (Wambugu and Kariuki versus KBA) accused KBA of contempt of court. “These are delaying tactics and personal vendetta by the big man,” said Nyaga “He (Wamae) could not come here knowing that there is contempt.”

KVF executive meeting is set to convene to deliberate whether the number of teams for the play off will be increased from four to six and if that happens, KPA and Prisons shall have secured their tickets to Makande Hall. Increasing the number of teams will mean that they will have to avoid any slip-up in the last leg to move to Mombasa which will host the play offs for the second year running. Geofrey Omondi coached Cooperative Bank of Kenya stunned defending champion Prisons with a hard fought 3-2 win before silencing Administration Police by straight set (25-11, 25-20, 25-13) in another match. Brazilian referee pulls gun after pitch scuffle Cases of players and fans beating up match officials are increasingly becoming rampant in the world of football, local Kenyan Premier League not alien to such unbecoming behaviour. In Brazil, a referee has invented a way of dealing with indisciplined players who are quick to raise their hands on officials. Referee Gabriel Murta Murta pulled a gun on a player who ‘kicked and slapped’ him in a lower-league Amantes de Bola. Murta, who is said to be a policeman by day, reacted by racing to the changing rooms and returning with a firearm after he was beaten by the unnamed player in the incident where the manager of the opposing team invaded the pitch
demanding a red card. The incident happened at the weekend during a regional league match in Brumadinho near Belo Horizonte, Brazil’s sixth largest city and the capital of the state of Minais Gerais according to The Mirrow. Amateur side Brumadinho was playing against Amantes da Bola - which literally translates as ‘Lovers Of The Ball.’ Referees’ association boss Giuliano Bozzano said the official felt threatened and went to look for the weapon to defend himself. He was due to undergo a psychological assessment later today and could face suspension or a permanent ban.
Footage taken on a mobile phone showed the player thought to have assaulted the referee running off the pitch as he sees the official storming towards him brandishing the rifle. He was stopped in his tracks by his linesmen and one of the goalkeepers who persuaded him to return to the dressing rooms and leave the gun in his locker. “At the moment it happened he opted for getting his gun because in his view it was a question of controlling a situation,” said Bozzano “What’s happened is obviously not a common occurrence and I don’t want to rush into anything.” The Minais Gerais Football Federation has already summonsed the referee.

Arsenal lose again in Europe ...as English clubs poor Champions League outings continue

nglish clubs’ poor show at the 2015 Champions League continues after Chelsea and Arsenal lost last night the matches to Porto and Olympiakos respectively. Arsenal manager Arsen Wenger had set a target of nine points in all his home matches, but dropped the first three when his side lost his second consecutive match to Greece Olympiakos while Jose Mourinho’s misfiring Chelsea side went down 2-1 in Porto, Portugal. Arsenal lost their opening match to Dinamo Zagreb two weeks ago, a week that also saw Manchester City and Manchester United also go down in their opening fixtures. Arsenal slumped to their second successive group stage loss at home to Olympiakos, something could that could jeopardise their hopes of moving past the group stages. Wenger’s side knew nothing other than victory would do after defeat by Dinamo Zagreb in Croatia in their opening game - and with two meetings with group favourites Bayern Munich still to come. Instead it was a dreadful night for Arsenal,
who must now become the first team since Galatasaray in 2012-13 to lose their first two group games and still reach the knockout stage. The Gunners’ display was summed up by the wretched first-half own goal conceded by David Ospina - preferred to Petr Cech in goal - when he dropped Kostas Fortounis’s corner into his own net after Theo Walcott equalised Felipe Pardo’s deflected shot. Alexis Sanchez gave Arsenal hope with a 65th-minute header only for Alfred Finnbogason to restore Olympiakos’s lead within a minute. The Gunners pulled a goal back to make the score 2-1 in injury time in the first leg then promptly rushed forward like lemmings in search of an equaliser, only to concede the decisive third goal that effectively put them out. Robert Lewandowski took his recent run to 10 goals in three matches with a hattrick as Bayern Munich beat Dinamo Zagreb 5-0 in another match. Douglas Costa scored first, Mario Gotze got the third and Lewandowski’s second put Bayern 4-0 up after 28 minutes. Lewandowski scored five goals in the 5-1 victory
over Wolfsburg on Wednesday, and two in Saturday’s 3-0 win at Mainz. The victory sees Bayern go three points clear at the top of Group F, with their next two matches against Arsenal. Luis Suarez got the winner as Barcelona scored two goals in two minutes to come from behind and beat Bayer Leverkusen 2-1. While the wins was significant for coach Luis Enrique, his main headache is the high number of players on injury list after midfielder Andres Iniesta became the latest casualty to join the recovery room at Camp Nou when he suffered a hamstring injury in the 60th minutes. “These are thorns in our side we have to shake off,” said Enrique of Barca’s latest injury to join the likes of Lionel Messi who is expected to be out for seven weeks. In Portugal, Mourinho endured a miserable return to face his old club FC Porto as Chelsea slumped to a 2-1 defeat. Andre Andre’s opener for Porto late in the first half was quickly cancelled out by a superb Willian free-kick, but Maicon’s 52nd-minute header proved to be the difference in this Group G clash played at a rip-roaring pace.
