The defence in their submission seeking to terminate the case at the prosecutor’s level had argued that the standard of proof beyond reasonable doubt should be applied. This is a standard of proof applied at the conclusion of a trial when the defense has already submitted its evidence.
“In light of the written submissions of the defence urging the chamber to assess the evidence at this level of the standard of proof beyond the reasonable doubt, the inquiry is whether the defence are then prepared to elect or stand upon their submissions and call no further evidence in the case notwithstanding that the chamber may not sustain their no case submissions. Legal experts interpreted Judge Osuji’s direction to mean that the defence teams were being asked to confirm whether in case of a rejection of their motion they will not call their defence with evidence but would instead rely on evidence already on record to establish that the prosecution had failed to prove the guilt of the accused persons. Senior Trial Attorney Anton Steynberg on behalf of the prosecution on the other hand argued that the standard of proof applicable at the stage was not proof beyond reasonable doubt – but a lower standard of proof. “All that the chamber is required to determine is whether there is evidence taken at its highest on which a reasonable court could convict not to enquire as to the strength of the evidence presented and not to embark upon issues of credibility and reliability,” he submitted. terminate the case at the prosecutor’s level. “If the defence have not thought about this they may take their time and think about it and give us their answers when it is their time to make their oral submissions or before close of proceedings on Friday.” The prosecution was also allowed

defence counsel with the right argument may see little forensic advantage for their case in calling extensive or any evidence at all if indeed they have made a wellfounded submission of no caseto-answer since any evidence they call maybe used against them,” he explained. “Such a move does not result in an inference of witness. It amounts to the popular expression that goes – putting the prosecution to the status proof of their case. But this is something to be considered with the greatest care for such a move can be just as hazardous to the defence if they fail to call evidence when the circumstances of the case, when correctly appreciated really recommend that the defence should really call evidence.” The prosecution on Tuesday presented the court with evidence convincing judges not to terminate the case against Ruto and Sang at the prosecutor’s level. The court heard that Ruto was the leader of a network organised to carry out attacks in the Rift Valley during the 2008 Post Election Violence in Kenya. Shock as woman kills boyfriend in tussle over TV remote control Police are holding a woman who allegedly stabbed her boyfriend to death in a quarrel over a television remote control in Nairobi’s Huruma Estate. Nairobi Police Chief Japheth Koome told Capital FM News that the man bled to death after the attack in their house on Tuesday evening. He said the two argued over the remote before it degenerated into a fight. “The couple were watching TV together when they started bickering on who should have the remote control. Things got out of hand and the woman ended up stabbing her boyfriend,” he said. He said the man died minutes later on arrival at a local hospital. “The man died soon after being taken to hospital,” he said. Indeed, the woman is now in our custody and she is due to be charged with murder,” said Koome. The incident follows a similar one in Nyayo Estate in Embakasi where a man allegedly killed his girlfriend and left the decomposing body in his house. The woman’s body was found in the house after four days. Meanwhile, three suspected thugs were last night killed in separate
robbery incidents in Nairobi. Koome said the gangs were separately attacking and trying to rob pedestrians and business premises when they were killed. Two of them were shot dead by police while the third was lynched by a mob. The first incident happened in Majengo slums where police shot dead a suspected thug and recovered a Berreta pistol. Police indicated that another suspect was killed in Pipeline area and a pistol found on him. In Zimmerman, a man was lynched in a botched robbery. In yet another incident Tuesday, a man was shot dead in a shop along Kirinyaga Road in the city in a robbery by a gunmen. Police say a gang of three raided a glassware shop and ordered customers who were inside and management to lie down and surrender their valuables and cash. In the process, one of the customers present is said to have argued with the gang prompting a shooting that left him with a gun wound in the head and chest. According to the Constitution, the term of the Transition Authority ends in March this year upon which they should have ensured that all functions are devolved. Yesterday, TA chairman Kinuthia Wamwangi said they will transfer all functions to counties by March if they are not granted an extension. At least 14 killed in blast near Pakistan polio centre At least 14 people have been killed in a blast outside a polio vaccination centre in the south-western Pakistani city of Quetta, officials say. Many of the casualties are thought to have been police guarding the clinic. Armed guards are routine for polio workers in Pakistan, who have been the target of many deadly attacks by Islamist militants in recent years. Militants oppose polio vaccination, saying it is a Western conspiracy to sterilise Pakistani children. Pakistan and Afghanistan are the only two countries where the disease is still endemic. The explosion took place in the morning around the time workers report for duty before heading out on their vaccination rounds, Sarfaraz Bugti, a minister for Balochistan province where the attack took place, told reporters. Correspondents say the number of attacks on polio teams in Pakistan declined last year, compared with 2014 which saw several deadly assaults.
Tributes to legendary Somali composer Tributes are being paid to legendary Somali composer, playwright, actor and poet Ali Sugule Egal, who has died at the age of 80. Mr Egal, who founded the Hargeisa Brothers music band, died at his home in the United Arab Emirates on Monday. He was born in the self-declared republic of Somaliland, whose president tweeted his condolences to the family and the people of Somaliland. A state funeral will be held for him on Thursday in the capital, Hargeisa. Fellow artists have been paying tribute to him on local radio stations across the country.
Ghana defends Guantanamo prisoners Ghana’s president has strongly defended the government’s decision to allow two Yemenis freed from Guantanamo Bay to live in the West African state. Opposition and church groups had condemned the decision, saying the men were a security threat. The men said they looked forward to living in Ghana, and had followed the national football team in prison. Putting aside a sudden crisis with Iran, President Barack Obama on Tuesday urged Americans in his final State of the Union address to reject the politics of tribalism and fear that have rocked the campaign to find his successor and to build a “clear-eyed, bighearted” and “optimistic” nation. Delivering his annual report to the nation, Obama did not name Republican 2016 candidates. But he took clear, implied shots at them nevertheless, particularly front-runner Donald Trump, as well as Sens. Marco Rubio and Ted Cruz. Half of South Sudan children ‘not in school’ due to conflict More than half of children in South Sudan are not in school, the highest proportion in any country, UN children’s agency Unicef has said. Government

by Sudan (41%) and Afghanistan 40 per cent. Worldwide, some 24 million children of more than 109 million living in nations at war are not in school, Unicef said.

KQ gets buyer of aircrafts as Fastjet disrupts market Kenya Airways Ltd, the country’s flagship carrier, has entered into sale agreement with Omni Air International for two of its Boeing 777-200 ER aircraft. The announcement comes just as the flyer’s monopoly is facing tough competition from Fastjet, a low-cost carrier that has shaken up the air transport industry. Fastjet CEO Ed Winter says the company’s new Kenya service has ended the long-running monopoly held by KQ. The low-cost Africa-focused airline announced this week that planes are now flying from Dar es Salaam and Kilimanjaro in Tanzania to Nairobi. Flights operate daily, with one-way fares starting from $80 (Sh8,190) and $50 (Sh5,120) respectively, plus tax. “Today’s flights are an important milestone in Fastjet’s development and
mark a significant achievement for the company. We have been working towards the launch of these routes for some time and are excited to be bringing our proven low-cost model to a new destination,” said Winter. After Tanzania, Uganda, Zambia, Malawi, Zimbabwe and South Africa, Kenya has become the seventh country market for Fastjet. It has been speculated that services on both routes will face direct competition, with Kenya Airways already operating 35 weekly flights between the capital cities of both Kenya and Tanzania. Fastjet General Manager for Est Africa Jimmy Kibati has said competition is good for consumers, arguing that it offers alternatives and brings air fares down. Meanwhile, KQ says its two aircrafts will be leaving for Omni in the next two
months after the company completes their exit preparation. The aircraft had been delivered to KQ when they were new in 2004 and 2007. They operated on the carrier’s scheduled routes, especially on long haul journeys to destinations in Asia and Europe. Kenya Airways had announced that it would be selling the plane in November 2014 as it sought to rationalise its fleet as part of the flyer’s turnaround strategy. “I am pleased that we have reached this milestone,” KQ’s Managing Director and CEO said in a recent address. “It has taken a while to find a good home for our B777-200ER. The North Sea job cuts are expected to take place over a two-year period. Meanwhile, Brazil’s oil giant, Petrobras, announced a massive scale back of its investment plans thanks to the lower commodity price. Regulators reject Volkswagen recall proposal Industry regulators in the United States have rejected Volkswagen’s recall plan for diesel cars equipped with emissions “cheat” devices, the BBC reports.The California Air Resources Board (CARB) proposals did “not adequately address overall impacts on vehicle performance, emissions and safety”. The board also said the proposed fix was not fast enough, adding that it would continue its investigation as well as talks with VW to find a suitable solution. The head of the California Air Resources Board, Mary Nichols, said: “Volkswagen made a decision to cheat on emissions tests and then tried to cover it up.” They
continued and compounded the lie and when they were caught they tried to deny it. The result is thousands of tons of nitrogen oxide that have harmed the health of Californians. They need to make it right.” The federal Environmental Protection Agency (EPA) also said the VW plan for vehicles with two litre diesel engines was not acceptable. The rejection comes ahead of a meeting between VW chief executive Matthias Muller and EPA chief Gina McCarthy on Wednesday to discuss the emissions scandal. last week he was optimistic the company would find a solution soon. “We will bring a package together which satisfies our customers first and foremost and then also the regulators,” he said.However, the EPA, which first revealed the existence of the devices, said that VW had not yet produced an acceptable way forward”. The US Department of Justice is suing Volkswagen on behalf of the EPA with a lawsuit that was filed on 4 January in a federal court in Detroit, Michigan.The Department of Justice said the filing was the first step in “bringing Volkswagen to justice”.
Tea prices dip as industry struggles to stay afloat Tea prices have lost up to five per cent of their value in the first auction of 2016 adding to the list of challenges facing the industry in the recent past. The quantities offered for trading have also dwindled to7.7 million kilogrammes from 9.1 million kilogrammes traded in the last week of December at the weekly Mombasa auction. East African Tea Traders Association (EATTA) managing director Edward Mudibo said the price of tea had been declining in the last two months even as the volumes for sale offered declined. “The week’s average price decreased to Sh278 from Sh294 achieved in auction 51. Some 7,745,063 kg were traded as compared to the
previous auction where 9,153,733 kg were offered for sale,” he said. The fall in prices comes at a time the industry is fighting for the scrapping of the ad valorem tax which is charged and collected by the Tea Board at one per cent of the export cost, which experts warn may hurt the farmers and consumers. The green leaf industry is also at a risk of losing close to Sh2.3 billion which it had deposited in Imperial bank prior to its collapse and closure last year. The volumes are projected to drop further on the onset of a dry season in most of the tea growing zones which EATTA says could drive the average price per kilogramme to Sh265 in
the second half of the financial year. According to the Kenya National Bureau of Statistics (KNBS), the volumes of tea decreased from 338,943 tonnes to 301,330 in quarter three as harsh weather in major tea producing counties saw the production of the green leaf fall. The volume of green leaf produced by smallscale farmers dipped to 1.03 billion kg over the period from 1.1 billion kg the previous year, according to Kenya Tea Development Agency (KTDA). The Agriculture, Fisheries and Food Authority, the farming regulator, said tea output fell to 175.2 million kg between January and June compared with wilson_x254 224.8 million kg in 2014.

Treasury, CoG form team to fast track e-procurement The National Treasury and Council of Governors (COG) have formed a taskforce expected to smoothen the implementation of e-procurement at the counties. The team will look into the challenges that the Counties have been facing in implementing the electronic procurement and payment platform and make concrete recommendations to deal with the hurdles they face. The team is expected to report back to the Treasury and the Council of Governors on the way forward by end of January. Recommendations by the taskforce will then be implemented in the course of February and give way to a much more efficient use of e-procurement in the 47 counties starting March. The taskforce is made up of three officials from Treasury and three officials from COG.

Imperial Bank stakeholders accuse CBK, KDIC Imperial Bank Limited (IBL) shareholders have accused the Central Bank of Kenya (CBK) and the Kenya Deposit Insurance Corporation (KDIC) of keeping them out of the loop with regard to the lender’s current situation. Alnashir Popat, Imperial Bank’s Chairman has argued that there has been no formal response from both entities on a solution to bring the bank back to business. Popat said the shareholders want to work towards re-opening the bank, which is currently under receivership, and are prepared to protect their rights in the courts. The shareholders claim they have been left in the dark in all matters, saying they were not consulted when the CBK announced a payment plan for the bank’s depositors. Imperial Bank’s depositors were able to access their deposits in December last year though KCB and DTB for those with less than Sh1 million in their accounts. The rest will access their money by March 2016. The shareholders said the events leading up to placement of the bank under receivership began around September 15 when IBL Managing Director Abdul Janmohammed died of a cardiac arrest and Naeem Shah (Head of Credit) together with James Kaburu (Chief Financial Officer) were appointed acting Managing Director and Deputy Managing Director respectively, the following day. McDonald’s faces competition complaint in EU Fast foods chain McDonald’s has been accused of abusing its market power by imposing unfair and restrictive contracts on people operating its franchise restaurants in Europe. A formal complaint has been made to the European Commission by a group of Italian consumers’ organizations, reports the BBC. They accuse McDonald’s of forcing franchisees to pay excessive rents and high fees while McDonald’s said it shared risks and rewards with its licencees.In a statement, McDonald’s said: “We are proud of our franchisees and are committed to working closely together so that they have the support they need to operate their restaurants and their businesses.” This approach, with the principle of sharing risk and reward, has been successful for many years and has helped create the best business opportunities for our franchisees and the best overall experience for our customers.” The Service Employees International Union (SEIU) and European unions, including the Bakers Food and Allied Workers Union in the UK, are supporting the formal antitrust complaint.

esterday the Kenya Union of artistes (Mombasa faction) held a demo demanding that all artistes should have their dues in terms of playback and ringtone royalties paid. The union, through a statement to newsrooms said that they are tired of the cat and mouse games being played by middle men with their monies. The union is however in support of an initiative by Safaricom and Collective Management Organizations (CMOs). The debate as to whether artistes should be awarded Skiza tunes royalties through middlemen or directly from Safaricom has raged on for a while now. Last year Safaricom initiated a deal to have artistes paid double their royalties and the money channeled through Collective Management Organizations (CMOs). A deal was then struck between Safaricom and MCSK, PRISK and KAMP (referred to as CMOs) that saw artistes paid 15% an increase from 7.5 percent previously offered by Premium Rate Service Providers (PRSPs). Undeterred most PRSPs are still acting as agents between Safaricom and the artistes by providing a platform to access music through the internet , they are still on the dance floor. As was expected, a misunderstanding ensued when some artistes rushed to court to have the deal blocked saying that they were willing to have their money paid directly from Safaricom while others held that PRSPs (were) the better option. . Safaricom was the bigger person when they decided that instead of targeting artistes directly, they were in favour of CMO’s.This has held thus far
but still warring camps harbor different views. Speaking to X-Access, Benga musician Ohangla Makadem known for his vocal stand on all matters music, still maintains that there is more than meets the eye. “There are cartels out to exploit artistes. These include unwanted middlemen.” Makadem supports CMos but without middle men. “We are okay with having CMO’s but not PRSP, these people called PRSP’s are not genuine,” The bone of contention for most artistes is that everyone wants a piece of their pie. The CMOs and Safaricom are currently in discussions on how to strike a new deal without the offensive PRSP, but can it hold? Top songbird Achieng’ Abura says it could but artistes must wake up. She says, ’Safaricom can pay artistes directly, they have the capacity, they have the platform and infrastructure.’ Achieng’ also wants changes at MCSK and better representation. She takes issue with the current crop of artistes who sit behind the internet and do nothing. Reached for comment MCSK said they are doing their best in association with PRISK AND KAMP to make artistes earn better, citing the recent launch of NHIF health scheme .PRISK through their communication head DNG, added that dialogue will ensure that the industry thrives. Through his social media pages, industry player Arthur K, lauded every positive effort but urged artistes to actively participate in their own affairs and get lawyers to help them decipher the small prints.

That said, we’ve highlighted 5 simple steps that outline how to rip jeans yourself. Choose your jeans The first step, obviously, is picking out which pair of jeans you want to rip. Do a few trial runs with a pair of jeans you don’t really wear anymore. If you want your jeans to look extra-worn, wash them a few times in hot water and a little bleach. Gather your supplies to distress and rip To really make jeans look authentically ripped,
distress them a bit before you start cutting the holes. Grab some sandpaper or a paintremoving block, steel wool, and a pumice stone. For the holes, use a pair of supersharp small scissors or a box cutter. Use a piece of cardboard or a small wooden block inside the pant legs so you don’t alter the back of the jeans. Put your jeans on to mark Use a pen, chalk or a safety pin to denote exactly where you want your rips and/ or distressed areas. You might want to grab a ruler, too. Do this while you’re standing. YOURSAY Wetang’ula’s bribery claims purely political The case in which Bungoma Senator Moses Wetang’ula has been accused of voter bribery is a typical example of how Kenya laws if not the institutions mandated to interpret the law can be unfair including the Supreme Court. If you look at money dished out in a weekly basis during campaign periods and nothing is said about it by these relevant institutions, one will be persuaded to believe that the Senate Minority Leader is politically being targeted. Claims of voter bribery were widespread across the political divide during the 2013 General Election,
therefore if indeed Independent Electoral Boundaries Commission (IEBC) wanted to prove to Kenyans that their antielection offences were genuine and were out to create a level playing field for all candidates including women candidates who have mostly been affected, there would be many other leaders currently in the dock with Wetang’ula. Even the issuance of land titles by President Uhuru Kenyatta to Coast residents is bribery and misuse of public offices to sway or tilt the 2017 General Election in favour of the ruling Jubilee and if IEBC cannot take
any action against him, it will not auger well for the Opposition if one of their own is punished for similar offence. If the court wanted to deal with the bribery claims against the Bungoma Senator, they should have barred him from contesting in the by-election that followed as a result of the nullification. IEBC should also summon all the Bishops who allegedly received Sh260,000 from Wetang’ula to confirm that the law cuts both sides otherwise to Cord coalitions the law will remain unfair. — Enock ndayala
Boundary clashes trend worrying as polls nears The government through the ministry of security and interior coordination should look into the spiraling ethnic clashes along our ethnic territorial boundaries that have become flashpoints of crime. The latest fighting erupted on the Nandi-Kisumu border has claimed five lives and left a trail of destruction. Similar ethnic clashes have occurred in parts of Narok and Kisii counties. Internal security Cabinet Secretary Joseph Nkaissery should seek measures to
cure the erratic boundary disputes and cattle rustling which have been cited as some of the major causes of the clashes between some communities majorly drawn from the western region of Kenya. Whatever grievances that locals may have, cannot be justifications to take the law into their own hands. The senseless killings and destruction of property must be stopped. The ministry must move from the tale and assumption that local politicians are to
blame and dig deeper to gain a better understanding of the root cause. Politics must not be left out in this clashes as it’s the tendency for such conflicts to occur more frequently in the run-up to a General Election. Lobbyists must come out against gender violence The Kenya National Human Rights Commission (KNHCR) and the National Gender and Equality Commission (NGEC) together with other human rights lobbies should remain steadfast to rein on the soaring cases of gender-based violence in the country. In the recent past, acts of gender-based violence have been reported with the most heinous being of the 32-year-old Fatuma Ibrahim from Wajir County after her husband lodged a knife in her cheeks. There was also another case of a Form Three girl who was raped and murdered in Othaya, Nyeri County. Numerous cases are not being reported due to alleged intimidation from the perpetrators of the crimes and stigma drawn from the victims
themselves, therefore the lobby groups and the authorities must ensure sources or those who want to report such cases are protected. Out of these threats, many of the cases flop in court due to lack of evidences and witnesses. As such, the lobbyists ought to come up with clear laws and strategies to aid the victims such as initiating educational programmes of ‘dos and don’ts’ when a victim has been involved in rape, abductions or and other forms of violence. Mere campaigns and street chanting is no longer enough. Indicators such as global warming should not be ignored and ecosystembased adaptations need to be harnessed to protect the future generations from negative effects of ecosystem integrity. Urbanisation and industrialisation have been seen to be the major threats to biodiversity as many
countries are investing in energy and infrastructure in a bid to develop their economies and eradicate poverty. These countries are quickly moving to address hurdles like unemployment, growing youth population and insecurity by investing more in technologies and industrialisation. However, for sustainable development to be achieved, a balance needs to be struck to ensure one
area of the economy does not progress at the expense of the other. Africa has enormous potential and is well endowed with abundant living things, agricultural potential, fresh water sources, arable lands among other biodiversity resources. IEBC should be impartial in Wetang’ula case As the Independent Electoral and Boundaries Commission (IEBC) retreats to scrutinise the submissions by Bungoma Senator Moses Wetangula’s legal team, a few things need to be take into consideration by the electoral body. First, they have to exhibit high level of independence in their decision to expunge the name of the Cord co-principal Wetang’ula after the court found him guilty of voter bribery. They must dissociate themselves from any external forces that may want to influence the
outcome of their decision and hence jeopardise the political future of the senator who is now a potential presidential candidate. SPORTS BRIEFS Froome extends SKY contract until 2018 Two-time Tour de France champion Chris Froome has extended his contract with Team Sky until the end of 2018. The 30-year-old Kenyan born Briton, who won the Tour in 2013 and 2015, said it was a “very easy decision”. “I’ve been part of the team since its inception in 2010 and that’s a special feeling,” he told BBC Sport. “This is beginning to feel like a family. Manchester United players celebrate after Rooney second goal, third for the team that appeared like the winner before Newcastle pulled one back to grab a 3-3 draw at the St James Park last night.
Magpies draw pushes United down to sixth Paul Dummett’s late strike rescued a point for Newcastle as Manchester United missed the chance to go level on points with fourth-placed Tottenham. Nairobi SportPesa Super 8 tourney illegal, says FKF The newly-launched the SportPesa Super 8 League is illegal, Football Kenya Federation (FKF) has said. The three tier league- SportPesa Super 8, Super 8 Division Two and Super 8 tournament League which is the brain child of former FKF presidential aspirant and Extreme Sport chief executive Hussein Mohammed was launched on Tuesday and is expected scheduled to kick-off next month. FKF, through its outgoing President Sam Nyamweya said in a statement that they have not sanctioned the league which is set to be played in Nairobi County. “It has come to the attention of the FKF national office and the Nairobi
branch that today Extreme Sports in partnership with betting firm SportsPesa have launched the above referenced league without seeking the mandatory clearance from the body mandated to ran, regulate football activities in the country FKF,” read the statement. When FKF came to the office in 2011, they gave an order that all football tournament must be sanctioned by the federation. This pronouncement saw the death of many soccer tournaments included the then famous Sakata ball which was sponsored by Safaricom. eigning Kenya’s Fair Play Player of the year and Sofapaka Captain John Baraza has retired from competitive football. Baraza, who announced his retirement today morning, paid special tribute to former coach Twahir Muhidin for shaping his goal scoring prowess as he ends an illustrious career spanning to 15 years. “Yes time has come...right time I guess, to say bye to the game we all love ...THE BEAUTIFUL GAME,” he said in a long post on his Social media account. “Coach TWAHIR MUHIDDIN stands out because he NEVER gave up to show me how to score goals even when I kept on missing lots of chances. So sincerely speaking, in him I got the ART of scoring. Thanks Coach for your trust, your honesty and your passion for pursuit of excellence in me,”
Baraza, considered one of the most prolific and consistent gaol scorers Kenyan has ever produced in the recent past scored nine goals last season despite his advanced age. The ever jovial and probably Kenya’s most disciplined player until today also mentioned majority of the coaches he worked with, both club and international level in an emotional post where he also took his fans down memory lane in his footballing career. “As I walk away from playing the game, I would like to say a big thank you to the people who throughout the way in my long playing career, propelled me into a mentionable figure in the football industry, they helped me SCOOP lots of AWARDS and championship medals.” Among those who got the special mention are current Ulinzi Stars coach Robert Matano, Salim Ali, Zedeki-
