In a statement, President Uhuru Kenyatta indicated that this will afford Kenyans the opportunity for healing and reconciliation. President Kenyatta pointed out that when the ICC case against him was dropped, he decided not to celebrate until all the other cases had been terminated. “Kenya has come a long way since the dark days of 2008. We have made peace. We have given ourselves a new constitution and a new political order,” the Head of State Indicated. “We have resettled and compensated many victims, and continue to respond to the outcomes of that unfortunate period of our history,” he said. All the six Kenyans named as suspects of the 2008 Post Election Violence have been acquitted. The Intergovernmental Authority on Development (IGAD) has in the meantime welcomed the acquittal of Deputy President William Ruto and Joshua Arap Sang by the ICC court. IGAD Executive Secretary Mahboub Maalim stated that Kenya can now focus on reconciliation, healing and post conflict reconstruction. On numerous subsequent occasions, it had called for the withdrawal of the remaining charges against Ruto and Sang.

The proceedings are declared a mistrial due to a troubling incidence of witness interference and intolerable political meddling,” the judges said. Only last year, Osuji accused Kenyan MPs and the Jubilee administration of a campaign to sabotage the trials. The MPs had protested the then Rule 68 which would allow use of recanted evidence in the case and even asked both Ruto and Sang to boycott the trial. “All these actions, coming as they were, in the course of this case, were always fraught with the danger of jointly or severally creating or contributing to an intimidating climate for witnesses,” Osuji declared. But even as the judges blamed the meddling for the collapse of the case, they also agreed that the prosecution evidence fell short of the required threshold. “The majority of the Chamber, having concluded that the prosecution did not present sufficient evidence on which a reasonable Trial Chamber could convict the accused, also concluded that a judgment of acquittal was not the right outcome, but only vacation of the charges and discharge of the accused,” a statement

by the court said yesterday. “The charges are hereby vacated and the accused are discharged from the process without prejudice to their presumption of innocence or the prosecutor’s right to re-constitute the case at a later time,” they added. The ruling brings to an end Kenyans’ six years engagement with the ICC during which five suspects, including President Uhuru Kenyatta, have been freed for lack of evidence.

President Kenyatta welcomed the acquittal of Ruto and Sang but blamed the ICC for pushing the case. “I welcome the aforementioned decision, which reaffirms my strong conviction from the beginning about the innocence of my Deputy President. From the start of this case, I have believed that this case was ill-conceived and never grounded on the proper examination of our experience of 2007/2008 as a nation,” he said from Paris yesterday.

The government will soon launch the International Crimes Division (ICD) of the High Court to domestically address crimes similar to those committed in 2007/8. Attorney General Githu Muigai yesterday announced that the government is further putting in place a programme to compensate and resettle victims of the Post-Election Violence. “We are going in a week or so – the Chief Justice and the Judicial Service Commission will be launching the stepping up of the ICD. I have personally been a great supporter of a domestic mechanism to deal with any problems of the nature of the crimes that took place,” he stated. He further explained that it will be in the interest of the government to ensure that there is capacity to deal with crimes such as those committed following the 2007 disputed presidential poll. Muigai regretted that the ICC intervened because the country did not have the capacity to deal with the violence. “We hope this will provide us with enough domestic capacity that we will

Zuma survives impeachment Parliament in South Africa has voted not to impeach President Jacob Zuma, despite a court ruling against him. The governing African National Congress (ANC) defeated the opposition-sponsored motion, saying Mr Zuma was not guilty of “serious misconduct”. Last week, South Africa’s highest court said he had breached the constitution by failing to repay public money used to upgrade his private home. The opposition said Mr Zuma was a “crooked” president, not fit to govern. After a rowdy debate, with MPs heckling and shouting at each other, a vote was called in the lower house, the National Assembly. The motion was backed by 143 MPs and opposed by 233. Mr Zuma was not present. The ANC had denounced the impeachment proceedings as a publicity stunt. The Democratic Alliance (DA) needed a two-thirds majority - 267 MPs out of 400 - to impeach Mr Zuma. The party has 89 seats, and the combined opposition 151.

More people executed in 2015 A surge in the number of executions recorded worldwide saw more people put to death last year than at any point since 1989, Amnesty International says. At least 1,634 people were executed in 2015, a rise of more than 50% on the previous year, the group found in its review of the use of the death penalty. Iran, Pakistan and Saudi Arabia were responsible for 89% of the executions. The total does not include China, where Amnesty said thousands more were likely killed but records were kept secret. On the other hand, the group also noted that for the first time ever a majority of the world’s countries had fully abolished the death penalty. Fiji, Madagascar, CongoBrazzaville and Suriname changed their laws in 2015, while Mongolia also passed a new criminal code that will take effect later this year. Amnesty said China remained the world’s top executioner. It estimated that thousands of people had been put to death and thousands of others sentenced to death in 2015. It added that there were signs that the number of executions in China had decreased in recent years but the secrecy around the death penalty made that impossible to confirm for certain.

Iceland’s prime minister has resigned - the first major casualty of the leaked Panama Papers that have shone a spotlight on offshore finance. The leaks, from Panamabased law firm Mossack Fonseca, showed Sigmundur Gunnlaugsson owned an offshore company with his wife but had not declared it when he entered parliament He is accused of concealing millions of dollars’ worth of family assets. Mr Gunnlaugsson says he sold his shares to his wife, and denies any wrongdoing. He is one of dozens of high-profile global figures mentioned in the 11.5 million leaked financial and legal records, which were first published on Sunday. Pressure on Mr Gunnlaugsson to quit had been building since then, with thousands of people protesting outside the parliament building in the capital Reykjavik on Monday and opposition parties tabling a confidence motion. Earlier on Tuesday, the prime minister had asked President Olafur Ragnar Grimsson to dissolve parliament and call an early election. But Mr Grimsson said he first wanted to consult leaders of the Independence Party, which has been in the ruling coalition with Mr Gunnlaugsson’s Progressive Party since 2013. Gudlaugur Thor Thordarson, the chairman of the Independence Party, said the prime minister’s request had come as a “total surprise” and was not “the rational thing to do”. Later, ahead of the proposed confidence vote, Mr Gunnlaugsson announced he was stepping down. The

Progressive Party’s deputy leader, Agriculture Minister Sigurdur Ingi Johannsson, told reporters after a meeting that the party planned to name him as the new leader and propose that he become prime minister. Despite the resignation, Katrín Jakobsdottir, head of the Left-Green Movement, told the Reuters news agency that opposition parties still wanted early elections. The documents leaked from Mossack Fonseca show that Mr Gunnlaugsson and his wife bought the company Wintris in 2007. He did not declare an interest in the company when entering

parliament in 2009. He sold his 50% of Wintris to his wife, Anna Sigurlaug Palsdottir, for $1 (£0.70) eight months later. Mr Gunnlaugsson maintains no rules were broken and his wife did not benefit financially. The offshore company was used to invest millions of dollars of inherited money, according to a document signed by Mrs Palsdottir in 2015. Court records show that Wintris had significant investments in the bonds of three major Icelandic banks that collapsed during the financial crisis which began in 2008. Some of Icelanders’ anger is believed to stem

from the perceived conflict of interest. The prime minister was involved in negotiations about the banks’ future and had characterised foreign creditors who wanted their money back as “vultures”, while Wintris itself was a creditor. Mr Gunnlaugsson had kept his wife’s interest in the outcome a secret. In a resignation statement, Mr Gunnlaugsson said he had no wish to stand in the way of further government work, such as reform of the financial system. Addressing the issue of his wife’s assets, the statement says the couple have “never sought to hide

these assets from Icelandic tax authorities and these holdings in Wintris have been reported as an asset on the prime minister’s wife’s income tax returns since 2008 and taxes have been paid accordingly in Iceland. “No parliamentary rules on disclosure have been broken. CBA, SBSA in Sh25 billion deal to pave way for repo market Commercial Bank of Africa (CBA) and Standard Bank of Southern Africa (SBSA) have executed a USD 25 million (Sh25.3 billion) cross-currency repo transaction, paving the way for a more robust, stable and inclusive interbank market in Kenya. The deal, facilitated and guaranteed by development finance company Frontclear, is a first of its kind transaction in East Africa and is set to shake up the banking sector. In the transaction which was officially executed in March, CBA receives USD 25 million in 1-year funding from SBSA and provides Government of Kenya Bonds as collateral. Jambojet announces East Africa expansion Jambojet, the low-cost carrier owned by Kenya Airways Ltd., hs announced plans to add seven routes in East Africa over the next five years as the flier continues to expand its presence across the region. The carrier also hinted at launching its first international route this month. Willem Hondius, CEO said the lowcost carrier doesn’t want to be a panAfrican operator, nor would it fly intercontinental routes. “We want to be a greater Eastern African operator, flying to Rwanda, Burundi, Tanzania, Uganda, the Comoros, South Sudan and Goma and Kisangani in eastern Democratic Republic of Congo,” he added in an announcement just days ago. “The target is to grow the market and increase passenger frequencies at a controllable pace,” he said. The airline, which controls roughly than a third of Kenya’s domestic aviation market, will also add at least one more aircraft this year to its existing four as it gradually boosts the fleet to 10, Hondius said. The flier has hinted at using B737-700s aircraft to replace its B737300 fleet. Jambojet currently operates three B737-300s and two Dash 8-400s on flights from Nairobi Jomo Kenyatta to Eldoret, Kisumu, Lamu, Malindi, Mombasa, and Ukunda. Communications Authority to spend Sh1.5 billion developing ICT infrastructure

The Communications Authority of Kenya (CA) plans to spend at least Sh1.5 billion from September to set up missing ICT infrastructure across the country. According to CA Director General Francis Wangusi, the move will focus on putting support physical infrastructure, a project that is expected to take one year to complete. The project will include building of base stations, rolling out of more optic fibre as well as other putting physical infrastructure that will allow all ICT connectivity to be done, among other initiatives. “We want the first implementation to start from September 2016. Already, we have set aside a budget of Sh1.5 billion which will be used to connect the gaps in the ICT infrastructure, as well as connect broadband to some schools, that will be identified in the counties,” Wangusi, who was speaking on Tuesday during the release of

The Report seeks to conduct a country level assessment to determine the extent of communication coverage and the access levels by citizens in the telecommunications, post and courier and broadcasting sectors, and the gaps in infrastructure and service coverage across all sub-locations in Kenya. The report indicates that Kenya’s basic mobile voice service gap has reduced to 5.6 per cent of the population which is a major achievement as the gap was still 11 per cent of the population in 2011. This has been attributed to expansion by the commercial operators, market forces and a wellregulated competitive sector, the study by Intelecon Research and Consultancy Company explains. The report proposes a large contribution to closure of the remaining gap in basic voice services which will help will

reduce the population coverage gap to 2.8 per cent by 2018. The report also states that almost all constituencies (264 out of 295) have at least one post office, and a third of the wards have a post office. However, access standards for universal postal services are yet to be developed by policymakers, based on actual demand. On broadcasting, at least 60 per cent of the population is covered by Digital Terrestrial Television (DTT) through the two licensed signal distributors KBC - Signet and Pan African Group (PANG). However the most recent TV penetration estimate noted in this report indicated that only 32 percent of Kenyan households own a TV. If ICT infrastructure is put beginning September, the study stipulates that all counties will have at least one transmitter and more than 47 per cent of sub-locations will have greater than 90 per cent signal coverage.

Orange in Sh8bn deal with Africa Internet Group Orange, the world famous French telecommunications company, has announced a 75 million euro (Sh8.6 billion) investment in the continent’s largest e-commerce platform Africa Internet Group. “With this strategic investment, Orange now has the capacity to play a leading role in the fast-growing e-commerce market in Africa,” Orange chairman Stephane Richard said. He noted that the move would “create value for all parties” while bolstering its ability to market products and services developed by Orange Middle East & Africa over the internet. Orange’s investment comes as part of its strategic Essentiels2020 plan to develop digital services in Africa and the Middle East. Africa Internet Group (AIG) was created in 2012 with the launch of Nigerian online shipping site Jumia. The group has 10 e-commerce sites in all, operating in 23 African states. The Markit CFC Stanbic Kenya Purchasing Managers’ Index (PMI) - a monthly survey of business conditions in the Kenyan private sector - fell to 52.6 per cent in March from 55.2 percent in February, but still above the 50.0 mark that denotes growth. “Though still signalling growth, the latest reading pointed to a second successive loss of momentum since January,” Markit said. The reading for March was the third lowest since the index was started 27 months ago, it added. The U.S. Agency for International Development (USAID) has announced that it is providing nearly $68 million (Sh6.9 billion) for emergency food assistance, to reach approximately 2.5 million people in Sudan and other neighboring states. This assistance will be delivered through the World Food Program, which will help address the complex emergency arising from conflict, natural disasters and widespread displacement in Sudan, including those affected by the impacts of El Niño. The contribution will support fortified foods for malnourished children under age 5 and pregnant or lactating women, emergency school feeding programs and food distributions to the most vulnerable and food-insecure populations.

The report states that countries like Kenya need to adopt better policies aimed at evenly distributing natural resources like water and pricing them I a way that is fair to consumers. According to a report from the Joint Monitoring Programme, access to safe water supplies throughout Kenya stands at 59 per cent and access to improved sanitation is at 32 per cent. Kenya faces challenges in water provision with erratic weather patterns in the past few years causing droughts and water shortages. Kenya also has a limited renewable water supply and is classified as a water scarce country. Urban migration contributes to challenges in sanitation, as people crowd into cities and urban growth is unregulated. Due to lack of access to water and sanitation, diarrhea is second to pneumonia in terms of child mortality for those under five years of age. Water, sanitation and hygiene related illnesses and conditions are the number one cause of hospitalization in children under age five. Access to water and sanitation also contribute to time savings for women, more hours in school for girls, and fewer health costs.

WhatsApp adds security feature to protect users’ personal messages Instant messaging service WhatsApp has declared that it will put all its users’ communications into code from Tuesday in a bid to boost the platform’s security. The social media service has added a system known as end-to-end encryption through which messages are scrambled as they leave the sender’s device and can only be decrypted by the recipient’s device. It renders messages unreadable if they are intercepted, for example by criminals or law enforcement. WhatsApp, which has a billion users worldwide, said file transfers and voice calls would be encrypted too. The Facebook-owned company said protecting private communication was one of its “core beliefs”. Encryption was thrown under the spotlight after the FBI asked Apple to help it access data on an iPhone used by California gunman Syed Farook. Kenyans are so quick to jump into conclusions after Safaricom chief executive officer Bob Collymore tied the knot with one Wairimu Kamiru, Kenyans branded Wairimu a gold-digger and after breaking up with her husband and father of her twins, that I understand Bob is so fond of. Kenyans never pause for a moment to imagine, what if she was truly a victim of abuse in her marriage and Collymore was her blessing and saviour from a man who did not appreciate her. Isn’t she beautiful? Have you done your research to know her net worth, her education background? Have you stopped to think that this may be the best thing that can happen to her husband? Everything is never what it seems. Kenyans must shun the trait of judging others and hold back their presumptions. If she in deed started cheating on him openly, then her husband does not deserve her. If a woman cheats on me, I will blame the woman, not the man she cheats with. Here is the thing: We all live in a world of temptation. Even when married, people always flirt. At the work place. At school and everywhere. It takes one being decent enough to know how far they can take it. Whoever cheats, and doesn’t protect his or her partner from knowing is the bad one. We are all made of flesh. The same way men can’t resist a provocative younger woman is the same way some women can’t resist a man with money. But before you call someone a gold digger, remember it is not your money she is digging. And a man may be naïve, but he will always know when he has to give money in order to win a woman. All in all, it is a fair game, because everyone gets what they want. If you believe in destiny, it wasn’t meant to be that she will leave her husband and marry Bob. And maybe they will both find happiness and they will be fulfilled. I have seen all manner of ethnic stereotype and slurs, and I wonder what if she was from any other tribe, what people would have said. If I told you to list down 10 women who you think

are gold diggers, I am sure you will discover that gold-digging knows no tribe. And if a woman decides to live off men, what exactly is your beef? Whatever happened to people just minding their freaking business? They will be fine. Even if they will not be, kindly worry about inflation, global warming, next year’s election. Anything. And can we just give the Kikuyu women a break. Stereotypes to quote Chimamanda Adichie once again, are not necessarily untrue, but they are always incomplete. Human beings are human beings. There are bad people everywhere. If you look through your family tree you will see bad people there. You probably have a man whore in your family. You probably have badly behaved female cousins, single mothers, divorcees, etc. Some of these things we accuse Kikuyu women of are not exclusive to them. Hating on them does not improve your situation in life or makes you a better person. You probably have decent Kikuyu colleagues or friends from college. When bereaved they have probably contributed towards your sick relative or the funeral arrangement. They have probably bought you beer. You have probably dated and slept with one and may be broke up on better terms. And a woman from a different tribe, or your tribe has probably ruined your life. Us men from Western Kenya like to focus on marriages that fail when you marry Kikuyu, yet there are some that succeed. I have a relative, who even after her husband died she still identifies with the family. Even as we denigrate Kikuyu women, we also don’t acknowledge that being a widow in Western Kenya is not one of the easiest things. I know many widows who have been dispossessed their husband’s wealth, abused and humiliated. Part of the reason being that we refuse to acknowledge death in West Kenya as a natural process. Graft war should extend to private sector The State Law Office must advise the Executive on the precise ways to kill graft even as it insist that there are enough laws to fight the vice. With the government now beginning to step a little harder on the accelerator in the drive against corruption, the conspicuously missing area of concern is the private sector. Indeed, the operatives in the government who turn the wheels of graft are inspired by the prospect of the huge potential gains in deals with wayward private individuals, companies, and organisations. In his State of the Nation address last week, President Uhuru Kenyatta outlined the ongoing government measures, including the seizure of assets acquired with the proceeds of corruption. Assets worth more than Sh1.6 trillion.

The anti-graft war calls for a comprehensive and systematic approach. The proposed legislation to get private companies and charity organisations fully involved and committed to the war against corruption is long overdue. Of particular significance, therefore, is the apparent involvement of the private sector in the coming up with the Graft bill. The proposed law contains recommendations by the umbrella Kenya Private Sector Alliance. The apparent buy-in by the private sector is a significant step in the war against graft. Indeed, some of the key drivers in the endemic corruption in the public sector are private firms and other organisations. Private firms, for instance, are the ones that often pay bribe

to win government tenders. And non-governmental organisations are also known to be avenues through which some individuals enrich themselves. The war on graft, therefore, cannot be won by merely focusing only on one sector. It calls for a comprehensive approach that the Bribery Bill, 2006 seeks to address. If passed, private organisations will be required to implement tough measures to stop their employees from giving or receiving bribes. Since it takes two to tango, it is noteworthy that the Bill seeks to ensure that both the givers and the recipients of bribes are severely punished. The MPs should vigorously debate and enhance the legislation. — Nderitu

Push to resettle people on forest land wrong The world’s forest capacity is reducing each day as a result of unending encroachment by human population. This trend not only depletes the forest’s ecosystem but also diminishes the natural resource capacity of the earth, a major contributor of the climate change. The pace at which the human race is plundering the forest leaves is alarming considering that the human generational phase of life is active and growing by day. This brings me to the recent Cabinet decision to take part of the 17000 hectares of the Mau Forest to settle illegal occupants. In fact, Lands ministry is in the process of generating title deeds to be given to the community members who are occupying the forest. This to me is not only a step in the wrong direction

by the government but will also reverse the gains made in forest and environment conservation and management. The government should have explored different alternatives to resolve this issue. The Mau Complex has always been a contentious matter. Any progress made to resettle and conserve the forest has been met with political disapproval and discontent from leaders seeking political mileage. The Cabinet should rethink and reevaluate its decision on the hiving of part of forest land and seek further clarity on the alternative solutions. We should not sit and watch the Mau Complex shrinking in volume. It should be preserved and protected in time and for the coming generation. — Hussein Cheptot

Demichelis accepts FA betting charge Manchester City’s Martin Demichelis has accepted a Football Association charge that he broke betting rules. The 35-year-old Argentina defender was accused of 12 breaches relating to matches between 22 and 28 January 2016. Demichelis, who is in France for City’s Champions League quarter-final at Paris St-Germain on Wednesday, had until today to respond. The FA will decide Demichelis’ punishment, with potential sanctions ranging from a fine to a ban. Rules introduced in the 2014-15

season prevent players and coaches from betting on any football activity worldwide. There is no suggestion the charge related to any City games in which Demichelis has featured this season, nor any match he could have had any influence over. Meanwhile Manchester City will face Paris Saint Germain in their UEFA Champions League quarter final first leg in Paris tonight. At the same time, Real Madrid will travel to Germany where they face Vfl Wolfsburg in another quarter final first leg clash. But Manchester City have a tougher task given that they will be missing

The trio all have calf problems. “It may be difficult for them to be fit by Wednesday,” Man City coach Manuel Pellegrini said of them. But the good news for City is that the attacking duo of Kevin De Bruyne and Samir Nasri are both fit again following lengthy injury layoffs. PSG has already been crowned French Champions and are expected to throw everything in the quest to win their first Champions League title.

Vidal on target as Bayern win Arturo Vidal’s early goal gave fivetime winners Bayern Munich victory over Benfica in the first leg of their Champions League quarter-final last night. The midfielder headed home Juan Bernat’s cross from the left in the first attack of the game after just two minutes. Bayern, though, failed to build on their advantage as they struggled to break down a well-organised Benfica. The visitors could have snatched a draw when Jonas’ second-half strike was blocked by Javi Martinez. Bayern, who have reached the semifinals every year since 2012, will need to improve on an unusually lethargic performance if they are to avoid an upset in next Wednesday’s return leg in Portugal. Manager Pep Guardiola suggested before the game that Benfica had the best defence in Europe. “I’m very happy with the result because I know how good our opponents are. Suarez shines in Barca’s fightback L

uis Suarez scored twice as Barcelona fought back to beat 10-man Atletico Madrid in an action-packed Champions League quarter-final first leg played at the Camp Nou last night. Atletico scored a potentially valuable away goal when Fernando Torres blasted in a clinical first-time shot. But the game turned when Torres was sent off before half-time for two needless bookings inside seven minutes. Holders Barca upped the tempo after the break, Suarez prodding in the equaliser then powerfully heading in the winner. However, the Uruguayan had been fortunate not to be shown a first-half red card for kicking out at Atletico right-back Juanfran. The teams will meet again in the second leg at the Vicente Calderon next Wednesday. Torres, 32, has failed to rediscover anything like prolific form since returning to boyhood club Atletico - but his goal against Barcelona was arguably the most important of his second spell. The former Liverpool and Chelsea striker showed the clinical edge which characterised the early part of his career as he latched on to Koke’s defence-splitting pass to fire in through Barca keeper Marc-Andre ter Stegen’s legs. However, his side’s tactical masterplan grab the away goal and sit tight - was blown

apart by his dismissal. Torres was shown his first yellow card for clipping Barca forward Neymar, then saw red moments later when he needlessly clattered into the back of midfielder Sergio Busquets close to the halfway line. Atletico manager Diego Simeone was incensed by the decision of German referee Felix Brych, who upset Los Rojiblancos by sending off Arda Turan in their Champions League quarter-final defeat by Real Madrid last season. And the Argentine may well believe his team were the victim of a further injustice when the official seemingly missed Suarez lashing out at Juanfran near the dead-ball line. “I can’t say what I think, but I am not angry with Fernando for sure,” said Simeone. With all their eleven men behind the ball when not in possession, staying compact and narrowing to limit the home side’s space, Barca knew exactly the tactics Atletico would employ. But the Catalan team were powerless to stop Atletico’s stubborn effectiveness in the opening hour. Atletico wanted to frustrate Barca, refusing to allow the home side to play their free-flowing football in a relatively comfortable first half capped by Torres’ opener.
