REFUSE: Disruption of refuse collection in Stanger Manor and Glenhills.

KwaDukuza Municipality has issued a notice informing members of the public of a disruption in the refuse collection service in some parts of KwaDukuza. The affected areas are Glenhills and Stanger Manor. KDM Media Liaison Officer, Sipho Mkhize said the disruption is caused by the untimely mechanical breakdown of refuse compactor trucks. “The municipality humbly requests that affected residents take all refuse bags back into their premises to keep them concealed and prevent them from being trashed by stray animals,” KwaDukuza Municipality said the public will be notified of the adjusted waste collection schedule.

T

he African National Congress (ANC) in KwaZulu-Natal has made a commitment to root out all manifestations of corrupt practices in government. Speaking at the party's 110th birthday provincial celebration at the weekend, ANC provincial chairperson Sihle Zikalala conceded that negative perceptions about the party had partly contributed to the erosion of electoral support that was witnessed last year. Zikalala said the local government elections, which saw the organization losing control in a number of municipalities across KZN, had taken place against the backdrop of reports of corruption emanating from various spheres of government. “The elections succinctly displayed that the contest was between the ANC and all other parties. Individually they contested elections, but the key objectives were common, namely; to reduce the support of the ANC. We salute the people of our country who

against such odds stood and voted for the ANC. Through them the ANC remains at the helm in most municipalities in the province and in the country. The ANC remains the leading party in most of the wards in the province. We thus vow to serve all those areas with sincerity and devotion. “We pledge to fast-track the struggle of socio-economic transformation to create jobs and ensure economic growth and redistribution. We pledge to fight poverty and build self-sustainable communities where all people are actively engaged in socioeconomic activity to sustain their livelihoods. We pledge to uproot corruption in all government spheres and further ensure effective service delivery. We pledge to uproot factionalism and restore the best values of our revolutionary movement, especially serving people with care, respect, efficiency and dedication,” Zikalala stated. The provincial head of the ruling party also attributed, to some extent, the shocking loss suffered by the organization to the climate of uncertainty brought on by the

Covid-19 pandemic, high levels of unemployment and voter dissatisfaction over government's piteous service delivery record. “We have listened to all such views and expressions and are already working towards correcting all weaknesses we have internalized before,” Zikalala said. He also spoke at length about the ANC's renewal programme, currently being championed by the organization's national executive committee (NEC). “Members of the ANC need to build trust and isolate those who peddle a divisive agenda. We must isolate all those who have made it their tasks to speak negatively about the ANC whilst they are in leadership positions within the movement. This is (the) time to close ranks and build solid unity. It is time to complement each other and intensify the implementation of the transformation programme,” he said.

Ilembe blames bulk infrastructure failures for water outages

Ndwedwe Reason: Supply from Hazelmere Dam to Ndwedwe is compromised because of the filter failures coupled with power failure challenges being experienced at the Ndwedwe Reservoir 1 which then feeds the other reservoirs. Even though filters have been fixed, levels are dropping further because of electricity challenges. Areas affected: Wards 3, 9, 10, 11, 12, 13, 14, 17, 18 and 19.

ILembe District Municipality has issued a statement acknowledging water supply challenges in KwaDukuza, Maphumulo and Ndwedwe over the past week. The municipality has attributed these challenges to what it described as “challenges facing Umgeni Water”. Umgeni Water is the bulk water services provider to this district and it operates and manages bulk infrastructure in the abovementioned local municipalities. Below are the causes of the water supply challenges;

KwaDukuza Home Affairs continues to disappoint “I don't know what to do anymore,” frustrated client By Xpress Reporter

A trip to the KwaDukuza Home Affairs offices still ranks amongst the worst experiences a person can endure. A woman from Verulam who visited Stanger Home Affairs on Monday in the hope of finally being able to apply for an ID for her son, was left extremely disappointed after she did not receive any help. The woman, who opted to remain anonymous, says she eventually came to Stanger Home Affairs after failing to get any joy from many other branches of Home Affairs. Unfortunately for her, her experience at the local branch proved to be equally, if not more, horrendous. “I arrived there at 4:30, hoping to be among those who will be assisted. It turned out the paras had other ideas as they kept on putting people ahead of us, upon receipt of a R100 payment. A single para will sell spots in the front of the queue to about three people, meaning those of us who

hadn't paid for a spot but (had) arrived early, we were kept pushed to the back of the queue. It was so frustrating,” the woman stated. She further said, with the restriction on the number of people being admitted inside the premises, some among those who had already paid for a spot, were also unlucky enough to be left out of the daily quota. It's understood that only 30 tickets are issued to those applying for first time IDs, on a first come first served basis (well, on a payment to the paras basis, really). “I honestly don't know what to do anymore. This was my second visit to the Stanger Home Affairs, and I haven't had any joy. My son is now 19-years-old, and he still doesn't have an ID,” the woman lamented. A local businessman who also spoke on condition of anonymity said it was ridiculous that, 27 years into democracy, government still failed to provide such a basic service as issuing

IDs and birth certificates. The businessman added that it was clear the culture of putting people first simply did not exist in many government departments. “You will find staff members sitting around and chatting while people are there waiting to be attended to. In the past year, the local media has been running a series of articles on the dreadful situation at Home Affairs, all to no avail, as officials remain unwilling to account.

KwaZulu-Natal police spokesperson Lieutenant Colonel Nqobile Gwala said police successfully secured 14 convictions which included seven life sentences and 99 years of imprisonment for the many suspects who appeared in various courts within the province. Many cases are still awaiting trial in court which will result in more suspects being charged and sentenced for their crimes. “Communities are encouraged to continue reporting crimes to police stations to curb the stigma attached to sexual offences. Court blow for Minister Mbalula and Aarto

The Pretoria High Court has last week delivered its r u l i n g o n t h e constitutionality of the AARTO Acts. The Organization Undoing Tax Abuse (OUTA) challenged the constitutional validity of AARTO and the AARTO Amendment Act, and asked the court in October 2021 to declare both the main act and the amendment act unconstitutional. Judge Annali Basson found in favour of OUTA and agreed with OUTA's position that the legislation unlawfully intrudes upon the exclusive executive and legislative competence of the local and provincial governments envisaged in the Constitution, preventing local and provincial governments from regulating their own affairs. The respondents in the case were the Minister of Transport, the Minister of Cooperative Governance and Traditional Affairs, the Road Traffic Infringement Authority (RTIA) and the Appeals Tribunal. The court ordered the Minister of Transport and the RTIA to pay OUTA's costs, including the costs of two counsel. OUTA says it believes that these pieces of traffic l e g i s l a t i o n a r e unconstitutional and will also not assist with the curbing of road traffic fatalities in South African.

In her judgement, Judge Basson concluded the following: “It therefore follows in my view that the AARTO Act and the Amendment Act must be declared to be inconsistent with the Constitution in its entirety. It is therefore declared that the AARTO Act and the Amendment Acts are unconstitutional and invalid.” “We are very pleased with the court's decision. OUTA believes that AARTO in its current format does nothing to improve road safety, nor does it reduce the scourge of road fatalities in South Africa. We are satisfied that the judgment will be sending government back to the drawing board. This time around, we trust the relevant departments will engage meaningfully with civil society to obtain our input when developing such important policies for the

country. South Africa needs effective processes enabled by fair adjudication that complies with the Constitution,” says Adv Stefanie Fick, Executive Director of the Accountability and Governance Divisions at OUTA. Adv Fick added that the court's judgement signals another important win for civil society, and yet again points out that government is out of touch with reality. “It is unfortunate that government once again chose to ignore valid concerns and well researched input, and pushed ahead with the amendment. Not only did they waste a lot of time, but also valid resources, as the AARTO roll out will have to be stopped while the act is once again amended and taken through the legislative process. Only then can it be implemented.”

South Africa recorded 1 691 new confirmed Covid-19 infections on Monday. According to a statement by the National Institute for Communicable Diseases (NICD), as of Monday, the country recorded 3 560 921 laboratory-confirmed cases. There were 25 new Covid19-related deaths in the previous 24- to 48-hour reporting period, bringing

the confirmed death toll to 93 451. The NICD said the 1 691 new Covid-19 cases identified in South Africa represented a 9.3% positivity rate. As of Monday, Gauteng recorded 1 155 973 confirmed cases, KwaZuluNatal 636 108 and the Western Cape 620 255. Most new cases were recorded in Gauteng, which

accounted for 27% of new infections, followed by the Western Cape with 19%. KwaZulu-Natal accounted for 17%; Mpumalanga 11%; Limpopo and North West 7% each; Free State 6%; Eastern Cape 5%; and Northern Cape 2%. Gauteng recorded 456 new cases on Monday, the Western Cape 316 and KwaZulu-Natal 285.

Hefty fine for refusing to be counted, Census 2022 South African citizens who refuse to be counted during Census 2022 may face up to six months' imprisonment or be liable for a R10 000 fine, according to the head of Stats SA in Limpopo, Nthambeleni Mukwevho. This as the R20 billion project is expected to see about 160 000 field workers counting the population from February 3 to 28. The project kicks off on the night of February 2, when the homeless will be counted.

The census is held every 10 years, and the data of each individual in every household is collected. While the country continues to battle the effects of Covid19, Mukwevho has urged the public to register online as the census goes online for the first time in the history of the country. Mukwevho warned that any member of the public refusing to work with the field workers may be jailed. Addressing the media at a

press briefing on the state of readiness at the Stats SA provincial headquarters in Polokwane last week, he said: “We can lay a charge for breaking the laws of the Constitution, and perpetrators could be sentenced to six months or pay a R10 000 fine. That would be the last option because we have no time to waste laying charges. Police will go to citizens' houses to arrest them if it comes to that.”
