Ballito Bay Mall to pay KDM R16 million By Xpress Reporter

n urgent application was launched at the Durban High Court on 13 November 2017 to interdict and prevent the KwaDukuza Municipality (“KDM”) from disconnecting the general lighting at Ballito Bay Mall for nonpayment of R950 000, was transformed in 3 days to a Court Order directing the liquidators of Ballito Bay Mall to pay the full amount, R16.5 million, claimed by KDM for rates and service charges within 5 days (ending this Friday, 24 November 2017), failing which the general lighting will be disconnected. Consolidated Aone Trade & Invest 6 (Pty) Ltd (“Aone”), is the registered owner of Ballito Bay Mall. Aone went into liquidation in September 2013. In May this year the liquidators of Aone sold Ballito Bay Mall to Cyber Savvy Merchants (Pty) Ltd (“Cyber Savvy”) for R135 million. In order

to transfer the property to Cyber Savvy, KDM has to be paid for outstanding rates and service charges. The liquidators applied for rates clearance figures from KDM in May and July this year, KDM supplied the figures, but payment was not made. Towards the latter part of August 2017, KDM instituted proceedings against the liquidators of Ballito Bay Mall for the full amount outstanding (then in the region of about R14 million) in the Durban High Court, and the matter is set down for hearing on 01st February 2018. On 27th October 2017, KDM caused letters to be sent to the liquidators of Aone and tenants of Ballito Bay Mall advising of the municipality's intention to disconnect the general lighting at Ballito Bay Mall on 15th November 2017 for non-payment of two electricity accounts amounting to R950 000. More than two weeks later, on 13th November 2017, Cyber Savvy, represented by Manogh Maharaj of Umhlanga-

The application papers were served on KDM at 1pm on 13th November 2017, with the matter being set down for hearing at 2.30pm that afternoon. KDM, represented by Asmal & Asmal Attorneys of Kwa Dukuza, opposed the application. The matter was heard by Judge Dhaya Pillay, who rolled-over the application to 15th November 2017, with KDM undertaking not to disconnect the general lighting until 15th November 2017. During the morning of 15th November 2017, KDM filed a voluminous opposing affidavit deposed to by its Director: Revenue: Rashina Singh. KwaDukuza Municipality Mayor, Councillor Ricardo Mthembu was a no-show at a meeting for the local business community which was scheduled to take place at KwaDukuza Council Chambers to discuss the implementation of the Pay Parking System and other developmental issues on Thursday, 16 November 2017. To add to the fury of residents, the agreed venue had

been “double booked”, and the meeting was moved to the KwaDukuza Supper Room. Infuriated attendees of the meeting who expected to engage with the Mayor himself, lamented the Municipality's “lack of interest” and “irresponsibility”, claiming that KDM “shows no respect for the community.” Chairman of the meeting, Mr Tarzan Naicker apologized on behalf of the Mayor, saying that he was held up at another meeting.

An irate businessman expressed his disappointment with the situation and said that people had left their businesses in the hope of engaging with the Mayor at the meeting. “We responded to the invitation given by the Mayor himself, and upon arrival we see that the venue is being used for another meeting, and the Mayor isn't here. This shows the blatant disrespect that KDM has for us.” Although KDM Deputy

Mayor, Councillor Dolly Govender represented the office of the Mayor, the majority of the local business community ultimately decided that the meeting should not go on without Mayor Mthembu, and proposed that a meeting be held at a later date. The meeting was intended to be “an opportunity to engage the local business stakeholders over concerns that have been raised by the public in relation to the Pay Parking System.”

Continued from page 1 not urgent, that Cyber Savvy has no legal right to apply for the interdict as Aone was the owner of Ballito Bay Mall, that Cyber Savvy was misleading the Court through non-disclosure of material facts, that Cyber Savvy, its attorney, and its Advocate as well were aware of the matter long before they alleged they had become aware of it, and that the liquidators had not disputed the electricity account. Cyber Savvy's attorneys indicated that they wished to reply to Singh's affidavit, and the matter was rolled-over to 16th November 2017. On 16th November 2017, the liquidators of Aone, represented by Adam Lombard of Edward Nathan Sonnenbergs Incorporated (Africa's largest law firm), agreed to pay KDM the full amount outstanding for rates and service charges for Ballito Bay Mall within five (5) days of receiving a computation of the amount from KDM. The costs of Cyber Savvy's application were reserved for argument. It has been learnt that KDM supplied a computation in which an amount of R16 million is claimed on 17th November 2017. Cyber Savvy was represented by Manogh Maharaj Manogh Maharaj of Umhlanga-based law firm Maharaj attorneys, the liquidators of Aone were

represented by Adam Lombard of Edward Nathan Sonnenbergs Incorporated (Africa's largest law firm), and KDM was represented by Ahmed Asmal of Asmal & Asmal Attorneys of KwaDukuza. When approached for comment, Singh stated that “I am happy that the Ballito Bay Mall saga finally appears to be nearing its end. Since 2013, KDM has been successful in all its matters involving Ballito Bay Mall. For the period June 2015 to October 2017, income of more than R32 million was collected by the municipality from Ballito Bay Mall. I would like to place on record my sincere appreciation to the CFO, to all Finance Department staff particularly Sharon Pitts, and to our legal team for their assistance in successfully opposing this application”. The CFO of KDM, Shamir Rajcoomar, said that “I am ecstatic! I personally attended the C o u r t proceedings on 16th November 2017. Despite t h e t i m e constraints and the limited time, F i n a n c e Department staff and our a t t o r n e y w o r k e d relentlessly. KDM now

intends applying for the costs of the application launched by Cyber Savvy. In accordance with its legal and constitutional obligations, KDM vigorously pursues non-paying consumers and ratepayers & those who tamper with electricity, and will continue to do so. Those consumers and ratepayers who are in arrears are urged to come forward to make payment arrangements or else face disconnection of electricity and costly legal of action”. KDM's attorney Ahmed Asmal commented that “This is the third successive matter this year where I, acting on behalf of KDM, have successfully opposed applications to prevent disconnections or to restore the supply of electricity. In April and November this year, applications brought for the reconnection of the electricity supply were dismissed with costs by the Stanger Magistrate's Court”.

ILembe family of municipalities together with the department of Cooperative Governance Traditional Affairs (COGTA) convened traditional leaders from under ILembe District at Hampshire Hotel in Ballito on Thursday, 16 November 2017. The aim of this gathering was to find ways to enhance the participation of traditional leaders at municipal level, facilitate

strengthened cooperation and interface between traditional institutions and municipalities for optimum service delivery and development in traditional communities. As part of the day's proceedings, COGTA capacitated all in attendance about cohesion and separation of powers. Speaking at the event, ILembe District Municipality Speaker, Lucky Makhathini cited that such

A white ribbon is a symbol of peace and represents the commitment of the wearer to never commit or condone violence against women and children. Participate in the various 16 Days of Activism events and activities:

Mandeni Municipality held the second Infrastructure Development Programme Steering Committee meeting for the new Council on Friday, 10 November 2017 at Princes Grant Hotel. Mayor of Mandeni, Cllr Sphesihle Basil Zulu said, “I am honoured to announce that Mandeni has officially appointed Mr Sizwe Khuzwayo as the new Municipal Manager. He has been one of the Directors in the institution for the past five years,” he said. Mayor Zulu continued to announce Mrs Nonjabulo Ngwane as the new Acting Director: Technical Services and Miss Mpumelelo Guzana as the new Acting Chief Financial Officer. “I wish them well in their term of filling the gap left by their predecessors and trust they will receive all of our support during their period of service in their respective roles.” He further said the purpose of the meeting is to ensure consistent engagements with the membership of this committee as the municipality's strategic partners in service delivery in the Mandeni area and possibly in the District of iLembe. The Mayor also stated that the collaboration between the municipality and other

various departments has yielded some remarkable success such as the Provincial Road D883 Upgrade and Improvement, Provincial Road P415 Upgrade and Improvement, the Macambini Water Supply Scheme and Lower Thukela Bulk Water Supply Scheme, as well as the Mangethe Substation. Mayor Zulu also said Mandeni has its own challenges as it serves the local people and it is hoped that the Infrastructure Steering Committee meeting will assist in addressing those challenges to ensure delivery on Vision 2030. “The meeting of this nature is aimed at dealing with special projects that can bring growth to Mandeni and the government at large.” he said. Zulu lamented those who vandalise the infrastructure, adding that it is saddening to see people devastating and vandalizing what has been delivered for them and urged people to preserve assets and maintain them. Among the government stakeholders who formed part of the meeting were ESKOM, DBSA, Department of Justice, SIVEST, Cogta, SAPPI, iLembe District Municipality and the department of Transport.

November 16 marked the 157th anniversary of the arrival of indentured Indian labourers to South Africa. In South Africa it was the British Colony of Natal that was most in need of cheap labour, especially on its sugar plantations. A deal was struck between the Natal colony, Britain and the British Indian government to import indentured labourers from India. The sugar magnates, like Sir James Liege Hulett, were instrumental in getting the agreement approved. The first group of 342 arrived in Durban in 1860 from Madras (now called Chennai) in the Indian state of Tamil Nadu. Between 1860 and 1911 more than 150,000 Indian migrants were transported to Natal as indentured labourers. Most of them came from Tamil Nadu and Andhra Pradesh, with some from Uttar Pradesh and Bihar. They were a heterogeneous group: 90% were Hindus, the rest mostly Muslim with small numbers of Christians as well as a few Jains and Buddhists. Although the majority worked on the sugar cane plantations, many also worked

on the railways, dockyards, in the municipal services, in coalmines and in domestic service. Their labour made an almost immediate contribution to the growth of the Natal Colony's economy - a fact that was widely acknowledged. The fact that common obstacles to a better life were in all Indian migrants' way, meant that caste, religious and linguistic differences became less pronounced than in the mother country. It made for a more

cohesive and integrated community. On the political front many Indian South Africans made huge sacrifices and contributions in the fight against apartheid, on a scale vastly disproportionate to the size of their community. KwaDukuza's renowned comedian Sthembiso 'Halo M' Mtshali, who was recently crowned best indigenous at this year's SATMA awards will host household name acts in the comedy industry on 26 November 2017 for the Halo KwaDukuza Comedy Festival. The event will be staged at KwaDukuza Town Hall and it will feature the likes of Pastor Mjosty, Simphiwe Shembe, Master, Anele Mgewu, Percy Imbongi and Muzi Ngema. Speaking to the Xpress Times, Mtshali said this will be an annual event with which he hopes to help the community forget about the hardships of the year and just have a good laugh. “People attending the show can just expect to have a good laugh. Ishwar's 1970 Ford Fairlane V8 was headhunted by the show, and presenters, Hezron Louw and Nick Rabinowitz were taken on a tour from the Groutville Toll plaza to Ballito. iLembe annihilate East Coast Spin twins: A. Nadasen and S. Logenathan cause East Coast collapse

Emphatic iLembe after defeating East Coast

This past Sunday, iLembe Cricket Club took on the formidable East Coast of Phoenix in the KwaZulu Natal Cricket Union Challenge League I 50 overs match played at the Phoenix Northcroft grounds and thrashed them by an emphatic 101 runs. East Coast won the toss and elected to field first with a reduced 45 over game due to the damp conditions from the heavy rain that fell. The iLembe openers, C. Pillay and A. Bageloo got off to a spritely start putting on 45 for the first wicket with Pillay being dismissed for 8 by spinner, M. Gangath. S.B. Hoosen was sent for an early shower being dismissed for a duck after being caught at slip by Gangath. Bageloo batted well dispatching the short balls to the boundary until he was adjudged LBW to K. Govender for 38 with iLembe on 52 in the 10th over scoring at 5.2 to the over. A. Nadasen (2), Y. Ismail (17) and I. Mahomed (14) took the tally to 116/6 in the 28th over. The East Coast bowlers began to feel the heat and batsmen, A. Sarwar and Z. Ali took full advantage compiling a partnership of 51 with Sarwar smashing away a well-deserved 52 which included four boundaries

and four gigantic sixes. Sarwar fell with the score on 167 in the 16th over and Ali soon followed for 30. The last 2 wickets fell for just 12 runs with iLembe posting 187 all out in the 41st over. M. Gangath was the destroyer-in-chief for East Coast claiming 5 wickets for a miserly 16 runs from his 9 overs. In reply, East Coast lost the first wicket of S. Srinanth for 12 before a hopeful partnership of 40 between A. Dudraj and S. Dayanand was broken by A. Nadasen in the 13th over. Dayanand was the top scorer for East Coast scoring 24. Spin twins, Nadasen and S. Logenathan halted the progress of the innings restricting the total from 58/3 in the 14th over to 86 all out after 24.1 overs. Nadasen ripped through the East Coast batsmen returning with fantastic figures of 4/5 in 6 overs whilst Logenathan claimed 2/20 in 7.1 overs. The innings also included 3 brilliant run outs.

In an iLembe and District Cricket Union T20 match played at the Umhlali Prep grounds on Saturday, Warriors Sport faced their nemesis, Pak International. Warriors Sport won the toss and elected to bat first. This decision backfired as Pak decimated the top and middle order in quick succession leaving them 36/8 in the 9th over. This was when Ash “Bulldozer” Balchand and Suhail Younus stepped in to restore some respect. Ash finished his innings on 40 not out

including 2 sixes and 7 fours, whilst Suhail went out for 20 giving Pak a target of 106 after the loss of 9 wickets. Zulfiqar Ali was the destroyer in chief claiming 4/6 off his 3 overs. In reply Asad Jutt put on a hard fought 50 including 2 sixes and 7 fours. Pak claimed victory by 5 wickets in the 13th over with 110/5. Rishen Mathapershad was the pick of the Warriors bowlers after claiming 2 wickets.

Bumper turnout anticipated at thunee tournament

A bumper turnout is anticipated at the Darnall Action Sports Bar on Saturday, November 25 to participate in the 15th annual Puckree Dhaver thunee tournament. Thunee is a popular card game pre-dominantly among the Indian communities, played with passion by the young and especially the older generation. The late Puckree Dhaver of Darnall, a well-known sugar-cane truck driver was passionate about the game of thunee, who spent his weekends playing the popular card game in Darnall, Amatikulu, Empangeni and Richards Bay both on a social and competitive level. Roy Dhaver (eldest son of the late Puckree Dhaver) said: “My late dad, Puckree Dhaver didn't know the meaning of social thunee and played every game as if it was a competition. He didn't hesitate to scold his partner (young or old) if they played badly and failed to throw down the correct card. “He had the uncanny, witty 6th sense of virtually reading the opponent's cards and wisely held the 9card and came down with the ace-card. He loved the game and would spend many hours engrossed in the game”. After his death almost 14 years ago, his family decided that hosting a tournament each year was a perfect way to perpetuate the memory of their late dad, Puckree Dhaver. Saturday, November 25th marks the 15th anniversary of the Puckree Dhaver memorial thunee tournament. The tournament gets underway at 2.30pm and is expected to finish in the early hours of Sunday morning. The winning team will walk away with a whopping R5 000 in prize-money and outright trophies. The runners-up will earn R3 000 for their effort. The losing semi-finalists will contest the 3rd/4th playoffs with R1 500 and R500 up for grabs for the winner and runner-up respectively and commemorative trophies. There will be a wellstocked canteen catering for the hungry and thirsty throughout the evening. Thunee players and enthusiasts are encouraged to take advantage of the happy hour announced throughout the night. Defending champions Babs Pillay and Ron Reuben are strongly fancied to successfully defend their title. However, the Puckree boys, Balu, Vassie and Roy have chosen their own partners and will not be making the trip to Darnall to visit any grave-sites nearby, but a determined bid to win the illustrious tournament in memory of their legend and hero.
